ITEM BEFORE COMMISSION:
The City Commission is requested to approve award to Minolta Business
Systems, Inc. for the lease of two photocopiers to be utilized by the Delray
Beach Fire Department Headquarters.
BACKGROUND:
The Delray Beach Fire Department currently has two leased Konica
photocopiers through Danka Industries, located in Fire Headquarters, and the
leases will be expiring on February 2, 1999. Quotes were solicited from four
vendors, Danka, Ikon, Copyco and Minolta. (Please see attached tabulation of
bids and quotes.)
After reviewing the features and prices of all bids submitted, Fire Chief Rehr
recommends leasing the following:
1. Minolta EP2080, 36 month lease, $221.69 per month (with one time
installation fee of $115.00) includes 15,000 copies per month, service and
all consumable supplies (except paper and staples). Overage charges
will be billed at the rate of $0.0139. (Total lease cost including installation
fee $8,095.84)
2. Minolta EP5000, 36 month lease, $304.00 per month (with one time
installation fee of $132.00)includes 30,000 copies per month, service and
all consumable supplies (except paper and staples). Overage charges
will be billed at the rate of $0.00993. (Total lease cost including
installation fee $11,076.00)

The Chief Rehr recommends the 36 month lease of two Minolta copiers from
Minolta Business Systems, Inc. at the total cost of $19,171.84 per the attached
memorandum dated January 26, 1999. Pricing is per Florida State Contract

The Minolta EP5000 copier Class 11 of the State Contract (600-380-97-1) is my
recommendation to you. Under Class 11 of the State contract, the department is allowed
to generate up to 30,000 copies per month at no overage charge. The monthly rate
includes service and all consumable supplies (except paper and staple) at no additional
charge.
The 36- month lease price for the EP5000 with a 2,700 -paper sheet cabinet is $304.00 in
addition to a one time installation fee of $132.00. The pr/ce includes an automatic
reversing document feeder, duplexing capability, 2,700 paper feed cabinet and a 20-bin
stapling sorter with 3-hole punch capability.

ITEM BEFORE COMMISSION:
The City Commission is requested to approve award to Minolta Business
Systems, Inc. for the lease of a Minolta EP 5000 photocopier to be utilized by the
following divisions of the Delray Beach Parks And Recreation Department:
Afterschool Program; Administration; Athletics/Special Events; and the
Community Center.
BACKGROUND:
The Delray Beach Parks And Recreation Department currently leases a Canon
NP 4050, and that lease expires on February 14, 1999, The Canon NP 4050
copier is utilized by the Afterschool Program, Administration Division,
Athletics/Special Events Division; and the Community Center Divisions of that
department. Quotes were solicited from Ikon Office Solutions, Copyco, and
Minolta Business Systems, Inc. (Please see attached tabulation of bids and
quotes.)
After reviewing the features and prices of all bids submitted, the Director of the
Parks and Recreation recommends leasing the following from Minolta Business
Systems, Inc:
Minolta EP 5000, 36 month lease, $365.95 per month (with one time
installation fee of $132.00. Lease includes 55,000 copies per month,
service and all consumable supplies (except paper and staples) and 2,700
sheet paper feeding cabinet. Overage charges will be billed at the rate of
$.006500. (Total lease cost including installation fee $13,174.20)

The lease agreement for our current copy machine expires February 14,1999. The current
machine is a Canon NP4050 which is 3 years old and over the past year has required
frequent service and repair calls.
The lowest of the three bids for the new copy machine is a Minolta EP 5000 class 14 per the
State of Flodda Contract # 600-380-97-1. The new machine will cost $359.95 per month
based on 55,000 copies per month with a copy overage of $.006500 per copy and includes
monthly maintenance, service and toner supplies. With an extra $6.00 a month the copy
machine will store 2700 sheets of paper in the feeding cabinet and the total per month is
$365.95. Current cost is running approximately $470.00 per month or $5,650.00 annually.
Mid-year budget transfers will be required to meet these costs as well as proposed new
contractual costs which are lower but still above budget. We had projected and budgeted for
15,250 copies per month but the average actually is running around 30,000 copies per
month, which was the final monthly average for FY98.

Inc. for one year for valet parking.

