11-13-12 Special Workshop MintesSPECIAL /WORKSHOP MEETING NOVEMBER 13, 2012 A Special /Workshop Meeting of the City Commission of the City of Delray Beach, Florida, was called to order by Mayor Nelson S. McDuffie in the Commission. Chambers at City Hall at 6:16 p.m., on Tuesday, November 13, 2012. Roll call showed: Present- Commissioner Thomas F. Carney, Jr. Commissioner Alson Jacquet Commissioner Adam Frankel Commissioner Angeleta E. Gray Mayor Nelson S. McDuffie Absent - None Also present were - David T. Harden, City Manager Brian Shutt, City Attorney Chevelle D. Nubin, City Clerk Mayor McDuffie called the Special /Workshop meeting to order and announced that it had been called for the purpose of considering the following Items. SPECIAL MEETING AGENDA 1. CONDITIONAL USE REQUESTS /ATLANTIC PLAZA II: Consider approval to increase the building height to a maximum of 60 feet 09 feet 4 inches proposed) and to allow a density increase above 30 dwelling units per acre (51.10 du /ac proposed) for Atlantic Plaza II, which is a proposed mixed-we development north of Atlantic Avenue, south of N.E. 1" Street, east of N.E. 6' Avenue, and west of Veterans Park. Quasi - %udicial Hearin Mr. Carney asked about signs that were removed from people's yards in relation to this subject. Mr. David T. Harden, City Manager, explained what happened. Mayor McDuffie read into the record the City of Delray Beach procedures for a Quasi-judicial Hearing for this item. Ms. Chevelle D. Nubin, City Clerk, swore in those individuals who wished to give testimony on this item. Mayor McDuffie asked the Commission to disclose their ex parte communications. Mr. Frankel stated he met with Carolyn Patton, Ann Swank, Andy Katz, John Papaloizos, Bill Milmo, Andre Fladell, Bill Morris, Jeff Edwards and Carl DeSantis. Mrs. Gray stated she spoke with Bill Morris, Jeff Edwards, Seabron Smith, and Mr. DeSantis and received emails. Mr. Carney stated he went to private meetings with Lake Ida, Palm Trail, and the Marina District; and spoke to the applicant and all parties to the applicant and with persons either by email or phone. Mr. Jacquet stated he spoke with Carolyn Patton, Ann Swank, John Papaloizos, Bill Morris, Jeff Edwards, Jestena Boughton, a few individuals from BPOA, Palm Trail, Del Ida and those that attended a meeting at Northern Trust, and received emails. In addition, Mr. Frankel stated he spoke with Jim Knight. Mrs. Cray, Mr. Carney and Mr. Jacquet stated they spoke with Tom LaDon. Mayor McDuffte stated he received numerous emails that he will forward to the clerk and he spoke with Jeff Edwards and Bill Morris. He stated Mr. DeSantis spoke to him this evening. Paul Dorling, Director of Planning and Zoning, entered the Planning and Zoning Department project file #2012 -182 into the record. Mr. Dorling stated this is for two conditional use requests for (1) an increase in building height to a maximum of 60 feet, and (2) to allow a density increase above 30 units per acre to 51.10 units per acre for the Atlantic Plaza II Development. He discussed the boundaries of the project and stated this property has a development approval on it that they received from City Commission on December 9, 2008. A new development application has been submitted and involves two 5 story buildings, two 4 story buildings, two 3 story buildings and a commercial component of approximately 52,000 square feet of retail, 29,000 square feet of restaurant, and 79,000 square feet of office and a residential portion of 442 dwelling units. At its meeting of September 24, 2012, the Planning and Zoning (P &Z) Board considered the application and the application was postponed. The board gave direction for them to address traffic, transportation management and access issues and they came back with a revised plan. At the meeting of October 15, 2012, the P &Z Board unanimously recommended approval of the conditional use request for height and the request for residential density was recommended for approval on a 4-3 vote. Staff is recommending approval of both conditional use requests subject to conditions one through eleven in the staff report. Mr. Dorling showed several slides of the plan and went through some of the elevations. In addition, he showed slides of buildings where increased density was approved. He stated it is important to note that density is not the issue it is about good design and highlighted the Land Development Regulations (LDR) Section 4.4.13. He referenced the Downtown Delray Beach Master Plan and the city's Comprehensive Plan. Carl DeSantis, Developer /Atulicant for the project, thanked Paul Dorling and stated he gave good information to the people about what they are after when all of this is done. He stated Jeff Edwards will give information about the project. He provided background information