The sewer easement was dedicated to the City of Delray Beach in August of 1963 by an Easement Deed recorded in Official Records Book (O.R.B.) 921, Page 421. This action is associated with the development of a proposed 36- hole miniature golf course located on the west side of NE 5th Avenue, between 3rd and 4th Streets (350 and 362 NE 5th Avenue). BACKGROUND The easement proposed for abandonment measures 10' wide by 249.55' long and contains 2,495 square feet (0.06 acres). The easement was dedicated via easement deed (O.R.B. 921, P.G. 421) in 1963, and no sewer facilities were constructed in this area. The correct location for the easement is along the eastern portion of the lots, adjacent NE 5th Avenue. However, as there are no sewer facilities in this location, the abandonment request is supportable. Along with this abandonment, under separate action by the City Commission, is the acceptance of a 4' water main easement to be located immediately adjacent to the NE 5th Avenue right-of--way. The replacement easement will provide additional protection and maintain the customary 6' wide protection on each side of the existing water main which is located approximately 2' east of the property line within the NE 5th Avenue R/W. REVIEW BY OTHERS Pursuant to LDR Section 2.4.6(l~(5), the following finding must be made prior the City Commission granting abandonment: The abandonment will not result in the detriment for the provision of utility services to the adjacent properties or the general area. http://miweb001 /Agendas/Bluesheet.aspx?ItemID=325 7&MeetingID=256 4/21 /2010 Page 2 of 2 The abandonment will not result in the detriment of services because no sewer lines are planned to be located within the existing easement and an easement for the existing water main which services the buildings will be provided. Therefore, the City's Environmental Services Department has no objection to the abandonment. Since the existing easement was dedicated exclusively to the City of Delray Beach as a sewer easement, Florida Power & Light, Comcast Cable, Florida Public Utilities Company and AT&T have no interest in this request and therefore are not required to comment.