Attached is a request received from Mr. Fran Marincola on behalf of Cafe Luna Rosa, Inc. to
allow his company to utilize the fourth through the seventh parking spaces on the south side of
Atlantic Avenue west of A-1-A for a valet parking queue Monday through Friday $:00 p.m. to
1:00 a.m. and on Saturday's and Sunday's from 11:00 a.m. to 11:00 p.m.
The Parking Management Advisory Board has reviewed this request and recommends approval
(7-0) with the stipulation that day time valet parking on Saturday's and Sunday's be allowed as a
trial period for six (6) months.
Attached for Commission consideration is a License Agreement which incorporates changes
approved by City Commission on January 12, 1999.
RECOMMENDATION
Staff recommends approval of the "Parking License Agreement" with Cafe Luna Rosa, Inc.
contingent on receiving:
1. A lease agreement or written authorization from the private lot owner.
2. A certificate of insurance as required.

PARKING LICENSE AGREEMENT
THIS AGREEMENT ("The Agreement") is made this __ day of , 199
by and between the CITY OF DELRAY BEACH, a Florida Municipal Corporation (the
"CITY"), and CAFFE LUNA ROSA, INC. a Florida corporation ("LICENSEE").
WITNESSETH:
WHEREAS, LICENSEE has requested permission to use a certain number of public
parking spaces along Atlantic Avenue and certain side streets for valet parking queues; and
WHEREAS, in order to use the parking spaces, the CITY requires that LICENSEE
enter into this non-exclusive License Agreement.
NOW THEREFORE, in consideration of the sum of Ten Dollars ($10.00), the mutual
covenants and conditions contained in this Agreement, and other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, the parties
hereby agree as follows:
1. Incorporation of Recitals. The parties hereby represent and warrant that the
above recitals are accurate and correct and hereby incorporate them in this Agreement.
2. Parkinl~ Queues. The CITY agrees to allow LICENSEE the non-exclusive
use of four (4) parking spaces located on the fourth through seventh spaces on the south side
of Atlantic Avenue, west of A1A for valet parking queues. The parking spaces are to be used
for valet parking queues daily between the hours of 5:00 p.m. and 1:00 a.m., Monday through
Friday and between the hours of 11:00 a.m. and 11:00 p.m. on Saturday and Sunday.
LICENSEE acknowledges that the valet parking queues may be unavailable for use during
certain special events from time to time (as determined in the CITY's sole discretion) and
during the special events the license will not be valid. It is also understood by the terms of
this Agreement that the valet queue location may from time to time be re-located by the CITY
in its sole discretion after providing thirty (30) days' written notice to LICENSEE. The valet
queues assigned may also be shared by other licensees who enter into a "Valet Parking License
Agreement" with the CITY. The City Police Department is assigned enforcement
responsibilities for the provisions of this agreement regarding the location, time, days of the
valet service, parking limitations and requirements, and compliance with all applicable laws
and ordinances.
3. Parking Locations/Agreements. LICENSEE agrees that it will not park any
cars in CITY owned on-street or off-street parking spaces. LICENSEE further agrees that
LICENSEE will provide the CITY with written assurances and/or a lease agreement for use
of a private parking lot(s). The private lot(s) must also comply with minimum City codes for
a parking lot(s). These assurances and agreements must be provided upon execution of this
License Agreement. Failure to comply with these conditions will be a basis for termination of
this License Agreement.
4. Payment for Parking Queue Spaces. LICENSEE agrees to pay the CITY
fifty dollars ($50.00) per month, per parking queue space utilized by the 10th of each month.
A late fee of 5 % will be charged after this date. If more than one License Agreement is issued
for the queues, the fee will be shared proportionately.
5. Signage. The CITY agrees to post the valet parking queue spaces with valet
parking times and days authorized. Sandwich board signs may not be used to advertise the
valet service. Advertising signs will be allowed as prescribed by the City's Manager or his
designee.
6. Valet Equipment. The LICENSEE'S operator may for the storage of keys
install a moveable, temporary, valet desk on the sidewalk, either public or private, during the
hours of valet service so long as the desk does not impede the pedestrian flow.
7. Term and Renewal. The term of this Agreement shall be for one year from
the date written above. The license may be renewed annually by the City Manager following
receipt of a written notice from LICENSEE that LICENSEE desires to continue using the
parking spaces for valet parking queue, if the City Manager determines in his sole discretion
that the renewal is in the best interests of the CITY.
8. Revocable License. This Agreement is only a non-exclusive License
Agreement and may be revoked by the CITY at anytime without cause upon providing written
notice via U.S. Mail to LICENSEE. The revocation shall be effective when mailed.
9. Compliance with Laws. LICENSEE agrees to comply and adhere to all state
laws and local ordinances regarding parking that exist or as amended from time to time.
LICENSEE further acknowledges that due to the high traffic in this area, double parking
unattended vehicles will not be permitted.
10. Notice. Notices required to be provided pursuant to tlxis Agreement shall be
sent to the following addresses:

