11-29-54186 NOVE1~ER 29, 1954 A Special Meeting of the City Council of the City of Delray Beach was held in the Council Chambers at 2:30 P.M. with Mayor Catherine E. Strong in the Chair, City Manager W. E. Lawson, Attorney Harry T. Newett, and the following Council members present: Glenn B. Sundy, R. J. Holland and W. Cottingham Allen, a quorum being pre sent. The meeting was held for the purpose of adopting a Reso- lution requiring owners of certain described lands to abate nuisances thereon or be assessed cost thereof for abatement by the City. RESOLUTION NO. 938 . A RESOLUTION REQUIRING OWNERS OF CERTAIN DESCRIBED . LANDS TO ABATE NUISANCES THEREON OR BE ASSESSED COST THEREOF FOR ABATEMENT BY THE CITY. WH~V~EAS, the City Council did, in regular session on September 28th, 1954, enact a Resolution declaring th~ existence of a nuisance upon certain lots or parcels of land for viola- tion of the provisions of Ordinance No. G-147~ and ~EREAS, pursuant to said Resolution, the City Clerk of the City of Delray Beach, Florida, did furnish each of the owners of the lands therein declared nuisances with notice that the City Council would sit c~ November 29th, 1954, at 2:30 P.M. in the Council Chambers in A~elray Beach, Florida, for the purpose of allowing said owners to show cause, if any, why said nuisance described in said Resolution should not be abated; and WHEREAS, pursuant to said Resolution, the City Council of the City of Delray Beach, Florida, did, on November 29th, 1954, at 2:30 P.M. at the City Hall Council Chambers in Delray Beach, Florida, hold the hearing provided for in such notice, and did consider such reasons and facts as were presented by the owners of said lands, and such other material and pertinent evidence as was adduced before it. NOW, THEREFORE, BE IT RESOLVED that the existence of a muisance, for the reasons hereinafter set forth, be and the same is hereby adJuded upon the following lands in the City of Delray Beach, Florida, to wit: Ord. AND, BE IT FURTHER RESOLVED that the City Clerk of the City of ~elray Beach, Florida, furnish each of the owners of the lands hereinabove listed and described, with a copy of this resolution by registered mail, return receipt requested. AND, ~ IT FURTHER RESOLVED, that each of said owners be and they are hereby notified that they are~equired to abate the nuisance hereinabove adjudged and specified within thirty (30) days from the receipt of a cop of this re lution; otherwise, in default thereof, the ~ so ity of Delray Beach, Florida, will enter upon said lands and abate the said nui- sance hereinabove specified and will levy the co st of such work as an assessment against the property hereinabove de- scribed. The motion was seconded by Councilman Holland and unanimously carried. The City Clerk was requested to advise thos owners of lands who had requested adelay in abatement of nuisances on their lands for various reasons, of the advisability of an over-all abatement of said nuisances at this time, and of the intention of the City, by tree of a mower, to maintain said lands now cleared of nuisances in such a manner as to e~imi- nate further cause for violation of Ordinance G-147.~ The City Manager was requested to obtain bids on a mower suitable for this purpose. Council then discussed with Mr. Fred Neaffie an~ associate of John Smith, operators of cabana concessions on the beach, and a mutual understanding relative to the limitations of concessions operations, approved by the Swimming Committee as well as Steve Forsyth, Aquatic Direc~tor, was agreed upon, the above named operators assuring the ~ouncil of t heir full cooperation. A motion was made by Councilman Holland to grant a permit to the aforementioned concessionaires authorizing issuance of Occupational Licenses to Mr. Neaffie and Mr. Smith.
