85-88 ORDINANCE NO. 85-88 AN ORDINANC~ OF T~ CITY COMMISSION OP THE CITY OF DELRAY BEACH, FLORIDA, AMENDING TITLE XV, "BUILDING REGULATIONS", CHAPTER 162, "SIGNS AND BILLBOARDS", SECTION 162. 004, "DEFINITIONS", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SUBSECTION "ENTRANCE GAT~~, TO ALLOW IDENTIFICATION STRUCTURE~ TO BE PLACE~ IN THE MEDIANS OR RIGHTS-OF-WAY ADJACENT TO SUBDMSION ENTRANCES ALLOWING CERTAIN EXISTINQ SUBDI~SION IDENTIFICATION SIGNS TO REMAIN OFF PR~ISE~ PRO- VIDING A SAVING CLAUSE, PROVIDING A REP~ ~LA~SK AND PROVIDING AN EFFECTIVE DATE. NOW, T~w~.~ORE, BE IT ORDAINED B~ TH~' CITY OF DELRAY BEACH AS FOLLOWS: · Section 1. That Title XV, "Building Regulationm",J::C~a~te~ 162, "Signs and Billboards", Section 162.004, "Defi~tio-~", "Entrance Gates" of the Code of Ordinances of the City of DelraF Beach, Florida, be and the same is hereby amen~e~ to read as follows: Entrance gates: An identification structure locate~ alon~ the-mai~ access to a city-approve~ sub~ivision or com~ezcial, develol~men~ an~ directional signs. necessary Such sub~ivision i~entification be erecte~ within a right-of-way or median, strip adjacent to the sub divis.ion if approved bv the Cit~. A subdivision identification siOn a existing within right-of-wa~ or median as of July 1, 1988 shall be considerod adjacent to a subdivision. Signs erecte~ within the right-of-way shall be at least ten (10} feet from the pave~ roadway. Signs located within _a median shall be at least five (5) feet from any paved roadway. Any signs approved for location within the right-of-wa~ or median shall have a si~n face no ~reater than thirty-six (36) s~uare feet. If &.. right-of-way or me~ian is not within the ~uris~iction of the City. the applicant for said sign must obtain permission ~ro~ the ~overnmental entitX controlling the right-of-way or median to erect the sion in the requested and aDDroved location. Section 2. That should any section'or provision of this ordinance or any portion thereof, any ~aragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid.