11. Insurance. LICENSEE agrees to provide the CITY insurance for the valet
service in the amounts and under the conditions prescribed in Exhibit A and the City of Delray
Beach shall be named an additional insured.
12. Indemnification. In consideration of the payment of Ten Dollars ($10.00),
receipt of which is hereby acknowledged, LICENSEE shall protect, defend, indemnify and hold
harmless the CITY from and against any and all claims, suits, actions, damages and/or causes of
action arising during the Term of this Lease for any personal injury, loss of life and/or damage to
property sustained in or about the parking spaces/queues by reason or as a result of the use and
occupancy of the parking spaces/queues by LICENSEE, its agents, employees, licensees,
invitees, and members of the public generally, and from and against any orders, judgments,
and/or decrees which may be entered thereon, and from and against all costs, attorney fees,
expenses and liabilities incurred in and about the defense of any such claim. In the event the
CITY shall be made a party to any litigation commenced against LICENSEE or by LICENSEE
against any third party, then the LICENSEE shall protect, defend, indemnify and hold the CITY
harmless and pay all costs and attorney's fees incurred by the 'CITY in connection with such
litigation, and any appeals thereof.
13. Third Parties. Nothing in this Agreement, whether express or implied, is
intended to confer any rights or remedies under or by reason of this Agreement upon any
person other than the parties hereto and their respective heirs, successors, legal
representatives, and permitted assigns, nor is anything in this Agreement intended to relieve or

discharge the obligation or liability of any third persons to any party to this Agreement, nor
shall any provision thereof give any third person any right of subrogation or action over or
against any party to this Agreement.
14. Termination. LICENSEE acknowledges that the CITY may terminate this
non-exclusive License Agreement for cause for any violation of any terms and conditions
contained herein without notice unless otherwise specified, and this agreement shall be
immediately deemed null and void and shall have no further force and effect. LICENSEE
will at all times comply with the City's policy/procedure for use of public parking
spaces/queues which shall change from time to time subject to the sole discretion of the City.
15. Taxes. LICENSEE shall pay and comply with all laws regarding taxes, levies,
assessments, fees and charges, including, but not limited to gross receipts, taxes, use taxes,
property taxes, and sales taxes that may be imposed.
16. Assignment. This Agreement shall not be transferred or assigned without the

17. Further Assurances. The parties shall from time to time execute and deliver
such other and further instruments and documents and do all matters and things which may be
convenient or necessary to more effectively and completely carry out the intent of this
Agreement.
18. Binding Effect. All of the terms and provisions of this Agreement shall be
binding upon, inure to the benefit of, and be enforceable by, the parties hereto and their
respective heirs, successors, legal representatives, and permitted assigns.
19. Entire Agreement. This Agreement shall constitute the entire agreement of the
parties with respect to the subject matter of it. All prior understandings and agreements
between the parties with respect to such matters are merged into this Agreement, which alone
fully and completely expresses their understanding.
20. Amendments. This Agreement may not be amended, modified, altered, or
charged in any respect, except by a further agreement in writing duly executed by each of the
parties hereto.

1. Worker's Compensation per the Statutory limits of the State of Florida to include
Employer's Liability Insurance with limits of at least $100,000/$500,000/$100,000.
2. Garage Liability Insurance of at least $1,000,000 combined single limits per
occurrence to protect the City against all risks of injury to persons (including death)
or damage to property wherever located resulting from any action or operation under
the contract or in connection with the work. This policy is to provide coverage for
premises/operations including auto liability, independent contractors, broad form
contractual liability, products/completed operations. The liability insurance coverage
shall extend to and include the contractual indemnity and hold harmless agreement
exactly as written in "Insurance Requirements", Section 9 of this RFP.
3. Garage Keepers Insurance with limits of no less than $60,000 per auto, with an annual
aggregate of $500,000.

Attached is a copy of the request for installation of traffic calming on Highland Avenue,
together with a copy of my most recent letter to the Neighborhood Association. You will
also find attached a report on enforcement by the Police Department, and the results of
our most recent traffic volume and speed study on this street.
The staff agrees that Highland Avenue is a candidate for traffic calming. In the opinion
of staff, however, neither the volumes nor the speeds justify giving this location a higher
priority than a number of other locations in the City. But, if you feel that the Golf
Course is the primary generator of traffic volumes and speeds on this street, then you
might justify using Golf Course Funds to pay for traffic calming at this location. In that
case, funding could be made available more quickly. Otherwise, I recommend that this
project be evaluated along with other General Fund capital needs of the City when our
next five-year capital budget is developed this spring.

