13 '7 JULY 13TH, 1951. A Special ~ieeting of the City Council of the City of Delray Beach was held in the City Manager's office at 7:30 P.}i., with i~iayor Roth in the Chair, and City Attorney John 5Ioore, City ~lanager Robert Lovelace, and the following Councilmen present: R. J. Hol- land, and W. A. Jacobs, a quorum being present. Mayor Rot~ announced that ~Ir. W. C. }Iusgrave had been selected to serve a~ Councilman for the unexpired term of ~ir. J. L. Saunders, who resigned on July 9th, to enter the ~iinistry, and that }ir. Sius- grave's appointment would be confirmed at the next regular meet~g of the Council. The City ~lanager's estimate of cost of the installation of storm sewer drains on Sea Spray Avenue, from Ocean Boulevard to the Inland Waterway, having been filed in the amount of ~3,096.25, the following Resolution declaring the intention of the Council to make this improvement, was presented, and same was read in full: RESOLUTION NO. 806 A ~ES~LUTION OF THF~ CITY COUNCIL OF THE CItY OF DELRAY BEACH, FLOP~IDA, 0RD}~HING THE CON- STRUCTION OF STOI'~! WHERF~AS, the City Council of the City of Delray Beach, Florida, did on the 9th day of July, 1951, adopt a Resolution ordering the City Manager to prepare plans and specifications for certain storm drains, and an estimate of the cost, and requiring said plans, specifications and estimate of cost of such improvement to be placed on file in the office of the City ~anager, NOW, THEP~.FORE, BE IT RSSOLVED by the City Council of the City of Delray Beach, Florida, that it is determined to make the follow- ing described improvement, to-wit: Construction of storm se~er drains on Sea Spray Avenue, from North Ocean Boulevard ~est to the Intracoastal Water~ay, and the installation of seven necessary catch basins in con~unction ~ith such storm drains, the total estimated cost of which improvement is ~ 3,096.25. BE IT FURRIER R~S~}LV~D that the entire cost of such improvement shall be assessed against the following described properties in Delray Beach, Palm Beach County, Florida: Lots 1 to 28, inclusive, Sea Spray Estates, which property comprises the boundaries of the property so especially benefitted, said benefits to be determined and nrc-rated according to the spec- ial benefit derived from said improvement. AND BEIT FUI~[1]R I{ES()LVED that said special assessments against all of the lots and lands as set forth above, w~ich are specially benefited, shall be and remain liens superior in dignity to all other liens, except liens for taxes, until paid, from the date of the assessment upon the respective lots and .narcels of land ass- essed, and which may be paid in ten equal yearly installments with accrued interest on all deferred nayments. Payment shall be made at the same place that taxes payable to the City of Delray Beach are paid, namely, at the office of the City Tax Collector, and upon failure of any property owner to pay any annual installment due, or any part thereof, or any annua& interest upon deferred payments, the City of Delray Beach may bring necessary legal pro- ceedings by a Bill in ~hancery to enforce payment thereof with all accrued interest, together with all legal costs incurred, including a reasonable Attorney's fee. The total amount of any lien may be paid in full at any time, with interest from the date of assessment. IT IS ORDi.~]RED that the City Council shall sit at the City Hall in the City of Delray Beach, Florida, at 7:30 P.~I. on august 13th, 1951, for the purpose of hearing objections, i~ any, on said pro- posed improvement, as set forth above. G-121, PERTAINING TO CIVIL DEFilNSE IN SAID CITY. A motion was made by Councilman Holland, seconded by Councilp man Jacobs, that the foregoing Ordinance be placed on first readi~g, and. upon call of roll carried unanimously. As Col. E. F. Altman, County Director of Civil Defense, had urged the passage of a Resolution to effect this change in our Civil Defense organization, it was suggested by the City Attorney that a Resolution also be passed at %bis meeting to comply with his request, and that this Ordinance be allowed to pass in the normal way. 7/ 3/ 1 133 Upon motion of Councilman Jacobs, seconded by Councilman Holland and unanimously carried, that a Resolution be adopted covering the material in this-Ordinance, the following Resolution was introduced: RESOLUTION NO. 809 A RESOLUTION OF T}t~ CITY COUNCIL OF TH~ CITY OF 1);~L1LaY BEACH~ FLO~,IDA, Pi~RTAINING TO CIVIL DI~F~,TS~ IN SAID CITY. City Manager Lovelace then advised the Council that his esti- mate of the cost of his trip to ~-'oland Spri~gs~ Maine~ ~ attend the International City Manager's Conference to be held September 9 - 13, 1951~ would be about $225.00~ but that he would C~nish an itemized list of his expenses upon his ret~n. A motion was then made by Co~cilman Holland that the City Manager be instructed to attend this ~nference~ as he had outlined. ~e motion was seconded by Co~cilman Jacobs~ a~ upon call of roll carried ~animously. The Council was advised by &'tr. Lovelace ~at the City had funds in the local bank at certain times which could be invested in short term Treasury notes, which would earn 1~ interest. These notes could be sold i~ediately if the f~ds were needed, lie stated that northern banks would h~dle such accounts For a fee of about 1/64 of 1~, where the local bank might ~arge 1/2 of 1~. As the Co~cil felt this money should be h~dled locally, rather than through northern banks~ a motion was made by Councilm~ tlollmad~ seconded by Councilman Jacobs~ and unanimously c arried~ to instruct the City M~ager to contact the First National B~k of t~s City with reference to investing City Funds either in short te~ Treasury Notes or in a Savings Account. City Manager Lovelace informed the Co~cil ~at by ~lling in Muck Lots on the north side of Atlantic Avenue~ water previously absorbed by these lots now flooded Seabreeze Avenue~ creating ~e necessity Cop draining this Street. tlc reco~ended the installation of a storm sewer dr~inage line, to be assessed aga~st the property benefitted.
