01-02-50OrgMtg JANUARY 2~3, 1950. The organization meeting of the newly elected Council of the City of Delray Beach was held in the Council Chambers at ,~ p. m. with Councilmen R. J. Holland, W. A. Jacobs, John N. Kabler, Walter A. Roth, and J. L. Saunders present. The oath of office as City Councilmen was administered to the new members of the ,Council by the City Clerk. A motion was then made by Councilman Jacobs nominating Council- man Kabler as Mayor for the year 1950, which was seconded by Council- man Holland. Councilman Jacobs then moved that nominations be closed, and that Mr. Kabler be unanimously elected~ayor. The motion was seconded by Councilman Holland, and upon call of roll carried, Counoilmen Holland, Jacobs, Roth and Saunders votifig in favor of the motion, and Councilman Kabler not voting. Er. Kabler assumed the Mayor's chair, and thanked the Council for the confidence they hsd placed in him, stating he felt it was a great honor to be Mayor of the City of Delray Beach, and realized the obligation it imposed upon him to do his best for the City as a whole. He also congratulated retiring Mayor Saunders on his accomplishments during the past year, and hoped to be able to do as well. A motion was made by Councilman Saunders, that Er. Jacobs be named Vice-~ayor, and that nominations be closed and he be declared unanimously elected. The motion was seconded by Councilman Roth, and upon call of roll carried, ~ouncilmen Holland, Kabler, Roth and Saunders voting in favor of the motign, and Councilman Jacobs passing. Upon motion of Councilman Roth, seconded by Councilman Saunders, and unanimously carried upon call of roll, Mr. Charles E. Black was reappointed as City Manager for a term of one year. Upon motion of Councilman Holland, seconded by Councilman Jacobs, unanimously carried, Attorney John ~oore was reappointed City Attorney for the ensuing year. Two applications for the position of City Judge having been received, same were read as follows: "To: Honorable Council - Delray Beach, Florida From: W.E. Wilcox I hereby make my application for reappointment for Nunicipal Judge, City of Delray Beach, Florida. Sincerely, (Signed) W. E. Wilcox" "January 2, 19~0. City Council City of Delray Beach Delray Beach, Florida Gentlemen: I herewith make application for the position of ~unicipal Judge of the City of Delray Beach, Florida, for the two year te~m begi~n~Ing January 2, 19~0. In accordance with the City Charter I am an Attorney duly licensed to practice in the Courts of the State of Florida. I am a resident, home owner, and qualified voter of the City of Delray Beach, Florida. Respectfully yours, (Signed) ?aul E. Gringle" City Attorney ~oore referred to a portion of Section 47, Article VII of the City Charter, relating to the qualifications for ~unicipal Judge, as follows: "Such person shall be an Attorney qualified to practice in the Courts of the State of Florida, and residing in the City of Delray Beach, Florida. If no person with such legal qualifications is available for the position of Nunicipal Judge, then the City Council may appoint es ~unicipal Judge some other person. ~In view of this provisi~on, City Attorney Noore stated that he considered it mandatory upon the Council to follow the Charter, and appoint the applicant 'qualified for the position. A motion was then made by Councilman Saunders, that A~ttorney Paul E. Gringle be appointed for a period of two .years to serve as ~unlctpal Judge. The motion was seconded by Councilman J~cobs, and upon call of roll carried unanimously. The following Resolution was presented by the City Attorney, and same was read in full: RESOLUTION NO. ?43 A RESOLUTION OF THE CITY C0UI'ICIL OF THE CITY OF DELRAY BEACH, FLORIDA, PROVIDING THAT ALL SALARIES AND ?;AGES PAID TO ALL F2~PLOYEES, EXCEPT COUNCILMEN, 0F THE CI~ 0F DELRAY BEACH, AT THE PRESE~ TIR~E, REM~ N UN'CHANGe. BE IT ~SOLVED BY THE CITY COUNCIL OF THE CITY 0F DELRAY BEACH, ~0RIDA, as follows: SECTION 1. That all salaries and wages paid to all employees, except Councilmen, of the City of Delray Beach, at the present time, be and the same are hereby unchanged, until future order of the Council. Smith City Cle'~k ( SEAL ) The fact that salaries for Councilmen, as provided in the new Charter, at $ ~.00 per meeting, for not over four meeti~s per month, had not been included fn the c~rent budget, the adv!sibtllty of the Council waiving these salaries until the end of this fiscal year was =~!scussed. Councilman Holland contended that the Charter provisions should be followed in every respect, and upon motion of Councilman Roth, seconded by Councilman Jacobs, and unanimously carried, the foregoing Resolution No. 7~3 was passed and adopted as read. Upon motion of Councilman Jacobs, seconded by Councilman Sanders, and unanimously carried, the time for holdl~ regular meetings of the Council was set for the 2nd and ~th Tuesdays of each month, at 7:30 p. m.
