A Regular Meeting of the City Council of the City of Delray
Beach was held in the Council Chambers at 2:30 P.M. with Mayor
Catherine E. Strong in the Chair, City Manager W. E. Lawson, Jr.,
City Attorney Neil MacMillan, and the following Council members
present: Mrs. alma ~. WOehle and W. Cottingham ~llen, a quorum
being present.
An opening prayer was delivered by Rev. Thomas Oozeman.
The minutes of the December l~, 17 and 23rd meetings were
approved, upon motion of Councilman ~llen, seconded by Mrs.
Woehle and unanimously carried.
Inasmuch as the options for right-of-way deeds relative
to the proposed widening of Federal Highway (U.S. iI expire
December 31, 1954, it was recommended by City Attorney MacMillan
that the City Manager contact the State Road Depart~.ent and the
Chairman of the County Commission by phone, confirming conver-
sations by letter, as to any further procedure at this time
relative there to.
In regard to a new list of lots to be clared in accordance
with Ordinance ~-147, it was ur~nimously agreed to table the
m~tter until a later date when a full Council is in session.
Mr. Lawson ~eported that he and Mr. Chevalier have had t~o
conferences with Mr. Carlson and Mr. Kapp, developers of Breezy
Ridge Estates and as a result thereof, recomEend that the C~ty
pay the additional amount necessa~,y to install a ten inch water
main, over and beyond the cost of a six ~ch main sufficient fon
the Breezy Ridge Estates devel~o~mment.
Councilman Allen made a motion to accept the recommendation
of Mr. Lawson subject to deposit by the developer of his esta-
blished cost of the installation prior to commencement of said
installation. Motion was seconded by Mrs. Woehle and unanimously
carried.
The request of Frank Seely for set-back deviation on ~ot
17, Block 92 was referred to the ~lanning Ooard upon motion of
Councilman ~llen, seconded by Mrs. Woehle and unanimously carried.
The following resolution was then read:

SPECIFICATIONS, AND AN ESTIMATE OF THE CCST
OF GRADING AND SURFACING SW 2ND AVENUE FROM
SW 3RD STREET TO SW 4TH STREET TO i WIDTH OF
T~E~Y-TWO (22) F~ET.
WHEREAS, the City Council of the City of ~elray Beach,
Florida, deems it to be necessary for the safety and conven-
ience of the public to cause t~ grading and surfacing of SW
2nd Avenue from ~W 3rd Street to SW 4th Street to a width of
twenty-two (22) feet, and to aeeess the cost of such improve-
ment against the lands abutting thereon,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of ~elray Beach, Florida, as follows:
SECTION ~: That the City Manager be required to submit
plans, specifications and an estimate of the cost of such
improvement to be made, and that the same shal~ be placed on
file in the office of the City Manager.

Motion was made by Mrs. Woehle, seconded by Councilman
Allen and unanimously carried to adopt the foregoing resolution.
The following resolution was then read:

NPIEREAS, the City Council is oresently composed of men
and women and the term "Councilmen%' is inappropriate in ~e-
ferring to the ladies of the Council, and
WHEREAS, the terminology "Co~m,.issioner"-is often used to
denote the office of Councilman, and
WHEREAS, the terminology "City Council" and "City Commission"
are 'synonymous for all general purposes,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of ~elray Beach, Florida:
1. That the City Council of the City of Delray Beach be
hereafter referred to as the City Commission of the City of
Delray Beach.
2. That City Councilmen of the City of Delray Beach be
hereafter referred to as City Commissioners of the City of
De lray Beach.
3. That nothing herein is to be construed as altering
or in any wa~ changing the powers and duties of the City Council,
now referred to as City Commission, of the City of Delray ~each
as prescribed by law.

Motion was made by Councilman Allen, seconded by Mrs. Woehle
and unanimously carried, that the foregoing resolution be adopted.
The following ordinance was then read:
AN OP~DINANCE OF THE CIT~ COUNCIL OF THE CITY OF
DELRAY BEAC~ AMENDING CHAPTER V OF THE CITY CODE
OF THE CITY OF DELRAY BE~CH BY PPOVIDING ~OR A
~UALIFYING HOUR DEADLINE FOR PRIMARY ELECTIONS.

A motion ~as made by Mrs. Woehle, seconded by Mr. Allen
and unanimously carried, to place the foregoing ordinance on
first reading.
A motion was made by Mrs. Woehle, seconded by Mr. Allen
and unanimously carried, to accept the recommendation of the
Planning Board regarding the request for zoning change by Mr.
R.J. Holland.
The following ordinance was then read:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, PLACING CERTAIN PROPERTY o
LYING WEST OF THE SEABOARD RAILROAD AND SOUTH OF
ATLANTIC AVENUE IN "MANUFACTURING AND INDUSTRIAL
DISTRICT".
Councilman Allen moved the ordinance be placed on its
first reading. Seconded by Mrs. Woehle and unanimously carried.
Concerning the request for front-yard set-back variance
in Blocks l, 2, 3, 4, 5 and 6 of Northridge subdivision, Council-
man Allen moved to again refer this to the Planning Board for
their special attention in view of circumstances and conditions
relative thereto. Seconded by Mra ~oehle the motion carried
unanimous ly.
Councilman Allen moved that bills in the amount of ~35,481.40
be paid, subject to the approval of the Finance Committee. Motion
was seconded by Mrs. Woehle and carried unanimously.
Mr. La~son reported that no bids had been re ceived in re-
sponge to request for bids on roofing the Civic Center and
further stated that he would re-advertise for bids thereon.
Councilman Allen moved that the adjusting entries recom-
mended by the auditors- Himes & Himes -be accepted, subject to
the receipt and filing of a letter of explanation previously
requested. Seconded by Mrs. ~oehle and unanimously carried.
Councilman Allen moved that the front foot Unit value of
I~8.00, which was recommended by the Tax Assessor for assessment
purposes, in the Swinton Heights S/D be approved. Seconded by.
Mrs. Woehle the motion carried unanimously.
The Tax Assessor requested Council's authorization to assess
all lands in the City of Delray Beach on a front foot basis with
the following exceptions:
Unplatted parcels of land containing two & one-half acres
or more per parcel. AI~ all subdivisions that have had or will
make special arrangements with the City of ~elray Beach for a
flat fee on unsold lots for a specified period of time.
Councilman Allen moved that the recommendation be accepted.
Seconded by Mrs. Woehle the motion carried unanimously.
Mr. Lawson read a letter from the Palm Beach County~
Commission relative to ceremonies being held on December 30 at
Juno Beach dedicating the Welcome Statl on. This matter will be
referred to the Chamber of Commerce.
Mayor Strong advised the press, who were absent frcm the
special meet ing held December 23 to approve purchase of a parcel
of land located in Section 29, containing approximately ten acres
to be used for the purpose of relocating the City Dump. This
land is outside the present city limits.

Allen and unanimously carried, that the annual meeting be held
at 8:00 P.M. January 3, 1955.
The meeting then adjourned.