regarding his health and read a statement into record about the project. He stated the area is. currently an eyesore and the new project will bring jobs. Mr. DeSantis stated they want to deliver the best and discussed the plans, funds, county and improvements to Veterans Park. Jeff Edwards, Partner in the Project, stated they are here to seek approval of two conditional uses for height and density. He stated they would like to demonstrate that they comply with city codes and to answer any questions.. Mr. Edwards stated their traffic consultants are present tonight. He stated they will spend a great deal more time on the design and conducted a Power Point presentation. He highlighted the renderings of the project, units, and onsite parking. He discussed the height of the buildings, traffic, green space, pedestrian areas, etc. In addition, Mr. Edwards reviewed the "myths" regarding the project and discussed the site plan. He stated they have made meaningful changes. Mayor McDuffie stated if anyone from the public would like to speak in favor or in opposition of the conditional use requests, to please come forward at this time. 2 November 13, 2012 Steve BluM Delray Beach, stated this is about the Mayor and Commissioners sending a message. He read a statement into record. He stated this project will never get built if it goes against the will of approximately 60,000 Delray Beach citizens. He stated he is initiating a boycott of Atlantic Plaza II. Pauline Moody, Delray Beach, stated she is a resident and asked the city not to approve the project. She discussed density, traffic, apartments and Veterans Park. She stated the park is not an eyesore and this project cannot happen. Lee Harrison, lives on Banker's Row, stated he is a resident of Delray Beach for the last 20 years and is the owner of the Blue Anchor Pub and he is in favor of the project. He asked Commission to allow this project to move ahead. Walter Lindy, lives in Pahn Trail, Delray Beach, stated he has a question regarding the parking inside of the project. He discussed the LDR regarding the parking and others waivers that were granted. Fred DeFalco, Real Estate Broker in the area, stated he is in favor of the development and stated he has worked with Mr. DeSantis previously. He referenced Boca Raton and stated if you look at the plans this is not a concrete jungle. Alex Blodgett, Delray Beach, stated he has a company in Boca Raton and would like to be able to relocate. He stated he knows Bill Morris and he has built great developments and stated he feels the project will be outstanding. He spoke regarding Mizner Park. George Kientzy, owns Kien!U jewelers on Atlantic Avenue, stated there have been a lot of changes on Atlantic Avenue and stated this is progress Delray Beach is an international destination and he thinks the project is an incredible project. Alan Schlossberg, resident for last 16 years and lives at Seagate Towers, 200 MacFarlane Drive, Delray Beach, stated this project is in close proximity to the jewel of Delray Beach: its downtown area. He stated the project is inconsistent with the homes and the surrounding area and mentioned traffic, garbage and parking, etc. Till Schifferli, 321 Pahn Trail, Delray Beach, asked Commission to not approve the project and read a statement into record. lose Lorenzo, Attorney, 777 East Atlantic, Delray Beach, stated he is present in support of the project. He commented regarding growth and stated they need a project like this as small business owners to draw in customers that they need. Mr. Lorenzo stated this is a Class A project. Richard Edick, 615 North Ocean Boulevard, stated it comes down to two issues: he does not see the justification of the increased residential density and secondly, he does not see that this is in the appropriate location. He mentioned height and density and stated as far as the project itself, it is not compatible with the neighborhood. Mr. Edick stated other issues are traffic and underground parking in reference to the water table. November 13, 2012 Eric Schifferli, 321 Palm Trail, Delray Beach, provided background information and stated the increase in density can be a problem if not handled very carefully. In addition, he stated there is potential for a lot of noise issues and spoke regarding Class A office space and traffic. He stated land use decisions last a long time and urged Commission to make sure the issues are properly addressed. Gail Lee McDermott, 721 S.E. 3'a Avenue, Delray Beach. read a statement into record regarding Rome in reference to the project. She stated she would like to see the density lower than currently planned for Atlantic Plaza II. She stated this is not the best use for Delray Beach downtown. Terry David, 32 S.E. rd Avenue, Delray Beach, stated he has lived here for a little over a year. He