Due to regulations which prohibit irrigation with reuse water within 75 feet of a portable water well, other course changes, in addition to the greens and irrigation system, have been incorporated into this report. Mr. Northrup has been coordinating his preliminary design work with our Engineering staff as it relates to the reuse water element of the plan. Construction costs do not include costs for a reuse distribution line, a new pump station, or lake expansion and lining. These elements, as well as costs for item numbers 5 and 7, would be paid by the utility fund as part of the reuse water portion of the project. Additional information will be provided by Mr. Northrop at the meeting. I have also attached a month-by-month analysis of overtime hours and costs for the last two (2) event years (July-June). The draft was distributed for review and comment to William Wood, Marjorie Ferrer, Joe Gillie, Brahm Dubin, Chief Schroeder, Chief Koen, Joe Weldon, and Rich Olson. Comments and suggested changes that I received were incorporated into the final draft. I have attempted to define a special event and purposes of an event as well as three levels of events. I utilized a cost to the City value in defining each event level. Other policies from different cities I reviewed utilized crowd estimates. I do not agree with using crowd estimates because they can easily be under or over estimated. General policies have been written to attempt to limit events without setting a specific event number but allow for some flexibility. I have also attempted to define a sliding scale of payment to the City for overtime costs and other hard costs based on the type of event sponsor and event level. The payment schedule does not include a recommendation for payment of staff costs for regular time or costs for time spent by senior staff planning the event. The policies as written would not prevent contracting for events which might result in different payment plans, i.e. Tennis Center Events. One alternate staff recommendation has n6t been included in this draft. An alternative recommendation was to require private event sponsors to pay all event costs beginning in year one. I am seeking City Commission input and direction. Once we have agreed on a policy and procedure for special events, I will prepare a permit form and instruction booklet to be utilized by event sponsors with the goal of also putting this information on the intemet. Def'mifions A) Special Event - A special event is a non-routine happening or social activity bringing a large number of people together in a defined area on City facilities, right of way, or private property which requires City services to ensure safety and coordination. Special events include activities such as festivals, concerts, sporting events, parades, walks and rllns, etc. B) Purpose of Special Events - The purpose of special events is to fund-raise for non-profit or charitable organizations serving the citizens of Delray Beach, to enhance community and/or neighborhood relations and unity, to promote cultural and ethnic diversity to market and/or promote the City of Delmy Beach, or the County, and/or to enhance and promote economic activity within the City. Types of Events A) Major Event - An event of one or more day duration with a cost of over $10,000 for City services, staff overtime and equipment use. B) Intermediate Event - An event of one or more day duration with a cost of between $1,000 and $10,000 for City services, staff overtime, and equipment use. C) Minor Event - An event of one day or less duration, with a cost of under $1,000 for City services, staff overtime and use of equipment. General Policies A) Events must meet defined purposes. B) Events must contribute financially to City residents, non-profit or charitable groups, neighborhood associations or must be of significant economic or marketing value to the City. C) Event sponsors are required to obtain all City, State, County and Health Department pemtits as may be needed. D) Event sponsors are responsible for submitting in writing permission as may be required from other governmental agencies, private property owners, and designated managers of City property i.e. Tennis Center and Old School Square. E) Event sponsors are primarily responsible for event promotion, marketing and advertising. City assistance will be provided through its Public Information Officer web page and other printed publications. A major and intermediate event will not be allowed on the same day or during the same week. No more than two (2) intermediate events will be allowed within the same week when total costs exceed $10,000. City staff will assist in obtaining parking lot use agreements from the County and CRA