11-12-57 NOVEMBER 12TH, 1957 · A Regular Meetin~ of the City Council of Delray ~3each, Florida, was held in the Council Chambers at 7:30 P.M., with Mayor George V. Warren in the Chair, City Manager W. E. Lawson Jr., City Attorney Harry T. Newett and the following Council Members bein~ present - Col. Dugal G. Campbell, Mr. R. J. Holland and Mrs. Catherine E. Strong~ An opening prayer was delivered by Rev. Rudolph J. Keyl. Commissioner Strong moved that the Minutes of the October 28th and November 6th Meetings be approved. Motion seconded by Commissioner Holland and unanimously a~reed. Mr. Harry McKean informed the Council of having accompanied City Manager Lawson to Ft. Lauderdale, on two occasions, fcr consultation with desi~ning engineers and the District Engineer of the State Road Department, who, on November 7th, assured the City Manager and Harry McKean that the State Road Department would be glad to cooperate with the City of Delray Beach to the extent of including drainage areas in excess of the area which the State intends to drain in conjunction with the improving of U.S.#l w£thin the corporate limits of Delray Beach. At the second meeting, ~he City Manager and Mr. McKean were advised by Mr. Carleton that the Cl'ty of Delray Beach would be held liable for any cost difference of larger pipe, necessary fc~ additional drainage area beyond that contemplate~ by the State in the U.S.~l improvement project; and would appreciat~ a Resolution from the City requesting assistance and coordination of the tw~ projects to aid him in solicit- ing co-operation from ~he State Road Board at Tallahassee. The City Manager then proc~eeded to read Resolution No. 1077: A RESOLUTION OF THE CITY COUNCIL REQUESTING THE STATE ROAD DEPARTMENT TO ASSIST AND COORDINATE THE PROPOSED IMPROVEMENT OF STATE hOAD NO. % (U.S.HIGHWAY NO. 1) WITH A PROPOSED DRAINAGE SYSTEM OF THE CITY OF DELHAY BEACH. The Council further unanimously agreed, on motion of Commissioner Campbell and seconded by Commissioner Holland, to effect minor improve- manta of N.Eo 2nd Street by sand seal and repair in order to make it most usable ~til such time as the State is prepared to make known the improvements now contemplated by the State Road Board as reported by the City Manager and Mr. McKean. City Manager Lawson in~¢rmed the Council of the Tax office~s ap- praisal value of $1,500.00 for each of the two following described par- cels of land, the first of which, being city owned, the Council has ex- pressed a desire to exchange for the privately owned second identified tract: (City Owned) That part of the W~ of the NE¼ of the SE~ of the SE~ of Section 18-~6-43, which lies West cf the S.A.L.RB. Motion seconded by Com- missioner Holland and ~uanimously carried. NOVEMBER 12th, 19.~7 Mi~. William Grimditch, of North Tropic Isles, Inc., advised the Council that the County Attorney has requested a clarification of the action of the Council pertaining.to proposed drainage plan in Tropic Palms S/D and the neighboring subdivision of Hidden Valley, which will include a canal thru Tropic Isle Section 4 as reflected in the motion of Commissioner Campbell as appears in the Minutes of the October 28th meett.n.$; .... Commissioner Campbell moved to amend his motion, appearing in the Minutes of the October 28th meeting referred to above, to read as follows "Commissioner Campbell moved for tentative acceptance of the pro- posed replat of Section Four, of Tropic Isle Subdivision, in accord- ance with the recommendations of the Planning Board and authorized and directed the City Manager to indicate on the proposed replat for iden- tification purposes that the City of Delray Beach had tentatively ap- proved said replat, and further moved that when the final replat is submitted to the City Council of the City of Delray Beach conforming to the tentative replat that the City Council approve said replat for filing. Motion was seconded by Commissioner Strong and unanimously a greed. CommiSsioner Strong moved that the proposed agreement, submitted by Mr. Grimditch, providing that the County should not be held liable for maintenance cost or any part %hereof concerning the proposed drainage canals in Tropic Palms, Tropic Isle and Hidden Valley S/Ds, for study, and recommendation by the Planning Board together with the City Attorney. Motion seconded by Commissioner Campbell and unani- mously passed. Att'y, Neil MacMillan presented a letter from Mr. John N. Kabler together with an affidavit from Mr. C. Y. Byrd, as further evidence in support of his-claim, on behalf of Mr. Louis D. Tenerellt, that an agreement was entered into between the City of Delray Beach and Mrs. Ed%th..G.