AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING CHAPTER 4, "ZONING
REGULATIONS" SECTION 4.4.13 "CENTRAL BUSINESS (CBD)
DISTRICT ", SUBSECTION 4.4.13 (G) "SUPPLEMENTAL
DISTRICT REGULATIONS ", OF THE LAND DEVELOPMENT
REGULATIONS OF THE CODE OF ORDINANCES OF THE CITY OF
DELRAY BEACH, FLORIDA, TO CLARIFY THE PARKING
REQUIREMENTS FOR THE CENTRAL BUSINESS DISTRICT,
PROVIDING A SAVING CLAUSE, A GENERAL REPEALER
CLAUSE, AND AN EFFECTIVE DATE.
WHEREAS, pursuant to Section 1.1.6 of the City of Delray
Beach Land Development Regulations, the Planning and Zoning Board
reviewed the proposed revisions at its meeting of October 18, 1993,
and forwarded this revision to the City Commission with a
recommendation of approval; and,
WHEREAS, pursuant to Florida Statute 163.3174(1)(c), the
Planning and Zoning Board, sitting as the Local Planning Agency, has
determined that this ordinance is consistent with the objectives and
policies of the City of Delray Beach Comprehensive Plan.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 4, "Zoning Regulations ", Article 4.4
"Base Zoning District ", Section 4.4.13 "Central Business (CBD)
District ", Subsection 4.4.13(G) "Supplemental District Regulations ",
of the Land Development Regulations of the Code of Ordinances of the
City of Delray Beach, Florida, be, and the same is hereby amended to
read as follows:
(a) Within that portion of the DDA bounded by
Swinton Avenue on the west. North 1st Street on the
north. the Intracoastal Waterway on the east and
South 1st Street on the south. parking requirements
shall apply to new floor area only. Changes in use
shall not be required to provide on -site parking.
The parking required for the creation of new floor
area shall be at the rate of one space for each 300
square feet, or fraction thereof, of floor area in
addition to the replacement of any previously
required parking which may be eliminated. Within
all other geographic areas of the CBD
Zone District, the provisions of Section

After January 1. 1994, when the parking
requirements of Section 4.6.9(C) are applied
to either new development or a change in use.

occur once.
(c) If it is impossible or inappropriate to
provide required parking on -site or off -site,

Section 2. That should any section or provision of this
ordinance or any portion thereof, any paragraph, sentence or word be
declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a
whole or part thereof other than the part declared to be invalid.
Section 3. That all ordinances or parts of ordinances which
are in conflict herewith are hereby repealed.
Section 4. That this ordinance shall become effective
immediately upon passage on second and final reading.