as may be needed. Event sponsors or their contractors are required to submit required certificates of insurance, to include liquor liability when applicable, hold harmless agreements, and any required cash bonds to the City at least one week before the event. Submittal Requirement: · Major Event - Initial requests must be submitted to the City Manager or his designee at least 90 days prior to the event. The permit including all back up material must be submitted at least 45 days before the event. · Intermediate Event- Initial request must be submitted to the City Manager or his designee at least 60 days before the event. The permit including all back up material submitted no later than 45 days prior to the event. · Minor Event - Initial requirements be submitted to the City Manager or his designee at least 30 days prior to the event. The permit and all back up materials must be submitted at least 20 days prior to the event. · Event submittals may require (based on the type and the size of the event) · Site plan · Parking plan · Traffic plan Private security plan · Alcohol control plan · Police security plan · Pyrotechnic permit submittals shall be submitted to the Fire-Rescue Department at least 30 days prior to the scheduled display. · Maintenance/clean up plan City staff will provide assistance in developing said plans. · Entertainment schedule · Load in and take down schedule · Event Sponsors will be required to submit an event budget. Event staffing: Police - mandatory police or other trained non-sworn personnel is required for: · Directing traffic for pedestrian safety · whenever alcohol is served or sold by the event sponsor, event vendor, or other businesses within the event foot print. Mandatory staffing can be waived by the Police Chief in consultation with the City Manager or his designee if deemed appropriate based on the type of event. Fire - mandatory staffing may be required as determined by the Fire Chief in consultation with the City Manager or his designee normally when the total estimated crowd at anyone time in the venue area exceeds 2,500 people. However, staffing requirements must take into account venue risks, type of activity, and other safety considerations in addition to the size of the event. Mandatory staffing can be waived by the Fire Chief in consultation with the City Manager or his designee if deemed appropriate based on the type of event. At your meeting of February 5, 2002, Mr. Jim Smith suggested that the City add a Bicycle/Pedestrian Coordinator position to the budget. Mr. Smith also presented to Commission at your June 4, 2002 meeting, 44 recommendations to make Delray Beach a bicycle pedestrian friendly community. One of these recommendations was to establish a Bicycle/Pedestrian Advisory Board. Mr. Aronson, the Parking Management Specialist has been assigned additional duties of a Bicycle/pedestrian Coordinator. He has been attending the MPO Bicycle/pedestrian Advisory meetings on the 2nd Thursday of every month. The question before Commission is whether or not you wish to establish a task team or advisory committee. If it is Commission's intent to establish a committee we would need to know how many members, frequency of meetings, duties and whether there would be a time specific task team or an ongoing advisory board. Said motion passed with a 5 to 0 vote. At this point, the Commission moved to Item ll.B., Comments and Inquiries on Non-Agenda Items from the Public. 11.B. From the Public. ll.B.1. Jim Smith~ 1225 S. Ocean Boulevard~ expressed concern over Delray Beach not being bicycle-friendly and feels two things should be done to help Delray Beach become more bicycle-friendly. First, Mr. Smith suggested adding a new Bicycle Pedestrian Coordinator to the City's budget this year. Second, Mr. Smith suggested the City apply for bicycle-friendly projects and urged the City to give the Parks and Recreation Department the resources they need to make Delray Beach bicycle friendly. 11.B.2. Kenneth Gra% 696 Udell Lane~ stated many people in the Delray Shores area are concerned with the drug activity and the youth hanging around the Dollar Saver Store. Mr. Gray stated this store is providing the kids with beer and cigarettes and commented that the store also stocks nude magazines and video tapes. Based on some of the phone calls made under these circumstances to the Delray Beach Police Department, Mr. Gray stated response time has taken up to forty minutes. Mr. Gray asked that there be more Police enforcement at the Dollar Saver Store because he does not want to see his neighborhood become a drug hangout for the youth. ll.B.3. John Benneth 137 Seabreeze Avenue~ distributed a proposal of the Rules of Procedure to the Commission to change the Rules of Procedure by allowing people to yield their allotted three minutes to another person for a longer period of time. At this point, the time being 7:50 p.m., the Commission moved to Item 9.J. of the Regular Agenda. 