OCTOBER 10TH, 1950.
Regular meeting of the City Council of the City of Delray
Beach was held in the Council Chambers at 7:30 p.m. with MaNor
John N. Kabler in the Chair, and City Attorney John Moore, City
Manager Charles E. Black, and the following Councilmen present:
R.J.Holland, W.A.Jacobs, Walter A. Roth, and J.L.Saunders, a
quorum being present.
The minutes of the Council meeting held September 26th
were approved as written.
Mr. F.H.Link appeared before the Council~ requesting per-
mission to build a dwelling on Lot 2, Block 5, Del Ida Park,
with a 29' front set-back instead of the required 35' set-back.
He explained that this was an irregular shaped lot, and by
building with a 29' set-back he would be in line with an exist-
ing building on the adjoining lot~ and would be better able to
utilize his irregular lot.
Upon motion of Councilman Holland, seconded by Councilman
Saunders, and unanimously carried, this request was referred to
the Zoning Board for consideration of a special permit to deviate
from zoning requirements.
Mr. Howard Cromer then addressed the Council with reference
to a contract to furnish and install two gasoline engines for
pumping equipment at the Water Plant, claiming that he had been
required to pay a license fee by the City, but he had not been
given an opportunity to bid on this contract. He asked for an ex-
planation of the awarding of the contract.
Mayor Kabler explained that a special meeting of the Council
had been called on July l?th for the purpose of authorizing the
City Manager to fulfill the City's needs for civilian defense~ in
view of the pending national emergency at that time. The minutes
of this meeting were read by the City Attorney.
City Manager Black stated that it Dad seemed imperative to
order the equipment which would be needed immediately, without
the delay of asking for bids, as the City Charter does not req-
uire the advertising for sealed bids unless it is to the advan-
tage of the City to do so. For the furnishing and installation
of these engines, the price quoted by the Murphy Construction Co.
of West Palm Beach, had seemed fair and they were instructed to
order the equipment immediately and arrange for its installation.
City Attorney Moore stated that he felt the Charter had been
complied with, that the Council Dad felt that an emergency existed
and they had acted in good faith for the good of the people of
the Town.
Councilman Jacobs, who was not present at the special meeting
on July 17th, stated that people should have been given a chance
to bid on the furnishing of all of the equipment authorized on
that date.
Attorney C.Y.Byrd also criticized the Council for
entering into a contract of this amount without asking
for bids~ and also purchasing other equipment without
obtaining competitive bids. He claimed that the Council
had no authority to authorize the City Manager to spend
public money without competitive bidding~ under the City
Charter, and that the Charter has no provision for an
emergency.
After further discussion by the Council~ a motion ~a~
made by Councilman Holland to instruct the City Manager to
notify the Murphy Construction Co. that their contract was
being cancelled for non-compliance with the time element
in delivering the engines by October 10th, and let them
advise the City of its obligations. The motion was seconded
by Councilman Jacobs, and upon call of roll the motion
carried unanimously.
A motion was then made by Councilman Saunders that all
equipment approved bn July 17th which had not been purchased
be purchased only after obtaining competitive bids. The
motion was seconded by Councilman Roth~ and upon call of
roll carried unanimously.
The City Manager was instructed to procure some type
of loud speaking equipment for the Council room~ to enable
the audience to hear.
Mr. H.A.Helm~ President of the Seagate Cabana Club,
addressed the Council~ outlining his plan to construct a
swimming pool on Lot l~ Block 2~ Seagate Subdivision, for
the use of members of the Cabana Club only. He explained
that he intended to build apartments on this property
later~ but was asking permission to build the pool first,
to be used this season. It would be built according to
State Board of Health requirements, and include Men's and
Women's locker rooms and lavatories.
Upon the suggestion of the City Attorney~ a motion
was made by Councilman Saunders~ seconded by Councilman
Holland~ that this request be referred to the Zoning
Board for consideration and recommendation~ as this
property is zoned for Apartment House construction. Upon
call of roll the motion carried unanimously.
Mr. Edward A. Schellenberg, Chairman of Seagate
Property Owners Association~ appea~ed before the Council
urging the Council to clear lots in Seagate which are
overgrown with brush and pine trees~ and have become a
hurricane and fire hazard. All property owners were willing
to pay their share of the cost of this project, he stated,
but it would not be feasible for one person to clean his
own lot~ that it should be handled as one City project,
and it was definitely an emergency.

The Council realized the importance of such a project
but also felt it should be set up on a priority basis, to be
started when funds are available.
City Attorney Moore also explained a charter provision
to the e~ect that property owners be notified to clear their
lots by a certain date, after which time the City will clean
them and assess the cost against the property. However, it is
an expensive undertaking for the City.
Upon motion of Councilman Holland, seconded by Councilman
Roth, and unanimously carried, the City Manager w~s authorized
to lay out a map showing lots in need of clearing in the entire
beach section, east of the Canal, and sec~zre competitive bids
on the work~ and also make a survey of the balance of the City
in the sections where clearing is most needed.
Upon motion of Councilman Saunders. seconded by Councilman
Roth, and Unanimously carried, a request for a street light at
the corner of N.E.Sth Ave. and 8th St. was approved, as it had
been approved by the Street Light Committee, and the pole was
available.
City Manager Black advised the Council of a request by the
Jr. Woman's Club for permission to erect a fence in the City Park,
along the Canal bank, as a protection for children. They offered
to furnish materials for the fence, but asked that it be erected
at City expense.
Upon motion of Councilman Saunders, seconded by Councilman
Jacobs, and unanimously carried, the matter was deferred at this
time, for more definite information.
Two applications for "gratis" occupational licenses, filed by
persons over 6~ years of age, were presented for approval of the
Council, as follows:
1. H.E.Joliet--Real Estate salesman, l~l N.Federal Hwy.
2. O.Helland --Apartment House owner, W.Atlantic Ave.
at S.W.lst Ave.
Councilman Jacobs contended that a person over 6~ years of age
operating an individual business, is entitled to ~ free license,
under the existing Ordinance.
It was pointed out by the City Attorney that the Ordinance
stated "upon approval of the City Council". The majority of the
Council felt that it was intended to apply to "hardship" cmses only.
After further discussion, a motion was made by Councilman
Holland, and seconded by Councilman Saunders, that the above requests
for "gratis" licenses be denied, as no proof of hardship was in-
dicated. Upon call of roll the motion carried, Councilman Holland,
Kabler, Roth and Saunders voting in favor of the motion, and
Councilman Jacobs not voting.
A request for a free blanket license, filed by Lions
Industries for the Blind, to sell articles made by the blind~
was approved upon motion of Councilman Saunders, seconded by
Councilman Roth, and unanimously carried.
The following Resolution~ setting up a budget for the
operation of the Water Department for the 1950-1951 fiscal
year, was presented by the City Manager and read as follows:

