A Regular Meeting of the City Council was held in the Council
Chambers at 7:SO P.M., with Mayor George V. Warren in the Chair, City
Manager W. E. Lawson Jr., City Attorney Harry T. Newett and Council
Members Col. Dugal G. Campbell, Mr. R. J. Holland, Mrs. Martha K.
Holland and Mrso Catherine E. Strong.
An opening prayer was delivered by Rev. Jo W. Swanson.
Commissioner Strong moved that the Minutes of November 2$th and
December 3rd be approved. Notion seconded by Commissioner R. J.
Holland and unanimously passed.
City Manager Lawson informed the Council that, since the November
2$th meeting, at which time a public hearing had previously been pro-
vided for hearing objections, if any, to Resolution No. 1073, and
during which hearing the Council deferred action on certain items as
shown below, and in the minutes of said meeting, a review of each of
these parcels as to procedure, work done and results accomplished had
been made with Fire Chief Gregory and the nurseryman who cleared the
various lots -

The City Manager further stated that, in his opinion, satisfactory
clearinghad been accomplished at the best obtainable price and all
procedures were in order, upon which report the Council approved the
assessments against each property, for identified nuisance abatement~
as contained in Resolution No..lOTS
Mr. John Henderson of Mike Blank Nurseries, ~. James T. Prillaman
of Oneman Engineering Company and Nurseryman Mr. Dick MacMurray were
present and concurred with the City~.~anager that necessary clearing of
parcels of land, in compliance with Chapter 15 of the Code of Ordi-
nances, as contracted, had been accomplished at a reasonable and pre-
vailing cost, all of whom emphatically pointed out that, following a
major lot clearing job, an annual mowing of grass, the growth of
which is encouraged in this area by the elements, would result in well
kept lots at a charge not in excess of $20.00, and night anount to
considerably less than such amount.
The Council expressed appreciation to the above nurserymen for
their attendance and advice.
Commissioner Campbell moved that together with "Notice" to abate
a nuisance the property owner be advised an estimated cost, as pro-
vided by lot clearing contractors equipped to do this type of work.
Motion seconded by Commissioner R, J. Holland and unanimously agreed.
Mr. R, D. Schell, part owner of Lots 12 thru 19, Block 12, Osceola
Park, was informed by Mr. Henderson that an annual mowing of any weeds
and grass, which may hereafter appear on said lands recently cleared
by Mike Blank Nurseries, should not cost over approximately $12,00,
which Mr. Schell agreed appeared very satisfactory, it being clearly
stated, however, that such mowing of grass would only extend to the
mango area.
Mr. M. F. Riley, Jr., owner of an irregular tract of land in the
S.W.¼ of Section 17-46-42, abutting on the east side of proposed State
Road 9, and running southward from Atlantic Avenue, approximately 660'

had been ordered to abate a nuisance, due to over-growth thereon,
Resolution No. 1079 and requested c~nsideration due to the relation-
ship of his land to the County owned land adjacent and to the west
thereof.
Commissioner Campbell moved that Mr. Riley be granted permission
to only clear only that part of his acreage running southward from
Atlmntic Avenue for a distance of 150 feet but that such grant is not
to be considered a precedent for similar clearing allowances. Notion
seconded by Commissioner R. J. Holland and unanimously passed.
Mrs. Graham, Nanager of the Sea Lure Estates, which property com-
prises part of Ocean Beach Lot 28 on which an alleged nuisance has
been ordered abated, as per Resolution No. 1079, was advised to con-
tact Chief Gregoi~y to determine the actual nuisance violations.
The 'Report' of Yard Trash Collection was tabled for further study.
City Manager Lawson read the following letter from F. A. Johnson,
Incorporated:
December 7th, 1957,.
RE: Tract of land approx. 280 x 867 owned by City of Delray Beach,
which lies in the SE portion of Lot i Nodel Land Co. $/D as per
Plat Book 8, Page
Dear Mr. Lawson:
We are the present owners of the W. S. Carper Tract, which is di-
rectly north of the subject property owned by the City of Delray Beach~
An examination of the city map will show that the only access to
the Carper Tract, now that the State has acquired the Road #9 Right of
Way, is across private Seaboard Railroad property.
We feel that the only remaining logical way to develop this Carper
Tract, now that it has been split off from its original method of
proach, is by our acquiring by purchase the subject tract of land now
owned by the City of Delray Beach.
If we ~re able to acquire said tract, it is our intention to im-
mediately apply for subdivision of the entire nine acres, so as to de-
velop it into an industrial area of several small cle~n plants, which
we feel to be its highest and best land use.
We fee~ that Delray Beach needs such an area to help provide em-
ployment for the many new residents who are continuall~ moving in. We
further feel that every city must eventually make prowsion for the
small industrial plant which often is the backbone of the economy in
times of duress.
Our plan will further result in placing this property, which is
now contributing little or nothing t~xwise to the City, in its proper
position so that each lot will share its given part of the costs of
City government.
We are therefore writing this letter so that it may be considered
our first step toward negotiation and acquisition of subject Tract now
owned by the City.
Would you kindly place this letter in the proper hands so that it
may be considered by the City Council?

