A special meeting of the City Council of Delray
Beaoh was held in the Council Chambers at V:30 P. M.
with Mayor John N. Kabler in the chair, and City Attorney John Moore
City Manager Chas. E. Black, and the following Councilmen
present: W. A. Jacobs, Walter A. Roth and J. L. Saunders
a quorum being pres ent.
The following letter from the Delray Beach Zoning Board
was read:

Members of the City Council
Delray Beach, Florida.
Gentlemen:
Your zoning board met at ll:O0 a. m.
in the City Manager's.~0ffice with the follow-
ing members present: Chairman Kenneth Jacobson,
Garland Thayer, King S. Cone and R. Bruce Puckett.
The first matter considered was the request
of Mr. W. C, Burton to deviate from the required
10' rear set-back and allow the construction of a
building with a $' rear set-back on his property at
the S. E. Corner of East Atlantic Avenue and Bronson
Street.
We do not feel that the adherance to the re-
quired minimum set-back regulations will work a
hardship on the property owner. Due to the fact that the
adjoining property at the rear has not been ded-
icated as an alley or easement, in order to main-
tain uniformity in minimum rear set-backs, and pro-
vide adequate access to business buildings. We recommend
the adherance to present regulations.

Upon motion of Councilman Roth, seconded by Councilman
Saunders, and unanimously carried upon call of roll, the
reco~endation of the Zoning Board was accepted.
Application of W.Hunter A~ha for building permit to
construct eight stores on Lots 3, 4, 5 and part of Lot 6,
Block lO1, on East Atlantic Ave., was approved , upon
advice of the building Inspector that the plans showed that all the
specifications and zoning restrictions would be complied
with, upon motion of Councilman Saunders, seconded
by Councilman Roth and unanimously carried.
On motion of Councilman Saunders, seconded b~
Councilman Roth, and unanimously carried, application for
building permit filed by W. C. Musgrave for the construc-
tion of a store building with an apartment above on the
east ~3.16 ' of Lot 16, Block V6, was approved, subject to
compliance with all requirements, and the approval of the Build-
ing Inspector.
Councilman Jacobs brought up the question of some
protection at the N. E. 1st Street railroad crosming. He
p~tnted out that this corner was a "Death Trap" caused by
buildings so close to the tracks that trains can not be seen
or heard approaching this corner. He also felt that inasmuch
as the City had paid for the opening of the crossing,over the
protests of the railroad, the responsibility for anacci-
dent would be upon the City. With the new Post Office located
on N. E. 1st Street, traffic had increased, making this crossing
even more hazardous, Mr. Jacobs suggested putting up "STOP"
signs immediately, and strictly ez~orcin~ the law regardin~
sam~.
Signs would have to be on Railroad property to be
effective, City Manager Black stated, but he felt the Railroad Com-
pany would not object.
After further discussion, a motion was made by Councilman
Jacobs, that "STOP" signs be placed at the East and West entrance
to the N. E. 1st Street railroad crossing, and that the traffic
laws pertaining to stopping at this crossing be strictly
enforced., and that a letter be written to the Florida East
Coast Railroad Co., asking permission to place these signs on
railroad property, at the same time advising them O2~the
new location of the post office on N. E. 1st Street, which
increases traffic considerably over this crossing, and re-
questing them to install traffts lights as a safety measure.
The motion was seconded by Councilman Saunders, and upon call
of roll carried unanimously.
The meeting then adjourned.