the City of Delray Beach~ Palm Beach County, Florida, that

and ending September 30th, 1951, is hereby agreed upon and
adopted and there is hereby appropriated to such respective

Mayor Kabler recommended setting up a Revolving Improve-
ment Fund within the Water Department, whereby all water line
extensions in the City limits would be assessed against the
property, to protect the capital outlay for wa2er mains. He
suggested breaking down the Capital Improvement item of
$20,300.00 into an item of $10,000.00 for a Revolving Improve-
ment Fund~ and an item of $10,300.00 for Capital Improvements.
The Council discussed this recommendation, but no action
was taken.
A motion was then made by Councilman Jacobs, seconded by
Councilman Saunders, that the foregoing Resolution No. 772 be
passed and adopted as read, and upon call of roll the motion
carried unanimously.
The City Engineer's Assessment roll on the grading and
rocking of the alley through Block lO1, was filed as follows:

Gentlemen:
As you know, we have audited the books and records of the
City of Delray Beach for the fiscal years 19~6, 19~7, 19~8,
and 1959. During that time we have made a complete revision of
accounting records and procedures, and have brought the account-
ing methods in line with the recommendations of the Municipal
Finance Officers Association.
We are in complete agreement with the American Institute
Of Accountants that competitive bidding for audit engagements
is unsound, and not to the best interests of the client. A
copy of the Institute's release on that subject is enclosed.
This then is not a bid, but a confirmation of the terms pre-
viously agreed upon.
Under the same strict terms which have governed our past
audits--the use of trained accountants in municipal accounting,
conformity with the recommendations of the National Committee
on Municipal Accounting~ and the giving of suggestions for im-
provement wherever found necessary--we propose to make an audit
of the City's books and records for $900.00, exclusive of the
Water System's books and records, which are properly subject
to a separate audit. The fee for auditing the Water System will
vary from $300.00 to $~50.00, depending on the amount of work
involved.

On request of the City Attorney~ a motion was made by
Councilman Holland, and seconded by Councilman Jacobs, that
he be empowered to notify in writing the three proposed fis-
cal agents for the refunding of the City's present indebtness
to whom letters were previously addressed, that bids should
be on the amount of the present indebtedness less any sum of
money which has been accumulated in the sinking fund specifically
for the purpose of retiring the bonded indebtedness. Upon call
of roll the motion carried unanimously.

City Attorney Moore advised that the present Occupat-
ional License Ordinance would superce~e the Electrical 0rd-
inance, and Electrical Contractors should be given the same
period of time for renewing their licenses as other contrac-
tors~ and upon motion of Councilman Holland, seconded by
Councilman Saunders, the Tax Collector was instructed to ac-
cept payment from the J.R.Himes Electric Co. ~ and all future
licenses of like category.

Upon motion of Councilman Saunders, seconded by Councilman
Roth~ and unanimously carried, the foregoing Ordinance was placed

With reference to the prohibition of parking on the Federal
Highway from N.E.lst Street to S.E.lst Street, City Manager
Black reminded the Council that it had been agreed that if the
State Road Department should pave the highway from curb to curb,
it would abandon parking in that area, so that the paving might
be utilized for traffic. He recommended that this be done as a
safety measure.
The Council considered this recommendation at length, and
upon motion of Councilman Roth, seconded by Councilman Holland,
and unanimously carried, the Police Department was instructed to
prohibit parking in the area of the Federal Highway which has

City Manager Black suggested the appointment of an advisory
Insurance Committee to study the insurance needs of the City,
and to set a date each year when all insurance will become due,
when the City would advertise for bids each year. He recommended
the appointment of Matt Gracey, Chairman, Carl Amlin and Lucile
Nichols, as members of such a Committee.
Upon motion of Councilman Holland, seconded by Councilman
Saunders, and unanimously carried! the appointment of an Insurance
Committee as recommended by the City Manager was approved.
At the request of Mayor Kabler, a motion was made by Council-
man Holland, seconded by Councilman Roth, and unanimously carried,
that the City Manager and City Clerk be instructed to bring the
printed copies of the Zoning Ordinance up to date, and that amend-
ments be added in the future.
Upon motion of Councilman Saunders, seconded by Co%u?cilman
Jacobs, and unanimously carried, bills totaling $~d+,603.67 were
approved for payment, after approval by the Finance Committee.
Upon motion of Councilman Holland, seconded by Councilman
Roth, and unanimously carried, a bill from City Attorney John Moore
in the amount of $986.50 for Attorney's fees and costs in connection
with the issuing of the Golf Course Revenue Certificates, was approved.
