A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA AUTHORIZING THE CITY
MANAGER TO APPLY FOR A FLORIDA BOATING
IMPROVEMENT PROGRAM GRANT.
WHEREAS, the State of Florida has established the Florida Boating Improvement Program
to provide grants to local governments for boating access, and
WHEREAS, the City of Delray Beach is eligible to receive a grant award under this program,
and
WHEREAS, the City of Delray Beach wishes to improve boating access at the Mangrove
Park boat ramps.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA AS FOLLOWS:
Section 1. The City Conirmission of the City of Delray Beach authorizes the City
Manager to apply for a Florida Boating Improvement Program grant in the amount of $102,500 to
be used for improvements to boating access at the Mangrove Park boat ramps.
Section 2. The City Commission of the City of Delray Beach authorizes the
Environmental Services Director to serve as project manager on behalf of the City.

ITEM BEFORE COMMISSION
This item is a request for Commission approval of Resolution No. 38 -10 authorizing the City Manager
to apply to the Florida Fish and Wildlife Conservation Commission (FWC) for a grant of $102,500 for
funding reconstruction of the Mangrove Park Boat Ramp.
Mangrove Park was developed in 2007 by the City with grant funding from Palm Beach County and the
Florida Inland Navigation District (FIND) for the purpose of expanding boating access to the
Intracoastal Waterway (ICWW) in southern Palm Beach County. Upon completion of the park, the City
began receiving complaints from boaters that the ramps were too steep and created challenging and
intimidating conditions for boat launching and retrieving activities. Monitoring of ramp use verified
that, while there were a handful of boaters using the ramps having larger four wheel drive tow
vehicles, very few recreational boaters were using the facility, preferring instead the ramps at Knowles
Park just to the north. A review of the project indicated that the ramp design and construction slightly
exceeded the maximum slope recommended by the U.S. Army Corps of Engineers due to horizontal site
restrictions as well as minimum elevation requirements for the site as established by surface water
management parameters. After presenting this information to Commission along with multiple
proposals for rectifying the problem, staff was directed to pursue grant funding to accomplish the
necessary ramp reconstruction.
Staff has made application to FIND for a grant in the amount of $87,500 toward the construction project
which represented 50% of the estimated construction cost when the application was submitted. The
City's consulting engineers for the project are 60% complete with construction plans and have provided
a cost estimate with low and high ranges of $178,000 and $214,000 respectively depending on bid
values for alternate items such as type of ramp surface. As a conservative measure, staff has increased
it's opinion of cost by $15,000 to $190,000. The attached grant application to the FWC reflects the
increased project cost estimate and requests funding in the amount of $102,500, sufficient to
supplement the FIND grant to provide a total funding level of $190,000.

A required attachment to the FWC grant application is a resolution from the City Commission
authorizing the application for the grant and designating a project manager for the grant. Resolution
#38-10 attached will authorize the City Manager to make application for the FWC grant, and will
designate the Environmental Services Director to act for the City as project manager for the grant.

VVHEREAS. DISTRICT is the owner in fee simple of a parcel of laud in the City of
Delray Beach, Florida, designated as M. SA 650 which may be used by DISTRICT acid the
United States for the improveffiew and,inainteaance of the Intracoastal Water- Ay fr oni,
Jacksonville to Miami, Florida;, and holds title. subject,to an easement by it to the United
States of America for such, use and
WHEREAS, CITY desires to lease fiwn DISTRICT MSA 650, a description of
which is attached hereto as Exhibit A -and inade a part hereof, for recre ation 0
, purp ses.
.subject to said rights of DISTRICT and the rights and easement of the United States of
America and to the tears and conditions of this Lease,. and
WHEREAS, DISTRICT desires to collaborate with. the CITY in -the. proper
development and inanagetnent of DISTRICT's property, and
WHEREAS, DISTRICT is of the opinion that such use by the 'CITY pursuant to
the provisions of this agreement is in the public interest, and
in
WHEREAS, DISTRICT is agreeable that a lease should be executed for a limited
term at a nominal rental subject to the teinisand conditions stated herein,

NOW THEREFORE, in consideration of the promises and mutual covenants and
agreements contained herein, the receipt l and' sufficiency of which. is -hereby
acknowledged, it is agreed by the parties hereto.

