A Special Meeting of the City Council of the City of Delray
Beach was held in the City Manager's office at 11:00 A.M., with
Mayor J. L. Saunders in the Chair, and the following Councilmen pre-
sent: H. j. Holland, W. A. Jacobs, John N. Kabler, and Walter A.
Roth, a quorum being present.
The folio,ring resolution, declaring an emergency affecting the
entire City, with reference to the zoning code and maps, was present-
ed and read as follows:

A RF. SOLUTION OF Ttlb] CITY COUNCIL OF THE
CITY OF DELRAY BEACH, FLORIDA
WHEREAS: In a certain cause in the Circuit Court of the Fif-
teenth Judicial Circuit in and for Palm Beach County, Florida en-
titled the City of Delray Beach vs. Schellenberg, the said Court
in its Final Decree stated that the Zoning Code of the City of Del-
ray Beach, Florida, as applied to the property in question in said
cause, was unenforceable due to a lack of definiteness in setting
out the various use districts, and
WHEREAS: this defect may extend to the entire Zoning Code,
rendering it unenforceable,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ~tiE CITY
OF I)ELPolY BEACH, FLORIDA, as follows: That an emergency affecting
the entire City is decl~.red to exist, and that the City Council of
the City of Delray Beach, Florida, take all steps necessary to ren-
der the Zoning Code of the City of Delray Beach, Florida, valid ard
enfo rc eable.
PASSED AND ADOPTED by unanimous vote of the City Council of the
City of Delray Beach, Florida, at a special meeting this grid day of
June, A.D. 1951.

Upon motion of Councilman Kabler, seconded by Councilman Holland,
and unanimously carried, the foregoing Resolution No. 799 was passed
and adopted as read.
A motion was then made by Councilman Roth to instruct the City
Attorney to prepare a Zoning Ordinance setting out clearly and defi-
nitely the boundaries of the various "Use Districts" of the Zoning
Ordinance, and a map corresoonding thereto, and to take all legal
steps required by the City Charter and by law. The motion was seconded

The meeting then adjourned.