Commissioner Campbell moved that the above request be referred to
the Planning/Z~ning Board for study and recommendation. Notion was
seconded by Commissioner R. J. Holland and unanimously agreed.
A public hearing, as scheduled in Resolution No. 1078 passed and
adopted Novembe~ l~th, was then held for the purpose of hearing ob-
jections, if ar4y, to alleged nuisances of Lots considered in violation
of Chapter 15 of the Code of Ordinances.
The lot clearing program, desired by the Council to be ~arried on
as originally planned, resulted in no exceptions being granted con-
cerning the properties listed in said Resolution No. 1078.
City Nanager Lawson then read Resolution No. 1079:

Commissioner R. J. Holland moved that Resolution No. 1079 be
passed and adopted on first an4 final reading. Motion seconded by
Commissioner Strong and unanimously carried.
The City Manager then submitted a Report from the Planning Board
RE: Proposed annexation of area south of city and east of Waterway as
presented by Totterdale Development, Inc., which lies between A-1-A
and the Waterway.

Commissioner Campbell inquired concerning the Water Distribution
set-up as outlined in Section ~.-.Paragraph ~g), and was assured by
the City Attorney that the prows~ons of said section and paragraph
are comparable to those applying to Plat l, previously annexed.
Commissioner Strong moved that Ordinance No. G-277 be placed on
first reading. Motion.seconded by Commissioner R. J. Holland and
unanimously passed.
Commissioner Campbell requested the City Attorney to review Sec. 3
of Ordinance G-2??, and to provide, if found advisable, for clarifi-
.etlon of ownership of Tropic Palms - Plats 2, S and 4.
City Nanager Lawson read a letter from Mr. Ao Consuelo S. Hagen,
wherein permissive use of certain lands in the southwest section of
the city for construction of small d~lexes was requested.
Public hearing on this request will be provided forFriday, Decem-
ber 20th, at 4:00 P.M., the Council being unanimously agreed that
everything possible should be done to better the general conditions
around the area involved,
Commissioner R. J. Holland moved that Bills, in the amount of
$58,321.21 submitted by the City Manager, be paid subject to the ap-
proval of the Finance Committee. Motion seconded by Commissioner
Strong and unanimously passed.
Commissioner. Campbell moved that the City Manager provide for.
the City of Delray Beach to give a Christmas Bonus to employees of
the City in the amount of one day's pay per employee. Motion seconded [.~
by Commissioner R. J. Holland and unanimously agreed.
Commissioner C~mpbell, with reference to prior action concerning
Georgia Town Tavern, moved that the Council unanimously desired to go
on record as acknowledging the co-operation of Mr. John Thieme in the
cleaning of the premises and taking necessary steps to provide better
control of the operational functions at the Tavern and that the actior
relative to said operation be considered closed. Motion seconded by
Commissioner R. J. Holland and unanimously passed.
City Attorney Newett informed the Council of having attended a
conference this A.M. with Warren G. Grimes, relative to Sale of the
Golf Course, at which time Mr. Grimes requested that the previous
actions concerning the Sale be rescinded and to begin anew with re-
.vised Advertisements, reflecting amendments to the original terms.
Commissioner Campbell stated that the current attitude of the
Grimes Foundation, as expressed by Mr. Grimes, appeared to indicate
that the Foundation does not now desire to abide by the original agree-
ment, all phases, of which, were distinctly understood and agreed to
by both the City of Delray Beach and Mr. Warren G. Grimes.
The Commissioner further reminded Mr. Grimes of not only the orig-
inal ~nd definite understanding but to the many advertisements and
letters, incorporating the many terms contained in said original agree-
ment~ prepared and distributed to publications (news) and mailed to
home~ of property owners by Mr. Vincent who was in Delray Beach acting
in behalf of Mr. Grimes.
DUring a general discussionwhich followed, concerning the present
turn of events apparently due to the advice of Mr. Vance Brand, legal
counsel for Mr. Grimes, Commissioner Campbell informed the Council
that neither Mr. Grimes, nor anyone else, had challenged any portion
of the original agreement,
Commissioner R. J.Holland moved that inasmuch as the original
term~ and agreement are not now satisfactory to Mr. Grimes the City
of D~lray Beach should refund the $850,000.00 to Mr. Grimes and void
the entire deal. Motion seconded by Commissioner M. K. Holland and
upo~ Call of Roll - Commissioners R. J. Holland and M. K. Holland
voted in favor thereof, Commissioners Campbell and Strong together
witb MayorWarren were opposed.
Commissioner Campbell informed the Council that the action of Mr.
Grimes, early in November, in effecting increases in the salaries of
e~ployees at the Country Club, reflected an act of management and
thereby clearly indicated Mr. Grimes intention of assuming control of
the Golf Club's operation and ownership.
Commissioner Campbell then moved that the Sale of the Golf Course,
in accordance with the terms and agreement previously agreed upon by
both the City of Delray Beach and Mr. Grimes acting for The Grimes
Foundation be referred to the City Attorney for process. Motion was