~ ~ane., cgncernin, g. Resolution No. 640, passed and adopted in -Regul~ Session' ~n December'~ 19~?, a~d relating to Lots 2 and 3, Block l, Ocean Park, Delray Beach, Florida. Co~mmissibner Campbell, taking exception to some comment about town that the present Council was running out on a contract of a prior City Council, reviewed, in detail, for the benefit of the public and the press, various documents pertaining to the transaction referred to in the preceding paragraph, reading Resolution No. 6~0, Minutes of the Special meeting held-on December .l~th, 19~0, Minutes of the Special Meeting heSd on November l?th, 19~? and letter from Mr. C. Y. Byrd dated November 12th, 19~7, wherein this Council finds no record of commitment by the Council of 19~7 granting any consideration to Mrs. Slane as a result of the execution of Resolution Nc. 6~0, which should be conclusive evidence that the present Council is not running out on any commitment of the said prior Council. Commissioner Campbell then moved that the.Building Department be instructed to deny the request of Mr. Tenerelli for permit for con- struction as per plans submitted. Motion seconded by Commissioner Strong and upon ~oll Cal~ - C~mmissioners Campbell and Strong together with Mayor Warren favored the motion, Commissioner Holland abstaining. Commissioner Strong desired to state that she favored the granting of Mr. Tenerelli's request at a previous meeting but since having made a thorough study of all documents pertaining to the issue is determined that no commitment was made and therefore favored denial of the permit. Commissioner Holland stated .that, in abstaining, he felt this is- sue presented a legal problem and apparently should be settled in c out" t..l::m o c. ed ~t,~ ~. Att'y. Paul Gringle, speaking in behalf of Mr. John Thieme, owner of Georgia Town Tavern, stated that Mr. Thieme had been a very highly respected resident of this area for ~6 years, and licensed operator of the Tavern for more than fifteen years, and that Mr. Thieme was much disturbed over the letter received from the City Attorney, relative to violations and undesirable actions at the Tavern and was completely surprised over the News items of local papers concerning actions at the Georgia Town Tavern. Att'y. Gringle further stated that he did not, in any manner, aid Mr. Thieme in replying to the~City Attorney's letter, but would defend Mr. Thieme should any specific charges ever be brought against him or the Tavern. Members of the CounCil, toMether with the Chief of Police, visited several taverns and restaurants on the West side last Friday night and found deplorable conditions in the Georgia Town Tavern. Mayor Warren read a letter from Mr. John Thieme, addressed to the City Council and being in reply to the City Attorneyts letter to the owner of Georgia Town'Tavern (Mr. John Thieme), concerning violations on the premises thereof, and also submitted a Report from the Police Department reflecting over seventy calls frcm said Tavern since Jan- uary I st, 1956. ..... City'-Attorney Newett read excerpts from Chapter 17, pertaining offenses and violations and advised the Council that it must file charges and provide a tease, noble date to grant a hearing for an ac- cused to answer the charges. Commissioner Campbell moved that the City Manager be authorimed to conduct an investigation, with the aid and approval of the City Attorney, prepare charges and serve them, assurin~ the Council of proper legal procedure pertaining thereto, and to incorporate in said charges provision for a hearing. Motion seconded by Commissioner Strong and unanimously agreed. City Manager Lawson assured the Council that he and the City At- torney would investigate the feasibility of an Ordinance governing better ccntrols of such a situation as has arisen at the Georgia Town Tavern, and to check tho possibility of obtaining a Sanitary Engineer, as well as preparing and estimate of Cost for such engineering ser- vices, similar to that in effect in West Palm Beach. The City Manager advised the Council that this meeting, by notice to property owners, scheduled a public hearing providing an' opportunitl for individuals to be heard concerning Lots and Parcels of Land de- clared to be in violation of Chapter l~ of the City Code, as per Res- olution No. 1072 adopted on October 28th. Att'y. J. W. Nowlln protested against any health menace resulting from vegetation .g~owth on Lots I & ~, Block 87, and the Council re- quested Fire Chief John Gregory to check this item with Mr. Nowlin .... and*r~port his findin~s. Requests for "Extension of Time" from property owners - Leopold Philippart, Lot 18, Block 7, 0sceola Park; Loyal C. Selover, Lots I thru 18, Blk. l~, Osceola Park; Mrs. L. J. Grausso, Lot ll, Block 7, Osceol'a Park; Charles Marine, N.100 ft of So. 200 ft of E.I~ ft of Blk 71; were denied by the Council which requested that each property owner be so notifled~ and advised of procedure concernin~ ultimate abate- ment of alleged nuisances. City Manager Lawson then read Resolution N~~. 