Res 25-09RESOLUTION NO. 25-09 A RESOLUTION OF THE CITY OF DELRAY BEACH, FLORIDA, APPROVING THE APPLICATION FOR AND ACCEPTANCE OF UP TO $638,500.00 IN ENERGY EFFICIENCY AND CONSERVATION BLOCK GRANT FUNDS FROM THE U.S. DEPARTMENT OF ENERGY; AUTHORIZING EXECUTION OF DOCUMENTS AND PROVIDING ASSURANCES; PROVIDING AN EFFECTIVE DATE. WHEREAS, the American Recovery and Reinvestment Act of 2009, Public Law 111-5, appropriates funding for the Department of Energy (DOE) to issue/award formula-based grants to states, U.S. territories, units of local government, and Indian tribes under the Energy Efficiency and Conservation Block Grant (EECBG) Program to implement projects and programs to reduce total energy use, reduce fossil fuel emissions, and improve energy efficiency in building and other appropriate sectors; and WHEREAS, the DOE's authorization for this program is set forth in Title V, Subtitle E of the Energy Independence and Security Act (EISA) of 2007; and WHEREAS, EECBG projects will be funded, in whole or in part, with funds appropriated by the American Recovery and Reinvestment Act of 2009, Pub. L. 111-5, (Recovery Act or Act); and WHEREAS, the City of Delray Beach, Florida, has been allocated $638,500.00 in EECBG Funding; and WHEREAS, the procedures established by the DOE require the City to certify by resolution authorization for proposal submittal and Program participation; and WHEREAS, the City will enter into an agreement with the DOE for the grant funded Program/Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITO *F DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Commission approves the proposal submittal and acceptance of up to $638,500 in grant funding under the Energy Efficiency and Conservation Block Grant (EECBG) Program to implement projects and programs to reduce total energy use, reduce fossil fuel emissions, and improve energy efficiency in building and other appropriate sectors of the City of Delray Beach contingent upon grant funds being available. Res. No. 25-09 Section 2. That the City Commission certifies that the City has reviewed, understands and, to the extent consistent with all constitutional and local law requirements and this Resolution, agrees to the provisions contained in the EECBG Program Guidelines, Section 3. That the City Commission appoints the City Manager and/or his designee with the proper authority to apply for and receive funding based on Title V, Subtitle E, Energy Efficiency and Conservation Block Grants, Sections 541(3)(A) or 541(3)(B) of EISA 2007, Public Law 110- 140. As required by the EECBG Application guidelines, the Mayor will execute a letter to the Secretary of the Department of Energy certifying the name and contact information for the City Manager and/or his designee of the City of Delray Beach, Florida, that is authorized to serve as the City's Agent to receive funds and implement the EECBG Program, including, but not limited to, conducting all negotiations, executing and submitting documents including, but not limited to, applications, agreements, memoranda of understanding, payment requests, certifications, assurances and so on, which may be necessary for the completion of the Program/Project, consistent with constitutional and local law requirements. Section 4. That the City of Delray Beach, Florida, will abide by the "Davis-Bacon Act" Public Law 107-217-AUG. 21, 2002, as amended) for all aspects of this federal funding opportunity. Section 5. Harden, City Manager DATE: June 11, 2009 SUBJECT: AGENDA ITEM 8.H. - REGULAR COMMISSION MEETING OF JUNE 16, 2009 RESOLUTION TI ON BLOCK -GRANT (EECBG) ITEM BEFORE COMMISSION The item before the City Commission is consideration of Resolution 25-09 which approves the application for and acceptance of $638,500 in formula grant funding through the Energy Efficiency and Conservation Block Grant (EECBG) funded by Federal Stimulus funding. The American Recovery & Reinvestment Act (ARRA), also known as "Federal Stimulus Funding," which was signed by President Obama on February 17, 2009, is intended to preserve and create jobs, promote the nation's economic recovery and assist those most impacted by the recession. As part of the Recovery Act, the federal government has made available $2.7 Billion (in formula funding) for Energy Efficiency and Conservation Block Grant (EECBG) Program to implement projects and programs to reduce total energy use, reduce fossil fuel emissions, and improve energy efficiency in building and other appropriate sectors. In November 2007, the City Commission created the Green Task Force to provide recommendations to the Commission on ways to improve environmental sustainability, incentives for environmental conservation, means to enhance water and energy conservation, ideas for promotion of tree planting and xeriscaping and best practices to be considered for implementation including long -term strategies. In January 2009, the Green Task Force issued a comprehensive report with numerous recommendations. City staff reviewed the report and provided initial recommendations to the t Commission on May 5th. The City Commission, on May 19', re viewed Staff's final project/activity recommendations and provided direction to create new a Green Task Force. In order to receive this funding, the City is required to prepare and submit a Resolution and Application identifying the projects/activities that will be funded by this program as well as providing assurances and certifications that the City will comply with all aspects of the EECBG program and the "Davis-Bacon Act." Staff is recommending the following projects for inclusion in the EECBG Application: Creation of a Green Task Force Committee Creation of a Sustainability Officer Retrofit City Street Lighting to Light Emitting Diode (LED) Retrofit City Parks & Athletic Field Lighting to Light Emitting Diode (LED) Retrofit City Building/Facility manual thermostats to programmable thermostats Retrofit City Building/Facility lighting to Light Emitting Diode (LED) Install City Building/Facility motion detection lighting systems Develop a Solar Showcase Project that will leverage funding from the State of Florida's Solar Energy Systems Incentives Program — Fire Station #I- Headquarters (if funding is available within the formula allocation). It should be noted that the City's Application will include a Project Strategy (utilizing the Green Task Force Report and City Staff recommendations) identifying how the City will construct/complete each project/activity proposed to be funded. In addition, this Project Strategy will assist the City in reducing energy consumption and greenhouse gas emissions produced within our community. The attached Resolution 25-09 approves the application for and acceptance of the grant funding and states that the Mayor will execute a letter to the Department of Energy (draft copy attached) providing the City Manager's name and contact information (or his designee) who will be authorized to serve as the City's Agent to receive the grant funds and implement the program. The EECBG funding opportunity presents the City of Delray Beach with an extraordinary and unique opportunity to address our energy usage and reduce the City's annual energy budget while demonstrating to the public many of the Green Task Force's strategies to improve our environment and community. This 17.5 acres park includes a recreation center with a game room, gymnasium and auditorium. The park features 2- lighted little league baseball fields, 1- lighted junior /senior league baseball field, 1 multipurpose field, spectator bleachers /benches located at each field, 2 batting cages, press box, concession stand, outdoor lighted tennis courts, outdoor lighted basketball courts, outdoor lighted racquetball courts, a state of the art playground area, 2 picnic pavilions, and picnic areas with barbecue grills, tables, and benches. Adjacent to the recreation center is the Pompey Park Pool with both swimming and wading pools. This project proposes to replace the existing 102 existing sports lighting fixtures with 74 energy efficient fixtures. The City estimates a energy consumption savings of 36,372 kwh at 700 annual hours of use. PH is any information about an individual which can be used to distinguish or trace an individual's identity. Some information that is considered to be PH is available in public sources such as telephone books, public websites, university listings, etc. This type of information is considered to be Public PII and includes, for example, first and last name, address, work telephone number, e-mail address, home telephone number, and general educational credentials. In contrast, Protected PH is defined as an individual's first name or first initial and last name in combination with any one or more of types of information, including, but not limited to, social security number, passport number, credit card numbers, clearances, bank numbers, biometrics, date and place of birth, mother's maiden name, criminal, medical and financial records, educational transcripts, etc.