stated he has been involved in homeowner associations in the five cities he has lived in. He stated in some instances he was wrong in reference to development Mr. David stated he is in love with Delray Beach and has been looking for rentals for the last two months. He stated this development is very attractive and if built, he feels it would help drive more people and traffic for businesses and maybe he can find somewhere to live. Jay 222 N.E. 8" Avenue (600 feet north of the Proposed develoument), Delray Beach, stated he takes exception to two comments from the applicant and staff and spoke regarding property tax and density. He discussed the proposal in regards to height and density and stated he has an issue with how it is spread within the site plan itself and discussed his points. John Papaloizos, 50 East Road, Barr Terrace, Delray Beach, stated he is a taxpayer and read a letter into record in reference to Atlantic Plaza II from his attorney Ralf Brooks. Chris Davie, 319 East Mallory Circle, Delray Beach, commented regarding LDR Section 4.3.4 and continued to read the letter from Attorney Ralf Brooks into the record. Joe Collard, lives on Brooks Lane, Delray Beach, spoke regarding traffic, parking, etc. Mr. Collard continued to read the letter from Attorney Ralf Brooks into the record. Jerry Fabluitz„ permanent resident for 30 years and lives in Barr Terrace, Delray Beach, stated there have been a lot of numbers regarding Atlantic Plaza and he decided to do some research regarding the units, etc. He read a statement into record. Christina Morrison, 2809 Florida Boulevard, Delray Beach, stated she is in favor of the redevelopment of Atlantic Plaza unfortunately the current plan is way too dense and way too residential. Ms. Morrison commented regarding the apartments and stated more office space is needed. She handed out petitions from the FRB. Joe Silk, has lived in Delray Beach for 22 years and works in the area, stated he is in favor of the project and spoke regarding businesses and Class A Office Space. He stated he recommended approval of this project 4 November 13, 2012 jestena Boughton, lives in Town Square, Delray Beach, stated Beac stated she is in favor of this project continuing on the road to getting better. She stated there have been many changes and Commission should not accept this plan until it is in writing exactly what they are going to approve. Carolyn Patton, 1020 Tamarind Road, Delray Beach, commented regarding properties that she owns and stated that she is a preservationist. leis. Patton read a statement into record regarding the proposed project and placed a map and photo into record. She asked Commission to deny the project. Arlin Dominick, resident of Delray Beach, thanked the Commission for the opportunity to present to them and read a statement into record regarding the project. Cogy Cassid y, 424 Fahn Trail, Delray Beach and, resident for stated the project is not compatible with the neighborhood. She stated she is opposed to the size and density of the project in relation to the size of the parcel. Judy Craig, 306 NE $t' Avenue, Palm Trail, Delray Beach, stated she has 813 signed petitions and submitted them into the record. In addition, Ms. Craig read a statement into record and asked Commission to not approve the project. Peter Emanick (mi), Delray Beach, stated he has problems with the density and the height. He also spoke regarding office space and the scheduling of the item. Brandon Roth, resident of Delray Beach, stated he is in favor of the project and feels it is a great project for Delray Beach that will tie the east and west together. He stated Delray Beach needs residential and office space. Andy Katz, Beach Property Owners Association, stated the project is located outside of the beach area but it is a very major project for Delray Beach and spoke regarding traffic. They have a serious concern with the major increase in density and NE 7`h Avenue. He asked whatever is built regarding density, that 7th Avenue remains public and that parallel parking not be allowed on the north side of Atlantic Avenue close to the bridge. 