02-02-50SpMtg FEBRUARY 2ND, 1950. A Special Meeting of the City Council of the City of Delray Beach was held in the Council Chambers at 7:30 p. m. with Mayor John N. Kabler in the Chair, and City Attorney Moore, City Manager Chas. E. Black, and the following Councilmen present: R. J. Holland, W. A. Jacobs, Walter A. Both, and J. L. Saunders, a quorum being present. The Council considered a request for permission to erect a tent on vacant property in Block 78, on East Atlantic Avenue, for the purpose of holding Seventh Day Advent Evangelistic meetings, starting March 19th, for ~pproximately ten weeks. City Manager Black explained that the tent would be a fire- proof substantial structure, and meetings would not be held after 9p.m. After consideration, a motion was made by Councilman Both, seconded by Councilman Saunders, that permit be granted as requested, and upon call of roll the motion carried unanimously. Proof of publication of notice calling for bids on furnishing Fire Hose, was presented and spread upon ~he minutes as follows: INVITATION TO BID The City of Delray Beach will receive sealed bids until 4:30 p. m., E. S. T., Tuesday, January 24, 1950, on ten (10) each 5o foot lengths of 2~" double Jacket fi~e hose equal to or better than Bilateral Fire Hose Company's easy fold "Bi-lat-lite Durobelt". Each section to be coupled male and female forged rocker lug coupling National Standard 7~ threads per inch. Delray Beach 1.50 Jupiter 2% 1.45 City Manager Black stated that after considering the service of hose used in the past with Fire Chief Gregory, they recommended that the bid of the B. F. Goodrich Co. to furnish Jupiter DJ Brand hose at $ 1~5 per foot with couplings, through the Butler Mercan- tile Co., be accepted, and upon motion of Councilman Roth, seconded by Councilman Saunders, unanimously carried, this recommendation was approved. No action was taken with reference to the establishment of a new east boundary line on the Seacrest Hotel property, at East Atlantic Ave. and N. Ocean Boulevard, pending receipt from Mr. Scott of a survey showing the differences between the existing structures and the Brockway line. Mr. R. W. Hertwig, representing the Town of Highland Beach, appeared before the 'Council with reference to obtaining water from the City of Delray Beach for approximately three months, before their water plant, now being constructed, is ready for use. He advised the Council that Mr. D. E. Ptckens, the last property owner on South Ocean Boulevard receiving City water at the present t~me, had given them permission to connect their pipe lines with his line, which they had done, and they were ready to install indifidual water meters immediately. He also~ guaranteed the payment of individual water bills by the Town of Highland Beach. City Manager Black explained that the water pipe lines, through Seagate and Byrd Beach were privately owned and maintained by residents of those sections, and that two property owners had compl~ ned of the possibility of a reduction in their pressure by the extension of the line farther south. Mr. Black believed that negotiations could be made with the owners of the pipe llne for the City to take it over and maintain it in the future. This would enable the City to extend the line where necessary, and provide new customers at "Outside the ~ity" rates. He felt that the mains were large enough to insure adequate water pressure to Highland Beach, as well as Seagate and Byrd Beach. After further consideration by the Council, a motion was made by Councilman Both, seconded by Councilman Holland, authorizing the City Manager to negotiate'with the owners of the water pipe lines in Sea- gate and~in Byrd Beach, to acquire these lines. Upon call of roll the motten carried unanimously. Upon motion of Councilman Saunders, seconded by Councilman Holland, and unanimously carried, the City Attorney was instructed to prepare a contract to furnish water to Highland Beach for a period of ninety days, subject to the City's ability to furnish water, and subject to the lines being kept open by other parties, giving High- land Beach the privilege of extending the time-if necessar,y, and authorizing the Mayor and City Clerk to execute said contract. With reference to the clearing of a vacant lot in the south- west corner of Muck Lot 164, on East Atlantic Avenue, between Sea- breeze and Andrews Avenues, City Manager Black explained that this lot was a breeding place for mosquitoes and rodents, and surrounding property owners had complained of this condition. He had obtained an estimate for removing the debris, fallen trees, etc., and cleauing the lot, from Mike Blank Nurseries, of $ 300.00, and had so informed the owner, Mr. John M. Bransfield of Evanston, Ill. at three different times, but had received no reply to his letters. Upon motion of Councilman Both, seconded by Councilman Saunders, and unanimously carried, the Gity Attorney was instructed to write a letter to Mr. B~ansfield, advising him that if he did not have the lot cleaned the City would proceed to do the work, and the cost would be assessed against the property; the ~e~ter to be sent by registered mail, and return receipt requested. Councilman Holland advised the Council of the operation of a wood-working business being conducted by Roy B, Evans at 312 S. E. 5th Ave. He stated that residents in that neighborhood had com- plained to him of the noise of electric machinery being operated during the day and often late at night. It was explained that Mr. Evans had been previously asked to move his business from this location, which is a Residential District, but he had not complied with the request. A motion was then made by Councilman Holland that Mr. Evans be advised by the City Attorney that the Council had instructed that this nuisance be abated immediately, and that he would be given sixty days to comply with the Zoning Ordinance and move his business to a commercial zone; also that the Ordinance would be enforced through the Police Department if it becomes necessary. The motion was seconded by Councilman Saunders, and upon call of roll carried unanimous ly. Ma~or Kabler complained of the traffic problem at the Post Office, stating that in his opinion the condition was worse since the reversing of one-way traffic on S. E. 1st Avenue in front of the Post Office building. As the new Post Office will be completed soon, it seemed in- advisable to make any changes at this time, although on recommenda- tion of City Manager Black, a motion was made by Councilman Saunders, that two-way traffic be allowed on the alley south of the Bon Air Hotel, between S. E. 1st and 2nd Avenues, to relieve congestion at the corner by the Post Office. The motion was seconded by Council- man Jacobs, and carried unanimously. The Council again discussed the height of a wall on the property of Philip Stevenson, located on Lot 10, Nassau Park, on the north- east corner of Nassau and Gleason Streets, which is a hazard to traffic on that corner. It was explained by the City Attorney that the wall complied with the Ordinance existing when it was built, but does not comply with the present Ordinance governing the height of hedges and walls on corners. He stated that the wall at the corner was about 3'4", running back about 15 feet, and that by running .back 15' further, and measurtng~ from the crown of the road, it would comply with the present Ordinance. He felt that if Yin. Stevenson were given assur- ance that he would not be asked to lower the wall further, or for a gte ater distance back, he would be willing to do this. 12pon 'thee' recommendation or-Mayor Kabler, a motion was made by Councilman Holland, that Mr. Stevenson, and also Mr. Jacoby, owner of Lot 12, Wheatley Subdivision, located on the southwest corner of Gleason and Nassau Streets, be contacted with reference to putting Stop signs on their property on these corners, before asking Mr. Stevenson to lower the wall on his property.