9.J. SOLID WASTE AUTHORITY INTERLOCAL AGREEMENT/ TEMPORARY USE PERMIT: Approve a new lease agreement between the City and the Solid Waste Authority of Palm Beach County for the SWA's temporary use for up to 2 years of the Public Works Warehouse located on Lake Ida Road, just east of Congress Avenue. Paul Dorling, Planning Director, stated on March 15, 2000 SPRAB approved a Class II Site Plan Modification for significant upgrades to the Solid Waste Authority Transfer Station on the east side of S.W. 4th Avenue, south of Linton Boulevard. The Solid Waste Authority is ready to begin construction (anticipated for March 1st) and is requesting to relocate the Household Hazardous Waste Collection aspect to the Public Works Warehouse on the south side of Lake Ida Road. The request is to allow the temporary use at this location for up to two years and staff is recommending approval of a temporary use permit based upon positive findings with respect to LDR Section 2.4.7(B)(5) subject to the condition that all aspects of this operation comply with the conditions set forth in the Interlocal Agreement between the City of Delray Beach and the Solid Waste Authority. -22 - ~5~2 City Commission Meeting February 5, 2002 Fact gl - Since 1997, aH five miles of A1A in Boca Raton have had designated bicycle lanes. Delray Beach's A1A has none. Fact #2 - Boca Raton has over 30 miles of designated bike lanes. Delray Beach has none. Fact #3 - Boca Raton has had a bicycle/pedestrian coordinator on the payroll for the past 9 years. Delray Beach does not have such a position. Fact # 4 - Boca Raton has a code that requires new residential developments to provide a convenient space for bicycles. Delray Beach does not have such a requirement. Fact # 5 - Boca Raton has a pending ordinance that would require bicycle/automobile parking at a ratio of 1:10. Delray Beach does not. Fact # 6 - In Delray Beach's Parks & Rec pamphlet the word "bicycle" is not mention one time. Conclusion: Boca Raton is bicycle friendly; Delray Beach is not. What e can be done to make Delray Beach more bicycle friendly? Add a new bicycle/pedestrian coordinator position to the city's budget this year. Apply for bicycle friendly projects when we make our application for T-21 Funds this year. The Palm Beach Planning Department has already told us, in a meeting with Paul Dorling, our City Engineer and me, that bicycle projects will receive a much higher priority in awarding T-21 Funds than sidewalk and sidewalk beautification projects. Don't allow the CRA to submit a request for-S500,000 and have the City of Delray Beach shut out at the window when we could have easily received $500,000 for bicycle related projects. Mrs. Archer moved to adopt Ordinance No. 8-02 on FIRST READING/FIRST PUBLIC HEARING, seconded by Mr. Perlman. Upon roll call the Commission voted as follows: Mrs. Archer - Yes; Mr. Levinson - Yes; Ms. McCarthy - Yes; Mayor Schmidt - Yes; Mr. Perlman - Yes. Said motion passed with a 5 to 0 vote. ll.A. City Manager's response to prior public comments and inquiries. With regard to Mr. Smith's presentation at the last meeting regarding the City's need for bicycle facilities, the City Manager stated the bike lanes on A-1-A have been constructed by the Florida Department of Transportation (FDOT). Recently, the City Manager stated the City of Delray Beach adopted a Landscape Maintenance Agreement for the section up as far as the Linton Bridge which will be constructed within the next year and then in subsequent years will eventually go through the entire City. The City Manager stated as FDOT does the work they are making provisions for bicycles and commented that this is nothing the City of Boca Raton had anything to do with. The City Manager stated Objective D-2 under the Transportation Element of the Comprehensive Plan states, "Facilities which accommodate the use of bicycles as an alternative means of personal transportation shall be assessed and required during development review." The City Manager stated Policy D-2.1 states, "Bicycle traffic shall be accommodated in the design and construction of Collector and Arterial roadways. These improvements are to emphasize safer bicycle movements (e.g. 14-foot outside travel lanes) rather than providing separate bicycle facilities and lanes. The City, by adoption of this policy, requests that such improvements be included in all projects undertaken per Florida Department of Transportation or the County Five-Year Road Program, as well as the City's