(1) RESOLUTION NO. 11-95: Consider a resolution authorizing the
City to acquire from the Community Redevelopment Agency the

(4) PURCHASE AWARD/PALM BEACH HARLEY DAVIDSON: Award the pur-
chase of five replacement motorcycles for the Police Patrol
Division to Palm Beach Harley Davidson at a total cost of
$60,000.00, with funding from City Garage Vehicle Replace-
ment (Account No. 501-3312-591-64.20).

DATE: FEBRUARY 24, 1995
Resolution No. 11-95 authorizes the City to purchase from the
Community Redevelopment Agency the Monterey House property located
at 20 North Swinton Avenue. The purchase price is $260,000.00. As
discussed and approved in concept on February 7th, the purchase
price will be absorbed by giving a credit to the CRA against their
debt service on the tennis stadium.
The required advertising for the acquisition of this property prior
to adoption of the authorizing resolution has been done. However,
it is anticipated the City Attorney will request at the special
meeting that this item be continued to a date certain.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF ./
DELRA Y BEACH, FLORIDA, AUTHORIZING THE CITY TO PURCHASE
FROM SELLER CERTAIN REAL PROPERTY IN PALM BEACH
COUNTY, FLORIDA, AS DESCRIBED HEREIN , HEREBY
INCORPORATING AND ACCEPTING THE CONTRACT STATING THE
TERMS AND CONDmONS FOR THE SALE AND PURCHASE BETWEEN
THE SELLER AND THE CITY OF DELRA Y BEACH, FLORIDA.
WHEREAS, the City of Dekay Beach, Florida wishes to acquire certain property located at 20
North Swinton Avenue, known as the Montery House property; and,
WHEREAS, the Seller, the Delray Beach Community Redevelopment Agency, desires to sell the
property hereinafter described to the City of Delray Beach, Florida; and,
WHEREAS, it is in the best interest of the City of Dekay Beach, Florida, to purchase said
property for the purpose of providing office and meeting space for Historic Palm Beach County, Inc. and other
municipal purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DELRA Y BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Commission of the City of Dekay Beach, Florida, as Buyer, hereby
agrees to purchase from the Delray Beach Community Redevelopment Agency, as Seller, land for the purchase
price of two hundredsixty thousand dollars ($260,000.00), and other good and valuable consideration; said
parcel being more particularly described as follows:
Lot 12, Less the South 4 feet thereof, Block 60, Town of Dekay, Florida, as
recorded in Plat Book 1, Page 3 of the Public Records of Palm Beach County,
Florida.
Section 2. That the terms and conditions in the contract for sale and purchase and addenda
thereto between the City of Dekay Beach, Florida, and the Dekay Beach Community Redevelopment Agency
are attached hereto as Exhibit A and incorporated herein.

WHEREAS, the City of Delray Beach, Florida, is presently involved in an inverse
condemnation lawsuit brought by Stanley Tate, as Trustee, ("TATE") concerning property north /of
Atlantic A venue and west of the Lake Worth Drainage District's E-4 canal; and
WHEREAS, in an effort to settle the lawsuit, the City of Delray Beach desires to enter
into purchase contracts with Temple Sinai and Tate for the acquisition of property hereinafter described
and immediately a designate, Financial Florida Developers, Inc. as the buyer; and
WHEREAS, the City of Delray Beach, Florida has previously entered into a reservation
agreement with Temple Sinai, Inc. for the acquisition of property for road right-of-way purposes, and at
this time the City of Delray Beach desires to exercise its option to purchase the road right-of-way and
immediately transfer to its designee; and
WHEREAS, further the City desires to release andlor quitclaim any interest it may have
in the Davis Road right-of-way south of Owens Baker Road, north of the L-33 Canal and west of the E-4
Canal, as well as any interest the City may have in the Lake Worth Drainage District's E-4 Canal
easement south of the L-33 Canal, north of Atlantic Avenue, and east of the fifteen foot alley as
indicated on the plat of replat of part, Breezy Ridge Estates, as recorded in Plat Book 24, Page 116 of
the Public Records of Palm Beach County, Florida; and
WHEREAS, Financial Florida Developers, Inc. desires to accept the release or quitclaim
of the City's interest in Davis Road south of Owens Baker Road, north of the L-33 Canal and west of the
E-4 Canal to accept designation as outlined in the agreements; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DELRA Y BEACH, FLORIDA, AS FOLLOWS:

hereby agrees to designate to Financial Florida Developers, Inc., the purchase and sale contracts with
Temple Sinai, Inc. and Stanley Tate, as Trustee, for the above described property pursuant to the
assiginnent agreement attached hereto for other good and valuable consideration as set forth in composite
Exhibit "B" hereto.
Section 3. That the City Commission of the City of Delray Beach, Florida, hereby agrees
to release and/or quitclaim any interest it may have acquired in the Davis Road right-of-way south of
Owens Baker Road, north of the L-33 Canal, and west of the E-4 Canal, as well as any interest the City
may have in the Lake Worth Drainage District's E-4 Canal easement south of the L-33 Canal, north of
Atlantic A venue, and east of the fifteen foot alley as indicated on the plat of replat of part, Breezy Ridge

