07-11-50 JULY llth, 1950 Regular meetin of the City Council of the City of Delray Beach was held in the Council Chambers at 7:30 p. m. with Mayor John N. Kabler in the Chairn and City Attorney John Moore, City Manager Chas. E. Black, and the following Council- men present: Walter A. Hoth, and J. L. Saunders, a quorum being present. The minutes of the meeting held June 27th were approved as written. A report from the Beach Committee (Improvement) of the Chamber of Commerce, dated June 27th, and also a revised report, were filed. The revised report was read as follows, and explined by Mr. Fred S. Beever, Chairman of this Committee. June 27th, 1950 The following is a report submitted by the Delray Chamber of Commerce Board of Directors at their regular meeting Thursday, June 22nd, 1950, by Mr. Fred Beever, Chairman of the Chamber's Beach Improvement Committee. 0. C. Plaxice and Sam0gren helped Mr. Beever gather this data: The County Crane has been working on the beach but the shoulders have to be seeded and planted with Bermuda grass, approximately 1,000 feet of l~ water mains and 5 more showers are needed. Truck and labor costs $ 400.00 ( for entire 20' of shoulder, i mile long for 2" of top soil) Bermuda Grass & Fertilizer .......... 180.00 Additional 1000 feet of 2" water mains 1.ti00.00 (Includes labor & material & 8 Showers ) 1,650.00 Some discussion was given to sprinklers but the Com- mittee decided the cost was prohibitive and it was agreed to wait until more money was available, however every 100.!~ a plug tee will be installed for the 2uture sprinkler system. ~ive steps are to be replaced and some to be repaired plus walks and platforms to be put in. 5 new steps at $ 20 each- $ 100.00 15 new walks at $ 12. each. 180.00 15 new Platforms at $3. each 45.00 Re-setting steps, walks Etc 25.00 30 more trees needed at $11. each--- 330.00 Maintanance, cleaning year-round ~ The city will be able to use city prisoners, work crew and eq uiPmemt whenever possible to put down soil, plant grass trees etc. All the above figures are estimated. Plaxico Sam 0gren .Revised Repor,t The County crane has been working on the beach filling in for a 20' shoulder and should be completed this next week. It is possible no charg~ will be made by the County for this service. There is additional work to be done on the shoulders, such as, seeding, planting salt water bermuda grass and haul- ing in 2" of top soil. This salt water grass has been donated by Mr. George White who is a representative of the "John B. Reid Village". There?is sufficient grass in the Village to complete the Job on the shoulders. Approximately 1000 ft. of l~ and 2" water main is yet to be installed and four additional showers,~ are needed. Some discussion was given to a sprin~ler sys- tem, but the Committee decided the cost was prohibitive and it was agreed to wait until more money was avail- able, every 100 ft. a plugged tee will be left for future sprinkler connection. New steps, walks and shower platforms are needed in~,additio~i to repairing the ones that are now in use. One Life Guard during the summer months, and two during the winter m~nths, would be an additional expense of $ 1,200.00, and twenty new benches of a durable type would ~ost about $ 400.00. The Council was in favor of keeping a Life Guard on the Beach at all times, but did not feel the expense of cleaning the entire Beachthe year-round would be Justified. Mr. Chas. Senior, President of the Chamber of Commerce, addressed the Council, ststing that they felt that maintaining the Beach was the most important community project. He asked the Council to consider their proposals in its budget for the coming year. Mr. Senior also iuvited the members of the Council to attend their next Board meeting, which will be held at 8 o?clock on June 2Oth, at which time their plans for operation for the coming year will be discussed. A letter form King S. Cone, on behalf of the American Legion, requesting permission to erect a monument in memory of deceased Veterans, in the local Cemetery, preferably in the Circle, was referred to the City Manager. Mrs. Alice Mayer, owner of several properties in Block 125, again appeared before the Council with reference to the increase in taxes on her properties during the last three years, and the reduction in taxes on other properties in the same block. The City Manager was instructed to check the cubic footage of these buildings, to verify the correctness of ass- essments, and report at the next meeting. Nowlin, representing Niss Ella Harding, owner of Lots ll and 12, Block ll4, protested the opening of the alley through this block, stating that Niss Harding had built one building on the rearof her lots and planned to build a larger building on the fron~tof the property. By opening the alley as a public thoroughfare, she felt it would be detr ~mental to her property and she would not care to erect another building. Nr. Nowlin also stated that it had been the policy of the City in the past not to pave streets or alleys unless 81% of the property owners affected requested it, and he asked the Council to continue this policy, and not open this alley on the request of bnly one person. City;~Nanager Black explained that the alley was now rocked a short distance from each end, which left only about 200' in the center unpaved, and it seemed practical to pave the remaining portion, as it would enable the City garbageand trash trucks to make their collections through the alley, and it would be possible to keep the alley e~ear and clean. Letters of protest were also filed from Cecil S. Farrar, and Arthur V. Williams, owners of property in Block ll4, requesting that this improvement not be made. Upon motion of Councilman Saunders, seconded by Councilman Roth, and unanimously carried, the