A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF DELRAY BEACH, FLORIDA, OPPOSING AN
AMENDMENT TO THE FLORIDA CONSTITUTION THAT
WOULD REQUIRE VOTER APPROVAL PRIOR TO
ADOPTION OF A LOCAL COMPREHENSIVE PLAN OR
COMPREHENSIVE PLAN AMENDMENT(S).
WHEREAS, cities and counties throughout the State of Florida have experienced
tremendous growth over the past several decades; and
WHEREAS, the City of Delray Beach has adopted a Comprehensive Plan as a growth
management tool used to help identify and carry out the City's long-range goals for the community;
and
WHEREAS, the City Commission of the City of Delray Beach recognizes the importance of
public input through public meetings which provide an efficient and economically effective means
for interested and affected citizens to provide input in the comprehensive planning process; and
WHEREAS, the City of Delray Beach has sought and will continue to seek public input
from its citizens during the process of reviewing and adopting its Comprehensive Plan and any
amendments thereto; and
WHEREAS, a proposed amendment to the State of Florida Constitution ("Amendment 4")
will be included on the November 2010 ballot and, if approved, would require voter approval via
referendum for all future proposed City of Delray Beach comprehensive plan or plan amendment
adoptions; and
WHEREAS, this amendment poses a threat to Florida's economy in that it will effectively
halt growth and development within the state by requiring citizens to vote on hundreds of proposed
amendments each year; and
WHEREAS, local governments and their taxpayers will be obligated to fund elections for
thousands of technical planning changes; and
WHEREAS, the City Commission of the City of Delray Beach opposes the proposed
"Amendment 4" which will operate to subvert awell-established, open, and accessible democratic
planning process at a very high cost to local taxpayers.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, DOES HEREBY:
Section 1. Oppose the proposed "Amendment 4" to the Florida Constitution requiring a
referendum for voter approval of adoption of a local comprehensive plan or comprehensive plan
amendment(s).
Section 2. Direct the City Clerk to provide copies of this resolution to the President of the
Florida Senate, the Speaker of the Florida House of Representatives, Florida Governor Charlie Crist,
the Palm Beach County Legislative Delegation, the Palm Beach County League of Cities, and the
Florida League of Cities.

ITEM BEFORE COMMISSION
The item before the Commission is consideration of Resolution 28-10 expressing opposition to
proposed Amendment 4 (Hometown Democracy) to the Florida Constitution.
BACKGROUND
At the April 23 workshop meeting, there was a consensus of the Commission to prepare a resolution
opposing proposed Amendment 4 (Hometown Democracy) to the Florida Constitution. This
amendment will appear on the November 2010 ballot for consideration by voters and would require all
city and county comprehensive plan amendments to be approved by referendum. A resolution
expressing opposition to Amendment 4 is attached for Commission's consideration.
RECOMMENDATION
Staff recommends approval of Resolution No. 28-10.