Carpeting for the Delray Beach Golf Clubhouse to Galen Neff & Associates
at a total estimated cost of $30,132.70.
Background:
City Commission approved this design with the coloration and strike offs
at a prior Commission meeting of September 20, 1994. The carpet and
pattern chosen at the September meeting is a copyright design and as such
is a sole source item.

y 1. CARPETING - Durkan has the copyright of the design along with the coloration and strike

2. LIGHTING - The Custom fixtures are only made by three (3) companies who have the
C copyright of design which slightly vary from each other. Three (3) bids have been
submitted.
L 3. SPECIALTY FURNITURE - The specified companies have the sole design along with the
U fabrics that are applied on them, which have sole design and coloration only
B available from that company.
4. W ALL COVERING - The patterns and coloration are only available from the specified
company.
D 5. REUPHOLSTER Y & REFINISHING - The bids submitted are from companies that will do
E both seIVÍces which saves in freight costs and they are local.

CONDITIONS OF SALE
"Overage
We require the right to ship and bill 10% overage on patterned carpet on
orders 200 - 1500 square yards, 20% on orders under 200 square yards to be
billed at the unit price. This is not included in the total cost listed above.
Selection of an Approved Carpet Installation Contractor
Patterned carpet has a higher cost than plain carpet.
It calls for considerably more effort, more time expended and more expertise
in effecting a proper installation. All of this increases the cost of installation.
Accordingly only a top rated installation contractor should be engaged. The
owners or their agents should carefully qualify the credentials of the
prospective installation contractors by checking their past work on patterned
carpet.
Achieving false economy on installation costs often proves more costly in the
long run. Many times a top rated installation contractor might have to be
called in to correct bad work on the part of cheaper installers.
If contacted, we will be most pleased to recommend a number of approved
installation contractors in you area, so that you may be able to make an
informed selection.
Deposit Required
A 1/3 deposit is required upon placement of the order. Need for this deposit
has no reflection on the credit worthiness of our customers. It is standard
procedure in the manufacture of custom carpet.

Terms

Sales Taxes will be charged according to ship to location unless Durkan is
supplied with a resale certificate.
Fabrication
All fabrication will be done on the job site.
( Delivery
Based on the order being received with the 1/3 deposit, carpet can be shipped
within 5 weeks from the date of receipt of signed confirmation of order. On
orders that require mill seaming please add one week to date of delivery. If
beck dyed solid is to be seamed with a printed carpet add two weeks to
delivery date. Receipt of deposit is critical to our ability to meet promised
shipment dates. Deposit should be sent at time of order.
Method of Transmission
In contract work, time is of the essence. Therefore we are transmitting this
proposal by Airborne and we are enclosing a prepaid Airborne envelope for
acceptance. Upon necessary approvals, execute and return at once with
deposit. In this manner valuable time can be saved on delivery.

Acceptance
We are enclosing carpet layout plans which clearly illustrate how the
carpet is to be installed and which indicate seams. These plans are
based on the architectural plans submitted to us. and the accuracy
can only be determined by field measurements.
If a carpet workroom has already been selected for the job, most
workrooms will perform on site measuring at no additional fee. If a
workroom has not yet been selected most aspiring workrooms will
measure for a moderate fee rebatable upon being given the job.
Please have your installation contractor do an "on job site" field
measurement to verify measurements and yardages stated on our
plans and proposal, and if correct, return a plan signed with your
approval. If there are variances, please return the plan with the
marked variances and your signature.
Please read, review, and sign one copy of the proposal and return it
with your deposit and approved plans.
The proposal then becomes a formal contract. $26,744.20

