Riley wanted assurance that the 'Council will accept these deeds when tendered, with t~ orovisions contained there~n, so they will know that, the City will then assume liability. Gillsspie" 27 97H, 953 Upon motion of Councilman Holland, seconded by Councilman Kabler, and unanimously carried, the low bid of James B. Clow & Sons, of Birmingham, Alabama, to furnish pipe as specified, was accepted in the total amount of $ 105,521.20, as recommended. The tabulation showed that the low bid submitted by the Florida Valve & Fitting Co. for Valves and Hydrants provided 4,~' valve openings, which would not meet the specifications of 4~' valve openings, therefore it was recommended that the second low bid, sub- mitted by the M & H Valve Co. of Anniston, Alabama, be accepted, in the total amount of $ 13,617.60. Upon motion of Councilman Holland, seconded by Oouncilman Kabler, and unanimously carried, the bid of the M a H Valve Co. for Valves and Hydrants, in the amount of $ 13,617.60, was accept- ed. Upon motion of 0ouncilman Holland, seconded by *ouncilman Kabler, and unanimously carried, the bid submitted by James B. Clow & Sons, for fittings, etc., in the total amount of $ 6,330.22, was accepted as recommended. The low bid of $ 770.75 submitted by the Florida Valve Co. for Valve Boxes, contained the provision that they would not accept this contract unless given the contract to furnish Valves and Hydrants, therefore it was recommended that the second low bid of the Mueller Co. of Decatur, Illinois, in the amount of $ 882.00 be accepted. If contract is not accepted by the Mueller Co. it was recommended by the Consulting Engineers that the contract be given to the Davis Meter Co. in the amount of $ 889.35. A motion was then made by Councilman Kabler and seconded by Councilman Holland that contract for Valve Boxes be awarded to the Mueller Co. in the amount of $ 882.00, and if not accepted the contract then be given to the ~avis ~eter Co. in the amount of $ 889.35. Upon call of roll the motion carried unanimously. City Manager Lovelace presented a Chamber of Commerce bill for approval, payable to the Geo. Evans Co. in the amount of $ 1,932.68, covering 10,000 three-color brochures. Upon motion of Councilman Holland, seconded by Councilman Kab- let, and unanimously carried, the foregoing bill was approved for payment, to be charged to the Chamber of ~ommerce advertising account. The following Ordinance was then brought up for second and final reading, and same was read in full: ORDINANCE NO. G-159 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, PLACING THE WEST 170 FEET OF THE NORTH ONE-H~LF OF MUCK LOT 16~, EXCEPT THE NORTH 110 FEET THEREOF, CITY OF DELRAY BEACH, FLORIDA IN 'APARTMENT HOUSE DISTRICT.' Gregory Chief Fire Department~ The following Resolution was then presented: RESOLUTION NO. 891 A RESOLUTION DECLARING CERTAIN LANDS IN THE CITY OF DELRAY BEACH, FLORIDA, TO CONSTITUTE A NUISANCE IN VIOLATION OF ORDINANCE NO. G-147. WHEREAS, Ordinance No. G-147 of the City of Delray Beach, Florida, declares all lands in the City not kept free from debris, vegetation (including trees) or other matter, which may become a danger in time of hurricane, and from weeds exceeding a height of 18 inches, and from filth and trash, constitute a nuisance; and WHEREAS, pursuant to said Ordinance, the Chief of the Fire Department of Delray Beach, Florida, has made a survey report, in writing, to the City Manager, describing certain lots or parcels of land in said City wherein conditions such as speci- fied in Sections 1,2 and 3 of said ordinance exist; mud WHEREAS, the City Council of Delray Beach, Florida, after consideration of said survey report, is of the opinion that a prima facie case showing the following lands constitute a n6i- sance within the provisions of Sections 1, 2 and 3 of said Ordi- nance i~o. G-147, has been made: NOW, THEREFORE, BE IT RESOLVED that the existence of a nui- sance be, and the same is hereby declared, upon the following de- scribed lots or parcels of land for violation of the provisions of said Ordinance No. G-147, as specified after each description, and the City Clerk of the City of Delray Beach, Florida, is di- rected to furnish the owners of each parcel of land, as herein- after set forth, a notice in accordance with Section 5 of said Ordinance, and that the City Council will sit on the 24th day of February, at 7:30 P.M., at the City Hall in Delray Beach, ~lorida, FEBRUARY 9TH, 1953 for the purpose of allowing said owners to show cause, if any they can, why said nuisance should not be abated. A plat of atract of land in Section 8, to be known as 'Chevy Chase Subdivision, Walter J. Seymour, Developer, was presented for final approval. City Manager Lovelace explained that .this was a part of a tentative plat previously approved by the Council, and that. no changes had been made. He recommended approval of the Plat. Upon motion of Councilman Holland, seconded by ~Councilmm~ Kabler, and unanimously carried, the Plat of Chevy Ohase Sub- division was flnAly approved as requested. City Manager Lovelace then presented a tentative plat of a Subdivision of a tract of land in Section 20, lying west of So. Swinton Avenue, and south of S.W. 7th Street, R. O. Priest, de- veloper. He advised that the width of the Streets and the size of the lots shown were satisfactory, and recommended tentative approval of the Plat. Councilman Jacobs felt that an alley should be provided between lots facing on two streets, although provision was made for a utility easement. After discussion, a motion was made by Councilman Kabler and seconded by Councilman Holland, that the Plat be tentatively approved as submitted. Upon call of roll the motion carried unanimous ly. Upon motion of Councilman Holland, seconded by Councilman Kabler, and unanimously carried, bills totaling $ 71,010.64 were approved for payment, after approval of the Finau ce Com- mittee.
