ITEM BEFORE COMMISSION The City Commission must authorize a proposed millage rate for FY 2013 in accordance with State TRIM guidelines. BACKGROUND The City Commission is required each
year to submit a proposed millage rate in accordance with State TRIM guidelines which is used by the Property Appraiser’s Office to notify property owners of their proposed taxes for
FY 2013. For practical purposes, the proposed millage rate set by the Commission will be the maximum millage rate that can be levied in FY 2013. The Commission can still lower the millage
rate at either of the public hearings for budget adoption in September. For FY 2012 the Operating Millage rate is 7.19 and the Debt Service millage rate is 0.6133 for a total millage
rate of 7.8033. For FY 2013 the Debt Service Millage will drop slightly to 0.6041. A slight modification to change the Operating Millage Rate to 7.1992 for FY 2013 will maintain the
same Total Millage Rate of 7.0833 which is what I recommend as a minimum for FY 2013. Should the Commission wish to consider alternative millage rates, a chart is attached showing various
alternatives. An Operating Millage rate of 7.6805 (.50 mils over the rollback rate of 7.1805) would generate an additional $2.39 million for the City, an amount close to the current
gap in the FY 2013 Proposed Budget. If the total millage rate is kept at 7.8033 for FY 2013, further spending reductions or other additional revenues will be required to balance the
budget. RECOMMENDATION Staff recommends that the City Commission set a minimum total millage rate of 7.8033 for FY 2013 (7.1992 Operating millage rate).

MEETING OF AUGUST 3, 2012 DOWNTOWN DEVELOPMENT AUTHORITY'S PROPOSED MILLAGE RATE FOR FY 2013 ITEM BEFORE COMMISSION The item is before Commission for acceptance of the Downtown Development
Authority’s proposed millage rate for FY 2013. BACKGROUND On July 2, 2012, the Downtown Development Authority (DDA) held a Goal Setting/Budget Meeting to discuss their budget. They voted
to approve a proposed millage levy of 1.0 mil for FY 2013. Per Ms. Marjorie Ferrer, the DDA will have a meeting on August 13, 2012 to discuss their budget. The approval letter is attached
for your review. The DDA current year millage rate is 1.0 mil. The enabling legislation for the DDA states that their tax levy will be 1.0 mil unless the DDA Board decides to levy a
lesser amount. RECOMMENDATION Accept the DDA’s proposed millage rate of 1.0 mil for FY 2013.

OF AUGUST 3, 2012 RESOLUTION NO. 35-12 ITEM BEFORE COMMISSION This item is before Commission to authorize Early Voting in the City of Delray Beach for the August 14, 2012 Primary Election.
BACKGROUND Ms. Susan Bucher, Palm Beach County Supervisor of Elections, has requested the use of the Delray Beach City Hall/Community Center for Early Voting. The dates for early voting
are Saturday, August 4, 2012 until Saturday, August 11, 2012 for the August 14, 2012 Primary Election. The daily hours for early voting will be 10:00 a.m. until 6:00 p.m. The Supervisor
of Elections Office is responsible for the equipment and setup as well as staffing for early voting. Ms. Bucher will pay any additional staff costs for the opening and closing of the
facility. In addition, we could not accomodate Ms. Bucher's request to use our Community Center in October for Early Voting due to the Chris Evert Tournament. Therefore, we have initiated
and completed arrangements with the Delray Beach Public Library to allow Ms. Bucher to utilize their facility for early voting from Saturday, October 27, 2012 until Saturday, November
3, 2012 which affords our residents and other voters the opportunity to utilize a centrally located facility to cast their votes. RECOMMENDATION Recommend approval of Resolution No.
35-12.
1 RESOLUTION NO. 35-12 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AUTHORIZING “EARLY VOTING” IN THE CITY OF DELRAY BEACH TO PROVIDE VOTERS IN THE CITY
AN OPPORTUNITY TO CAST AN EARLY VOTE DURING THE AUGUST 14TH PRIMARY ELECTION AND AN EXTENDED TIME PERIOD OTHER THAN THE PRIMARY ELECTION DATE; PROVIDING AN EFFECTIVE DATE. WHEREAS, early
voting is defined as “casting a ballot prior to the Election Day at a designated location for same and depositing the voted ballot in the tabulation system”; and WHEREAS, in 2004 the
legislature passed legislation which standardized Early Voting throughout the state of Florida and the Supervisor of Elections requested the use of the Delray Beach Community Center
which is directly adjacent/annexed to City Hall and geographically located within the municipal boundaries to accommodate all voters desiring to cast an early vote; and WHEREAS, the
City Clerk was authorized to begin the procedures to implement “Early Voting” in the City of Delray Beach in conjunction with the August 14, 2012 Primary Election; and WHEREAS, under
the new House Bill 1355, a directive was issued that became effective May 2011, that Early Voting will be conducted ten (10) days before the election and end on the 3rd day before the
election; and WHEREAS, it is the desire of the City to designate City Hall/Community Center as an Early Voting site in the City of Delray Beach to provide accommodations to the voters
and residents of the city as well as the state of Florida an opportunity to cast an early vote during the Primary Election scheduled to be held on August 14, 2012. NOW, THEREFORE, BE
IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the Palm Beach County Supervisor of Elections is authorized to setup the necessary
equipment and to provide the necessary site staffing for the Early Voting dates. Section 2. That the dates and operational hours for the scheduled Primary Election are: August 14, 2012

