A Special Meeting of the City Councilor the City of Delray
Beach was held in the Council Chambers with Mayor J. L. Saunders
in the Chair, City Manager C. M. Black, and the following Council-
men p~esent: John N. Kabler, .~. A. Jacobs, and ~alter A. Hoth,
a quorum being present.
Mr. Rhea ~hitley stated there had been a description correction
in the Totterdale subdivision plat and that it had been. revised to
show a 50 foot right of way on the north and west, dedicated for
public use. Mr. Totterdale is dedicating the streets so that
adjoining property owners could have egress through the property.
City Attorney Moore stated he was the City prosecutor for
a drunken driving case and suggested the City appoint an assistant
attorney to prosecute the case as he was representing the wife in
a divorce action.
Upon motion of Councilman Jacobs, seconded by Councilman Kabler,
appointment of Neil MacMillan was made to serve as prosecutor. The
motion carried unanimously.
The proposed Legislative Bill was discussed, Councilman Kabler
suggesting that terms and procedure for the sale or leasing of
real estate to be set forth in the City Charter.
The City Attorney was instructed to advertise the Bill.
The following letter was then read:

Gentlemen:
The undersigned recommends that the offer of Frederic Dunn-Rankin
& Co., in the amounts of ~1350.00 and $600.00, for annual and
semi-annual audits of the General Fund accounts and Water Syst em
be accepted.
This office is ~600.00 over the amount paid last year for the annual
audit alone. I ~eel that the volume of tramsactions of the City
of Delray Beach justifies the extra audit at the end of the first
six months period of the fiscal year.
As you know from past experience reputable auditing firms will not
enter competition on auditing services. I feel that the past
services of the Frederic Dunn-Rankin & Company Justifies your
acceptance of their offer for the 1950-1951 fiscal year.

The City Manager ~ecommended the policy of the audits be
continued.
Upon motion of Counbilman Jacobs, seconded by Councilman
Roth, the Council accepted the recommendation of the City
Manager for audit reports. The motion carried unanimously.
The following Resolution was read and adopted:
RESOLUTION NO. 793
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, APPROVING T~ WRITTEN
REOOMMENDATIONS OF THE CITY MANAGER TO ACCEPT
PROPOSAL OF FREDERIC DUNN-RANKIN & CO. TO MA~E
SE$I-ANNUAL AUDITS OF THE CITY BOOKS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF,~ D~W. RAY
BEACH, FLORIDA:
That the City of Delray Beach, Florida~ follow the written
recommendations of the City Manager to the City Council of the
City of Delray Beach, Florida, under date of April 26th, 1951,
to employ the firm of Frederic Dunn-Rankin & Co. to make semi-
annual audits of the General Fund accounts and the Water System
account for ~1,350.00 and ~600.00 per year, respectively.
PASSED AND ADOPTED at a Special Meeting of the City CoUncil
held April 26th 1951.

Upon motion of Councilman Roth seconded bY Councilman Kabler
and unanimously carried, the recommendation of the Tennis Committee
was approved. It was a~reed to write Mr. Bissel notifying him of
the decision.
Upon motion of Councilman Kabler, seconded by Councilman Roth,
the Telephone Company would be assessed for personal property and
real estate as returned by them. Unanimously carried.
A motion was made by Councilman Kabler, seconded by Councilman
Roth to incomporate in the Legislative Act the five sections as
read consisting of a Policy Book, a Book listing Public Requests
to the City Council, a Status Board in the Council Chambers, the
City Manager to maintain a press desk in the City Hall, and a L.and
Assessment map under glass.
The motion carried unanimously.
The following Resolution was then read:
RESOLUTION NO. 794
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA
'WHEREAS, on February 27th, 1918, a Plat was filed in Plat Book
7, page 9, of the Public Records of Palm Beach County, Florida,
showing the Subdivision of Dlock "D" and Block "E", Palm Beach Shore
Acres in Sections 9 and 10, Township 46 South, Range 43 East, which
was properly executed by B. ~. Mitchell, and ~hich dedicated to the
perpetual use of the Public, roads shown thereon, and
WHEREAS, on said Plat there was shown a 15 foot "Road Reserve"
located on the northern edge of Lot 1 of Bloc~ "E", and
WHEREAS, on February 27, 1918, the said B. W. Mitchell execut~
~ warranty deed to Frederick Hildebrand, which deed was recorded
March §, 1918, in Deed Book 90, at page 409, of the Public Records
of Palm Beach County, Florida, conveying Lot 1 of Block "E" to Palm
Beach Shore Acres, but reserving therefrom a strip of land 15.7 feet
in width across the north sia~ of said lot, and
'~HEREAS, other deeds conveying Lot 1 of Block "E", Palm Beach
Shore Acres since that date refer to the said north 15.7 feet of
said lot as a private road, and
WHEREAS, Fpntaine Fox, the present owner of ~'ot 1, Block "E",

Palm Beach Shore Acres has requested the City Council of Delray
Beach to abandon and vacate any interest that they may have in
said "Road Reserve" for the purpose of perfecting the title to
said property and
WHEREAS, the City of Delray Beach has never claimed any in-
terest in said "Road Reserve" as a public road op right-of-way
and is willing to abandon and vacate the same.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Delray
Beach, Florida, that the north 15 feet of Lot l, Block "E",
Palm Beach Shore Acres, which is marked as "15 fQot road reserve"
on that certain Plat filed February 27, 1918, in Plat Book 7, Page
9 of the Fublic Records of Palm Beach County, Florida, and which
is also sho~n on the revised plat of Block "D" a~d Clock "E" Palm
Beach Shore Acres, recorded March 14, 1919, in Plat Book 7, at Page
38 of the Public Records of Palm Beach County, Florida, be and the
same is hereby vacated and abandoned.
PASSED in Special Seesion on this the 26th day of April 1951.
