A joint meeting of the City Council and the Delray Beach Zoning Board
was held in the Council Chambers at 5 P M with Mayor L H Brannon in the Chair,
and City Manager Charles E Black, City Attorney John Moore, and the following
Councilman present: John N Kabler and Neil E Macmillan, a quorum being presen~
A petition signed by five property owners, requesting a change in zoning
restrictions on the East side of Gleason Street between Schulson to Casuarina
Streets, from a Residence A District to an Apartment District was presented
and read as follows:
"Mr Charles E Black, City Manager
Delray Beach, Florida
Dear Mr Black:
The undersigned property owners on the east side of Gleason Street from Schulson
to Casuarina earnestly~ request that the property facing west on this street be
zoned for apartments instead of residential A.
There are several reasons for this; First, the property across the street in
John B Reid's Village is zoned for apartments which would make undesirable
development of this area for residencez. Gleason Street has Just been recently
paved which will open the area up and cause the construction of considerable
units: in fact, we understand Mr Reid has already embarked upon a development
program.
Second, the property as it now stands is not being used in any way and is
an economic waste. Changing the zoning to apartments would force it into
improvement and would materially increase the income of the City from a tax
standpoint.
Your prompt action on this petition will be very much appreciated.

Gentlemen:
I am very desirous of having the property consisting of the west 175'
feet of government lot 30, facing on Gleason Street to be rezoned from
Class A Residential to the special hotel and apartment zone, and thank you
in anticipation for passing my request on to the Zoning Board.

Mr King S Cone, Chairman of the Zoning Board explained to the Council
that Mrs Warner, owner of the S 59.~' of Ocean Beach Lot 32, was the only
property owner in the block effected who had not signed the petition, but
she was agreeable to the zoning change. He stated that proper,fy on the west
side of the street is zoned for apartments, as well as property south of
this block in Seagate.
Mr Cone recommended that the east side of Gleason Street from Atlantic.
Avenue to Casaurina Drive be zoned as an Apartment District in order to
make the zoning uniform, in view of the fact that the west side of the
street in an Apartment District, which makes the east side undesirable for
residences. He urged the Council to include this change in the contemplated
over-all rezoning, and call for objections at that hearing.
City Manager Black was in favor of approving this specific request only,
at this time, as a step toward uniform zoning.
City Attorney Moore explained that such a change could be made before

but recommended that surrounding property owners be notified of this
public hearing.
After further discussion a motion was made by Mr Puckett of the
Zoning Board that a recommendation be made' to the Council that the above
request be granted, and the change in zoning be included on the over-all
rezoning map. The motion was seconded by Mr O'Neal, and upon call of roll
carried unanimously.
A motion was then made by CounciLman Kabler, seconded by Councilman
MacMillan that the recommendation of the zoning Board be approved, and
this change be included in the overall rezoning plan. Upon call of roll
the motion carried unanimously.
City Manager Black presented a copy of a petition submitted by
Mr Puckett, pertaining to a request for the rezoning of property on
the north and south sides of NE 8th Street, but as it was only signed
by one property owner, could not be considered at this time. Mr Cone
was in favor of not considering such matters until there was a specific
demand for it, in other words to let expansion take its course. The ~
bridge at 8th Street will not be finished before another year, and that
will be time enough to consider a change in zoning restrictions in that
area, in his opinion.
Mr Jacobson and Mr O'Neal felt that this matter should be given
more study before a recommendation could be made.
A motion was then made by Council Kabler, seconded by Councilman
MacMillan that the petition be referred to the zoning Board for future
consideration, and upon call of roll carried unanimously.
Mr Puckett brought up the rezoning of Lots &A-&6, Block 125, which
adjoin the Delray Patio on the south, explaining that the owner would like
to develop stores on the first floor with offices on the second floor, and
asked that the zoning be changed from an Apartment Zone to a Business Zone,
on account of the noise and odors from the Patio making the location
undesirable for apartments.
APRIL 1st, 1948
No action was taken on this request, but Mr Puckett was instructed to
have the owner of the lots submit a petition re-questing the zoning of these
lots be changed to a Business District, for consideration of the Council.
Councilman Kabler advised the Council that the North 1/2 of Block 159
had been changed to a Special Hotel District but it was not so indicated on
the Zoning Map. He asked that this be corrected before the new over-all map
was adopted.
A motion was made by Councilman MacMillan, seconded by Councilman
Brannon that the City Manager be authorized to make this change on the new
zoning map, and upon call of roll the motion carried unanimously.
The Council then adjourned.