This is before the Commission to award the purchase of five
replacement motorcycles for the Police Patrol Division to Palm
Beach Harley Davidson at a total cost of $60,000.00. Funding is
available from City Garage - Vehicle Replacement (Account No.
501-3312-591-64.20) .
The motorcycles to be replaced are in excellent condition and have
not reached their scheduled replacement date. However, due to the
market demand for Harley Davidsons, our intention is to sell the
older cycles at auction with an expected minimum return of $10,000
each. The original purchase price for them was $42,000. The new
motorcycles are also expected to appreciate in value. They have a
factory warranty of one year/100,000 miles. Unless there is a
change in the market, staff recommends upgrading every year. By
doing so, this division shows a profit and the Police Department's
motorcycle program has the benefit of using the newer machines.
Recommend approval of the purchase of five replacement motorcycles
for the Police Patrol Division from Palm Beach Harley

Subject: REPLACEMENT VEHICLES
Please initiate proceedings to purchase replacements for the City the vehicles described below.
Specifications and pricing have been taken from the Harley Davidson dealer in West Palm Beach
and are consistant with quotes from Fort Lauderdale and Miami. In the absence of a State bid,
and due to high demand, the dealers are quoting only in their assigned territory.
The machines to be replaced have not attained the scheduled replacement date and are in
excellent condition to continue in service. The justification for replacement is the unique
position Harley Davidson has achieved in the market place. We intend to sell the old machines
at auction with every expectation of realizing a minimum return per machine of $10,000. The
purchase cost was $42,000. We expect the new machines to appreciate in value at least as well.
The factory warranty is 1 year, 100,000 miles. Until there is a radical change in the market, we
recommend upgrading every year, and show a profit from this division.
Auctions of the Police model through out the State for the past year report sales up to $12,000.
The new machines offer numerous safety and comfort features we feel are extremely important in
the continued success of the Motor Program for the Police Department and the City.

generated boundary proposal for elementary schools affecting Delray
Beach.
BACKGROUND
Mr. Thomas Fleming, Mr. Charles Ridley, Ms. Denise May, and Ms. Jean
Beer met with representatives of the Concerned Parents Network and
other Boca Raton residents on Saturday, to try one more time to work
together to develop a boundary change proposal that might be agreeable
to all parties. Their joint proposal is attached. The net impact to your
amended proposal dated February 8, 1995 is as follows:
Delray SACs 299C, D, and H to Morikami versus 299B, C, D and H,
Delray SAC 3DDC to Verde versus Blood's, and SAC 299B to Blood's
versus Morikami. The proposal also splits Boca SAC 312SP and moves it
to Morikami.

The citizen proposal is close to your Amendment # 1. The drawback to
the proposal is that if the School Board does not move SACs 304 and 305

students attending Blood's will drop to 629 with a Black % of 42.7%.
RECOMMENDATION

This proposal i~ the product of a joint effort of the South County Educational
Alliance (SCEA), a group of parents and other individuals from Delray Beach.
Boca Raton and unincorporated \Vest Boca Raton, who have joined together to
assist the School Board in carrying out its task to make bow1dary and school
~1ssigmncnts th;¡t are in the best interest of all children in South Palm Beach
County.
SCEA finnly and expressly believes that strong communities are essential to the
success of our schools. In fonnulating this proposal, SCEA has utilized
standards and criteria as established hy District Staff and the Office of Civil
Rights for creation of new school bOWldaries which support the conununity
concept. Criteria applied takes into consideration the three prunary factors
presently utilized by District staff: the opening of new schools; overcrowding. at
existing schools; racial balance. Additional considerations. deemed equally
iInpormnt by SCEA, are likewise applied: reduction of forced busing. contiguity
of neighborhoods: reduction of enclaves (a/k/a "doughnut holes "'). Underlying
data and the above mentioned criteria supporting tills tmal proposal were
provided to representc1tives of SCEA on February 24, 1995 by Ms. Linda
Hines.
We fully agree with the expressed objective of Board Member Diane Heinz that
guidelines and standards be !onnulated and adopted by the District for future
use. Throughout SCEA~s recmnn1endations and comments. the reader will note
[he application of such standards and guidelines. although time constraints
preclude SCEA from forwarding with these proposals a sWl1mary outline of
same. SCEA is presently drafting a sutmnary and will promptly deliver it to the
School Board.
SCEA grew as an infant organization out of the recognition of many in the

South County that lHatters pertaining to our public schools can only effectively
be addressed by a broad representation of diverse points of view. All points of
view must be allowed free and full expression. Only then can they be
considered and deliberated.
SCEA is inclusionary; it will expand to include representatives of all interests,
from Boynton Beach south to the County line. desiring to participate. We would
encourage others throughout Palm Beach COW1ty to replicate these endeavors

ride the bus to Whispering Pines, and their community entrances
are contiguous with the bus route proposed for SAC 311 A.
.Space left at this site is for placement of gifted cluster to alleviate
overcrowding at Banyan Creek and Del Prado gifted clusters.
-Unlike Bloods, Morikami is truly a neutral school built in the most
neutral of zones. Centrally located east to west, it is sited literally
on the Boca-Delray boundary. Accordingly, we believe that its racial
make-up should proximate the racial make-up of the Delray-Bol'a
community that it serves. There are approximately 28,500 students
in South Count)' of whom approximately 5,000 are Black, which
projects to a 20O/c; Black and 80% Other racial composition.
Therefore, we propose that Morikami open at 26% Black and 74%
Other.

