A Special Meeting of the City Council of the City of Delray
Beach was held in the Council Chambers at 4:30 P. m. with Mayor
J. L. Saunders in the Chair, and City Attorney John Moore, City
Manager Chas. E. Black, and the following Councilmen present:
L. H. Brannon, John N. Kabler, Neil E. MacMillan, and Walter A.
Roth, a quorum being present.
Mr. Jay R. Shattuck again appeared before the Council, with
reference to his previous request for permit to erect an a~uing
in front of his restaurant on So. Ocean Boulevard, ~hich would
extend 4'6" over the sidewalk, with no stantions or supports on
the sidewalk, nor blocking of the sidewalk in any way. This request
had been tabled at a previous meeting.
After consideration, a motion was made by Councilman MacMillan,
seconded by Councilman Kabler, that permit be granted, as other
similar awnings had been permitted to be erected in the City. Upon
call of roll the motion carried unanimously.
City Manager Black explained to the Council that Mr. C. Y.
Byrd, of the Board of County Commissioners, had tentatively promised
that the County would pay for necessary work to be done on the beach in
building up the shoulder from 8' to 10', although he would have to
get the approval of the Board at its next meeting. Mr. Black stated
that the necessary machinery was available locally, aud he estimated
that the shoulder could be evened up from 8' to 10' for ~p proximately
$ 400.00. He suggested that he be authorized to start the work,
feeling sure the County would pay for it. He recommended the use of
a drag-line rather than a bulldozer, as it could move more fill in a
shorter time.
Upon motion of Councilman Kabler, seconded by Councilman Mac-
Millau, the City Manager was authorized to e~ploy Howard Cromer to
start this work, spending up to the extent the County will allow, and
upon call of roll the motion carried unanimously.
Proof of publication of Invitation to Bid on furnishing certain
automobile ecpipment was presented, and spread upon the minutes as
follows:

The City of Delray Beach will receive sealed bids until 4:30
P. M., E. S. T., Tuesday, November l, 1949, on the vehicles and/or
equipment itemized below. Bids must be submitted on each unit to
be sold or purchased by the bidder. The bidders may also submit a
lump sum bid on all items which he proposed to purchase from and/or
sell to the City of Delray Beach.
Bids must be accompanied by a certified check or bid bond in
the amount of 5% of the net bid on all items covered by said bid.
ITE~M 1. Purchase by the City: One truck cargo-dump, 2 - 2~
ton range minimum gross vehicle, weight rating 15,500
pounds. Sufficient wheelbase to accommodate at least 15' long
flat dump body. Drive to be standard 4 speed transmission with two
speed rear axle, or equivalent; tires to be minimum 8.25" dual rear
and 7;50" front. Body to be flat platform minimu, 90" wide and 15'
fleOe~ with minimum l0 ga.u~e alloy steel floor. Sidebaords to be 4
high, lined with-14 guage galvanized iron. Dump cylinder to be
8" minimum diameter.

to narrow cab which will permit use of side racks for pipe and
equipment. Undercarriage to be coated with asbestos undercoating.

It ~as explained that this brand had been specified to use with
present equipment, and City Manager Black recommended that the bid be
accepted, as the equipment was needed immediately.
A motion was made by Councilman Brannon, ~seconded by Cour~ilman
Roth, that the foregoing proposal be accepted, in the total amount of
$ 506.00. and upon call of roll the motion carried unanimously.
Action on bids received on Radio Equipment was deferred, ~fter
Mr. Black explained that there was a possibility that present equip-
ment could be converted, and it ~ould not be necessary to purchase
complete new radio sets.

