04-02-48SpMtg APRIL 2nd, 1948 A Special meeting of the City Council of the City of Delray Beach w~s held in the Council Chambers at 7:30 P M for the purpose of opening bids received on Two Submersible Motor Deep Well Pumps, for the water plant improvement project, and for any other necessary business with Mayor L H Brannon in the Chair, and City Manager Charles E Black, City Attorney John Moore, and the following Councilmen present: John N Kabler, Nail E MacMillan and C J White, a quorum being present. The Clerk presented proof of the publication of notice calling for bids on this equipment, which was spread upon the minutes as follows: "INVITATIONS FOR BIDS~ Sealed proposals will be received by the City Council of the City of Delray Beach, Florida, at the City Hall, Delray Beach, Florida until 4:00 p.m., EST, April 2, 1948, for furnishing and installing two (2) Submersible Motor Deep Well Pumps, complete and ready for operation. Specifications and contract documents are open to public inspection at the City Office, City Hall, Delray Beach, Florida, or may be obtained from Smith and Gillespie, Engineers, P 0 Box 1048, Jacksonville l, Florida, upon payment of $2.00. Bids must be accompanied by a certified check or Bid Bond in an amount not less then five percent of the bid. No bid may be withdrawn for a period of thirty (30) days after the scheduled closing time for the receipt of bids. The owner reserves the right to reject any or all bids and to waive formalities. Nr Black said that he would have no objection to the use of Layne-Atlantic pumps in place of Byron-Jackson pumps, if approved by Smith & Gillespie, Engineers. A motion was made by Councilman Kabler, seconded by Councilman MacMillan that the low bid be accepted, subjected to the approval of the consulting Engineers on satisfactory completion date as stated in the specifications, all proposals to be held until contract is signed. Upon call of roll the motion carried unanimously. In inquiry regarding Daylight Saving Time was referred to each Civic Organization, for their consideration and responce. Councilman MacMillan recommended that as the peak of the political campaign was near, all City employees be prohibited from passing out any campaign material ~er'~any particular candidate during working hours. The City Manager offered to put out a memorandum to City employees to this effect if necessary. The use of posters and bill boards is covered by a City Ordinance. In a motion by Councilman Kabler, seconded by Councilman MacMillan, and unanimously carried, the City Attorney was instructed to proceed with the preparation of a Resolution for the release by property owners of 5' needed for sidewalk construction on West 5th Avenue, in the colored section. Mayor Brannon recommended that a No Stop sign, or some kind of a warning signal be put up at the corner of North Federal Highway and 8th Street, as this is a very dangerous corner. At the suggestion of the CounciLman White, the City Manager was instructed to ask the State Road Department to put up their usual inter- ~section warning, or a blinker light to control traffic at this corner. Mr Black agreed to also ask them to put directi6nal signs where needed. The following letter from Attorney J W Nowlin, regarding the sale of certain property at the City Tax Foreclosure sale, was presented and read in full: ,,Now]in & Adams Attorneys at law Delray Beach, Fla April 2, 1948 The Honorable City Council Delray Beach Florida Gentlemen: APRIL 2nd, 1948 At the request of F D Kitchens, one of our colored citizens, t have checked into the City Tax Foreclosure which I completed for the city in 19~7. I find in checking the Foreclosure that the following described lots, in which Kitchens is interested, were purchased by the city at Master,s sale. These lots arid the amount paid for the same are as follows: Lot i Block A Tourist Nook $ 19.06 Lot 2 " " " 26.93 Lot 3 " " " 23.91 Lot & " " " 25.91 Lot 5 " " " 25.91 Lot 6 " " " 25.33 I find that in this sale, lot l, block 4, Whiddon Addition was sold to 0 D Priest for $50.00, and that the following property was sold to Carl Robinson, to-wit: Lot 4 Block B Tourist Nook $ 22.08 Lot 7 " " " 25.80 Lot 11 " " " 17.22 Lot 23 " " " 31.01 Total ~ 96.11 I f~ther find that I was in error in having these lots sold at Master's sale because F D Kitchens had made a deposit on these taxes and I had agreed with him to withold them from the sale. On August 7, 19&7, Kitchens paid the taxes on all of the above described lots which taxes and interest at that time amounted to $206.09. At the same time Kitchens paid the Abstract cost of said lots amounting to $11.OO and my attorney's fee of $10.11 for collecting the taxes. I have discussed this matter with Carl Robinson and have worked out an agreement with him whereby he will deed the four lots which he purchased at the Master's sale to Kitchens and will sign an agreement authorizing the City to refund the amount paid for these lots, to-~it $96.11, to Kitchens. I have not discussed this matter with Mr Priest, but I believe I can reach an agr.eement with him to deed Lot l, Block ~, Whiddons subdivision to Kitchens upon the refunding to him of the $50.00 which he paid in the purchase of this lot. I recommend that the City of Delray Beach authorize these refunds when these lots have been deeded to Kitchens. Since the title to the remaining lots is now held by the City it is mu recommendation that the City issue a Fee Simple Deed direct to F D Kitchens for these lots. I find in checking the foreclosure and the tax receipt, that I received my attorney' s fee in this matter both direct from F D Kitchens and from the City of Delray Beach.