DOWNTOWN DEVELOPMENT AUTHORITY'S PROPOSED MILLAGE R ATE FOR FY
2013
ITEM BEFORE COMMISSION
The item is before Commission for acceptance of the Downtown Development Authority’s proposed
millage rate for FY 2013.
BACKGROUND
On July 2, 2012, the Downtown Development Authority (DDA) held a Goal Setting/Budget Meeting to
discuss their budget. They voted to approve a propo sed millage levy of 1.0 mil for FY 2013. Per Ms.
Marjorie Ferrer, the DDA will have a meeting on Aug ust 13, 2012 to discuss their budget. The approval
letter is attached for your review. The DDA current year millage rate is 1.0 mil. The enabling legisla tion
for the DDA states that their tax levy will be 1.0 mil unless the DDA Board decides to levy a lesser
amount.
RECOMMENDATION
Accept the DDA’s proposed millage rate of 1.0 mil f or FY 2013.

ITEM BEFORE COMMISSION
This item is before Commission to authorize Early V oting in the City of Delray Beach for the August
14, 2012 Primary Election.
BACKGROUND
Ms. Susan Bucher, Palm Beach County Supervisor of E lections, has requested the use of the Delray
Beach City Hall/Community Center for Early Voting. The dates for early voting are Saturday, August
4, 2012 until Saturday, August 11, 2012 for the Aug ust 14, 2012 Primary Election. The daily hours for
early voting will be 10:00 a.m. until 6:00 p.m. The Supervisor of Elections Office is responsible for the
equipment and setup as well as staffing for early v oting. Ms. Bucher will pay any additional staff co sts
for the opening and closing of the facility.
In addition, we could not accomodate Ms. Bucher's r equest to use our Community Center in October for
Early Voting due to the Chris Evert Tournament. The refore, we have initiated and
completed arrangements with the Delray Beach Public Library to allow Ms. Bucher to utilize their
facility for early voting from Saturday, October 27 , 2012 until Saturday, November 3, 2012 which
affords our residents and other voters the opportun ity to utilize a centrally located facility to cast their
votes.
RECOMMENDATION
Recommend approval of Resolution No. 35-12.

RESOLUTION NO. 35-12
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AUTHORIZING “EARLY VOTING” I N
THE CITY OF DELRAY BEACH TO PROVIDE VOTERS IN THE
CITY AN OPPORTUNITY TO CAST AN EARLY VOTE DURING
THE AUGUST 14 TH PRIMARY ELECTION AND AN EXTENDED
TIME PERIOD OTHER THAN THE PRIMARY ELECTION DATE;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, early voting is defined as “casting a ballo t prior to the Election Day at a designated
location for same and depositing the voted ballot in the tabul ation system”; and
WHEREAS, in 2004 the legislature passed legislation which standardized Early Voting throughout the
state of Florida and the Supervisor of Elections requ ested the use of the Delray Beach Community Center
which is directly adjacent/annexed to City Hall and geo graphically located within the municipal boundaries t o
accommodate all voters desiring to cast an early vote; and
WHEREAS, the City Clerk was authorized to begin the pr ocedures to implement “Early Voting” in the
City of Delray Beach in conjunction with the August 14, 201 2 Primary Election; and
WHEREAS, under the new House Bill 1355, a directive was issued that became effective May 2011,
that Early Voting will be conducted ten (10) days befor e the election and end on the 3 rd day before the election;
and
WHEREAS, it is the desire of the City to designate C ity Hall/Community Center as an Early Voting
site in the City of Delray Beach to provide accommoda tions to the voters and residents of the city as well as
the state of Florida an opportunity to cast an early vote during the Primary Election scheduled to be held on
August 14, 2012.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISS ION OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1 . That the Palm Beach County Supervisor of Electio ns is authorized to setup the necessary
equipment and to provide the necessary site staffing for the Ea rly Voting dates.
Section 2 . That the dates and operational hours for the scheduled Primary Election are:
August 14, 2012 Primary Election
Saturday, August 4, 2012 daily until Saturday, August 11, 20 12 daily
10:00 a.m. until 6:00 p.m.

Section 3 . That this Resolution shall take effect immediately upon it s adoption.
PASSED AND ADOPTED in special session on this 3 rd day of August, 2012.