Pine Grove
-'"
Pine Grove is an historically troubled school. Substantial progress
has been made through implementation of the Title I Grant ''Success
For All" program. We urge a continuation of this highly successful
program at Pine Grove. Moreover, the cost to the District of
continuing this program will be substantially less than other
remediation efforts. Teachers are already trained. Materials are in
place. Students and faculty arc familiar with the program.
Additionally, we urge the immediate implementation of an
Inclusive Arts Magnet. We envision that this program win be
a"ailable to ESE students sutTering disabilities as an inclusion
program. We believe that it is especially attractive to bridge the Rap
for ESOL students. We remind the Board that numerous magnets,
including Arts magnets are currently in existence or planned in North
County, which are geographically out of reach for South Count:y
elementary school students. Considerable expression of District
support for the Arts Magnet has been voiced throughout South
County.
Barbara Shannon, Regional Director of the Office for Civil Rights,
has suggested that Pine Grove's problems would be satisfactorily
addressed by continuation of "Success For All" provided that issue of
equity in resources and services is delivered in a non "discriminatory
environment. She also needs to see the District's plan for Pine Grove
after the three year "Success For All" program concludes in June
1996. Pine Grove has been identified by Ms. Shannon as third on a
list of twelve schools that are of greatest concern to the OCR. A
comparability study for Pine Grove has been requested and action
taken to correct disparities that are found will be addressed by the
District.
The history of Pine Grove indicates that the ever increasing
assignment of non-Black SACs has had no discernible desegregath'c
effect on the school. Accordingly, we believe that the continued
assignment of SACs 304 and 305 will not be effecthre (nor will the
assignments of SACs 289, 291 and 292), and urge the alternatives
suggested above. Taken as a whole, these proposals satisfy OCR's
objectives as evidenced by her 2/13/95 meeting with the School
Board.

..The District's proposal places SAC 300C at Bloods. We recommend

of years. A shuttle bus is available between Verde and Del Prado.
It is recommended that any child residing in SAC 300C who desires
to remain enrolled at Del Prado be given the option of this shuttle
service.
**While we recognize that the Alliances proposal results in slight
overcrowding at Verde, we believe that it is justified under the
circumstances, and not out of line with other schools in the area
(e.g. J.C. Mitchell will be 1220/0 under the District's Proposal).
Experience reflects that the 67 children assigned from SAC 300C
has resulted in only 38 children actually attending Del Prado.

Per my discussion with Michael Wright, the City will assume
responsibility for the cost of transferring all title and interest to
the various associations.

RESOLUTION NO. 19-95
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AUTHORIZING THE CITY TO DONATE
ONE 1991 FORD CROWN VICTORIA, V.LN.
#2FACP72GOMX177155, MILEAGE 70,024, TO THE PXI1BS OF
DELRAY WEST ASSOCIATION, INC.
WHEREAS, the City of Delray Beach, Florida, wishes to donate
this former Delray Beach Police vehicle to the PINES OF DELRAY WEST
ASSOCIATION, INC. for the purpose of crime prevention activities
within the City; and
WHEREAS, it is in the best interest of the City to assist
the PINES OF DELRAY WEST ASSOCIATION, INC. in their efforts to rid our
City of criminal activity.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Commission of the City of Delray
Beach, Florida, hereby authorizes and directs the Delray Beach Police
Department to donate one (1) 1991 Ford Crown Victoria, V.I.N.
#2FACP72GOMX177155, to the PINES OF DELRAY WEST ASSOCIATION, INC. of
Delray Beach.
Section 2. That the cost of transfer of title shall be
borne by the CITY OF DELRAY BEACH, FLORIDA.
Section. 3. Tha t the terms and conditions contained in the
transfer of title between the City of Delray Beach, Florida, and the
PINES OF DELRAY WEST ASSOCIATION, INC. as hereinabove named are
incorporated herein.
PASSED AND ADOPTED in special session on this the 28th day
of February, 1995.
