Regular meeting of the City Council of the City of Delray Beach was
held in the Council Chambers at 7:30 P. M. with Mayor'M. M. DeWitt in the
Chair, and City Manager H. P. Edmond, City Attorney J. W. No,lin, and the
following Counc~lm~n present: B. C. Butler and J. B. Smith, a quorum being
present.
The minutes of the meeting of the Council held on June 10th were presented
and approved .as written.
Councilman Butler, as Chairman of the Finance Committee, rec~mnem/ed that
a deficit of $ ~9.72 incurred from a recent Tennis Tournament, be paid by the'
City, and in a motion made 'by Councilman Smith, seconded by Councilman Butler,
this reccemendation was approved, check to be paid to the De]may Beach Tennis
Committee for this amount.
The following communication from Elton Harvel, offering to sell two pieces
of used road equipment to the City, was read as follows.'

I am wanting to sell two pieces of my road equipment, and if you are in-
terested, I am willing to give you an excellent price on then~
One piece of equipment is a No. 12 Caterpillar Road patrol in axzellent
mechanical condition, but with tires about half worn; this machine, when new,
cost about $ 8,000.00, ar~ I will quote you a price of $ 2,500.00.
The other piece of equipment is a new Huber 5 to 8 ton roller which, when
purchased, cost about $ ~,?00.00 ard ~as been used less than thirty hours;
this I can price to you at $ 3,500.00.
If at this time it is not convenient to pay cash, terms can be arranged
to war convenience.

A letter from the Florida C~orgia Tractor Co. with reference to a Dozer-Shovel
which they can furnish immediately, for use in the Street Department, was read as

City Manager Edmond explained that a tractor of this type had been ordered
several months ago, and delivery had been promised by May 15th, but up until the
present time it had not been shipped, and as they were now able to purchase this
equipment at a better price, for immediate delivery, he w~uld recommend that the
Bucyrus-Erie Dozer-~hovel be purchased at a price of $ 6,713.~0, as submitted by
the Florida-Georgia Tractor Co. of Miami.
Mr. Edmond was authorized by the Council to advertise for bids on this equip-
ment, to be received at 10:00 A. M. on Ju~ 2nd, 19~7.
A letter from Mrs. Marc He Segnitz of Miami Beach was read as follows:

3 - That I will be permitted to run a driveway to the premises through the strip
of land, designated as a City Park, which extends along Marine Way, in
front of said premiaes.

Mr. Edmond advised the Council that the property referred to is located in
an~'..Apartment House District. He also stated that he would reco,,,end moving the
Dock Master' s office to the east side of Marine Way at the south end of the City
Park, which would be more accessible to boat owners, but that he did not favor
allowing property owners to build private drivaways through the City Parkway,
suggesting that a road be paved between Block 126 and the City Parr for the use
of' property owners in this Block.
City Attorney Nowlin stated that an agreement had been made by the City
several years ago whereby, owners of property fronting on the City Park, in
Block 126, paid for the paving of Marine Way in exchange for the privilege of
cutting private driveways through to their property when they improved it.
Action was withheld on the request of Mrs. Segnitz until City records
could be checked as to any agreement entered into by the City when Marine Way
was paved.
An application 'filed by W. H. Frey .for permit to add a screened porch and
kitchen to an accessory b,,~_ding on the rear of Lot 2, Block 2, Sophia Frey Sub-
division, on the North Fede. ral Highway, was presented by Mr. Edm~nd, who stated
that all set-backs and restrictions wo,,]a be coe~lied with, and that two single
family b,,~ldings are allowed in this Residence "B" Zone, whereupon a motion was
made by Councilman Butler, seconded by CouncLlman Smith, that permit be granted as
requested. Upon call of roll the motion carried unanimously.
The following letter from Allen M. Bond, proposing extension of the City
limits north along the Canal, was read:

Gentlemen:
Since no progress seems to have been made with respect to taking into
the City the area between Delray Beach and Boynton, may I suggest that we try
taking a line 700 feet west of the Intracoa'stal Canal right-of-way running
north following the Canal to the north boundary of Snow Hill.
This will e]/minate from the contest voters along the Highway who oppose
the plan and would only include 3 or ~ voters in Hacienda, all ~f whim I think
are homesteaders and should not oppose it. How should we proceed to accomplish
this if you favor it? There will be _many nice homes built along the canal as
soon as building costs get down a little more and their taxes should carry the
expense the City m~ht assume in carrying water and other services to the area.
Hrs. Arkell and her Doctor have bought Lots F and G in Kenmont, and I propose
to bring Palm Trail from the north end of Snow Hill to Bradshaw. 'Have a buyer
for Bradshaw who will at once carry it through to Frey Subdivision. Surely
those south of Bradshaw will cooperate and connect it with O'Neil's dead end.
Should the bridge go to 8th Street, this whole section will develop
~,,,ediately and will make a desirable addition to the City, in my opinion.
The town is grc~ing northward rapidly and should be encouraged to continue.
If you would like me to come before the Council or its Committee and give
you further details, together with maps showing proposed extension of Palm Trail
and any other information, I will be glad to do so at any time. I am sure that
the property owners to be taken in are of the type who will want fire protection,
police protection, garbage cOllection and water, although water is plen*.iful and
wells and pumps are cheap. If you do not care to carry water to the then City
limits, I think we can get along 'without it until the City is able to get it out.