With reference to a required front set-back of 20' in a Business
#l District on West 5th Avenue, City Manager Bla..x stated t~t at the
time the property owners on this street deeded 5' to the City for the
construction of a sidewalk, they were told that 'their set-back from
the sidewalk could be 10', the same as in other Business Districts.
They had understood that their set-back would be 10' from the street
side of the sidewalk. The Zoning Board had unofficially reco~.ended

After discussion, however, a motion was mad~ by Councilman
Brannon, seconded by Councilman MacMillan, that the Zoning Ordinance
be amended to change the front set-back requirement in a Business #I
District on West Fifth Avenue from 20' to 10', and that any applica-
tions already filed for building peri, its be approved on this basis.
Upon call of roll the motion carried unanimously.
Application filed by Harry G. & Twtla J. Bare, for permit to
construct a small guest house with car port attached, on Lot 1~,
Block 106, in thc rear of an existing building, was approved upon
motion of Councilmau Brannon, seconded by Councilman Mac~..~llan, and
unanimously carried, subject to final approval of the Building In-
spector.
~n application filed by Mrs. R. B. Belden, for special permit
to erect a car port and modernize her home located on Lot 2, Block 2,
Del Ida Park, filed at a prex~ous raeeting, had been referred to the
Zoning Board, ~no made the fo!lo~ ng reco~_~endation:
"The request of Mrs. R. B. Belden for a Special Pez~uit to i~prove
and make additions to her property located on Lots i and 2, Block 2,
Del Ida Park, without complying with set-back requirements, was con-
sidered.
The Zoning Board re co r~e nd s that the permit be granted in con-
sideration of a waiver of compensation should the ..~ity ever require the
use of the property on which the improve~nts are made."
~ motion was made by Councilman MacMillan, seconded by Council-
man Kabler, that Special Permit be granted, without the recommended
waiver, as the hou~e is set back 60' from the center of Swinton Ave.
Upon call of roll the motion carried unanimously.

A Special Meeting of the City Council of the City of Delray
Beach was held in the City Manager's office at 4:30 p. m. with
Mayor J. L. Saunders in the Chair, and City Manager Chas. E. Black,
and thc following Councilmen present: John N. Kabler and Nell E.
MacMillan, a quorum beir~ present.
A tabulation of bids received November 1st, for furnishing
certain specified automobile equipment, was presented by the City
Manager, which is filed with the data concerning this meeting.
The tabulation of proposals received showed the Delray Beach
Motors as the low bidder on 2-Ton Dum~ Trucks, their proposal being
$ 2,?96.00 plus ~ 30.00 for 100 HP V-U Motors, and tbs Delray Service
Garage as the low bidder on Pick-Up Trucks, with no allowance for
trade-in of old trucks, their bid being ~ 1,225.00 each for 1/2 Ton
Chevrolet Trucks. However, considering the trade-in allowance
on old equipment offered by,~R~lank Motor~ Company, of hTest Palm
Beach, their bid on 1/2 Ton/~Yc~-Up trucks would be ~ 1,190.00 for
one truck, and ~ 1,300.00 for thc second truck.
Mr. C. F. Kiesel, representing the Joe Blank Motor Company,
pointed out that a certified check in the amount of ~% of their bid
had accompanied their proposal to furnish this equipment, and that
no check or Bid Bond had been furnished by the Delray Service Garage,
nor by the Delray Beach Motors, although it had been required in the
Invitation to Bid.
The City Manager explained that the Notice also provided that
the City Council would have the right to waive any or all formalities.
Councilman MacMillan stated that he was willing to over-look
the lack of a Bid Bond being filed, and to establish a policy whereby
such bonds would not be required in the future. He also suggested
that only the two 2-Ton trucks be purchased at this time, and that
the low bid of the Delray Beach Motors be accepted, and the two
Pick-Up Trucks be purchased at a l~ter date, although he knew they
were badly needed to replace worn-out equipment.
After further discussion, a motion was made by Councilman Kabler,
seconded by Council~nan MacMills~u, that t~0 2-Ton Trucks be purchased
from the Delray Beach Motors '~ $ 2,796.00 each, plus ~ 30.00 each for
100 HP V-8 motors, and upon call of roll the motion carried unanimously.
The meeting then adjourned.
