86-87 ORDINANCE NO. 86-87 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 9, "BUILDINGS AND CONSTRUCTION", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING ARTICLE II, "BUILDING CODE", SECTION 9-17, "AMENDMENTS AND ADDITIONS TO CODE", SUBSECTION 107.4, "SCHEDULE OF PERMIT FEES~, SUBPARAGRAPHS (c)(I), (II), (III), (IV), (V), (VI), AND (IX), TO MODIFY PERMIT FEES FOR NEW BUILDINGS AND ADDITIONS, MISCELLANEOUS PERMITS, SUB TRADE PERMITS, PERMIT FEES FOR LONG-TERM PERMITTING, PERMIT FOR MOVING OF BUILDING' OR STRUCTURE, PERMIT FOR DEMOLITION OF BUILDING OR STRUCTURE AND CERTIFICATE OF OCCUPANCY; BY AMENDING ARTICLE III, "GAS CODE", SECTION 9-31, "ADOPTED~, SUBSECTION 113.4, "SCHEDULE OF PERMIT FEES", SUBPARA- GRAPHS (a) AND (c), TO PROVIDE FOR AN INCREASE IN THE - PERMIT FEES; BY AMENDING ARTICLE IV, "MECHANICAL CODE", SECTION 9-42, "ADOPTED", SUBSECTION 106.3, "SCHEDULE OF PERMIT FEES", SUBPARAGRAPHS (a) AND (c), TO PROVIDE FOR AN INCREASE IN THE PERMIT FEES; BY AMENDING ARTICLE V, "PLUMBING", SECTION 9-54, "CODE AMENDED", SUBSECTION 113.4, "SCHEDULE OF PERMIT FEES", SUBP~.AGRAPHS (a) AND (c), TO PROVIDE FOR AN INCREASE IN THE PERMIT FEES; SECTION 9-67, "WELLS FOR POTABLE WATER", SUBPARAGRAPH (g), "PERMIT FEES", TO PROVIDE FOR AN INCREASE IN THE PERMIT FEES; AND SECTION 9-68, "WELLS FOR NONPOTABLE WATER AND SPRINKLER SYSTEMS", SUBSECTION (e), "PERMIT FEES', TO PROVIDE FOR AN INCREASE IN THE PERMIT FEES; AND BY AMENDING ARTICLE VI, "ELECTRICITY", DIVISION II, "PERMITS AND INSPECTIONS", SECTION 9-100, "PERMIT FEES GENERALLY", SUBSECTIONS (a) AND (c), TO PROVIDE FOR AN INCREASE IN THE PERMIT FEES; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 9, "Buildings and Construction", Article II, "Building Code", Section 9-17, "Amendments and additions to code", Subsection 107.4, "Schedule of permit fees", Subparagraphs (c)(I), (II), and (III) of the Code of Ordinances of the City of Delray Beach, Florida, be, and the s~me i~ hereby amended to read as follows: I. Permits for new buildings and addit{ons. A. Permit fees include: 1. '~uilding 2. Slectric 3. ?lumbtng 4. Mechanical 5. B. Single permit fee for the above will be: 1. Minimum fee: $88v~}{}-lml~te--$1~.-~0 $33.00 plus ~6.00 per required inspection Total valuation: $1,000.00 or less. 2. Construction over $1,000.00 of value: The fee shall be $33.00 plus 6~0v~}~ $11.00 for each additional $1,000.00 of value over $1,000.00 or port~on-l'6-~-ihereof. II. Miscellaneous permits. Miscellaneous permits include driveways, fences, reroofs, pools, utility sheds, patios, sidewalks. A. Single miscellaneous building permit fee will be: 1. Minimum fee: $~00 $23.00 plus $~700 $16.00 per required inspection. Total valuation: $1,000.00 or less. 2. Construction over $1,000.00 of 'value: The fee shall be $23.00 plus $~00 $8.00 for each additional $1,000.00 of value over ~-0'0-~.00 or portion thereof. III. Sub trade permit. A. Sub trades for, but not limited to: 1. Sitework 2. Structural pest control 3. Underground fuel tanks 4. General construction 5. Subcontracts for general construction B. Single sub trade permit fee ..will be: -' 1, Minimum fee:J $80700 $33.00 plus $~700 $16.00 per ~equired inspection. Total valuation: $1,000.00 or less. 2. Construction over $1,000.00 of v~ue: The fee shall be $33.00 plus $~0700 $22.00 for each additional $1,000.00 of value over TI,000.00 or port~ thereof. IV. Permit fees for long-term permitting. The permit fee shall be based on $½0~00 $11.00 per $1,000.00 construction cost and shall be paid at the beginning o-~. the yearly period. Within forty-five (45) days after the end of the yearly period, the business shall present to the city a statement of actual costs and shall remit ,to the city, or receive a credit for the difference between the project fees due and the actual fees due based on actual construction. The holder of the long-term permit shall comply with section 108.2(c) regarding inspections for general construction work and shall call for final inspections for electrical and mechanical work for small projects. V. Permit for moving of building or structure. For the moving of any building or structure, the fee shall be a~t--fSf~y~-d~Hars-~$g60700) two hundred and seventy-five dollars ($275.00). VI. Permit for demolition of building or 'structure. For the demolition of any building,' or structure, the fee shall be ~$60~00) fifty-five dollars ($55.00~. X. Certificate of occupancy. (1) For the issuance of an addilional certificate of occupancy, the fee shall be ~f~y-~k~lt~-(-$~.