AN ORDINANCE OF THE CITY COUNCIL ~OF THE CITY OF DELRAY
BEACH, FLORIDA, ANNEXING TO THE CITY OF DELRAY BEACH A
PARCEL OF LAND LOCATED IN SECTION 20, TOWNSHIP 46 SOUTH,
RANGE 43 EAST, WHICH LAND IS CONTIGUOUS TO EXISTING
MUNICIPAL LIMITS OF SAID CITY; SAID LAND IS LOCATED SOUTH
OF S.W. 10TH STREET, BETWEEN S.W. 8TH AVENUE AND
GERMANTOWN ROAD; REDEFINING THE BOUNDARIES OF SAID CITY
TO INCLUDE SAID LAND; PROVIDING FOR THE RIGHTS AND
OBLIGATIONS OF SAID LAND; PROVIDING FOR THE ZONING
THEREOF TO RH (MEDIUM HIGH TO HIGH DENSITY DWELLING)

particularly described as follows: Beginning at the Southwest corner of

SUBDIVISION, according to the Plat thereof on file in the Offic~ of the

WHEREAS, Raul G. Salinas and Irma G. Salinas, his wife, are the
fee-Simple owners of the North 8.9 feet of Lot 3, and the South 31 feet
of the West One-Half (W 1/2) of Lot 2, Block 1, STRICKLAND SUBDIVISION,
according to the Plat thereof on file in the Office of the Clerk of the
Circuit Court in and for Palm Beach County, Florida, recorded in Plat
Book 23 at Page 173; and,
WHEREAS, Genevieve B. Ledbetter is the fee-simple owner of the
South 76.1 feet of the North 85 feet of Lot 3, Block !, STRICKLAND
SUBDIVISION, according to the Plat thereof on file in the Office of the
Clerk of the Circuit Court in and for Palm Beach County, Florida,
recorded in Plat Book 23 at Page 173; and,
WHEREAS, David C. Ledbetter, a single man, is the fee-simple
owner of the South 15 feet of Lot 3, the South 30 feet of Lot 4, and all
of Lots 5 and 6, Block 1, STRICKLAND SUBDIVISION, according to the Plat
thereof on file in the Office of the Clerk of the Circuit Court in and
for Palm Beach County, Florida, recorded in Plat Book 23 at Page 173;
and,
WHEREAS, Adela Gonzales is the fee-simple owner of Lot 4, less
the South 30 feet thereof, and the South 15 feet of the East One-Half (E
1/2) of Lot 2, Block 1, STRICKLAND SUBDIVISION, according to the Plat
· thereof on file in the Office of the Clerk of the Circuit Court in and
for Palm Beach County, Florida, recorded in Plat Book 23 at Page 173;
and,
WHEREAS, Glenn R. Haggerty, as Agent for Glenn R. Haggerty and
Patricia B. Haggerty, his wife, Irwin Fenner and Audrey Fenner, his.
wife, Raul G. Salinas and Irma G. Salinas, his wife, Genevieve B.
Ledbetter, David C. Ledbetter, a single man, and Adela Gonzales, has
requested by his petition to have the property annexed iDto the
municipal limits of the City of Delray Beach; and,
WHEREAS, the subject property hereinafter described is now
contiguous to the corporate limits of the City of Delray Beach, thus
making said petition for annexation effective at this time; and,
WHEREAS, the designation of a zoning classification is part of
the annexation proceeding, and provisions of City Code Section 30-23
have been followed in establishing the proposed zoning'designation; and,
WHEREAS,- the City of Delray Beach has heretofore been
authorized to annex lands in accordance with Section 171.044 of the
Florida Statutes,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CIT7
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council of the City of Delray Beach
Palm Beach Coun. ty, Florida, hereby annexes to said City the followinc
described land located in Palm Beach County, Florida, which lie~

The subject property is located south of S.W. 10th
Street, between S.W. 8th Avenue and Germantown Road.
The above-described parcel contains a 9.09 acre parcel of
land, more or less.
Section 2. That the Boundaries of the City of Delray Beach,
Florida, are hereby redefined to include therein the above-described
tract of land and said land is hereby declared to be within the
corporate limits of the City of Delray Beach, Florida.
Section 3. That Section 30-23 of the Zoning Code has been
followed in the establishment of a zoning classification in this
ordinance and the ~racts of land hereinabove described are hereby
declared to be in Zoning District RH (Medium High to High Density
Dwelling) as defined by existing ordinances of the City of Delray Beach,
Florida.
Section 4. That the land hereinabove described shall immedi-
ately become subject to all of the franchises, privileges, immunities,
debts, obligations, liabilities, ordinances and laws to which lands in
the City of Delray Beach are now or may ~e subjected and persons~
residing thereon shall be deemed citizens of tke City of Delray Beach.
Section 5. That this annexation of the subject property,
including adjacent roads, alleys, or the like, if any, shal~ not be
deemed acceptance by the City of any maintenance responsibility for such
roads, alleys, or the like, unless otherwise specifically initiated by
the City pursuant to current requirements and conditions.
Section 6. That if any word, phrase, clause, sentence or part
of this ordinance shall be declared illegal by a Court of competent
jurisdiction, such record of illegality shall in no way affect the
remaining portion.
Section ~. That this ordinance shall become effective immedi-
ately upon passage on second and final reading.
