This Memorandum reflects the current intent and understanding of and between the Parties with respect to this relationship. Agreements, Procedures & Modalities: • Employer agrees to provide their employees with periodic appropriate information regarding free services and information available from CCMS through the Tier One Program. This can be satisfied by the Employer placing (on a quarterly basis) information regarding financial help and counseling available through CCMS on a website link on or in a location convenient to employees (i.e., the Company's Web Site or Intranet, employee newsletter, payroll inserts, etc.). • Employer agrees to review and discuss with CCMS this Memorandum at least annually. This discussion should include Employer satisfaction with the level of services CCMS is providing and what, if any, additional services or appropriate seminars and/or webinars the Employer may be willing to underwrite. • CCMS will provide the Employer the appropriate link to "Consumer$ense", a free Financial Education program for employees which provides a certificate of completion when successfully finished. If desired, CCMS will provide (for a minimal amount of approximately $500 per year) a dedicated URL for Employer's website that wil[ allow the Employer to track their employees' usage of this program. • Each Party shall perform its obligations under this Memorandum in a manner that reflects favorably upon the good name and goodwill of the other Party. • The Parties acknowledge that the agreements under this Memorandum are not exclusive. • "Phis Memorandum may be terminated by either Party for any or no reason by providing written notice. Upon termination of this Memorandum, the Employer shall remove and cease all use of CCMS Property and if applicable, CCMS Links from the Employer Web Site within thirty (30) days of the date of notice. • CCMS does not endorse, approve, certify, or control the F,mployer's Web Site and does not warrant, guarantee or make any representations regarding the accuracy, completeness, efficacy, timeliness, merchantability, or fitness for a particular purpose of the content or data located on such site. ITEM BEFORE COMMISSION Presentation from the Downtown Marketing Cooperative (DMC), in partnership with Blue Web Mobile Media, on a proposed agreement to provide Digital Signage, Interactive Kiosks and free Wi-Fi within the downtown corridor between 5th Avenue (West) to AlA (East) and NE 2nd Ave (Pineapple Grove). BACKGROUND Staff has met with Sarah Martin and the representative from Blue Web Mobile Media regarding their use of the proposed technology in the downtown area. The DMC will be entering into an agreement with Blue Web Mobile Media that provides for the sharing of revenue generated from the sale of advertisements that are accessed by iPhone, Blackberry and Android users as they enter into the Wi-Fi area. In addition, they propose to erect four to eight Virtual Kiosks and several digital touch pad Signage locations in store windows. Interactive Mega-applications may also be projected from sides of buildings or sidewalks. If the Commission wishes to consider this initiative, the sign code must be amended. Currently, Section 4.6.7(E)(6) Design, Prohibition and Restrictions, states that signs should not involve intermittent lighting, animation, motion or rotation of any part of a sign, structure or display. Also, window Signage is limited to 20% of the aggregate glass area of any business. Section 4.6.7(J)(2) Off Premise Signs states that signs that advertise an establishment, merchandise, service or entertainment which is sold, produced, manufactured or furnished at a place other than the property on which the sign is located are prohibited. If the Commission entertains allowing this Signage in the downtown area, consideration should be given to the fact that it does not necessarily preclude other vendors from making similar requests for other areas of the City. Commissioners have noted the congestion and conflicts with pedestrian access since the permitted use of sidewalk cafes in the desired target area; the mega projections might exasperate this further. We believe that the use of technology is the wave of the future; on the positive side, the long- awaited Wi-Fi within the downtown corridor, at no fiscal cost to the City, may be achieved. However, consideration should be given to how technology is used and its impact to the City as a whole. A copy of the PowerPoint being presented is attached for reference. BACKGROUND In 2009, the City Commission created a new City Board, the Green Task Force, (GTF), which was later renamed as the Green Implementation Advancement Board (GIAB), to make recommendations to the Commission regarding environmental sustainability and ideas to implement the recommendations. The Board is made up of seven (7) members with two (2) appointed alternates. Each Board Member maintains expertise and/or an interest in environmental conservation and sustainability. The GIAB is charged with the responsibility of reviewing City operations and policies and providing recommendations to the City Commission toward achieving Delray Beach's green and sustainability goals. BACKGROUND Bill Wood (former Chamber of Commerce President, now with CCMS) submitted a request for the City to partner in a financial literacy program titled "Operation: Money Makeover" with CCMS. Harden, City Manager DATE: March 2, 2011 SUBJECT: AGENDA ITEM WS.4 -WORKSHOP MEETING OF MARCH 8, 2011 DISCUSSION OF A PROPOSED ORDINANCE OUTLINING THE CONCEPT OF COMMUNITY GARDENS ITEM BEFORE COMMISSION Consideration of the rules, standards and other conditions proposed to be included under a new ordinance governing the permitting and approval of "Community Gardens." BACKGROUND By definition and history, community gardens are green spaces that are communally cultivated and