04-13-49SpMtg APRIL 13TH, 1949 A Special Meeting of the City Council, $ogether with the Zoning Board, was held in the City Manager's office at ~4 P. M. with MaYOr J. L. Saunders in the Chair, and City Manager Charles E. Black, City Attorney John Moore, and the following Councilmen present: John N. Kabler, Neit E. MacMillan and L. H. Brannon, a quorum being present. MaYOr Saunders e~plained that the meeting had been called to reconsider the request of the Standard Oil Co. to remodel their Service Station at~. the corner of Atlantic Avenue and Federal Highway, as the Council felt the Zoning Board had not been thoroughly informed on their plans, and they should be given an opportunity to Further explain them. Mr. C. T. Thames, representing the Standard Oil Company then outlined their plans to add on the back of the property, and on the north, stressing the fact that their plans would not affect the Future widening of the Federal Highway. He stated that they were trying to modernize and improve their property, and alterations or additions would all conform with set-back regulations. Mr. King S. Cone, Chairman of the Zoning Board, then explained that the Zoning Board had recommended that the permit be denied because of non-conformity of set-backs. He contended that if a new building were to be constructed on this corner, buildings and pumps would be required to set back 20', and that in order to eventually get uniformity of set-backs the Zoning Board would not recommend a Special permit to allow a deviation from this requirement. He further stated that if the Council felt the set-back requirement should be decreased in this instance, the Ordinance should be amended to provide this change, SO that adjoining property owners would benefit as well. Councilman Macmillan agreed with Mr. Cone theoretically, but favored granting a special permit to the Standard Oil Company to make their contemplated improve- ments, believing it would be an improvement to the appearance of the City. The consensus of opinion of the Zoning Board was that if special permits were granted whenever requested, the Zoning Board might better be abolished, as their plans for uniformity and their over-all plan for the future of the City could never be accomplished. The Zoning Board, therefore, did not change its recommendation to the Council that special permit be denied in this ca. se, but referred the request back to the Council. Councilman Kabler then stated that he was in favor of issuing permits for remodeling, or alterations, to Service Stations on the Highway, as nothing could be gained by not issuing them. He felt it would not be setting a precident for the future, but it would improve the appearance of the entrance to the City; but he did not recommend that the present set-back requirement of 20' be changed. After.further discussion, a motion was made by Councilman MacMillan, seconded by Councilman Kabler, that a special permit be granted the Standard Oil Company to improve their property, as requested, subject to their meeting other require- ments of the building code, and the filing of plans and specification with the Building Inspector. Upon call of roll the motion carried, Councilmen Kabler, MacMillan and Saunders voting in favor of the motion, and Councilman Brannon opposing. It was understood that permits for s~m~lar repairs or remodeling, filed by other Service Stations on the Federal Highway, would be granted as requested. APRIL 13TH, 1949 Upon motion of Mr. Jacobson, seconded by Mr. MacNab, a system of des- ignating street numbers which was being worked out by Mr. F. J. Schrader, -' Building Inspector, was approved by bhe Zoning Board; even numbers to be designated to every 25' from Atlantic Avenue and Swinton Avenue on the east and north sides of streets, and odd numbers on the west and south sides of each street from this point. A motion was then made by Councilman Mac~gillan, seconded by Councilman Br_~_unon, that the foregoing recommendation of the Zoning Board be approved, and that Mr. Schrader be authorized to proceed ~ith his plans; the City Attorney to prepare an Ordinance to cover this authorization.
