A Special Meeting of the City Co~mission of the City of Delray
Beach, Florida, was held in the Cozmission Chambers at 7:30 P.
with Mayor W. J. Snow in the Chair, City Manager ~/. E. Lawson Jr.,
City Attorney Neil MacMillan and the following Coeuaission.~embers
present, E~ory $. Barrow, Catherine E. Strong, Glenn B. Sundy and
W. Cottinghma Allen.
This meeting was called for further study of the proposed
budget and consideration of the proposal of Archer & Warriner, Inc.
to lease the City Dock area.
Attorney Rhea ~hitley, addressing the Comission, advised that
Messrs. Archer and ~arriner were out of the City and not expected to
return for approximately ten (10) days, however, he believed that
Archer & Warriner, Inc., were in substantial agreement with the City
on the proposed Lease but could not speak nor act for them relative
to suggested amendments and possible additions, especially a rec-
ommended performance bond.
Att'y. Whitley expressed doubt that Archer & Warriner, Inc.,
would agree to any abolishment of an option, for extended Dockage
Facilities, of the area immediately north of the Atlantic Avenue
Bridge.
Co~missioner Strong reminded the Attorney that a tentative
option agreement had been agreed upon at the regular meeting of the
City Commission held on August 23rd, 1955.
Hr. Henry Pope informed the Commission that serious damage, by
loss of business, to the Harbor House Apartments would result from
heavy duty construction going on in front of the Harbor House during
the season, and was in hopes that such installation might be done in
the off-season.
Commissioner Allen stated that, in his opinion, the ultimate
gain would more than justify any possible short-term loss.
There was considerable discussion as to the limit of activities
in connection with the project, it being feared that one activity
might lead to others, some of which would be detrimental to the wel-
fare of the area. Mayor Snow advised that such concern should not
be entertained as curtail~ent off any undesired activities is controlled
by the requirements of Permits For any activity within the boundaries
of the City.
The City Manager and the Commission unanimously agreed that the
proposed ~Lease~ should be as specific as possible in identifying the
limitations of activities to be sanctioned in the operation of the
Dock Facilities.
Commissioner Allen moved for execution of the amended ~Leasee
between the City of Delray Beach and Archer & Warriner, Inc., subject
to acceptance by the Lessee of providing a Performance Bond, the amount
of which, together with Completion Date of Installation, being subject
to the approval of the City Manager.
~otion was seconded by Commissioner Strong and upon Call of Roll,
Mayor Snow and Commissioners Barrow, Strong and Allen favored the mo-
tion, Commissioner Sundy being opposed.
Mr. Sidney Zuckerman addressed the Commission and explained in
detail the operation of the Public Library, the sincere effort in
effecting the Budget Request submitted to the City Manager for the
coming fiscal year which totaled $20,060.00 for operational purposes
and in the opinion of the Library Association Committee could not be
reduced if the Library is to continue to the extent warranted, origin-
ally planned, and to furnish the public with a service commensurate
with the demand and growth of the City.
Mayor Snow expressed the appreciation of the Commission for Hr.
Zuckerman's interest in the operation of the Library and his detailed
explanation of the Committee's Budget request.

Coach Spencer C. Pompey, of Teen Town Center, expressed the
need and desire of all concerned for a Swimn~ng~ol in that area
and was assured by the Hayor that the Commission is. definitely
well avare of the need and is considering the creation of this
project.
City NanagerLawson informed the Commtssi~n of Tax Rates,
and the percentage of assessed valuation to appraisal value as
now existing in Ft. Lauderdale, Pompano, Lake Worth and West Palm
Beach, all of which information, togetherwith the knowledge
the Homestead Exemption factor, clearly indicates the necessity
for revaluation of all property in the City of Delray Beach, from
which may be derived operating revenue sufficient to meet thm
quirements of the City.
A tentative millage of twenty-two (22)mills, 15 for operat-
ing and 4 for debt, is being considered by the Commission.