Capital Improvement Program." The City Manager stated if someone desires to have bicycle lanes instead of the wider outside lane, the Comprehensive Plan would have to be changed. Secondly, the City Manager stated bicycle parking facilities shall be required on all new development and redevelopment. Particular emphasis is to be placed on development within the transportation concurrency exemption area. The City Manager stated there is some designated bike lanes in the City i.e. when North Federal was rebuilt FDOT installed the designated bike lanes from George Bush Boulevard North into Boynton Beach. The City Manager stated one of the fun things about his job is trying to connect people together. The City Manager commented he is the Chairman of Seminole District for Boy Scouts. The City Manager was informed by Mr. Russ Mawson, Boy Scout Master that his unit was rebuilding some computers and asked if there was someone he could donate the computers to. The City Manager stated people in Moshi asked for the computers so the Sister Cities Committee was able to arrange the transportation of the computers to Moshi, Tanzania. 11.B. PRESENTATIONS: 7.A. 13th Annual Del-Aire/Delra¥ Citizens for Delray Police - Charities Golf Tournament to benefit Delra¥ Beach Fire Rescue and Police Departments. Perry DonFrancisco, owner of Boston's Restaurant, stated the residents of Del- Aire recently hosted their 13th Annual Charity Golf Tournament and for thirteen years the proceeds of this tournament have been used to benefit the Delray Beach Fire Rescue and Police Departments. Mr. DonFrancisco stated the generosity of the Del-Aire residents has allowed the City the opportunity to purchase many life saving and crime fighting pieces of equipment that otherwise the City would be unable to purchase because of budget limitations. PUBLIC HEARINGS: NONE. At this point, the Commission moved to Item 11, Comments and Inquiries on Non-Agenda Items from the City Manager and the Public. ll.A. City Manaeer's response to prior public comments and inquiries. In response to a concern regarding the need for bike racks in the downtown area, the City Manager stated the City's Comprehensive Plan calls for the installation of bicycle facilities in the downtown area to accommodate and encourage the use of bicycle as transportation. These could include bike racks, bike lockers, and other bicycle parking facilities. In addition, transportation policies in the Comprehensive Plan call for a design of bicycle lanes on collector arterial roadways and requires bicycle parking on all new development and redevelopment projects. Implementation of these policies as was the designation of the current staff person to coordinate bicycle issues in the City is a good start in making Delray Beach more bicycle-friendly. Secondly, with regard to a concern expressed by a resident who lives on N.W. 22nd Street about speeding in the area, the City Manager stated in the past the Police Department has conducted nine selective enforcement operations in this area and since that time they have not received further complaints. However, the City Manager stated the Police Department will be setting up in that area for some follow-up investigation for this particular complaint. With regard to a concern expressed by Mr. Calvisi who resides at 1206 N.E. 2nd Avenue #2 in Delray Beach, the City Manager stated Mr. Calvisi relayed to the Commission his concern about the different construction sites between his residence and place of employment. The City Manager stated one of the City employees drove the route and mentioned to the City Commission that he noticed a number of construction sites (West Atlantic Avenue and sidewalks, 1-95 and Atlantic Avenue interchange, and 1-95 and Lowson Boulevard overpass). The City Manager stated all these sites are swept weekly by Public Works and they sweep up to the barricades that are in place. However, because they are active construction zones there is a considerable amount of debris that daily finds its way on to the roadway. The City Manager stated all these areas are FDOT projects with the exception of the West Atlantic Avenue sidewalk and street lighting project. The construction zones also tend to be high traffic accident areas and the City has asked the Police Department to insure that they require the tow truck operators to clean up the site after an accident prior to leaving the area. The City Manager stated the City will also increase the frequency of sweeping in these areas while construction continues. The City Manager stated there was also a concern expressed about cement trucks dropping wet concrete on the roadway which causes problems for bike riders. As a follow-up to the City Manager's