11-22-55 NOVEKBER 22nd, 1955. A regular meeting of the City Commission of the City of Delray Beach, was held in the Commission Chambers at 2:30 P. M., with Vice- Mayor Emory J. Barrow in the Chair, City Manager W. E. Lawson Jr., City Attorney Nell MacMillan and the following Commission Members being present; Catherine E. Strong, Glenn B. Sundy and W. Cottingham Allen, a quorum being present. An opening prayer was delivered by Neil MacMillan. ~ Commissioner Strong moved that minutes of the November 8th meet- ing be approved as written. Motion was seconded by Commissioner All.r. and unanimously carried. Commissioner Sundy made a motion that the following persons be appointed to serve as Clerks and Inspectors at the General Election to be held on Tuesday, December 6th, 1955; CIVIC CENTER - Florence Cramp, Clerk Blanche Lamb, Inspector M. T. Knox, C. C. Turner, " AHERICAN LEGION POST NO. 188 - Ozzie Youngblood Clerk Alberta Palmer Inspector Lens Brunner " Motion was seconded by Commissioner Strong and unanimously carried. Attorney Paul Oringle, appearing on behalf of Lindsley Lumber Co., addressed the Commission relative to a deviation request in Lot 4, subdivision of See. 9, T. 46 S., R. 43 E. Commissioner Allen moved that the matter be referred to the Planning Board for consideration and recommendation. Motion was seconded by Commissioner Sundy and unanimously carried. City Manager Lawson informed the Commission of having received the following bids for base, rock and paving of the parking lot in Block 92 between N.E. 3rd and 4th Avenues; Rubin Construction Co., $ 8,125.00 Hardrives, Inc., 8,382.50 Jack Carver 8,960.00 Commissioner Sundy moved that the low bid be accepted and award the contract for such construction to H~bin Construction Company. Motion was seconded by Commissioner Allen and unanimously carried. The City Manager then advised the Commission of having received the following bids for a truck to be used in connection with the 16 Cu. yd. garbage packer; Ford (Earl Wallace Ford) $ 4,099.00 Dodge 4,125.00 International 4,438.50 Reo 4,592.90 Commissioner Strong moved that the low bid be accepted, awardin~ the contract to furnish said truck, in accordance with the specificat- ions furnished, to the Earl Wallace Ford agency. Motion was seconded by Commissioner Sundy and unanimously carried. Commissioner Strong requested City Hanager Lawson to extend the appreciation of the Commission to the operators of the cabana concess- ions at the beach for their co-operation during the past season and to solicit their further aid toward minimizing complaints during the coming season. Mr. Kirk Sullivan, Attorney for Dorson & Ude11, advised the Comm-. ission of having George S. Brockway re-survey a proposed route, connect- lng N. W. 4th Street with a count~ highway west of Lake Ida, and sub- mitted a revised plat showing a Hf~ location for said proposed route. The City Attorney then read Resolution No. 990, pertaining ~o tile proposed plat of said H/W, as prepared by the engineering firm of Brock- Way, Weber and Brockway: NOVEMBER 22nd, 1955. RESOLUTION NO. 990. WHEREAS, Jack Dorson and Dan Udell own a tract of land north of Atlantic Avenue and west of the City o£ Delray Beach, Florida, which they intend to subdivide in the immediate Future; and WHEREAS, the said Jack Dorson and Dan Udell have entered into a tentative agreement with Palm Beach County, Florida, to build an access road From that proposed subdivision into the City of Delray Beach, Florida, in such a manner that it will connect with Swinton ^venue at the intersection with Northwest Fourth Street; and WHEHEAS, a proposed plat of said roadway has been pre- pared by the engineering firm of Brockway, Weber and Brockway, a copy of which plat is attached hereto and made a part of this resolution by reference; NOW, THEREFORE, be it resolved by the City Commission of the City of Delray Beach, Florida; 1. That the plat of the proposed roadway prepared by Brockway, Weber and Brockway, being identified as Sheeg No. 1 of 2, File No. TF-1565-A, be and the same is hereby approved by the City Commission of the City of Delray Beach, Florida. 2. That the County Commissioners of Palm Beach County, Florida, be and they are hereby requested to construct said roadway eastward through the City to a point immediately North of the center line of the extension of Northwest Fourth ~venue where the 80 foot right' of way ceases on the attached plat. 3. That Jack Dorson and Dan Udell have agreed to pay the entire cost of paving the proposed roadway from the point where the County interests cease eastward to the intersection Swinton Avenue. Motion was seconded by Commissioner Sundy and upon call of roll Vice-Mayor Barrow and Commissioners Sundy and Allen voted in Favor of the motion and Commissioner Strong was opposed. A deviation request From the Sea Ray Corporation, concerning cabana operation on a triangular parcel of land East of AIA, in Section 21-46-43, was discussed. Upon motion by Commissioner Allen this request was referred to the Planning Board for their early consideration and recommendation. Motion was seconded by Commissioner Stron~ and ~manimously carried. Col. Fabens assured the Commission that this matter would re- cel~,e immediate attention by the Planning Board permitting a recommend- ation to be Furnished in time for City Commission consideration at a special meeting to be held at 2:30 P. M., on Friday, November 