1VIr. Katz thanked Commission and the developer for rescheduling the hearing. Sheryl Jones, SE 7th Avenue and resident for over 20 years, Delray Beach, spoke regarding the traffic study and stated the study did not include SE 7th Avenue. She asked Commission to do something about traffic calming and stated the plan has less office space than it did four years ago. Kristine De' Haseth, 235 NE 6`h Avenue, Delray Beach, stated that Commission has been asked to consider compatibility, building mass and intensity. She spoke regarding the project and unintended consequences. Jackson Langford, NE r' Court, Delray Beach, stated he and his late wife moved here 20 years ago because of the quiet and charm of the city. He spoke regarding compatibility and density of the project. He stated the project can be a success just not in its existing form. November 13, 2012 Bill Plum, asked Commission to approve the project and read a statement into record regarding the project. He stated he feels, as a team, he, Jeff Edwards and Carl DeSantis have created an outstanding work of art. Dan Carter, 3204 Lakeview Drive, Delray Beach, stated he has put together some sketches of building mass studies and feels no one has done this. He stated this is a city altering project and the density and scale is too intense for this area. He stated not much has been said about the impact of this on Veterans Park. He commented regarding the taxes generated by this project and stated that will go to the Community Redevelopment Agency and not the city. Card Glickstein, Delray Beach, stated Commission has a difficult task tonight balancing the proposal with the Village By The Sea character. He stated the project will change Atlantic Avenue and nearby neighborhoods forever. Mr. Glickstcin read a statement into record and asked Commission to send this back to the drawing board. Zack, 32 SE a Avenue, Delray Beach, stated the last time he was present at the Planning and Zoning Board Meeting the city's goals and how this project meets those goals were discussed. He reiterated some of the points from that meeting. Shelly Petrolia, resident of Delray Beach, thanked Commission for allowing them to speak and stated she has concerns regarding the project. She spoke regarding the apartments, jobs, transportation, etc. Ms. Petrolia stated her biggest concern is density and it is a very sensitive parcel of land with the Intracoastal on one side and a neighborhood on the other. She asked Commission to make sure that this is a project that this area can handle. Tony Newbold, 401 West Atlantic Avenue, Delray Beach stated he remembers when Atlantic Avenue was a two lane road heading to the west and commented regarding development in the past. He stated he is extremely proud of what Delray Beach has become and this project should be approved although there are other issues to be worked out. He stated he believes it meets the city's needs moving forward. Robert Ganger, Chairman of the Florida Coalition for Preservation with membership of about 1500 families, stated they support a redevelopment of this area and when they get it right it will have a positive impact for generations to come. He spoke regarding office space in 2008 -2009 and stated there has been a fundamental change in the plan. He stated the office space part of the plan is not being thought through and urged Commission to ask the developer to come back with a plan that everyone will be proud of. Norma Hirshfield, 310 East Mallory Circle, Delray Beach. read a statement into record stating it is the job of the Commission to act in the best interest of the citizens of Delray Beach and to follow the Comprehensive Plan. She stated nothing about this project fits and commented regarding the Planning and Zoning Board meeting. Margery Johnson, 46 Marine Wa34 Delray Beach, commented regarding Carolyn Patton-'s photo of parking on her street and spoke about density. She asked Commission to consider what they are doing to the town. November 13, 2012 Ralf Brooks, Attorney, provided background information regarding his career and stated he would like to object to the increase in height and density, because of the increased impact to the residential neighborhood. He discussed findings pertaining to the Comprehensive Plan regarding the project He stated citizens are here speaking because they are not in favor of the project. Greg Weiss, Chair of Economic Development /Chamber of Commerce, Delray Beach, stated the Chamber of Commerce is in support of this project. Mr. Weiss read a letter into record. Jim Smith, Chairman of SAFE, Delray Beach, spoke regarding Atlantic Plaza II and asked Commission to make sure that all of the promises the developer made tonight be included as conditions of approval and stated SAFE has done their research regarding traffic. He asked Commission to base their decision on facts. Francisco Perez Azua, 55 SE 2nd Avenue, Delray Beach, stated he is here to support the project and stated you cannot separate density and height that is what the Land Development Regulations (LDR) is about. He stated Commission can approve density and height, continue to improve the elevations and site plan and address traffic issues of the project. He spoke regarding job creation. Clair Johnson, 46 Marine Way, Delray Beach, stated he is a half block away from the project and read a statement into record. He asked Commission to have the developer go back to what was approved five years ago. Victor Kim% Former President of Tierra Verde, Delray