A Regular Meeting of the City Commission of the City of Delray
Beach, was held in the Commission Chambers at 2.30' Po M., ~th Hayor
W. $. Snow in the Chair, City Manager W. E. Lawson Jr., City Attorney
Nell MacMillan and the following Commission Members being present;
Emory $. Barrow, Catherine E. Strong, ~lenn B. Sundy and W. Cottin~ham
Allen, a quorum being present.
An opening prayer was delivered by Rev. Arthur R. Charlesworth.
Commissioner Strong moved that the Minutes of the October 24th
and 25th Meetings be approved as corrected. Motion was seconded by
Commissioner Allen and unan/mously carried.
Mr. Kirk Sullivan, representing Dorson & Udell who anticipate
developing Section 7-46-43, submitted a new sketch of the proposed
route connecting N. W. 4th Street with a County paved highway west
of Lake Ida.
Mr. Robert Blake, Chairman off the Planning/Zoning Board,
formed the Commission that the Board felt that this sketch showed
an area between the actual paving at the no~th end of 4th Avenue and
the proposed connecting road, referred to above, which would possibly
result in only a temporary stop-gap. The Board suggests that the
proposed connecting route be so established as'to miss the north end
of N. W. 4th Avenue, at this point, by 50 to 60 Feet in order to avoid
entry into the proposed route by traffic from said 4th Avenue.
The Board further stated that it might be Well to dead-end No
3rd and 4th Avenues at this point in order to possibly retain as great
a residential atmosphere northward From the proposed route as possible,
and further that if such desd-ending of 3rd and 4th avenues could be
accomplished it would avoid the necessity of penetrating the property
of Dr. Davis as well as, to a large degree, control the traffic.
Commissioner Allen then suggested that the Mayor, together with
Mr. Blake, arrange to meet with Dr. Davis as soon as possible to effect
a possible solutionto the present problem.
The Mayor agreed with Mr. Blake to contact Dr. Davis immediately
after adjournment of this meeting, a satisfactory solution of the curr-
ent problem and approval of the proposed route being of paramount
pevtance at the earliest possible date to permit the County to proceed
with H/W acquirements°
Commissioner Allen moved that the proposed reassessment schedule
of all improved property within the City be tabled until such time as
the Mayor could call a Special Meeting for consideration thereof.
Motion was seconded by Commissioner Sundy and unanimously carried.
Commissioner Sundy moved that the City of Delray Beach work with
the County Commission with regard to obtaining the necessary rights-
of-way and construction of a sidewalk on South Swinton Avenue from SoE.
4th Street to 10th 9treet. Motion was seconded by Commissioner Strong
and unanimously carried.
Commissioner Strong moved to accept the recommendation of the
City Manager and purchase the Gar-Wood garbage packer. Motion was
seconded by Commissioner Barrow and unanimously carried. Purchase
price of said Packer to be $4,325.00.
Commissioner Strong then moved that the Commission.accept the
City Manager's recommendation and purchase the International TD9 with
Drott Loader, for the sum of $10,120.92. Motion was seconded by Comm-
issioner Allen and unanimously carried.
There being no objections at the Public Hearing, scheduled for
.today, relative to the Sidewalk Assessment Roll presented to the Comm-
ission at the regular meeting held on October 25th and subsequently
advertised, said assessment roll being for the conslruction of the

