AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING CHAPTER 11 "FIRE
PROTECTION AND PREVENTION", ARTICLE II, "FIRE
PREVENTION", OF THE CODE OF ORDINANCES OF THE CITY
OF DELRAY BEACH, FLORIDA BY REPEALING SECTION 11-17,
"CODES ADOPTED"; BY ENACTING A NEW SECTION 11-17
"CODES ADOPTED", TO PROVIDE FOR THE ADOPTION OF
CERTAIN STANDARD FIRE CODES; BY REPEALING SECTION
11-18, "SECTION 14.4 OF CODE AMENDED: AUTOMATIC
SPRINKLER SYSTEMS"; BY ENACTING A NEW SECTION 11-18,
"AMENDMENTS TO NATIONAL FIRE PROTECTION ASSOCIATION
1, FIRE PREVENTION CODE, 1987 EDITION "; TO PROVIDE
FOR LOCAL AMENDMENTS TO ADOPTED NATIONAL FIRE CODES
CONCERNING SPRINKLER SYSTEMS AND STANDPIPES; PRO-
VIDING A REPEALER CLAUSE; PROVIDING A SAVING CLAUSE;
PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 11 "Fire Protection and Prevention",
Article II, "Fire Prevention", Section 11-17, "Codes Adopted" of the
Code of Ordinances of the City of Delray Beach, be, and the same is
hereby repealed.
Section 2. That Chapter 11, "Fire Protection and Prevention",
Article II, "Fire Prevention" of the Code of Ordinances of the City of
Delray Beach, be, and the same is hereby amended by enacting a new
Section 11-17, "Codes Adopted", to read as follows:
Sec. 11-17. Codes Adopted.
With exception to occupancies covered by uniform fire safety
standards, there is hereby adopted by the City for the purpose of
prescribing regulations governing conditions hazardous to life and
property from fire or explosion, the following National Fire Codes,
prescribed by the National Fire Protection Association (NFPA), including
al! revisions, save and except such portions as are hereinafter deleted
modified or amended of which codes not less than one (i] copy has been
and is now filed in the office of the Clerk of the City and the same are
hereby incorporated as fully as if set out at length herein and the
pr,~visions thereof shall be controlling within the limits of the City;

Section 3. That Chapter 11, "Fire Protection and Prevention",
Article II, "Fire Prevention", Section 11-18, "Section 14.4 of code
amended: Automatic Sprinkler Systems", of the Code of Ordinances of the
City of Delray Beach, be, and the same is hereby repealed.
Section 4. That Chapter 11, "Fire Protection and Prevention",
Article II, "Fire Prevention", of the Code Of Ordinances of the City of
Delray Beach, be, and the same is hereby amended by enacting a new
Section 11-18, "Amandments to NFPA 1" to read as fcllows:
Sec. 11-18. Amendments to National Fire Protectiou Association 1, Fire
Prevention Code, 1987 edition.
(A) Section 3-5.2 of NFPA 1,, 1987
edition, as recommended by the Naticnal Fire Protection
Association and adopted and incorporated by reference into the
Code of Ordinances of the City by Section 11-17, thereof, is
hereby amended as follows:
(1) Approved automatic sprinkler systems shall be installed
throughout the following buildings and structures or
appropriate sections thereof for which building permits
are issued after September 22, 1981.
(a) All buildings more than four (4) stories or fifty
(50) feet above the lowest level of fire department
vehicle access.

(b) Ail portions or sections of buildings and structures
which are below grade or which constitute the
basement area of a building or structure or vehicle
parking areas, shall have automatic sprinkler
systems regardless of square footage of floor area
or type of construction.
(2) The above provisions shall also apply to buildings for
which building permits were issued on or before September
22, 1981, if alterations or repairs are made to said
buildings within the time period and to the extent
hereinafter set forth.
(a) If, within any twelve (12) month period, alterations
or repairs costing in excess of fifty percent (50%)
of the then physical value of the building are made
to an existing building, such building shall be made
to conform to the requirements of this section for
new buildings.
(b) If an existing building is damaged by fire or
otherwise in excess of fifty percent (50%) of its
then physical value, before such damage is repaired,
it shall be made to conform to the requirements of
this section for new buildings.
(c) If the cost of such alterations or repairs within
any twelve (12) month period or the amount of such
damage as referred to in Paragraph (2) is more than
twenty-five percent (25%) but not more than fifty
percent (50%) of the then physical value of the
building the portions to be altered or repaired
shall be made to conform to the requirements of this
section for new buildings to such extent as the
Building Official may determine.
(d) The physical value of the building as referred to in
(B)(1), (2) and (3) above, shall be determined by
the Building Official.
(3) The automatic sprinkler systems herein referred to and
the installation thereof which are required by this
section shall conform to 'the current adopted edition of
the National Fire Protection Associate Standard No. 13
entitled "Standards for the Installation of Sprinkler
Systems."
(B) Section 3-5.3 of the NFPA 1, 1987 edition, as recommended by
the National Fire Protection Association and adopted and
incorporated by reference into the Code of Ordinances of the
City by Section 11-17, thereof, is hereby amended as follows:
(1) Standpipes R~quired. All buildings more than three (3)
stories in height or-over fifty (50) feet in height above
grade and containing intermediate stories or balconies
shall be equ~.pped with a standpipe system in accordance
with NFPA ?.4, "Installation of Standpipes and Hose
Systems", 19~{6 edition.
Section 5. That all ordinances or parts of ordinances in
conflict herewith be and th,~ same are hereby repealed.
Section 6. That should any section or provision of this
ordinance or any portion thereof, any paragraph, sentence, or word be
declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a
whole or part thereof other than the part declared to be invalid.
Section 7. That this ordinance shall become effective upon
passage on second and final reading.