Beach, stated he has been before Commission at eveiT meeting in the last 3 and 1/2 years. He commented regarding developers, residents and Worthing Place. Vin Nolan, Economic Development Director, Delray Beach, stated he supports the project and it is an important project for the business development growth of Delray Beach. He stated everyone in the business corridor is negatively affected by the existing conditions. Mr. Nolan stated the proposal does not violate code. and the developer needs the density and the height to make the financial models work. Benita Goldstein, Palm Trail, Delray Beach, stated she attended the Downtown Development Authority Fleeting today. She asked what precedent is being set and stated this is all about the future. Ms. Goldstein commented regarding traffic and density. Jeff Costello, Assistant Director Community Redevelopment Agency, Delray Beacb. stated the CRA board looked at factors and the approved development order. He commented regarding office space and average daily trips; and stated the CRA is extremely supportive of the Class A Office space and the residential in the downtown area to provide a sustainable downtown. Mr. Costello spoke regarding the taxes from the project Mares To Beckman, Trol?ic Harbor, Delray Beach, stated she represents the "Raging Grannies ". She spoke regarding the project and stated this is a wonderful community here and commented about Atlantic Avenue and the beach. Ms. Beckman also spoke regarding just improving the plaza. November 13, 2012 James Quillien, Osceola Park, Delray Beach, commented regarding uncontrolled growth in Fort Lauderdale and Miami. He stated there is big money at stake and the developer will make a profit on the backs of the residents. Chris Brown, 218 NW 9th Street, Delray Beach and has lived here for 15 years, stated a lot has changed in Delray Beach since 1991 for the better and he would judge the project based on several things. He stated this project is an example of increasing the quality and will bring the kind of retail the city does not have now. He stated Commission should consider this favorably and feels it will fill in a gap that is very necessary. There being no one else who wished to address the Commission regarding the conditional uses for Atlantic Plaza II, the public hearing was closed. Mr. Dorling had no cross examination or rebuttal. Mr. DeSantis stated he and Mr. Edwards would like to take questions from the Commission and spoke regarding the approval of the project in 2000 and a lawsuit. Mr. Jeff Edwards stated he had no specific rebuttal but could answer questions. Commissioner Carney asked about the traffic study and stated it was dated in June. He asked if there are any figures related to peak season. Adam Kerr with Kimley Horn and Associates stated the traffic studies are based on peak season and spoke regarding the Department of Transportation. Mr. Carney stated he spent some time going through the petitions and asked how the developer will insure that the rentals will not be rented to transients. Mr. Edwards spoke regarding the leases. In addition, Mr. Carney stated there was a comment made about underground parking in the petition and others here. He asked if any successful underground parking has been provided anywhere in south Florida along the Intracoastal and if there were statistics backing this up. Mr. Edwards stated every one of their civil and structural engineers is based out of Florida and Mr. DeSantis discussed the underground parking and consultants, etc. that they have used to do their preliminary study work. Mr. Edwards stated that they are doing everything they can to keep the garages out of the ground and as far away from the water table as possible. lbir. Carney spoke regarding rentals and homeowners and what happens if Phase 11 does not get built. Mr. Edwards discussed the phases and stated they have a plan in the interim that addresses traffic and parking at that time. Mr. Frankel stated he has no questions and feels everything has been explained very well. In addition, he thanked the public for coming out tonight and stated he received emails and tried to respond to everyone. He stated it is initially important to recognize Mr. DeSantis, Mr. Milmo, Mr. Edwards, and Bill and Elaine Morris. He stated with the exception of Mr. Edwards everyone else are locals who give to the community. He stated he lives close to the project and he will consider himself as very familiar with the traffic patterns and the other concerns presented tonight. He stated what he has gathered from both sides is that everyone here loves Delray and pointed out what he felt were positives. Mr. Frankel acknowledged certain comments from the public regarding office space and parking. He thanked Mr. Jim Smith for his information and stated he sees two issues that we are here to discuss: height and density. 