proposed paving of the alley through this Block was abandoned. Objections were then asked for pertaining to the rocking of the alley through Block lO1, and as none were received , the following Resolution was introduced: Rw~0LUTION NO. 761 A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AUTHORIZING THE CITY ENGINEER TO PROCEED WITH THE GRADING AND ROCKING OF TEE ALLEY RUNNING NORTH AND SOUTH THROUGH BLOCK lO1 , WHERE NOT ALREADY ROCKED. WHEREAS, the City Council of the City o£ Delray Beach, Florida, did on the l~th day of J~me, 1980 determine to proceed with the grading and r~cking of the alley running north and south through Block lO1, where not already rocked, and WHEREAS, the Resolution providing thereforehas been duly published as required by the City Charter, together with a notice ~hat objections to said improvement would be heard on this date, and WHEREAS, no objections have been made to such improve- ment, NOW, THEREFORe, BE IT RESOLVED by the City Council of the City of Delray Beach, Florida, that the City Engineer be, and is hereby instructed to proceed with the grading and rocking of the alley running north and south through Block 101, where not already rocked, according to .the plans and specifications heretofore filed with the City Clerk, and a copy thereof filed in the office of the City Engineer, and kept open for the inspection of the public. E. 6TH STREET FROM N. E. 8TH AVE TO PALM TRAIL, AND N. E. 8TH AVENUE FROM N. E. 5TH STREET TO N. E. 8TH STREET. WHEREAS, the 'City Engineer of the City of Delray Beach, Florida, has, in pursuance to the Charter of said City, sub- mitted to the City Council for approval, a report of the cost and assessment Roll for the Grading, construction, and paving of N. Upon call of roll, the motion carried unanimous ly. Mayor Kabler advised the Council that recommended changes in the Occupational License Ordinance were being prepared by the City Attorney, and copies would be mailed to each Councilman for study before the next meeting. An Ordinance pertaining to side street set-back requirements in certain designated areas, was then brought up for second and final ~ reading. Mayor Eabler explained that the Planning Board had suggested that Section I be amended to read as follows:, to clarify the exact intended meaning of that Section. This was mpproved by the Council, "Section 1. That this Ordinance shall apply only to property which is now and hereafter in any business zone in this City, which property is located on a Street or Avenue running North and/or South of Atlantic Avenue; that this Ordinance shall not apply to property located further from Atlantic Avenue than the first alley~way in the Block, or where no alley exists, a distance of one one hundred seventy three feet (173') from the center line of Atlantic Avenue." The Ordinance was then read im full as amended: ORDINANCE NO. BE IT ORDAINED by the City Council of the City of Delray Beach, Florida, as follows: SECTION l: That bhis Ordinance shall apply only to property which is now or hereafter ink, any business zone in this City, which p~roperty is located on a Street or Avenue running North and/or South of Atlantic Avenue; that this Ordinance shall not apply to pr~operty located further from Atlantic Avenue that the first alley-way in the block, or where no alley exists a distance of one hundred and seventy three feet (l~73'I from the center line of Atlantic Avenue. SECTION 2: That this Ordinance shall apply to side street set-backs only. SECTION3: That, if any building is erected and constructed within the designated area, and in said area, there are no existing structures, and the Street or Avenue has a right-oE-way forty feet (40') or more, then such building being erected and constructed shall set back ten feet (10') from the property line. SECTION 4 : That, if any new building is erected and con- structed within the above designated area, and in such area there is an existing structure or structures, such structure or structuresnot having been erected pursuant to a temporary building permit, and the Street or Avenue has a right-of-way forty feet (40)' or more, then such building being erected and constructed, shall set back as far as the existing building having the furthest set-back: provided, how~ever, that the new building shall not be required to set back/than ten feet (10') from the property line. farther SECTION 5: That, if any new building is erected and con- structed within the above designated area, and the Street or Avenue has a right-of-waY less than forty feet (40') then,t~nd in that event, such ~a~tA~agnew building shall set back a minimum of ten feet (10') from the property line. City Manager Black estimated the cost of grading and paving N. W. 1st Street, from N. W. 5th Avenue to 8th Ave., the first .prOject on the list, would be approximately $ 4,000.00 and stated that sufficient funds are available in the Revolving Improvement Fund to complete this improvement. City Attorney John Moore reported that title to the pr~operty inSection 18 which is leased to the PoliCe Ben- evolent Association, is i$ the name of W. S. Carper; that portion of ~-~ the property lying east of the La~e Worth Drainage District. Mr. Moore was instructed to request Mr. Carper to have his property surveyed to designate its exact location. City Manager Black reminded the Council that, in view of the National situation, it would be impossible to replace automobile equipment in a very short time, and that one pick-up truck was budgeted this year which has not been purchased. He recommended the :'~' purchase of this truck at this time. After consideration, a motion was made by Councilman Roth, that the City Manager be authorized to accept the low bid on one pick-up t~uck, based on bids received last November.