comments, Mayor Schmidt stated he has written to Sheriff Bieluch to advise him of her complaint and request copies of whatever records they have. With regard to a prior concern expressed by Mrs. Finst about the Neighborhood Summit topics and some issues she was concerned about that she brought to the floor at each session she attended, the City Manager stated staff is in the process of revisiting the ordinances that pertain to parking on front lawns and the requirement to have improved parking on private property. The City Manager stated staff's preference would be to workshop the proposed ordinance for the Commission prior to them being considered to first reading and public hearing. At the Chatelaine Strategic Task Team Meeting last month, the City Manager stated Assistant City Attorney Brian Shutt discussed the issue of overcrowded housing and his examination of options that might be available to the City to address some of these conditions. The City Manager stated there was also talk about Chatelaine's desire to limit the number of vehicles a family may own or park at their residence. The City Attorney was very direct about the City's limited ability to control some of these situations under the civil rights that all of us have as citizens. Jim Smith~ 1225 South Ocean Boulevard~ thanked the City Commission for agreeing to consider establishing a Bike Pedestrian Advisory Board. In addition, Mr. Smith thanked the City Manager for taking the first step toward nominating a Board representative to the Palm Beach County Bike Pedestrian Advisory Board. As a result of these actions, Mr. Smith stated two of the 33 Bicycle Friendly Steps have been addressed. Mr. Smith entered into the record 44 Pedestrian Friendly Steps to make Delray Beach more pedestrian friendly and urged the Commission to review each step and if in agreement come up with an implementation plan. ll.B.2. Anthony Vocaturo~ 2513 Coral Trace Place~ stated he came before the Commission approximately three months ago and expressed concern over the condition of the way the Tare property was left. Mr. Vocaturo stated the contractor just vacated the property and left 50 foot mounds of dirt on the site. Mr. Vocaturo stated he received a letter from the City Manager informing him that he would have the environmental specialists take a look at it. Mr. Vocaturo stated he looked at the World Almanac and noted that the amount of rainfall we have received from the time he received the letter was less than two-tenths of an inch of rain. Mr. Vocaturo commented about the severe drought in South Florida and stated he has two new cars that he washes nearly every other day due to the amount of dust which blows from this site and feels he cannot help to conserve water this way. In addition, Mr. Vocaturo commented about the poor condition of the sidewalks in the area. He urged the City to do something to make this area safe and confine the amount of dust that is coming from this property. -21- 06/04/02 Ma}, 7, :2002 44 Pedestrian Friendly Steps for Delray Beach 1. Establish a Citizens' Pedestrian/Bicycle Advisory Board for Delray Beach. 2. Budget/hire a Pedestrian/Bicycle Coordinator (new position). Amend the Comprehensive Plan to include Pedestrian/Bicycle goals, objectives and policies. Adopt a Pedestrian/Bicycle Master Plan based on recommendations received fromthe Citizens' Pedestrian/Bicycle Advisory Board. Complete sidewalk linkage and safe street crossings so that all school children that live within two miles of a school can realistically walk or bicycle safely to school, 6** Pass an ordinance that prohibits the use of automatic water sprinklers during daylight hours. Now, walkers and joggers must sometimes make unsafe or inconvenient detours to avoid flooded pathways. As an added benefit, watering lawns during nighttime hours would preserve our diminishing water table. ** Pass an ordinance that prohibits the planting of hedges within so many feet of a sidewalk (or future sidewalks). This will prevent future sidewalk "encroachment" into the right-of-way. ** Change fight-of-way design priorities, giving more weight and consideration for pedestrian/cyclists than we have in the past. e Encourage the use of awnings on all buildings that I~ont on a sidewalk. This will provide both sun and rain protection for pedestrians. 10. The City should plant more sidewalk shade trees and landscaping. Homeowners should be encouraged to do the same so that pedestrians will have more protection from the sun and a more pleasant walking experience. 