DISCUSSION OF NOISE ORDINANCE
ITEM BEFORE COMMISSION
The Commission discussed the proposed revisions to the Noise Ordinance, as developed by the City
Attorney's Office, at the regularly scheduled workshop meeting on February 12, 2013. The Downtown
Development Authority hosted meetings with businesses on this issue; however a number of residents
wanted to ensure neighborhood issues were addressed within the proposed ordinance. Staff hosted a
meeting, inviting both business owners and residential properties owners, at the Delray Beach Library
on May 13, 2013. I have attached a summary of the comments made at that meeting for reference.
One of the specific comments suggested establishing a committee representing restaurant and residential
property owners to work with the City Attorney to develop a new Noise Ordinance. Staff would not
recommend this process. The input meetings held to -date have been broad -based and
sufficient. Secondly, several comments were centered on establishing an "Entertainment District." This
implies a designated area where music can be played louder and later into the night and in some
instances, have more relaxed rules associated with public consumption of alcohol. Also, it may be
difficult to determine a boundary that is all inclusive.
RECOMMENDATION
Based on these comments and considering the proposed language drafted under the new ordinance, staff
is recommending the Commission move forward with adopting the Noise Ordinance as proposed.
Noise Ordinance Meeting
May 13, 2013

Lula Butler, Community Improvement Director: Opened meeting at 3:46pm, stating
that we are here to listen to the residents and business owners with regard to the
proposed Noise Ordinance which was distributed.
Brian Shutt, City Attorney: Gave an overview of revised Noise Ordinance presented to
City Commission in March and they agreed to table the item preferring to hear
additional input from the public.
Comments from participants at the May 13th meeting are listed below:
Gail Lee McDermott
• The residents would like to recommend creating a committee that consisted of
Brian Shutt, City Attorney, three (3) restaurants owners and three (3) residents to
put together an ordinance that everyone would be able to live with for the entire
City. She stated that Fran Marincola has worked on this.
Fran Marincola
• A lot of people do not know how instrumental Lula and Marjorie were in
making the town as it is today.
• He represents the Beach Property Owners (1,100 people), New Mammoth
Condo (23 people) and is a restaurant owner with music.
• Times 11:OOpm - 1:OOam: At eleven o'clock in season from Thursday to Sunday
98% of 260 restaurants are closed, about to be closed or closing. (Not concerned
with this time.)
• Times 1:OOam - 2:OOam: Closing time of 2:OOam the bar is cleared of glasses and
bottles and the customers are leaving. Responsible bar owners have last call at
1:15am. This ordinance is flawed because it only allows music /noise until
1:OOam. The bars do not close until 2:00am.
• Violation of Ordinance: (Patrick Dooley) Ordinance says when we disturb the
peace, quiet and comfort of neighboring inhabitants.
• Ordinance needs to go back to 24 hours if we are not going back to decibels.
• When setting up the committee, Restaurants/ Bars that border neighborhoods
should have one (1) person on it, one (1) resident and one (1) bar owner on
committee.

Barry Tunick, NE 4 Avenue
• Has constantly complained over 15 times about noise. He invested $8,000 to
have impact windows and he still hears noise.
• Cannot differentiate noise from one restaurant to the next. He does not feel that
restaurants have a right to make noise at 1:OOam. The sound of noise at 3:OOpm is
very different from noise at 1:OOam.
• The EPA has a simple guideline for what constitutes excessive noise as the
following: all should be 32 decibels, 5' from the outside surface of that building.
• If all are required to turn off at 11:OOpm it would be fair. Competitive advantage
should be the same. It is not safe on Atlantic Avenue after 11:OOpm.
Sherwood Forest Resident, Whatley
• Has experienced loud noise from residential neighbors usually until late night.
• Overjoyed to have an ordinance that will have enforcement opportunity. Does
not want the ordinance to be weakened for the neighborhoods.
Burt Rappaport, Deck 84
• We all know that we are not going to have something both residents and
businesses are 100% happy with. The original ordinance struck that happy
medium. Structure an ordinance that is as close to the original ordinance as
possible.

• Band stops at 1:OOam on the weekend. Either allow or do not allow live music.
Downtown needs to be designated as an Entertainment District.
• If you move downtown, you choose to live in the downtown area and the impact
if that choice.

