Res 85-02RESOLUTION NO. 85-02 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AUTHORIZING THE CITY TO PURCHASE FROM SI~JJ.ER, THE LAKE WORTH DRAINAGE DISTRICT, CERTAIN REAL PROPERTY IN PALM BEACH COUNTY, FLORIDA, GENERALLY DESCRIBED AS APPROXIMATELY 35 FEET NORTH OF THE L-33 CANAL LYING IN A PORTION OF SECTION 18, TOWNSHIP 46 SOUTH, RANGE 43 EAST AND LYING WITH THE LAKE WORTH DRAINAGE DISTRICT CANAL AS MORE PARTICULARLY DESCRIBED HEREIN; HEREBY INCORPORATING AND ACCEPTING THE LETI~ER AGREEMENT STATING THE TERMS AND CONDITIONS FOR THE SALE AND PURCHASE BETWEEN THE CITY OF DELRAY BEACH, FLORIDA, AND THE LAKE WORTH DRAINAGE DISTRICT AND AUTHORIZING THE CONVEYANCE OF AN EASEMENT TO THE LAKE WORTH DRAINAGE DISTRICT OF LAND IS GENERALI.Y DESCRIBED AS THE PROPERTY 40 FEET SOUTH OF THE L-33 CANAL AND AS MORE PARTICULARLY DESCRIBED IN ACCORDANCE WITH THE TERMS SET FORTH HEREIN. WHEREAS, the Lake Worth Drainage District desires to sell to the City the property hereinafter described in Section 1 to the City of De[ray Beach Florida; and WHEREAS, it is in the best interest of the City of De[ray Beach, Florida, to purchase said property to accommodate the new Atlantic High School site and to transfer a replacement easement to the Lake Worth Drainage District as described in Section 2. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOI J JOWS: Section 1. That the City Commission of the City of Delray Beach, Florida, as Buyer, hereby agrees to purchase from Lake Worth Drainage District, as Sellers, for the purchase price of $2.50 per foot in Exhibit "A" affixed hereto, and other good and valuable consideration; said parcel being more particularly described. Section 2. That the City shall convey an easement to the Drainage District over the property described in Exhibit "B" affixed hereto. Section 3. That the terms and conditions contained in the letter agreement sets forth the terms and conditions of the transaction and is incorporated herein as Exhibit "C". 2002. To sell the subject parcel to The City of Delray Beach for the fair-market value of $2.50 per sq. ft..