WHEREAS the City Hanager of the City of Delray Beach, Florida
has, in accordance with and pursuance to the Charter of said City,
submitted to the City Commission for approval, a report of %he cost
and the assessment roll for construction of five (5) foot sidewalks
and curb on the East and West sides of N. Eo 2nd Avenue, between
Atlantic Avenue and N° E. Second Street: and
WHEHEAS said report and assessment roll were approved by the
City Commission in regular session on the 18th day of October, A. Do,
1955; and
WHEHEAS due notice concerning said assessment roll was given
through advertisement by the City Clerk, in accordance with the City
Charter of the City of Delray Beach, for the purpose of hearing
objections, if any, to said assessment roll; and
WHEREAS no suffficient objections were received to the con-
ffirmation of the assessment roll,
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the
City off Del~ay Beach, Florida, as follows:
SECTION 1. The assessments, as shown by said assessment roll,
which is annexed hereto and made a part hereof, are he,by levied
ag4inst the property shom2 and in amounts specified on said assessment
roll, said assessments to be paid in three (3) equal annual install-
ments, together with interest at the rate of eight (8) per cent'per
annum, the first installment becoming due and payable on November 22nd,
1955, and on the 22nd day of November for the next ensuing two (2)
years; and said special assessment, so levied/ shall be a lien from
the date the assessment becomes efffective, upon the respective lots
and parcels of land described in said assessment roll, of the same
nature and to the same extent as the lien For general taxes, and shall
be collectible in the same manner and with the same penalties and
under the same provisions as to sale and Forfeiture as City taxes are
collectible.

this the 22nd day of November,A. D., 1955.

Commissioner Strong moved that Ordinance G-224 be placed-on
first reading. Motion was seconded by Commissioner Barrow and unan-
imously carried.
Mayor Snow instructed City Manaier Lawson to file the document
prepared by a structural engineer concerning the damage to the Webb
Building caused by the fire of last May.
Commissioner Sundy moved that bills in the sum of $27,921.82 be
paid subject to the approval of the Finance Committee. Motion was
seconded by Commissioner Allen and unanimously carried.
Commissioner Sundy moved that Mr. L. Stuart Lankton be appointed
to Fill the vacancy on the Palm Beach County Resources Development
Board. Motion was seconded by Commissioner Barrow and unanimously
carried.
Commissioner Barrow moved that the City accept the offer of Mr.
T. M. O'Neal to purchase the Davis House subject to removal within
thirty (30) days. Motion was seconded by Commissioner Allen and un-
animously carried.
City Manager W. E. Lawson Jr., read a request from one of the
Tenants of the Webb Building at the time off the May Fire therein,
seeking and requesting an adjustment of persoaal property tax due to
loss suffered by said Fire.
Commissioner Strong moved that this request be denied ~rlth regret.
Notion was seconddd by Commissioner Barrow and unanimously carried.

City Manager Lawson read a letter written by Mrs. Catherine
E. Strong, as a representative of the Gulf Stream Hospital Associat-
ion, thanking the City for its co-operation in the Hospital movement.
Mr. John N. Kabler requested that the City consider the clearing
of Lots 9 and 25 in the S. W. quarter of Sec. 21-46-43, principally
for the betterment of general appearance as well as providing vision
eastward and across the W~terway to an attractive and highly developed
area in Seagate.
Commissioner Allen moved that the City Hanager obtain bids for
the proper clearing of th~ tract of land in Section 21. Motion was
seconded by Commissioner Strong and unanimously carried.
Commissioner Sundy moved that the Zoning Request of Dr. Williams
be referred to the Planning Board. Motion was seconded by Commissioner
Allen and unanimously carried.
Commissioner Strong moved that the sketch submitted for a tempor-
ary building on East Atlantic Avenue, to be used by Hertz Car Rentals,
be referred to the Planning Board. Motion was seconded by Comnissioner
Barrow and unanimously carried.
Commissioner Strong moved that the plans kubmitted for the Delray
National Bank building be approved. Motion was seconded by Commissioner
Barrow and unanimously carried.
Commissioner Strong moved that the plans, as submitted for the
Buildin~ to be occupied by the First Federal Savings and Loan Associa-
tion and to be constructed on the N. W. Corner of East Atlantic and
Seventh Avenues, be approved. Motion was seconded by Commissioner
Barrow and unanimously carried~
Commissioner Allen moved for ratification of the City Commiss-
ion A~plicants whose qualifications have been approved by the City
Attorney, thereby authorizing the appearance of the names of the
qualified persons, sho~n below, on the Ballot at the General Election
to be held on Tuesday, December 6th, 1955.