11. By converting these four streets to pedestrian, skater and cyclist traffic, the merchants will reap the advantage of "walk by" rather than "drive by" traffic. Pedestrians will enjoy the benefits of a park-like atmosphere, with benches, fountains, and social interactions. Motorists will find less gridlock. Motor vehicle traffic flow at the comer of,Swinton Avenue and Atlantic Avenue will be improved with one-way east traffic only, on Atlantic Avenue between Swinton and East 1~t Avenue. Motor vehicle traffic flow at the comer of Atlantic Avenue and East 5a' Avenue (Federal Highway, South) will be improved as traffic converts from a three-way street intersection to a two-way street intersection. Widen the asphalt pathway on the west side of A1A that stretches from Highland Beach to the Seagate Hotel, so that it conforms to width design guidelines for a multi-purpose pathway. This pathway could be the highest volume pathway in Delray Beach and the City should insist that the Florida Department of Transportation (FDOT) accurately measure and provide for pedestrian, cycling, and skating activity in its redesign. Complete a Walkability Checklist for various neighborhoods throughout Delray Beach. Observe and celebrate "Delray Beach Pedestrian Month", "National Walk Our Children to School Week", "Walk to Lunch Day", etc. 23. Complete a Self-Guided Pedestrian/Cyclists Tour of Delray Beach's Historic Places. 24. Provide a Delray Beach Pedestrian Suitability Map so that residents and visitors alike know where the "best" and "worst" walking areas may be found. Designate specific scenic or historic walks with the mileage included for joggers and walkers. 25. If sidewalks are not installed at the time of development, establish clear regulations as to who (developer, property owners, or governmental agency) will pay for the sidewalks. Whoever is paying for the road must pay for the sidewalks. If there is money for a road, there is money for a sidewalk. Developer contributions to sidewalks should be set-aside in an escrow account at the time of development. Pass an ordinance that requires property owners to pay for necessary sidewalk repair. Relocate telephone/electric poles that are in the middle of the sidewalk on the east side of Pineapple Grove (bi. E. 2 Ave-hue). Aid to Victims of Domestic Abuse (AVDA) - Commissioner McCarthy Ms. McCarthy stated last month the first bicycle rally was held locally which was organized by Jim Smith who is a Delray Beach resident. Ms. McCarthy announced Allie Adams the raffle winner and introduced Albert Richwagen, owner of Delray Bike and Sports/Richwagen's who donated a bike so that funds could be raised. The RFP Review Team consists of 9 members including 3 staff members, 4 local design professionals, and two residents from adjacent neighborhoods (see attached list). The Team has met on three occasions. The first meeting was held on September 12th, and items of discussion included Sunshine Laws, an overview of the RFP, RFP Evaluation Criteria, and the various proposals. The second meeting was held on September 20th, and the RFP Review Team discussed the various proposals and each developer gave a presentation of their Master Development Plan. While, it was anticipated that the RFP Review Team would rank the proposals at their meeting of September 30th, the Team felt they needed to meet on one more occasion. Therefore, at the September 30th meeting, the Team reviewed a comparison matrix that staff developed. While the matrix is attached for informational purposes, it is a work in process. An updated copy should be available at the October 8th meeting. In addition, the Team discussed in depth each plan and whether or not it met the intent of the RFP. The Team will rank the proposals at their next meeting scheduled for October 10th. Bounda~j Survey Plat (with legal description of property) will be checked upon presentation of Record Plat with same. 32. Prior to construction of any improvements, Davis Road must be built, submit plans and include in estimate for improvements of kind re- quired. Note: Drainage of the project above will have to be maintained on site or out through the storm sewer system. No drainage will be allowed to flow over land on adjacent property. City Engineer March 26, 1979 SUBJECT: Site Plan Review Rainberry Lakes The revised Site Plan indicates a very narrow waterway off of RainberryLake. The waterways are such a minimum size that it would be 'difficult to accommodate boat traffic and if appropriate slopes are put in; in lieu of seawalls or other erosion control structures, then there would be insufficient depth for boating pu~_--poses. It is noted that Davis Road has been shown. Provision would have to be made to vacate the existLng used road S.W. 23rd Avenue and provide for the Davin= of Davis Road. This department, therefore, has no objection to the approval of this site and development plan as submitted.