• 1:30am - 2:OOam still hear music. Noise is ridiculous and time for a change.
• Delray has loose rules, lived in France and we are destroying Delray.
• Bringing drugs, crime and prostitution.

• Delray Beach is a "Fun City ". Thousands of people get enjoyment from live
music.
• Compare the numbers that come to enjoy the City nightly with the 40 people in
this room.

• Who will pay or be responsible to pay fee? Lula answered that the citation can be
paid by either the owner or renter.

• The noise Thursday through Sunday is extremely loud; the later it gets, the
louder is gets. Has driven downtown and the doors of the restaurants are open
with the music coming out. Sometimes cars in the parks are playing music;
Sometimes it does not stop until 3:00am in the morning.

• Has lived in Delray Beach for 23 years.
• Thinks we should go back to the original ordinance and tweak it. Do not
reinvent the wheel.

• Lives behind Tim Finnegan s Irish Pub and you do not hear anything from them.

• Keep the noise inside.

• Thought it was a good idea to incorporate into leases that anyone moving into
the location acknowledges that they are next to a bar.
• He works hard to monitor his bar sounds.

• Why cant the restaurants/ bars be made to have doors as a start? I1 Bacio was
developed earlier and has a variance on this site, and it is legal what they are

CHAPTER 99 "NOISE CONTROL" OF THE CODE OF
ORDINANCES OF THE CITY OF DELRAY BEACH, BY
AMENDING SECTION 99.02, "DEFINITIONS" TO REMOVE
DEFINITIONS "COMMERCIAL ", "INDUSTRIAL" AND
"OFFENSE "; AMENDING SECTION 99.03, "LOUD AND
UNNECESSARY NOISES PROHIBITED" TO CLARIFY SAME
AND TO AMEND DISTANCE AND TIME REQUIREMENTS;
AMENDING SECTION 99.04 "EXEMPTIONS" TO CLARIFY
SAME; AMENDING SECTION 99.05 "TEMPORARY

WHEREAS, excessive sound is a serious hazard to public health, welfare, safety and quality
of life; and,
WHEREAS, people have a right to and should be ensured an environment free from
unreasonably excessive sound as would jeopardize their health, welfare or safety or degrade their
quality of life; and,
WHEREAS, the City Commission of the City of Delray Beach desires to prevent such
unreasonably excessive sound as would jeopardize the health, welfare or safety of its citizens or
degrade their quality of life; and,
WHEREAS, the City Commission of the City of Delray Beach desires to amend current
Noise Control provisions of its Code of Ordinances to comport with recent changes to the law.
WHEREAS, the City of Delray Beach has the authority to prohibit sounds that are
unreasonably loud, excessive, or unnecessary or plainly audible at a certain distance. ,See DA
Mortgage, Inc v. City ofMiami Beach, 486 F.3d 1254, 1272 (11th Cir. 2007).
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the recitations set forth above are incorporated herein.
Section 2. That Section 99.02 "Definitions" of the Code of Ordinances of the City of
Delray Beach, Florida, be and the same is hereby amended to read as follows:
Sec. 99.02. - DEFINITIONS.
The following words, terms and phrases, when used in this article, shall have the
meanings ascribed to them in this section, except where the context clearly indicates a
different meaning:
Amplification device. Any instrument, machine, or system, which by electronic means
augments sound by increasing the sound level or volume.
Amplified sound. Sound augmented by any electronic means that increases the sound
level or volume.

One day. A 24 -hour period from noon to noon.
Premises. Any real property or parcel of land, including the buildings, structures or
other improvements thereon.
Residential area. For purposes of this chapter only, residential area shall include the
following zoning districts:
(1)