-0~) fifty-five dollars ($55.00). (2) For the issuance of a tempc rary certificate of occupancy, the fee shall be ~-l~a~l--d~l~ars-($~0L~00) five hundred forty-five ($545.00). Section 2. That Chapter 9, "Buildings and Construction", Article III, "Ges Code"~ Section' 9-31, "Adopted", Subsection 113.4, "Schedule of permit fees", Subpara- graphs (a) and (c), of the Code of Ordinances of the City of Delray Beach, Florida, be, and the same is hereby amended to read as follows: (a) There shall be a minimum fee of $~0~00 $33.00 for $1,000.00 or less in construction value plus $~00 $16.00 per required inspec-'~-~'i~n. The fee shall be $80;00 $33.00 plus $~0~00 $22.00 for each additional $1,000.00 of construction value over 2 ORD. The permit fee shall be based on $~0~00 $11.00 per $1,000.00 construction cost and shall be paid at the beginning of the yearly period. The fee shall be $33.00 plus $~0~00 $22.00 for each additional $1,000.00 of construction value over ~I'~T0'0'.00 or portion t~f as determined by the building department or by evidence of a signed contract between the owner or his agent and contractor. (c) Long-term permit fee. The permit fee shall he based on $~0~00 $11.00 per $1,000.00 construction cost and shall be paid at the beginning of the year-F~y period. Section 5. That Chapter 9, "Buildings and Construction, Article V, "]'lumbing", Division 2, "Wells and Sprinkler Systems"; Section 9-67, "Wells for potable water", Subsection (g), "Permit fees", of the Code of-Drdinances of the City of Delray Beach, Florida, be, and the same is, hereby amended to read as follows: (g) Permit fees. Permit fee to be charged by the city for drilling or driving a potable well is ~4~y-~i~tlz~,~-(45~.~) fifty-five dollars ($55.00). Section 6. That Chapter 9, "Buildings and Construction, Article V, "Plumbing?'~i--v~n 2, "Wells and Sprinkler Systems", Section 9-68, "Wells for nonpotable water and sprinkler systems", Subsection (e), "Permit fees", of the Code of 3 ORD. NO. 86-87 Ordinances of the City of Delray Reach, Florida, be, and the same is, hereb.v amended to read as follows: (e) Permit fees. Permit fees to be charged by the citl~ are as follows: Permit fee for drilling or driving a well $50;-00 $55.00 Permit fee for sprinkler, minimum $50~00 $55.00 Plus $~0~00 $11.00 per $1,000 of construction cost above $1,000. Section 7. That Chapter 9, "Buildings and Construction", Article VI, "Electricity", Division II, "Permits and Inspections", Section 9-100, "Permit fees generally", Subparagraphs (a) and (c), of the Code of Ordinances of the Cit.v of Delray Beach, Florida, be, and the same is hereby amended to read as follows: (a) There shall be a minimum fee of $~0~00 $33.00 for $1,000.00 or less in construction value plus $~00 $16.00 per required insp~n. The fee shall $33.00 plus ${]0~00 $22.00 for each additional $1,000.00 of construction val~fe over ~-f~.00 or portion thereof as determined by the building department or by evidence of a signed contract between the owner or his agent and contractor. (c) Long-term permit fee. The permit fee shall be based on $~0~0 $11.00 per $1,000.00 construction cost and shall be paid at the '~eginning of the yearly period. Within forty-five (45) days after the end of the yearly period, the business shall present to the city a statement of actual costs and shall remit to the city, or receive a credit for the difference between the projected fees due and the actual fees due based on actual construction. The holder of the long-term permit shall comply with section 108.2(c) regarding inspections for ~eneral construction work and shall call for final inspections for electrical and mechanical work eot small proiects. To secure an electrical permit for a state-approved modular home, the fee for building the service shall be ~½i~t~-~ol4ars-~$80~00~ thirty-three dollars ($33.00). Section 8. That should any section or pro-~ision of this ordinance or portion thereof, any paragraph, sentence, or word be declared b~ a court of cor~petent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid.