8 November 13, 2012 He stated he has no issue with the height but the density needs improvement. He stated his issue is the units and the 3 to 1 ratio of renting versus owning. Mr. Frankel stated he met with Mr. Katz and Mr. Patton and stated previously a charrette has not been done on this project and he would like to see time given to take this into account. He stated he is not prepared to approve what is presented with the residential components being so dense. Mrs. Gray thanked everyone who came out and expressed their concerns. She asked questions regarding traffic concerns on NE 7'h Avenue and if there is anything that can be done on SE 7`h that will prevent the traffic from going through the neighborhood. Mrs. Gray also asked about the road staying public. Mr. Dorling stated that section of the road has been abandoned based on Commission's previous approval and it functions for public purposes. Mr. Brian Shutt, City Attorney, explained the abandonment and easement. Mrs. Gray asked about the Leed Certification and what is being done regarding this. lair. Edwards provided an update. Mrs. Gray asked how the traffic will flow through the garage off of NE 7d' and how much the rentals units will be. Mr. Edwards stated the rentals will be $1,200 up to mid $2,000 range per month and explained the parking for the garage. Mrs. Gray asked about Veterans Park and its parking as it exists today. She asked if this has been looked at as well. Mr. Dorling stated this is based on a draft plan that the city has done but has not yet come before Commission for approval. Mrs. Gray stated the green space is going to be very important and asked if there is any more open space for the project. She stated she is in favor of economic development, redevelopment and likes the project. However, she does not like the density. She asked if it was possible for the developer to come back with something else regarding the density. Mr. Jacquet thanked lair. Edwards for his interest in the city. He stated the residents and Mr. DeSantis wants what is best for the city and stated he believes in a win -win situation. Mr. Jacquet stated that is not where the project is right now. He commented regarding office space and Mizner Park. He stated underground parking is a concern. Mr. Jacquet also commented that this is a long term decision - decades into the future and stated we have to be mindful of the decision we make and would like to see this worked out as win -win. He thanked Mr. Jacobson for his points. He spoke about the facade on the north side of Atlantic Avenue and regarding the stability of the nearby neighborhoods. Mr. Jacquet stated he loves Veterans Park and asked the developer to not change the park too much. Mr. Jacquet responded to comments made by Victor Kitson and stated he was pleased to see the Economic Development team here and feels they have been working hard. He stated he does not feel comfortable going forward with the project the way it is. He stated he was glad to see the Chamber of Commerce present as well. Mr. Jacquet stated he would like to see more diversity regarding the number of bedrooms for the units. 9 November 13, 2012 He stated that he thinks development is needed in that area and has concerns about the current plan but is reassured that the developer is truly willing to work with the city in making this work. However, he will not vote in favor of the plan the way it is now. Mr. Carney stated he is finally glad to be able to discuss this issue. He stated he has spent a lot of hours reading the emails and trying to respond to them. In addition, he stated he took time to review the LDR and thanked Jeff Edwards, Bill Morris and Mr. DeSands for committing to the city to invest $200+ million which is a great thing for the city. Mr. Carney stated that he cannot support the project in this form. He stated he thinks the density is too high and it needs to be compatible with the neighborhoods. Also, he stated he would like to see commitment regarding one year leases, etc. He asked the developer to focus more on Class A office space and spoke regarding in town- residents. Mr. Carney stated he was thrilled to see everyone come out tonight. He stated he supports the redevelopment of this project but cannot support it in this form but is confident that we can get there.. He encouraged the developer to defer consideration of this item to another meeting to have time to absorb the comments and try to re- incorporate them and see what he can do. Mayor McDuffie stated when you are building something in any community it is always a passionate thing. He stated the city does not have any plans to sell Veterans Park -it belongs to the city. lair. David T. Harden, City Manager, stated the park cannot be sold it