R -1- AAA -B;
(3)
R -1 -AA;
(4) R- 1 -AA -B;
(5) R -1 -A;
(6) R- 1 -A -B;
(7) RM;
(8) RR;
(9) A;
(10) PRD;
(11) MH;
(12) RL;
(13) Community Facilities (CF);
(14) Open Space (OS);
(15) Open Space & Recreation (OSR); and
(16) Conservation District (CD).
Structure. A building of any kind, either temporary or permanent, which has a roof
over it.
Violator. A person or entity determined or cited by a code inspector or a law
enforcement officer as being in violation of the provisions of this article.
Section 3. That Section 99.03 "Loud And Unnecessary Noises Prohibited" of the Code
of Ordinances of the City of Delray Beach, Florida, be and the same is hereby amended to read as
follows:
Sec. 99.03. - LOUD AND UNNECESSARY NOISES PROHIBITED.
It shall be unlawful for any person to make, continue or cause to be made or
continued any unreasonably loud, excessive, or unnecessary noise.
(A) Certain Acts Declared Unlawful. The following acts, and the causing thereof,
among others, are declared to be unreasonably loud, excessive, or unnecessary noises and in
violation of this Chapter:
(1) Radios, televisions, musical instruments, loudspeakers, etc. Using, operating,
or permitting to be played, used or operated any radio receiving set, television set,
musical instrument, loudspeaker, public address system, sound truck or other
machine or device for the producing or reproducing of sound in such manner as to
disturb the peace, quiet and comfort of the neighboring inhabitants, or at any time
with louder volume than is necessary for convenient hearing for the person or
persons who are in the room, vehicle or chamber in which such machine or device is
operated and who are voluntary listeners thereto.
(a) The operation of any such set, instrument, machine or device
between the hours of 11:00 pm and 7:00 a.m. in such a manner as to be
plainly audible at a distance of 100 feet from the boundaries of the property
surrounding the building, structure, or vehicle in which the device is located,
except as set forth in Section 99.03(4(l)(a)(i). shall be prima facie evidence
of a violation of this section.
(i) For buildings or structures used for commercial purposes in the
Central Business District (CBD) and in the Central Business District -
Railway Corridor (CBD -RC), operation of any such set, instrument,
machine or device between the hours of 11:00 p.m. and 7:00 a.m.
Sunday through Thursday and between the hours of 1:00 a.m. and
7:00 a.m. Friday and Saturday in such a manner as to be plainly
audible at a distance of 100 feet from the boundaries of the property
in which the device is located shall be prima facie evidence of a
violation of this section.
ii) The 100 -feet distance shall be measured in a straight line from any
point on the property line of the sound source as shown in the
accompanying illustration.
(b) Where the noise source is located in a building or other structure, the