2. LEASE. DISTRICT hereby leases to -CITY the property heren"lafter
known as the "Leased Preiuises". as described in paragraph .4 below, subject ;to the terms
and conditions set forfli herein.
3. PROJECT U&N—AGEMBNET. The Project Manager for the DISTRICT
is its Executive Director and all correspondence and communications from the CITY
shall be directed to him/her.. The Project Manager shall be. responsible for overall
coordination and oversight on behalf of DISTRICT related to the perfaimaii,106 of this
lease.
4. DESCRIPTION QF T L E PREMISIE&: The property which is subject; to
this lease) is situated in the City of Delray Beach, State of Florida, as described fin Exhibit
A,.atta6hed hereto and made a part of this agreement.
5. EXISTING-CO
LNDITIONS: The CITY agrees to -accept the Leased
Premises in as is condition subject to any existing or future easements and deed
restrictions that may be. placed on the property by the District or others with District
approval,
5. TE17Iv1; The term of this LEASE shall be for ran initial 3'0 year period with
one (1) option to renew for a twenty-five (25) year extension. Rent shall be one (1)
dollar per year and shall be paid in advance. Prepayment of the rent shall not affect in
any way the DISTRICVs rights under-paragraph 23 below, The initial period shall
commence on the date of- execution, and continue for a period of 30 years. A second
fenn of 25 years shall automatically commence absent written notice of terry iati0ii by

conformance with this LEASE.
9. ASSIGNMENT: This LEASE sliall not be assigned in whole or in part

10. PLANS The following plans will guide the development; use and
management of the Leased Premises. These plans, if not already developed, will be:
developed in accordance with the schedule and .1-fiediod6logy stipulated below,
A. DEVELOPMENT -PLAN: The CITY will develop a public boat -ramp
development* p1mv for the Leased Premises. This plan ,titustbe approved by the CITY and
the DISTRICT prior to the solicitation for contractors for the development, of the CITY
public boatranip,
B. CITY PAIR MANAGEMENT AND OPERATIONAL PLAN: CITY shall
develop ;tnd inip1pnient, subject to approval by the DISTRICT, an, Operational
Managenieriu-Plan (OMP) for the property. The OM*P shall pTqvide general background
data on the _property,, contain information ow the properties resources, set forth, general
and specific management: goals, -objectives and guidelines and outline the specific
procedures, r funding
. requirements; staffing levels an,d management practices necessary for
their. accomplishment. The OMP shall be submitted by--the CITY to the DISTRICT at the
same t e as the - development plan is submitted.

The OMP shall be submitted for approval to the. DISTRICTS Board of
Commissioners. In the event the parties are not to obitib tb,agreement on the OMP
within one hundred eighty (180)- days of submittal, air if the public bosit snip is not
constructed by CITY widiin five (5). years of the date of this LEASE, this shall be
sufficient cause foreither party to terminate the LEASE pursuant pursuant to -paragraph 26. below,...

After the CITY public boat ramp has been constructed, the CITY and the
DISTRICT will ineet at least once annually to review and discuss the. management
activities authorized by this, OMP and to, agree to any changes in the OMP and/or
additional. rules and regulations governing public use of the lands covered by the OMP'
that may be -deemed appropiiate, The CITY shall prcpare, and submit, for discussion at
the annual meeting a yearly summary report loinclude:
1. 'CITY'S management program and activities on die property.
2. Status of -visitor use.
3. RevieW..of special problems roblem,s and concerns encountered over the previous
year.
The approved OMP shall provide the basiciguidatioe fOr all managementAtfivities
and. shall, be reviewed jointly by DISTRICT and CITY during the annual meeting and

11. EASBMENTS,- All easements to be granted by CITY iiicluding,, but not

DISTRICT.. Any easement not approved in writing. by DISTRICT shall be. void and
without legal -effect,.
12. SUBLEASES; This -LEASE is for the purposes speoffled herein; and
subleases of any nature are prohibited without the -prior w, n*qcn approval of DISTRICT.
