Regular Meeting of the City Council of the City of Delray Beach was
held in the Council Chambers at 7:30 P.M. with Mayor M.M. DeWitt in the
Chair, City Manager H.P. Edmond, City Attorney J.W. Nowlin, and the follow-
ing Councilmen present: B.C. Butler, F.B. McNeece, J.B. Smith, and C.J.
White, a quorum being present.
The minutes of the meeting of December 23rd, 19~6, were presented and
approved as written.
In a motion made by Councilman McNeece, seconded by Councilman Smith, and
unanimously carried, bills totaling $29,368.25 were approved for payment, sub-
Ject to the approval of the Finance Committee.
Upon recommendation of the City Manager, the City Attorney was instructed
to prepare an amendment to License Ordinance No. G-ii, to add the following
classifications:
Private Schools $25.00
Nursery Schools - 1 to 15 pupils 10.00
Nursery Schools - Over 15 pupils 15.00
City Manager Edmond presented the application of Mr. Wm. H. Deaderick for
a permit to construct a temporary building on Lot 6, Block 93, which is being
used as a parking lot, stating that the building would be 35' from the east
side of the lot and 65' from the alley on the north side, further stating that
a contract has been signed by Mr. Deaderick agreeing to remove the building
upon request of the City at any time after two weeks written notice.
A motion was made by Councilman Butler, seconded by Councilman White, that
building permit be granted as requested, and upon call of roll the motion carried
unanimously.
A tentative plat of a Resubdivision of Ida Lake Terrace was presented by
the City Manager for the approval of the Council.
After consideration, it was the consensus of opinion of the Council that
final plat will be approved if it conforms with this tentative plat.
There being no further business to come before the retiring Council,
Mayor DeWitt thanked the members of the Council for their cooperation during
the past year, as well as all City Departments, stating that Mr. H.P. Edmond,
City Manager, had been of great assistance to him, and that Mr. J.W. Nowlin
had done fine work as City Attorney. Mr. DeWitt also expressed his apprecia-
tion to the various Boards and Committees for their assistance to the Council
during the year.
Council then adjourned sine die.
January 6th, 19&7.
The annual Organization Meeting of the City Council of the City of Delray
Beach was held in the Council Chambers at 8:00 P.M. with City Manager H.P.
Edmond, City Attorney J. W. Nowlin, and the following Councilmen present:
B.C. Butler and F .B. McNeece, and the newly elected Councilmen M.M. DeWitt,
J.B. Smith and C.J. White present.
The oath of office was a~ministered to the newly elected Councilman by the
City Clerk, after which nominations were called for for the office of Mayor for
the coming year.
Councilman M.M. DeWitt was nominated for Mayor by Councilman White, and the
nomination was seconded by Councilman McNeece.
Mr. DeWitt then stated that he thought the office should be passed around~
and he would like to have his name withdrawn, Mr. McNeece replying that the
Councilmen had all enjoyed working with him as Mayor and would like to continue
through 19~7.
A motion was made by Councilman White, seconded by Councilman McNeece, that
nominations be closed, and upon call of roll the motion carried unanimously.
Mr. M.M. DeWitt was then declared elected Mayor for the coming year, in a
motion made by Councilman White, seconded by Councilman Smith, and unanimously
carried.
Mr. J.B. Smith was then nominated by Councilman Butler for the Office of Vice-
Mayor, and Councilman Butler was nominated by Councilman Smith for this office. A
ballot was taken, as a result of which Mr. B.C. Butler was elected Vice-Mayor.
Mayor DeWitt announced that all appointments would be made at a later
meeting, and requested that all City employees continue in their present positions
until the next regular meeting to be held January 13th, 19~7.
Mr. Kenneth Montgomery addressed the Council, expressing his satisfaction with
the Councilts actions during 19~6, and stated that it deserves a great deal of
credit for what it has accomplished.
Mr. Stevenson, being in the audience, asked that Mr. Edmond explain his plan
for the drainage of Nassau Street.