25th, 1955. NOVEMBER 22nd, 1955. City Hanager Lawson then read the revised "Barber Ordinance". Commissioner Strong requested that the Board of Committee Hembers for the Barbers organization should include one City Co~missioner to serve as ex-officio member thereon as is the custom on all similar BoardS. WHEREAS the City Manager of the City of Delray Beach, Florida, has, in accordance with and pursuance to the Charter of said City, submitted to the City Commission for approval, a report of the cost and the assessment roll for construction of five (5) root sidewalks and curb on the East and West sides of N. E. 2nd Avenue, between Atlantic Avenue and N. E. Second Street; and WHEI{FAS said report and assessment roll were approved by the City Commission in regular session on the 18th day of October, A.D., 1955; and WHEREAS due notice concerning said assessment roll was given through a, dvertisement by the City Clerk, in accordance with the City Charter of the City of Delray Beach, for the purpose of hear- ing objections, if any, to said assessment roll; and WHEREAS no sufficient objections were received to the conf~rm- ation of the assessment roll, NOW, THEHEFORE, BE IT ORDAINED by the City Commission of the City of Delray Beach, Florida, as follows: SECTION 1. HESOLUTION REQUIRING OWNERS OF CERTAIN DESCRIBED LANDS TO ABATE NUISANCES THERE- ON OR BE ASSESSED TIlE COST TI~HEOF FOR ABATEMENT BY THE CITY. WHEREAS, the City Commission did, in regular session held on the 27th day of Se,tember, 1955, enact a resolution declaring the existence of a nuisance upon certain lots or parcels of land for violation of Chapter 15 of the City Code of Ordinances; and WHEREAS, pursuant to said resolution, the City Clerk of the City of Delray Beach, Florida, did furnish each of the owners of the lands therein declared nuisances with notice that the City Comm- ission would sit on November 22nd, 1955 at 2:30 P. M., at the City Hall in Delray Beach, Florida, for the purpose of allowing said own- ers to show cause, if any, why said nuisance described in said resol- ution should not be abated; and WHEREAS, pursuant to said resolution, the City Commission of the City of Delray Beach, Florida, did on November 22nd, 1955, at 2:30 P. Commissioner Strong then moved that Resolution No. 989 be adopted. Motion was seconded by Commissioner Sundy and unanimously carried. City Manager Lawson submitted the recommendation of the Planning Board wherein the Board recommended that a temporary permit be granted to Hertz Hent A Car Service for a building on East Atlantic Avenue not to exceed two (2) years. Commissioner Sundy moved that the Commission accept the recomm- endation of the Planning Board and grant said temporary permit. Motion was seconded by Commissioner P. llen and unanimously carried. Commissioner Sundy made a motion that Bills, in the amount of $29,892.42, be ~aid subject to the approval of the Finance Committee. Motion was seconded by Commissioner Allen and unanimously carried. City Manager Lawson then read Ordinance No. 6-225. ORDINANCE NO. 6-225. AN ORDINANCE OF THE CITY OF DELRAY BEACH, FLORIDA, A~,NDIN6 PORTIONS OF THE SOUTHERN STANDARD BUILDINC, CODE AS ADOPTED IN SECTION 9-1 OF THE CODE OF ORDINANCES OF THE CITY OF I)ELRAY BEACH, Commissioner Strong requested that the following be added thereto under 706.4 'Ail flashing between roof and chimney shall be carried through to the flue liner. CommissiOner Strong then moved that Ordinance G-225 be placed on first reading. Motion was seconded by Commissioner Allen and unanimously carried. City Manager Lawson then read the Assessment Roll covering the paving of N. E. 2nd Avenue from Atlantic Avenue to N. E. 2nd Street. Commissioner Allen moved the apnroval of said assessment roll, same to be advertised in accordance with the requirements of the City Charter and Code of Ordinances for the City of Delray Beach, Florida. Motion was seconded by Commissioner Sundy and unanimously carried. Mrs. Miriam Cohen, speaking on behalf of Jim Smith and Bob Miller, inquired about the repair of the damaged anchor at the Boat Club. The City Manager agreed to remedy the trouble which had never been called to his attention. Mr. Chuck Wick made further inquiry concerning his letter relative to the parking meter in front of his place of business on S. E. 4th Avenue. ~lere followed considerable discussion regarding the sidewalk and meter installation which appears to be on private land and the Commission agreed to cover this particular meter until the next regu- lar meeting by which time it is hoped to be in accord with the affect- ed property owners with regard to obtaining necessary deeds for convey- ance of land, now showing sidewalk construction upon, to the City,whicln construction had been effected in 1948 without obtaining the necessary deeds to the needed right-of-way. Commissioner Strong inquired as to the status of the Zoning Map. Col Fabens advised the Commission that the proposed zoning map would be up to date in order that it may be reproduced in the news- oapers by the 1st of December thereby permitting a public hearing and Commission consideration thereof during the current calendar year. Commissioner Strong advised of a Citizens Committee being formulated, not to hold any official authority, but to be composed of Oossibly 18 Members, seven of whom would be White and seven Negro, to ~lan and work for the betterment of any and all local problems.
