WHEREAS, the City of Uelray Beach, Florida, received an application for abandonment of easements dedicated by easement deeds, as recorded in lleed Book 1034, Page 47; Ueed Book 984, page 44G; Deed Book BGU, Page =175; Deed Book 877, Page 48G; Deed Book 871, Page 184; lleed Book 9U1, Page 2G7; and Uecd Bex>k 99li, Page X39, of the Public Records of Palm Beach County, Florida, as more particularly described in Exhibits "A" to "C7"; said easements being located within the lambert Trailer Court Subdivision, located on the west side of Federal 1 iighway (U.S. 1) approximateh• 32U feet south of SF: lUth Street and north of the Plaza at Uelray; and WHEREAS, the application for abandonment of said casements was processed pursuant to Section ?.4.G(N), ":abandonment of public Easements", of the 1_and Development Regulations of the Cite of Delra~~ Brach, Florida; and WHEREAS, pursuant to I,UR Section 2.-LG(N)(3)(c), the application was forwarded to the Cite Commission with the recommendation that the abandonment be approved, based upon positn r findings; and WHEREAS, the City Commission of the City of Delray Brach, Florida, pursuant to LUR Section 2.4.G(N)(5), finds that the abandonment will not result in detriment for the provision of utiht~ services to adjacent properties or the general area, that its interest in the described property is no longer needed for the public good and deems it to be in the best interest of the City of llelray 13cach to vacate and abandon said easements, as more particularly described in Exhibits "A" to "G". WHEREAS, the City of llelray Beach, Florida, received an application for abandonment of easements dedicated by easement deeds, as recorded in Deed Book 1034, Page 47; Deed Book 984, Page 446; lleed Book 860, Page 475; lleed Book 877, Page 486; lleed Book 871, Page 184; lleed Book 901, Page 267; and lleed Book 998, Page 539, of the Public Records of Palm Beach County, 1~'lorida, as more particularly described in Exhibits "A" to "U"; said easements being located within the Lambert Trailer Court Subdivision, located on the west side of Federal Highway (U.S. 1) approximately 320 feet south of SE 10th Street and north of the Plaza at llelray; and WHEREAS, the application for abandonment of said easements was processed pursuant to Section 2.4.6(N), "Abandonment of Public Easements", of the Land llevelopment Regulations of the City of llelray Beach, Florida; and WHEREAS, pursuant to LDR Section 2.4.6(N)(3)(c), the application was forwarded to the City Commission with the recommendation that the abandonment be approved, based upon positive findings; and WHEREAS, the City Commission of the City of llelray Beach, Florida, pursuant to LllR Section 2.4.6(N)(5), finds that the abandonment will not result in detriment for the provision of utility services to adjacent properties or the general area, that its interest in the described property is no longer needed for the public good and deems it to be in the best interest of the City of llelray Beach to vacate and abandon said easements, as more particularly described in Exhibits "A" to "G". NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the foregoing recitals are hereby incorporated herein by this reference. The existing development on the property is known as the Floranda Mobile Home Park. The abandonment is associated with redevelopment of the property fora multi- family residential project, known as Franklin at Delray Beach. BACKGROUND At its meeting of January 4, 2011, the City Commission approved a conditional use application to allow a residential density of up to 22 dwelling units per acre for the subject property known as Franklin at Delray Beach. The project consists of 180 multi-family dwelling units on the site of the Floranda Mobile Home Park and Executive Quarters office building. A Site Plan Review application has been submitted for this project and the review is currently underway. Action by the Site Plan Review and Appearance Board is scheduled for April 13, 201 I . The easements to be abandoned have been dedicated for use by the adjoining property owners by seven separate easement deeds, recorded in Deed Book 1034, Page 47; Deed Book 984, Page 446; Deed Book 860, Page 475; Deed Book 877, Page 486; Deed Book 871, Page 184; Deed Book 901, Page 267; and Deed Book 998, Page 539. When combined, the easements constitute three parallel roadways which are 18' wide and run east to west through the entire subdivision. There are also road rights-of--way over the north two of these roadways which were dedicated by the Plat for Lambert Trailer Court. Portions of these road rights-of--way are also being abandoned by separate action.
