DECEMBER 7, 2012
A Special Meeting of the City Commission of the City of Delray Beach, Florida, was called to order
by Mayor Nelson S. McDuffie in the Commission Chambers at City Hall at 9:00 a.m., on Friday
December 7, 2012.
Roll call showed:
Present - Commissioner Thomas F. Carney, Jr.
Commissioner Alson Jacquet
Commissioner Adam Frankel
Commissioner Angeleta E. Gray
Mayor Nelson S. McDuffie
Also present were - Brian Shutt, City Attorney
Lanelda D. Gaskins, Deputy City Clerk
Mayor McDuffie called the Special Meeting to order and announced that it had been called for the
purpose of considering the following Items.
Mayor McDuffie stated that the flags are at half mast today in honor of Pearl Harbor Remembrance
Day. The Commission observed a moment of silence for those men and women that lost their life
during Pearl Harbor.
SPECIAL MEETING AGENDA
1. PUBLIC INTERVIEWS: The Commissioners will conduct public interviews for the
four (4) finalists for the City Manager position.

b. 10:00 a.m. Douglas Smith
c. 11:00 a.m. Paul White
d. 12:00 p.m. Oel Wingo
Mayor McDuffie provided instructions to the Commissioners as follows: the Commission will
conduct one hour interviews for each candidate. During each interview, the Commission will
have 55 minutes to ask the candidates questions including the questions from the public, and
each candidate will have five minutes of closing remarks. The questions received from the
public will be reviewed to make sure the questions meet Equal Employment Opportunity
Commission (EEOC) requirements. Mayor McDuffie suggested that upon completion of all
candidate interviews, the Commission make a motion to direct staff to enter into deliberation
and negotiations with Candidate X.
During each interview, the candidates were asked various questions by the Commissioners.
Mayor McDuffie asked the questions submitted by the public. Each candidate responded to the
questions and gave their closing remarks.
Mayor McDuffie thanked everyone for their attendance and for submitting some great
questions. He informed the Commission and members of the public that each Commissioner
would write down their top two choices on a ballot, the ballots will be tallied and the
Commission will continue until there is a clear cut winner. Mayor McDuffie also thanked Kurt
Bressner, ICMA, Florida City and County Management Association (FCCMA) range rider for
his assistance with the New City Manager search.
2. FINAL SELECTION OF THE NEW CITY MANAGER: Consider approval of the
final selection for the new City Manages and authorize staff to enter into contract
negotiations.
Mayor McDuffie asked the Commission to write down their choice one and choice two on a
ballot, pass the ballots to the City Attorney for tally of the votes, and the rankings will be 1 and 2.
Mr. Brian Shutt, City Attorney, asked if he is to tell the rankings based on 1 and 2. He also asked
each Commissioner to sign their ballot.
Mayor McDuffie stated that Commission had the pleasure to interview each candidate on a one
on one basis and have dinner with them. All four candidates are incredible. This will be a tough
decision for Commission.
The City Attorney stated the first choice was as follows: Louie Chapman-mo #1's, Douglas
Smith -one #1, Oel Wingo -one #1 and Paul White -one #1. the second choice was as follows:
Douglas Smith -three #1's, Louie Chapman -one #1, and Oel Wingo -one #1.
City Attorney Shutt stated that the ballot is not a binding vote. The Commission will have to
make a motion for the vote. He stated that the Commission is trying get to a consensus.
Commission continued to discuss the rankings and choices.
It was the consensus of the Commission to remove the lowest vote getter, re -rank the remaining
candidates and submit the top two choices on a ballot.
The City Attorney stated on round two, the first choice was as follows: three (3) votes for
Douglas Smith, and two (2) votes for Louie Chapman. The second choice was as follows: three
(3) votes for Ocl Wingo and two (2) votes for Louie Chapman.
Commission continued to discuss the rankings and choices.
Consensus of the Commission was to eliminate the number two choices and choose between
Douglas Smith and Louie Chapman.
Mr. Shutt stated on round three, the first choice was as follows: three (3) votes for Douglas
Smith and two (2) votes for Louie Chapman.
Mayor McDuffie stated Commission can discuss or he can entertain a motion.

It was the consensus of Commission to continue discussion.
Kurt Bressner stated that the Commission is down to a very important point and spoke as
follows: whatever the Commission decides to do in terms of authorizing the City Attorney to
move forward with negotiation for a candidate, keep in mind that there is a number two
candidate. From a direction point of view as well as an expression from the Commission if the
Commission could see its way through for a unanimous vote for the direction, it would be
beneficial for the parties involved. Recognizing that if Commission does not come to terms with
candidate number one there is still an opportunity to talk with candidate number two. It is
important for the incoming City Manager to receive support from the Commission.
Brief discussion between the City Commission continued.
Mayor McDuffie asked the Commission to write down their choice on a ballot and pass the
ballots to the City Attorney for tally of the votes. He thanked Bruce Koeser, Human Resources
Director and staff for preparing the Commission for the interviews.
Mr. Shutt stated that the vote did not change; the vote is still 3 -2.
Mr. Bressner stated that it is beneficial to the candidate to have a unanimous vote. He stated that
another alternative would be to have a second set of interviews for the top two candidates.
Discussion between City Commission and staff continued.
Mr. Frankel made a motion postpone the final selection for the New City Manager to the
December 11, 2012 Regular Meeting, seconded by Mr. Jacquet. Upon roll call the Commission
voted as follows: Mr. Jacquet — Yes; lair. Frankel — Yes; Mrs. Gray — Yes; Mayor McDuffie -
Yes; Mr. Carney — Yes. Said motion passed with a 5 to 0 vote.
Mayor McDuffie adjourned the Special Meeting at 2:04 p.m.
