AN ORDINANCE OF THH CITY COMPiISSION OF TH~ CITY OF
DELRAY B~ACH, FLORIDA, AMENDING TITLE XV, "BUILDING
REGULATIONS", CHAPTER 162, "SIGNS AND BILLBOARDS",
SECTION 162.020, "PERMIT REQUIRED; APPROVAL PROCESS;
EXCEPTIONS", BY AMENDING SUBSECTION {B) ( 2), OF THE
CODE OF ORDINANCF.~ OF THE CITY OF DELRAY BEACH,
FLORIDA, BY ENACTING A NEW SUB-SUBSECTION 2(g) TO
ELIMINATE TW~ NECESSITY OF CO~FUNITY APPEARANCE
BOARD APPROVAL FOR CERTAIN SIGNS WI~ THE CENTRAL
BUSINESS DISTRICT ZONING CLASSI~FICATION, PROVIDING
CRI%~RIA FOR SUCH SIGNS; PRDVIDING A SAVIN~ CLAUSE,
PROVIDING A GENERAL REPEALEK CLAUSE. AND P~X~VIDING AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CIT~ CO~MISSION OF THE_
CITY OF DBLRAY BEACH, FLORIDA', AS FOLLOWS: '-
Section 1. That Title XV,-"Building Regulations", Chapter
1'62, "Signs and. Billboards", Section 162. 020, "Permit R .e~ire~; Approval
Process; Exceptionm",. Subsection (B) { 2) of the Code of Or~inances of the
City of Delra¥ Beach, Florida, be, and the same is hereb~ amende~ by
enacting Subsection {2){g) to read as follows:
(2) (g) Within the central business district zoning classification one
fixed projection sign, one flat wall sign and one under canopy
sign per business, provided that the color scheme of the sign
is consistent with the color palette available from the
Building Department, an~ the sign face does not exceed twenty
{20) square feet for the fixed projection and flat wall signs
and four { 4) square feet for the under canopy sign. However,
where the sign requested is obviously inconsistent in color or
desig~ with the neighboring signs, the Building Department may
· refer the sign to the Community Appearance Board for their
review.
Section 2. That should any section or provision of this
ordinance or any portion thereof, any paragraph, sentence, or ~rd be
declared by a court of competent Juris~iction to ~e ~nval~, such
decision shall not affect the validity of the remainder hereof as a
whole, or part thereof other than the part declared to be invalid.
· Section 3. That all ordinances or parts of ordinances
which are in conflict herewith are hereby repealed.
seCtion 4. That this ordinance shall become effective, ten
(10) days after its passage on secon~ an~ final reading.