City Manager Edmond presented a plan prepared by M.B. Garis, Engineer, and
asked the Council to approve the plan, recommending that they connect the end
of Nassua Street with the drain at Gleason Street, which would be connected with
an open ditch through Shulson Street to the C~nal, stating that the open ditch
would be a temporary measure, and that later a right of way would be obtained
through the Reid development to the Canal.
After discussion, a motion was made by Councilman White, seconded by Council-
man McNeece, authorizing the City Manager to proceed with this work at once, in
accordance with his recommendations, and to advertise for bids for the digging of
the open ditch through S hulson Street. Upon call of roll the motion carried
unanimously.
The resi&~ation of Miss Marjorie P. Winn, Deputy Clerk in the Water Depart-
ment, was presented and read in full.
Upon motion of Councilman Butler, seconded by Councilman McNeece, the
resignation of Miss Winn was accepted.
January 6th, 19~7.
The following Ordinance was then brought up as an emergency measure, and same
was read in full:
ORDINANCE NO. G-20
AN EMERGENCY ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF D~.RAY BEACH, FLORIDA, REGULAT-
ING AND CONT~0LLING THE USE OF THE CITY DOCKS
IN THE CITY OF DELRAY BEACH, FLORIDA ON THE
FLORIDA INTRACOASTAL CANAL.
BE IT ORDAINED by the City Council of the City of Delray Beach, Florida, as
follows:
SECTION 1. That the City of Delray Beach hereby adopts the following rates
for charges for the use of City docks located on the Florida Intracoastal Water-
way between S.E. First Street and S.E. Second Street:
cHARGEs:
Dock No. I ............. Minimum charge of 20 feet
Docks No. 2 to 7, inclusive .... Minimum charge of 30 feet
Docks No. 8 to 18, inclusive .... Minimum charge of 50 feet.
Rates per week or fraction thereof . &¢ per day per foot
Per month ............. 3$ per day per foot.
The above rates shall include free City water and free garbage collection, but
shall not include electric service for which an additional charge of 1½$ per foot
per day shall be made.
SECTION 2. That the City Manager be and he is hereby authorized to appoint
a dock .master subject to the approval of the City Council at a monthly salary of
$60.00. The dock master shall be responsible for the proper operation and main-
tenance of the City Docks and shall be given special police power for the City
dock area only. He shall formulate proper rules and regulations for the operation
of City docks which shall be approved by the City Council, and the failure of any
user of the City dock to abide by such rules and regulations shall constitute a
misdemeanor and the violator thereof shall be subject to a fine of not exceeding
$50.00 or imprisonment in the City Jail not exceeding 30 days or by both fine and
imprisonment in the discretion of the municipal court.
SECTION 3. The City Clerk is hereby directed to furnish the dock master with
proper forms for the registration of each boat using dockage space at the City
docks. Such forms shall show the name of the boat, the name of the owner, the
dock space assigned, length of boat, the date and time of arrival and the dockage
fee paid. All fees shall be paid in advance for the period of occupancy, but no
payment shall be required in advance for more than one month at a time. The form
to be used by the dock master will have a clause therein releasing the City from
any liability for any damage caused by the condition of the docks or the use
thereof by the boat owner.
SECTION ~. The dock master is hereby directed to give preference in the
reservation of dock space to property owners of the City of Delray Beach and to
turn over weekly to the City Treasurer all sums collected by him for dock rental.
This is an emergency ordinance and its passage is necessary for the
preservation of public property and the proper operation of municipal doCks
and it shall become effective upon its passage on first and final reading on
this the 6th day of January, 19~7.

A motion was made by Councilman White, seconded by Councilman McNeece,
that the foregoing Ordinance No. G-20 be passed and adopted as read, and upon
call of roll the motion carried unanimously.
Mr. Edmond recommended that Mr. Frank Seely, Jr., be appointed Dock
Master, whereupon a motion was made by Councilman McNeece, seconded by Council-
man Butler that Mr. Edmond's recommendation be approved, and that Mr. Seely
be appointed Dock Master, and that he be bonded in the amount of $500.00. Upon
call of roll the motion carried unanimously.
Council then adjourned to the next regular meeting to be held January