is Deed Restricted. He commented regarding Class A office space and stated this project brings the office space the city is looking for. Mayor McDuffie commented regarding previous site plans for Atlantic Plaza as well as the current one. He discussed the goals and planning regarding Atlantic Avenue and upcoming partnerships. He commended the developer and partners. He stated the plan is not where everyone wants it today and although they have not had chartettes they have had meetings for community input. He stated Commission is here tonight to decide two things: density and height; and asked everyone to think about what compromise can be made. Mr. Frankel asked Mr. Shutt about making a motion to defer. Discussion ensued with the developer, City Attorney and Commission. The City Attorney clarified that this will be a continuation of this hearing. Mr. Frankel moved to continue the conditional use requests for Atlantic Plaza II (Quasi-judicial Hearing} to a time certain of December 4, 2012 at 6:00 p.m., seconded by Mr. Carney. Upon roll call the Commission voted as follows: Mr. Jacquet — Yes; Mr. Frankel — Yes; Mrs. Gray — Yes; Mayor McDuffie — Yes; Mr. Carney -- Yes. Said motion passed with a 5 to 0 vote. Mayor McDuffie adjourned the Special Meeting at 10:34 p.m. and at this point, the Commission took a ten minute break. Mayor McDuffie left the meeting at 10:39 p.m. Vice Mayor Carney opened the Workshop meeting at 10:43 p.m. 10 November 13, 2012 Mr. Frankel made a motion to move Workshop Items WS.2, WS.3, WSA and WS-5 to the November 20, 2012 Regular Commission Meeting, seconded by Mrs. Gray. Upon roll call the Commission voted as follows: Mr. Frankel --- Yes; Mrs. Gray — Yes; Mr. Carney — Yes; Mr. Jacquet — Yes. Said motion passed with a 4 to 0 vote. WORKSHOP MEETING AGENDA 1. Proposed Partnership with the YMCA of South Palm Beach County Mr. David T. Harden, City Manager, introduced this item and stated he, -Mr. Dick Pollack and Mrs. Linda Karch have had several meetings with the YMCA about the possibility of doing a joint project on the Western Community Center (Family Recreation and Fitness Center) and they have a conceptual outline of how that might work. He stated if this meets with Commission approval staff would like to take the next step and draft a detailed agreement on how our partnership would function. Mr. Pollack, President and CEO of the YMCA of South Palm Beach County, stated they have operations in Boynton Beach and Boca Raton. He introduced Paul Adkins, President and CEO of Florida Peninsula Insurance and Chairman of the Board of the YMCA of South Palm Beach County and a volunteer. Mr. Pollack gave an overview and conducted a Power-Point presentation regarding the concept and the YMCA services and programs. Mr. Frankel stated he thinks this is great and thanked Mr. Pollack for their patience tonight. He stated he will go along with Mr. Hatden's recommendation that staff be authorized to draft a formal partnership agreement with the YMCA. Mrs. Gray stated she is excited about this project and asked what the preferred rates are. She asked how the community children will fit into the YMCA. In addition, Mrs. Gray asked questions regarding the pool. Mr. Jacquet stated this is a great plan and he is in support of it. He stated the community out west needs something to do for seniors and youth. He asked about financial aid for youth regarding fees to use the facility. At this point, the City Attorney informed the Commission that it is eleven o'clock and according to the local rules, a vote was needed to continue the meeting. Mr. Jacquet made a motion to continue the meeting past 11:00 p.m., seconded by Mrs. Gray. Upon roll call the Commission voted as follows: Mrs. Gray — Yes; Mr. Carney — Yes; Mr. Jacquet — Yes; Mr. Frankel — Yes. Said motion passed with a 4 to 0 vote. Vice Mayor Carney commented regarding the bond issue and asked about the senior center. He stated there is a whole segment of the community in that area that are counting on there being something just for them. He spoke regarding the seniors and stated he would like to see something in the agreement for seniors. I1 November 13, 2012 Mr. Pollack spoke regarding membership units and target markets. It was the consensus of the Commission to move forward with this. 2. Financial Review Board Recommendations regarding Delray Beach Memorial Gardens Municipal Cemetery This item was moved to the November 20, 2012 Regular Commission Meeting. 3. State and Federal Lobbying Services This item was moved to the November 20, 2012 Regular Commission Meeting. 4. Discussion regarding Pension Fund Management 'Phis item was moved to the November 20, 2012 Regular Commission Meeting. 5. Policy on Naming of Public Facilities This item was moved to the November 20, 2012 Regular Commission Meeting.