cared for. These spaces may consist of individually-worked plots, communally-tended areas, and sitting areas. They are the result of the shared collective effort of people working together. Community gardening is an effective community-building strategy that contributes to neighborhood renewal, preservation, and stabilization. They provide a source of inexpensive, nutritious food and a rewarding personal experience. Enduring stewardship is needed to ensure success and the gardens demonstrate the impact of sustained volunteer efforts. In structuring the proposed ordinance, staff took into consideration the common basic elements of successful community gardens, past experience and other MunicipaUCounty ordinances that are in place. Proposed Rules/Regulations/Standards -Community Gardens The ordinance is intended to provide for the implementation of community gardens, setting forth standards and zoning area criteria where such gardens shall be permitted. The intent of permitting community gardens is to allow a group of residents to grow produce and horticultural plants for their consumption and enjoyment without creating adverse environmental impact or land use incompatibilities. General Rules & Regulations: -A community garden is not intended to be a commercial enterprise. Sale of produce and plants at the site are prohibited. Surplus of produce and plants may be sold off premises only. -The raising of poultry or other livestock, fish and the keeping of bees shall be prohibited. -Permitted uses within R1-A, R1-AA and Multi-family zoned residential neighborhoods. -All community gardens shall require administrative plan approval through the Community Improvement Department. The application shall require the property owner's consent and the following items attached: layout of plots and other components proposed on the site of the community garden, setbacks from adjacent properties, identification of water supplies, established operating rules identifying the governance structure of the garden and maintenance and security responsibilities; contact information for the person responsible for the oversight of the garden. -The owner of the property on which the garden is located shall be responsible for maintaining the property so that it does not become overgrown with weeds, infested by invasive exotic plants or vermin, or a source of erosion or storm water runoff. If the property is not used as a community garden for 120 or more consecutive days, the site shall be restored back to its normal condition. -The use of pesticides, herbicides and weed killers, insecticides made from synthetic chemical materials and chemicals is prohibited. The use of materials and practices used for organic production (guidelines) is strongly encouraged. -The site shall be designed and maintained to prevent draining or runoff onto adjacent property. -The community garden shall grow at least four (4) different food crops and/or non-food crops. No gardening activities shall take place before sunrise or after sunset. 50% or more of the planting area shall be in production at all times. -The property owner shall be prohibited from seeking an agricultural tax exemption afforded by the local, state, or federal tax regulations. Site Standards: -Community gardens are intended to occupy infill lots, thus a garden shall not be greater in size than the standard lot within the neighborhood it is located. Thus, for R1-A zoning districts, the maximum size is 7,500 square feet and for R1-AA, the maximum lot size is 9,000. -All planting shall be planted no closer than 10 feet from the front, interior side or rear property lines. Corner lots shall maintain a 15 ft setback from the side street. All plantings shall comply with the visibility at intersection requirements pursuant to applicable Land Development Regulations. -Community gardens shall consist of land used for the cultivation of fruits, vegetables, plants, flowers, or herbs by multiple users. The land shall be served by a water supply sufficient to support the cultivation practices used on the site. -A fence or hedge is required for all gardens. The fence or hedge shall comply with LDR Section 4.6.5 and must have adrive-through gate to accommodate trucks and other equipment that may be used from time-to-time as a part of the gardening maintenance. Hedges are encouraged and may consist of drought-tolerant flowers and shrubs; plants which attract butterflies, herbs are also well-suited to perimeter landscaping and help create barriers to unwanted pests and insects. -Compost and organic matter to be used for the community garden shall not be stored in open air. They shall be contained in appropriate containers, which shall be located with a 25-foot setback from all rights-of-way and a minimum of 5-foot setback from all property lines. Such containers shall be maintained to prevent odors and prevent the harborage of rodents and pests. -Sheds shall have a maximum size of 8' by 10' to be placed in community garden area and shall have a front setback of a minimum of 50% of the lot depth and meet the accessory setback requirements for the side and rear yards pursuant to Land Development Requirements. Such structures are not allowed in rights-of-way at anytime. The height of the shed shall not exceed 8 feet. -Storage of toxic and flammable materials is not allowed. No tires are allowed to be stored on-site. -One sign is permitted, which shall not exceed 16 square feet and with a maximum height of 5 feet. -No parking is allowed on-site. RECOMMENDATION Staff recommends City Commission review of proposed rules, regulations and standards for community gardens and direction for any changes to be a part of the proposed ordinance. Staff is recommending the first reading of the new ordinance to be on the March 15th regular meeting and the required public hearing to be held on April 5th
