Mr Andrew Bloetscher, owner of Lot 1, Southways, being part of Lot 28, Section 9, addressed the Council a follows: ,~r Mayor, Mr City Manager Gentlemen of the Comacil Members of the Zoning Commission I withdraw my petition for rezoning of the South of Lot 28, Delray Beach, Florida. Further study, plus new information and facts not previously clear to me now convince me that any rezoning at present of Lot 28 or any p~rt thereof, also including any and all petitions now submitted arid being considered he~. tonight, is not for the best interest of the major~ty of proerty o~ers affected. I believe more harm than good will result should any part of this rezoning be adopted a present. I see no present ~rg~nt need for this rezoning. Therefore, in raima, ss to the objectors, if in order please allow me to make a motion that the Cou~cil reject at this time all petitions now before them pertaining to the rezoniag of any part of~the North Delray between the Atlantic Ocean and the Canal. Yours very truly, (Signed) King S Cone King S Cone, Chairman AD Delray Beach Zoning Board" Mr W J Johnston, representing the Beach Taxpayer's League, addr~.ssed the Council asking that no decision be made on the rezoning of properties on North Ocean Boulevard until all members of the Laague had had an opportunity to study the question, stating that people who had bought property for homes in this vicinity should be protected. Mr Johnston felt that if a change were made it should only change the West 1/2 of the Lots, starting 300' west of the Boulevard, in order to protect homes already constructed on Ocean Boulevard. Attorney J W Nowlin addressed the Council, agreeing with the suggestion of Mr Johnston that the Apartment District be fixed as far back from the Boulevard as possible, or at least 150' west of the west line of the established right-of -way line. Mr Nowltn also recommended that the zoning be changed to a Special Hotel and Apartmemt Zone, rather than an Apartment House Zone allows several types of businesses that would be undesirable in this section of the Beach. Mr Seton Lindsay, Mayor of the Town of Gulfstream, urged the Council not to allow businesses to locate in the northern end of the City. Mr A B Clark, a property owner in this vicinity concurred in the opinion of Mr Nowlin that an apartment zone should be at least 150' west of the west right-of-way line of the Boulevard, or even a greater distance, in order to maintain a residential district between the Boulevard and the apartment district, rather than to allow apartment structures to set back 150' and still front on the Boulevard. APRIL 2?th, Mr Nowlin further recommended that the height of apartment buildings allowed in a Special Hotel and Apartment zone be lowered for this particular section. This suggestion was not considered favorably by the Co,mcil. After further consideration by the Council, a motion was made by Councilman MacNtllan, seconded by Councilman DeWitt, that the recommendation of the Zoning Board affecting Lots 26, 27, and the North 1/2 of Lots 28 and 29, Section 9, be approved, after being changed to read as follows: That the North 9/2 of Lots 28 and 29 and all of Lots 26 and 27, with the exception of the East 200' of Lot 27 and the East 200' of the North 1/2 of Lbt 28, be rezoned as a Special Hotel and Apartment ?~ District, in compliance with the request of the petitioners. Upon call of roll the motion carried unanimously. A motion was then made by Counci]mmn MacMillan, seconded by Councilman DeWitt, that the request of Nr Bloetscher that his petition asking for a change of zoning restrictions affecting Lot l, Southways, be withdrawn, be granted, and upon call of roll the motion carried unanimously. Upon advice of Mr Bruce Puckett, a member of the Zoning Board, that the request for rezoning of a parcel of land at NW 2nd Street and the Seaboard Airline Railway from a Residence "B" Zone to an Industrial Zone had not been considered by the Zoning Board, a :motion was made by Councilman NacNillan, seconded by Councilman DeWitt, that this request be referred back to the Zoning Board for consideration, and upon call of roll the motion carried unanimously. In a motion by Councilman DeWitt, seconded by Councilman Kabler, unanimously carried, the recommendation of the Zoning Board was approved to change the zoning restrictions of Lots &&, &5, and 46, Block 125, from an Apartment House zone to a Limited Business Zone, the Council not approving of the changing of restrictions on Lots 56, 57, 58, 91, 92, and 93, Block 133, Lots 9, 10, ll, Block 125, and Lots 17 and 18, Block ll7 as requested in the same petition. City Manager Black advised the. Council that the widening of SE &th Avenue between the alley and SE 1st Street, and setting back the sidewalk, utility poles owned by the American Telephone & Telegraph Co., and used ~a~ntly by the Southern Bell Telephone and Telegraph Company and the Florida Power and Light Company, would be over 5' from the curb line in the street right-of-way. Mr Black stated that both Companies have