107~: A RESOLUTION REQUIRING OWNERS OF CERTAIN DESCRIBED LANDS TO ABATE NUISANCES THEREON OR BE ASSESSED COST THEREOF FOR ABATEMENT DY CITY. Motion seconded by Com- missioner Strong and unanimously carried. The City Manager followed with the reading of Ordinance No. G-276: AN ORDINANCE OF THE CITY OF DEIRAY PEACH, FLORIDA, REZATING TO FEDERAL OLD AGE AND SURVIVORS INSURANCE · FOR FIREMEN; Commissioner Strong moved to place Ordinance No. G~276 on first reading,.' Motion seconded by Commissioner Holland and unanimously a g~eed. The City Manager then read Resolution No. 1076: A RESOLUT~0N DECLAHING CERTAIN L~NDE IN THE CITY OF DELRAY BEACH, FLORIDA, TO CONSTITUTE A NUISANCE IN VIOLATION OF CHAPTER 15 OF THE CITY CODE OF ORDINANCES. (See ~py of Res. ~1076 on Pages 286-I thr~ 286-P.) Commissioner Strong moved for adoptic,~ of Resolution No. 1076 on thin first and final reading, Motion seconded by Commissioner Camp-, bell and unanimously carried~ 254 NOVE~BER 12th, 1957. Mr, Allen, of Allen & Hoshall, consulting engineers regarding Natural Gas, infonmed the Council of having recently conducted a sur- vey of' this area for potential natural gas consumption, the result of which indicates a most favorable outlook and reason for consideration of a Gas Franchise. Mr, Allen stated that information had reached his firm's office indicating the injunction against the Gas Distri- buting Company had recently been set aside and further informed the Council that Mr, Hoshall would remain in this area for several weeks, also that local telephone service had been established. Results o£ Mr, Allen's survey and report will be studied by the City Manager, who, on motion of Commissioner Campbell, seconded by Commtssione~ Strong and unanimously agreed upon by the Council, was reGuested to provide for a Council meeting with the City Attorney, City Engineer and Financial Advisory Board tc review the Report and consider the feasibility of a Natural Gas Franchise at this time, City Manager Lawson then read Ordinance No. G-275: AN ORDINANCE RELATING TO ZONING, SUPPLEMENTING SECTION 29-?,6 OF TEE CODE OF ORDINANCES OF THE CITY OF DELHAY BEACH, FLORIDA, TO REGULATE AND RESTRICT CORNICES AND EAVES, PROJECTIONS AND EN- CROACHMENTS, AND WALLS AND FENCES IN THE CITY OF DELRZY BEACH, FLO]~IDA. Motion seconded by $om~. .missioner Strong and unanimously passed~ City Manager Lawson informed the Council that the Building ~nd Plumbing Inspectors had made a house to house survey of the west sector and found 57 out-houses now in use, some serving multiple families, and that all have been given notice to provide proper facilities with~ in thirty ~30) days. Commissioner Campbell moved to express the appreciation of the Council for the interest taken by the inspectors in providing for this survey and taking steps for correctg~we measures to be taken, and that NOVEMBER 12th, 19~?. - ~ - the Council desires to act cn each hardship case as it is presented but that no such consideration shall be extended on rental property. Commissioner Strong moved that Bills, in the amount of $31,668.28, as presented by the City Manager, be paid subject to the approval of the Finance Committee. Motion seconded by Commissioner Holland and unanimously carried. Commissioner Holland moved that the Dill cf Att'y. R. C. Burns, in the amount of $2,000.00, for legal services rendered, as outlined in the City Attorney's letter of November 5th, be paid from Unappro, priated Surplus. Motion seconded by Commissioner Strong and unani- mously passed. The Council, through Commissioner Campbell, requested the City Attorney to make certain, in the preparation of closing the Golf Course Sale, that same incorporates any capital gain thereon which may come to the Grimes Foundation, will, in case of re-purchase the Golf Course by the City, be recognized as a credit and that pro- vision for recognition of depreciation as well be provided. Commissioner Campbell moved that the City Manager prepare a lette:- for the Mayor's signature, reflecting a request to the State Road De- partment for slowing down of traffic on South Federal Highway just south of Tenth Street. Motion seconded by Commissioner Strong ~ud unanimously passed. City Manager Lawson was requested to make all possible effort to hasten the investment of Surplus Water Revenue Certificates - Series 1957 funds, investment of which is subject to the approval of the Ira C. I) WITH PRO?0SED D~iINAGE SYSTEM OF CITY. ~gHER~S, the City of Delray Beach, Florida is desirous of, and has made plans for, the installation of a drainage system in the areas west of thc Florida East Coast Railway with outfalls running east into the Intracoastal Waterway; and WHEREAS, thc State Road Department is now engaged in preparing plans for tho construction of State Road ~ through Dclray Beach, and contained in such plmns wi'il bo provisi~ms for drainage.