The foregoing request was referred to the City Attorney to ascertain whether
this section could be taken into the City without first having the approval of
the State Legislature.
Mr. Edmond presented an application for building permit, filed by Harry G.
Baer, to build a garage with living quarters attached,in the rear of an existing
building on Lot 13, Block 106, stati~ that the plans conformed with all requirements.

In a motion made by Counc~lm~n Smith, seconded by Councilman Butler,
unanimously carried, pe~mlt was granted as requested.
An application for permit to build a frame Display Building on Lots 22
and 23, Haller& Groatman's Subdivision, filed by Lindsley Lumber Co., was
presented f~r approval. Mr. Edmond explained that the size of the building
and the set-backs were all in order, but action 'on the permit was withheld
until it could be determined whether the applicant intended to store
and building material in an open yard in the rear of the b,,~l ding, which is
prohibited in a Local Business Zone.
With reference to a tentative request fc~ permission to operate a Skating
Rink in an Industrial Zone in the vicinity of the Seaboard Railway, Council
expressed its approval of such a project if properly located, and complying with
all restrictions.
Councilman Butler advised the Council that a letter had been written to Mr.
Jack Boucher, former Tennis Professional, by the Tennis Committee, stating that
the City Council had recommended the employment of Mr. Herman Peterson for the
coming season. Mr. Butler explained that this had been the recommendation of
the Tennis CommTttee, and should have been so stated.
Mayor DeWitt offered to contact the Chairman of the Tennis Committee and
have a correction of this statement made to Mr. Boucher, a copy of the letter
correcting this erroneous statement to be filed with the City Council.
Mr. Dunbar, representing the State Road Department, addressed the Council
asking that a Resolution be passed agreeing to deed a ~0' strip of land south of
the center line of West Atlantic Avenue from the canal to the City limits, a
distance of about 1/~ of a mile, to Palm Beach County to be used as a right-of-way
for road purposes.
After a verification of the description of the land involved, the following
Resolution was presented, and same was read in full:

A motion was made by Councilman Butler, seconded by Councilman Smith,
that the foregoing Resolution No. 625 be passed and adopted as read, and upon
call of roll the motion carried una~usly.
Mr. John A. Thayer, President of the Delray Beach Board of Realtors, then
addressed the Council, stressing the fact that the members of the Realty Board
were trying to maintain a high standard of practice in the real estate business,
~n order that the c~..m,-~ty might develop along constructive lines, and urging
the City to rigidly enforce their sign Ordinance with regard to the use of signs
advertising properties for sale.
Mr. Thayer also asked the Council to adopt a policy whereby a Broker from
another c~nmunity, with no previous interest in the City, could not come into
the town and he granted a license to engage in the real estate business, suggest-
lng a requirement of six or twelve months residence in the City, or requiring
the applicant to pass an examination before being granted a license, as required
in other nearby Cities. Mr. Thayer stated that the most valuable asset of the
City is its real property, and asked that the matter be given serious thought.
Mr. T~ayer was assured that the Council would give it aL1 consideration.
In a motion made by Councilman Butler, seconded by Councilman Smith, payment
of a bill in the amount of $ 509.80 was authorized to Mr. E. E. Hagerman for work
done and materials furnished for painting the Beach Pavilion, which work was
authorized by the City Council on September llth, 19&4, and which Mr. Hagerman
claimed was not completed until October of 1946, as he was not able to buy the
paint specified for the completion of the work.
Mr. W. A. Jacobs, who was a member of the Council at the time the contract
was awarded, verified the fact that the work had been done by Mr. Hagerman, al-
though it had been delayed by the lack of the specified paint, and it was upon
Mr. Jacob's statement of these facts that the b~l~ was approved for payment.
Mayor DeWitt was appointed to serve as a member of the Finance Committee in
the absence of Counctlm-n McNeece.
In a motion made by Councilman Butler, seconded by Councilman Smith, and upon
call of roll unanimously carried, bills to~ling $ 23,690.67, having been approved
by the Finance Committee, were ordered paid.
JUNE 2~TH, 19~7.
Councilman Butler, Chairman of the Finance Committee, advised the Council
that an offer had been received from Ogden & Co. of Ft. Lauderdale, to sell
$ 5,000.00 City of Delray Beach Refunding Bonds O 98 7/8 plus accrued interest,
and recommended the purchase of same by the City.
In a motion made by Councilman Smith~ seconded by Councilman Butler, and
upon call of roll unanimously carted, the recommendation of the Fina~e Committee
was approved.
Council then adjourned.
