A Special Meeting of the City Council of the City of
Delray Beach was held at ~:30 p.m. in the City Manager's
office, with Mayor John N.Kabler in the Chair~ and City
Attorney John Moore~ City Manager Chas. E.Black~ and the
following Councilmen present: W.A.Jacobs~ Walter A. Roth~
and J.L.Saunders, a quorum being present.
Action on a Resolution prepared by McCreedy & Co. of
Miami~ fiscal agents who are handling the proposed Refund-
ing Bond Issuer was deferred, and a special meeting of the
Council~ together with the Bond Conm~ittee, was called for
l0 o'clock a.m.~ November 18th, to consider adoption of this
Resolution.
The cancellation of 19~8 and 19~9 taxes on property in
Hofman Addition, in cases where Tax Certificates have been
issued stating that City taxes have been paid in fully was
discussed. It was explained by the City Manager that through
an error~ Hofman Addition had not been assessed for debt ser-
vice for the years 19~3 and 19~9, but when this error was dis-
covered in 1950~ taxes for these years were billed~ as is pro-
vided in the City Charter.
After consideration~ the Council felt that if a certifi-
cate had been issued by the Tax Collector stating that all
taxes were paid~ these 1945 and 19~9 taxes should be nulli-
fied~ and upon motion of Councilman Saunders~ seconded by
Councilman Roth~ the City Attorney was instructed to prepare
such a Resolution~ for adoption.
City Manager Black advised the Council that Mrs. Elsie
W. Davis~ owner of the So.16' of Lot 15, and all of Lots 16
and 17~ Block lOl~ adjoining the City Hall property on the
south, was willing to move the sidewalk on this property
inside her property line, in order to widen the Street, but
she had asked the City to build the sidewalk with the under-
standing that when business buildings are built on this prop-
erty she will reimburse the City for the cost of the sidewalk~
or in case she sells the property she will pass that agreement
on to the purchaser.
Upon advice of the City Attorney that such an agreement
could not be entered into bi~ the City~ Mr. Black suggested
that an assessment be made on the usual basis, allowing ten
years for repayment.
Action was deferred for further investigation.
Upon motion of Councilman Roth~ seconded by Councilman
Jacobs, and unanimously carried~ bills totaling ~51+,913.57
were approved for payment, subject to approval of the Finance
Committee.
The meeting then adjourned.