The purpose of this letter is to reque$~ a meeting with the city commission to
discuss traffic calming measures on Highland Avenue. We feel that your reply
dated January 5, 1999 was unsatisfactory because pedestrians are at an
extreme risk of being injured or killed by vehicles traveling at excessive speeds to
and from the golf course. We cannot wait until some unspecified future date
based on priorities in the city's Capital Improvement Plan. Instead, we seek
immediate relief due to the urgency of the situation.
On behalf of the Homewood Park/Golfview Estates Neighborhood Association,

Would there be adequate space in the intersection of Highland Ave. and
Snyder Dr. to install a traffic roundabout?
Would the City be willing to join our Association in a partnership for the
design, planting and maintenance of this traffic roundabout?
Please have Staff explore the possibility of entering into such a partnership
project. We would be happy to send representatives to the DSMG meeting to
discuss our ideas.
Before closing, two other issues were brought up during the meeting that we
would like to bring to your attention. The first issue is inadequate signage to the
golf course. The overhead road sign to Homewood Boulevard is not visible to
traffic heading westbound on Atlantic Avenue. This, combined with an
inadequate directional sign to the golf course at Highland and Homewood, may
be causing golfers to be late, thus contributing to excessive speeds. The second
issue brought up was excessive traffic speed on Homewood Boulevard. We
request that the city look into the signage problem and initiate speed analysis on
Homewood Boulevard.

The validity, interpretation and accuracy of the study submitted by Pubhc Works
needs clarification and explanation.
· What do the AM/PM peaks hour percentage totals mean?
· Can the AM/PM peak hour totals be East/West specific?
· Are the counters calibrated, and accurate?
· What does the speed summary mean and how is it relevant and reliable?
As you know, we conducted selective on 9/9 & 9/10/97, using the laser. The
officers conducting the study were not visible to the targeted population. In the two
day study during the a.m. peak period, 121 vehicles passed through the selective.
No drivers would have received a citation based on current law enforcement
standards. A more comprehensive study was conducted on 9/10, which broke the
u-affic pattern down between east and west. The average speed for eastbound traffic
was 24.5 mph, westbound was 23.1 mph. Based on our two day a.m. peak hour
study, speed is not a real problem on Highland Avenue.
I would recommend that a meeting be set up with the responsible parties to review
our questions and resolve the disparities between studies.

Attached is a copy of the traffic study taken on Highland Avenue over a 24 hour period
from 2/4 - 2/5. Counter//2 was located at the east end of Highland Avenue and counters
4 and 5 at the west end. The posted speed for this street is 25 m.p.h.
The average speed at location #2 was 31.8 m.p.h., location #4 was 22.5, and at location
#5 westbound 24.5 m.p.h. I have a concern with the traffic counter location #2 because
three of the busiest times did not show up on the report. We will reran this location on
Monday.

Seacrest/Del Ida Neighborhood Improvements Phase 1
HOA Request for Information
The Project Scope and Schedule for Phase1 are attached.
Roundabouts will be constructed at NE 3rd Ave & 10th St.
and at NE 3rd Ave. & 12th St.
= NE 14 St Improvements will be included in Phase 2.
Additional Swinton and Seacrest Ave. intersection calming utilizing
elevated intersections was not identified in the neighborhood plan and
will not be implemented in Phase 1.
Palm Beach County Traffic Engineering completed a traffic study at the
intersection of Swinton Ave. and George Bush Blvd. and concluded that
a traffic signal was not warranted.
Truck Traffic restrictions and signage improvements on Swinton &
Seacrest Avenues will be reviewed by the Development Services
Management Group.
Landscaping at divided medians will be designed by the City. Sight
distance at intersections will be reviewed and incorporated into final
design plans.
Local residences do not support two way traffic on Lake Court.
New infill sidewalks will be provided on NE 7th St., NE 5th St., &
Fern Court.
Some Sidewalks have been repaired through the City's annual sidewalk
maintenance program; the remaining repairs will be included in Phase 2.
Streetscape and Drainage Swale improvements will be incorporated into
the Phase 1 Design Plans.
Nancy Davilla has completed the landscape plans for NE 3rd Ave. FEC
buffer.
Engineering & Planning will be working with the City Attorney's office in
the establishment of the Special Assessment District.

Re: Seacrest Redevelopment Plan
Dear David:
I attended the Seacrest Property Owners' Association meeting on
January 12, 1999. The president of the association and a number
of residents expressed concern about what they perceive is a
delay in the implementation of the neighborhood plan.
If there is room on the February workshop agenda, I would like to
have this matter placed on the agenda. I would like staff to
give the commission a presentation on the progress of the plan
and what they hope to accomplish during this fiscal year.
