A Special Meeting of the City Council of the City of Delray Beach was
held in the Council Chambers at ~:00 P. ~.~. to open bids received for furnishing
and installing two turbine t~e well p~ps and two contrif~a! type se~ice

Proof of publication of noti~e callin~ for bids on the above eeuipment
was presented and spread u~on the minutes as follows:

Sealed proposals w~l be recieved by the City Cocci! of the City of
Delray Beach, Florida the the City Hall, Dclray Beach, Florida, mnt~ &:O0
P. M. ~T, Yay 14th, 19&8, for f~nishing and installing two turbine type
well p~ps, two centrif~al t~ service p~Os, oiping, and a~?urtenance.
Bids will be recieved in two parts as follows:
Part I Consists of two 1.200 g.p.m, turbine type well o~ps installed
comolete with app~tenant controls and installation work.
Part II Con~:~ists of one 1.500 g.p.m, and one 9~ g.p.m, centrif~al
p~p, piping and ~nor app,-tenant eouipment installed in the existing o~p
house.
Specifications and contract doc~ents are open to the public inspection
at tha City Office, City Hall, Delray Beach, Florida or ~y be obtained from
Smith and Cillespie, E~ineers, P. O. Box 1048, Jacksonville 1, Florida,
upon deposit of ~5.00 all of ~ich will be ref~ded to to actual bidders and
~2.50 of which will be ref,mded to non-bidders upon return of the doc~ents
in good condition within ten days 'after date for receiving bids.
No bid may be ~_thdrawn for a period of thirty (30) days after the
scheduled closing ti~ for the receipt of bids.
Bids must be accompained by a certified check or Bid Bond in an amour
not less than five oercent of the bid.
The ~.ner rescues the right to reject any or all bids and to vaive
informalities

As a result of a tabulation of the bids received, Mr. Howard Cromer was
low bidder in the amount of ~. 14,62~.00, the City retaining the equipment to
be removed. However, Mr. %~alker, o£ the firm of Smith & Gillespie, Engineers,
advised
~I. Cromer that no penalties had been specified in the Proposal form
for completion of the work within a certain time, and a_ asked ~r. Cromer if
he would agree to accept a provision for a penalty of ~ 10.00 Der day on hart
1 and ~ 15.00 per day on Part !1, on I-~.is own estimated completion d~te. ~.~r.
Cromer was willing to acce~t this penalt/ p-~'ov~,~-~.~
be increased to 150 days after award of the contract, to allow for delivery of
materials, which was accentab!e to the City ~.~anager and the Enrineers.
A motion was then made by Counci]gnan ~ac~.~illan, seconded by Councilman
Kabler, that the low bid submitted by ~r. Howard L. Cromer in the amount of
~ 14,623 be accepted, for furnishing and installing, complete and ready for
operation two well pumps and two service pumps, accordinF~ to plans and spec-
ifications as prepared b.v Smith & Giilespie, Engineers, subject to a written
agreement by letter to the C~tv that work will start within 30 days and be
completed within 150 days, and in th~ event it is not comoleted within that
time there will be a penalty of * 10.00 per day as to Item '~1 of the bid and
,~,:'~ 15.00 per clay as to Item ,~2 of thc~. bid, and that the !~ayor and City Clerk be
authorized to execute the contract. Upon call of roll the motion carried
unanimously.

City ~anager Black advised the Council that there was aa acc~nu!ation of
fill dirt at the City dumo, and suggested that it be disposed of at th~~ fo!lowin~

75¢ a yard in small amo~ts delivered in the City
6~ a yard sold in amours of 100 yar{]s or over, to be delivered at the
convenience of t~ City.
?'r. Black fu!'ther stated that he wo~d like to make any arramgement subject
to revocation upon receiving complaints.
After consideration by the Co~cil, a motion was made by Co,mclean Kabler,
seconded by Councilman Mac}~illan, that the City },,{anager be authorized to dispose
of fill dirt at the City d~p at 25¢ a yard loaded on customer' s trucks at the
dump. Upon call of roll the motion carried mnanimously.
