A joint meeting of the City Council and the Delray Beach Zon-
ing and Planning Board was held in the City Manager's office at 7:30
P.M., with Mayor Walter ~. Roth, ~ity Manager Robert Lovelace, and
the following Councilmen present: a. J. Holland, W. A. Jacobs,
John N. K~bler, and W. C. Musgrave; and King S. Cone, Oorothy Galvin,
and Garland P. Thayer, members of the Zoning and Planning Board pre-
sent.
The purpose of the meeting was to clarify any questionable
points in the Zoning Ordinance prepared by Mr. P. W. Chambers, based
on the present Zoning Map and Ordinances, before a public hearing
is called and the Ordinance is finally adopted.
In accordance with a request from Mr. John B. Heid, the business
zone in Block K, The Village, was reduced from Lots 1 - 6, inclu-
sive, %o Lots 1 and 2 only; all other zoning in The Village to re-
main as zoned.
An apparent error in coloring the present zoning map, with re-
ference %o Lots 3 and 18, Williamson - Deibel Subdivision, was point-
ed out by Councilman Kabler, who explained that %he map shows Lots
1 and 2 and the E. 18' of Lots 3 and 18 to be zoned as a Special
Hotel and Apartment zone. According to Zoning Ordinance No. G-16,
only Lots 1 and 2, which front on Ocean Boulevard, are in a Special
Hotel and Apmrtment zone, although deed restrictions covering all
lots in this Subdivision state that Lots 1, 2, 3 and 18 may be used
for hotel or apartment house cons%ruction.
After consideration of the conflict in the in%eh% of zoning,
the following motion was made by Councilman Kabler:
"Because of the scale of abservation of the supposedly offi-
cial zoning map of Delray Beach shows the zoning of Lots 1 and 2
of Williamson - Deibel Subdivision to be a Special Hotel and Apart-
ment House zone, and it also shows the E. 18' of Lots 3 and 18 to be
a Special Hotel and Apartment zone; therefore Lots ~ and 18 are
divided zoning. Further because of the fact that all of Lots 1 - 18
includive, of Williamson - Deibel Subdivision carry deed restrictions,
wherein it is clearly shown to all purchasers of said property that
Lots 1, 2, 3 and 18 can and may be used for apartment house purposes,
now, therefore, it is the intent of the Council, in order to clarify
middle of the lo% zoning, to set up in its new comprehensive zon-
ing map as a Special Hotel and Apartment zone, Lots 1, 2, 3 and 18
of Williamson - Deibel Subdivision.
The motion was seconded by Councilman Holland, and upon call
of roll carried unanimously.
Mr. Chambers advised that the tract of land, of approximately
ten acres, lying north of West Atlantic Avenue, which was recent-
ly annexed to the City, has not been zoned, and also a part of Home-
wood Subdivision, south of Atlantic Ave., lying west of the Golf
Cours e.
After discussion by the Council and the Zoning Board, a motion
was made by Councilman Kabler, as follows: "All property in ten
acre tract of land annexed to the City November 14th, 1950, in-
cluding Breezy ~idge Estates, which is a part of this tract; and
all land in Homewood mubdivision shown on Sheet 7-C of the official
Zoning Map of Delray Beach; and all property east of the Drainage
Canal marked "MacArthur Farms, Inc." shall be zoned as Residence
"A". Small tract of land lying south of State Road ~806, marked

"C. ~. Townes"; the west 1/2 of ten acre tract marked "Robert A. ~ .....
Johnson"; the five acre tract south thereof owned by the City
of Delray Beach; and the west 1/2 of ten acre tract owned by the
City of Delray Beach, all to be zoned Residence "B".
Section 19, as shown on Sheet 8-C (NE~ Section) of the pro-
posed official zoning map, the west 1/2 of Lots 2, .3, 6 and 7 to
be zoned as Residence "B"; Tract marked "MacAr%hur Farms, Inc"
and "City of Delray Beach", to be zoned Residence "A"; and all
property west of E-4 Canal to the City limits· to be zoned as
Residence "A".
The motion was seconded by Councilman Musgrave, and upon call
of roll carried unanimously.
The meeting then adjourned.