plans for changing their lines, putting cables undergromnd, and had asked that an extension of time be granted t o move their poles from the street right-of-way back in the alley. He recommended that for the time being, if the poles are allowed to remain in the Street, that the Street marked for diagonal parking, and that the. Utilit~eCompanies be reeuired to put up suitable guards to make the poles visible day and night. Mr J A Greene, Distribution Plant Superintendent of the American Telephone and Telegraph Company explained to the Council that they were planning on the installation of a dial system in the City, and hope to move the poles during the summer, but asked that they be allowed to leave the poles in the street for the present, stating that all precautions would be taken by marking the poles to avoid any danger. He further stated that if they were compelled to move the poles back against the curb they would do so. City Nanager Black then recommended that the Utility Companies be granted this extension of time with the provision that the City assume, no responsibility for damages due to the position of the poles in the Street. APRIL 27th, 1948 After discussion by the Council action was deferred to allow time for more study of the recuest, to be reconsidered at the next meeting of the Council. City Manager Black advised the Co~cil that he had received two bids in response to invitation for bids on the purchase of a 60,000 gallon water tank, as follows: "City of Delray Bid for Brown Tank Co - $ 1,250.00 (One Thousand Two Huhdred and Fifty Dollars) and request of 90 days to dismantle. If we are the successful bidder, we will furnish you our insurance certificate foz- Contractors Public Liability and ~orkmen's Compensation in the amount of $50,000 - $100,000 and $25,000 Property Damage. Yours very truly, W~W:mj (Signed) W M Whitmire" Eric: A motion was made by Councilman MacMillan, seconded by Councilman Kabler, that the high bid of ,~hitmire Tank Company in the amount of $ 2,198.50 be accepted. When questioned by Councilman DeWitt as to whether the tank could ever be of use to the City, the City Manager advised that it has not been~in operation for a long time, and would reouire painting and other maintenance immediately. Mr Black also stated that fire and emergency pumps will tie into the regular mains and system. Upon call of roll the foregoing motion carried unanimously. A request for tentative approval of a building permit, filed by Mr James A Blake, to construct two duplex efficiency apartments on the rear of Lots 4 and 6, Block 11, 0~eola Park, was presented by the City Manager, who stated that Mr Blake operates a restaurant located on Lot 5. The building would be of con- crete block stucco construction and would not be comnected by a driveway. APRIL 27th, 1948 It was the consensus of opinion of the Council that Mr Blake might intend to construct additional small buildings on the same lots in the future, which would resemble a Tourist Court, which the Cduncil would not approve, and the Building Inspector was requested to ask Nr Blake to reconsider his plans, to construct one larger building, or to arrange his buildings in some way that would not resemble a Court. A letter from the Golf Committee was pressnted, and read as follows: "April 27, 1948 City Council Delray Beach, Florida Gentlemen: At a meeting of the Golf Committee held April 20, 1948, Mr Cleo Johnson was hire~ as Greenskeeper by said Committee at a starting salary of $200.00 per month with the understanding that Mr Johnson is to have a raise in salary at the end of six months. We, the Committee, ask the City Council to cooperate with the Golf Committee in approving this porposition. The Golf Committee also asks the approval of the City Council in lowering green fees and membership dues for five months beginning May 1. The summer rates to go into effect would be as follows: Green Fees - $ 1.O0 per day; Family Membership - $40.00 (for five months); Single Nambership - $25.00 (5 months). We appreciate your cooperation in these matters. City Attorney Moore advised the Council that the Florida East Coast Railway Company, throught their Attorney, had requested an opportunity of appearing before the Council before condemnation proceedings are started to open the NE 1st Street crossing to traffic. A motion was made by Councilman Kabler, seconded by Councilman DeWitt, that representatives of the railroad be heard on any Tuesday night within the next three weeks, and upon call of roll the motion carried unanimously. Mayor Brannon stated that he had received a complaint from Postmaster LeRoy Diggans with reference to the ma~ing of parking areas in front of the Post Office building, stating that cars could not tell where they were supposed to park. The City Manager agreed to have' the parking spaces marked immediately. City Manager Black advised the Council that a short course for City Managers would be given at the University of Florida on %_{ay 20 - 22, and asking the Coua~t's opinion on his attending %his Course.