seconded by Commissioner Strong and upon Call of Roll - Commissioners
Campbell and Strong together with Mayor Warren voted in favor thereof,
Commissioners R. J. Holland and M. K. Holland being opposed.
On motion of Commissioner Strong, seconded by Commissioner Campbel~
the Council was unanimous in extending a most sincere Vote of Thanks
to Rev. James T. Hayes for past services rendered in the opening of
Council Meetings with a prayer.

Subject: Traffic Light at N.E. 8th Street and A-1-A.
OhM arch 25th, 1957, you adopted a re~~on requesting the
State Road Department to make a traffic study at the intersection of
State Road ALi and N. E. 8th Street, to determine whether or not the
installation of a traffic light would be warranted.
The results of the investigation by the S.R.D. were sent to
the State Road Board, and the Board, at its meeting of November 14,
1957, denied the request. The existing flashing beacon, however,
is warranted and was approved.

MayorWarren then read a letter from the CumberlandManufacturin~j
Company, of Winston-Salem, N. C., wherein the Company requested in-
formation as to possible available property for leasing for the pur-
pose of constructing and establishing a manufacturing unit for denim~
and sports wea~, with a potential employment of 150 to 200 people.
The Company al~o would appreciate whatever tax relief the City might
determine to extend. (Letter is on file with the official minutes
of this meeting).
The Mayor read a letter from Mr. Henry D. Delburn, President of
Palm Beach County Resources and Development Board, reflectin~ a
Speech made by Mr. Delburn, Wednesday, November 6th, 1957, a~ the
Delray Beach Country Club, which expressed the appreciation of the
entire Board for interest and cc-operation of[~r. Cal Garner, the
Delray Beach directors and the many people in this area, concerning
the activities of the Resources Development Board. (Copy of'this
letter is on file with the official minutes of this meeting).
Conm~issioner Campbell requested the CityManager to contact Dr.
C. A. Robinson, leader of the local medical profession, for possible
assistance in providing available Doctors in time of emergency, such
as accident and immediate need.
Due to not having been provided proper notification of excess
water consumption which would have permitted the Grosvenor House to
take steps to determine and locate leak or leaks, as meter reading,
for a~period of time, was not effected due to meter being under water,
on motion of Commissioner Strong, seconded by Commissioner M. K.
Holland, the Council unanimously agreed, in acceptance of the City
Manager's recommendation, to approve an adjustment of the Water bill
to the Grosvenor House, for the month of July, said adjustment to
result in the water bill being rendered in the amount of $270.00,
same being an average of the June, August and September monthly con-
sumptions.

WHEREAS, the City Council did, in regular session
held on the 12th day of November, 1957, enact Resolution
No. 1076 declaring the existence of a nuisance upon
certain lots or parcels of land for violation of Chapter
15 of the City Code and Ordinance G-147: and
WHEREAS, pursuant to said resolution, the City Clerk
of the City of Delray Beach, Florida, did furnish each
of the owners of the lands therein declared nuisances
with notice that the City Council would sit on December
9th, 1957, at 7:30 o'clock P.M. at the City Hall in Delray
Beach, Florida, for the purpose of allowing said owners
to show cause, if any, why said nuisances described in
said resolution should not be abated: and
VHEREAS, pursuant to said resolution, the City Council

or trash in which mosquitoes are likely to brood. "3" means there are
trees, debris, or vogetati~n, which, by reason of height, proximity to
neighboring structures or physical conditions are hurricane hazards.
"4" means there arc weeds exceeding 18 inches in height, and which eitl~
exhale obnoxious odors or constitute a likely source of disease or phys~
cal distress to human beings.
AND, BE IT FURTHER RESOLVED that tho City Clerk of the City of
Delray Beach, Florida, furnish each of tho o~nors of the lands heroin-
above listed and describe~! with a copy of this' resolution at their last
available address within ten (10) days fr~m the date this Resolution is
adopted.
AND, EE IT FURTHER RESOLVED that each of said owners be and
they are hereby n~tifted that they are required to abate the nuisance
hereinabove adjudged and specified within thirty (30) days from tho
receipt of a copy of this resolution; otherwise, in default thereof,
the City of Dolray B6ach, Florida, will enter upon said lands and a-
bate the said nuisance hereinabove specified and will levy the cost of
such work as an assessment against the prooerty heroinabove described.