(b) Where the noise source is located in a building or other structure, the
owner, occupant, resident manager or other person in charge of the premises
shall, if present, be presumed to have permitted the noise in the absence of
evidence to the contrary.
(2) Animals and Birds. Owning, possessing or harboring any dog, animal
or bird which causes frequent, habitual or long continued noise which is plainly
audible at a distance of one hundred (100) feet from the building, structure or yard in
which the dog, animal or bird is located. This provision shall not apply to public
zoos.
(3) Loading and Unloading. Loading, unloading, opening, closing or other
handling of boxes, crates, containers, building materials, garbage cans or similar
objects in a manner as to cause an unreasonably loud or excessive sound.
(4) Construction. Operating or permitting the operation of any tools or
equipment used in construction, drilling or demolition work in such a manner as to
create an unreasonably loud or excessive sound or vibration.
(a) The provisions of subsection (A) (4) of this Section shall not
prohibit construction, drilling or demolition work between the
hours of 7:00 a.m. and 7:00 p.m. on weekdays, nor prohibit
the use of any temporary pumps or machinery which are
required to be operated twenty -four (24) hours a day in
conjunction with construction work. Subsection (A) (4) shall
also not apply to emergency work for public utilities or where
there is an exemption pursuant to Section 99.04 or where a
temporary permit has been issued pursuant to Section 99.05.
(b) The provisions of subsection (A) (4) shall not apply to the use
of domestic power tools subject to subsection (A)(12)of this
Section.
(5) Vehicle or Motorboat Repairs and Testing. Repairing, rebuilding, modifying
or testing any motor vehicle, motorcycle or motorboat in a manner as to cause an
unreasonably loud or excessive sound.
(6) Refuse Collection Vehicles. No person shall collect refuse with a refuse
collection vehicle between the hours of 7:00 p.m. and 6:00 a.m.
(7) Stationag Mechanical Noise Source. Operating or permitting the
operation of stationary mechanical sources including but not limited to pumps
(except for pumping done pursuant to division (A) (4) (a) of this Section), motors,
fans, compressors, powered tools or similar devices, air conditioning or air - handling
systems, and cooling towers in a manner as to exceed 60 decibels (dB[A]) when
measured at any point on neighboring property line.
(8) Vibration. Operating or permitting the operation of any device on a
property. including bass emanating from audio speakers, so as to produce vibration
that is unreasonable.
(9) Stationary Nonemergency Signaling Derices. Sound or permitting the
sounding of any signal from any stationary bell, chime, siren, whistle or similar device
intended primarily for nonemergency purposes, from any place, for more than ten
(10) seconds in any hourly period. Devices used in conjunction with places of
religious worship shall be exempt from the operation of this provision.
(10) Emergency Signaling Derices.
(a) The intentional sounding or permitting the sounding outdoors
of any fire, burglar or civil defense alarm, siren, whistle or
similar stationary emergency signaling devices, except for
emergency purposes or for testing, as provided in subsection
(A) (10) (b) of this Section.
(b) (1) Testing of a stationary emergency signaling device shall not
occur before 7:00 a.m. or after 7:00 p.m. Any testing shall use
only the minimum cycle test time. In no case shall the test
time exceed sixty (60) seconds and five (5) minutes for
emergency generators.
(2) Testing of the complete emergency signaling system,
including the functioning of the emergency signaling device
and the personnel response to the emergency signaling device
shall not occur more than once in each calendar month. This
testing shall not occur before 7:00 a.m. or after 7:00 p.m. The
time limit for the test time specified in subsection
(A) (10) (b) (1) shall not apply to the complete system testing.
(c) The sounding or permitting the sounding of any exterior
burglar or fire alarm shall comply with the provisions of
Chapter 112.
(11) Motor Vehicles Operating on a Public Kz,&- of -Vay. Motor vehicles on a
Public Right -of -Way are regulated as set forth in F.S. Sections 316.272 and 316.293,
as currently exists or as may hereafter be amended.
(12) Domestic Pourer Tools. Operating or permitting the operation of any
mechanically powered saw, drill, sander, router, grinder, lawn or garden tool, or
similar device used in residential areas between the hours of 8 p.m and 7 a.m.
(13) Schools, Courts, Hospitals. The creation of any excessive or
unreasonably loud noise on any street adjacent to any school, institution of learning,
house of worship or court while the same are in use, or adjacent to any hospital,
which unreasonably interferes with the working of such institutions, or which
disturbs or unduly annoys the patients in the hospital, provided conspicuous signs
are displayed in such streets indicating that it is a school, hospital or court street.
(14) Tampering. The removal or rendering inoperative by any person other
than for purposes of maintenance, repair or replacement, of any noise control device
or element of design of any product having those devices.
Section 4. That Section 99.04 "Exemptions" of the Code of Ordinances of the City of
Delray Beach, Florida, be and the same is hereby amended to read as follows:
Sec. 99.04. - EXEMPTIONS.
The provisions of this Chapter shall not apply to:
(A) Radios, sirens, horns and bells and other sounds created by police, fire and
other emergency response vehicles;
(B) Parades, fireworks displays, and other activities for which a permit has been
obtained from the City Manager or his /her designee pursuant to Section 99.05, within such
hours and in accordance with such restrictions as may be imposed as conditions for the
issuance of the permit; or
(C) The emission of sound in the performance of an activity for which, pursuant
to this Chapter, the City Manager has expressly given a ,
temporary permit
pursuant to Section 99.05.
(D) Noises resulting from emergency work, including but not limited to the use
of generators or other equipment by communications and public utility companies in
connection with a commercial power outage and /or restoration of service operations and
the use of emergency generators due to loss of power other than non - payment of utility
services. The testing of emergency generators shall not occur before 7:00 a.m. or after 7:00
p.m. and shall not occur more than once in each week.
Section 5. That Section 99.05 "Temporary Permits" of the Code of Ordinances of the
City of Delray Beach, Florida, be and the same is hereby amended to read as follows:
Sec. 99.05. - TEMPORARY PERMITS.
(A) Requirements and procedures. The City Manager or his or her designee is
authorized to issue a temporary permit to allow noise when produced by a temporary use or
activity as provided in this section. The City Manager may prescribe any reasonable
conditions necessary to minimize any adverse effect upon the community. A permit granted
under this awe section shall contain all conditions upon which the permit has been
granted, including the decibel limit and the period of time for which the permit has been
granted. Such relief may be granted in the following situations:
(1) 34ecial events. When an applicant is appl, iinng for a Special Use
permit. a temporary permit to allow noise mU be granted at the same time. A
special event is a non - routine happening or social activi , bringing people together in
a defined area on City facilities, right of wad, or private property which requires City
services to ensure safety and coordination. Special events include, but are not limited
to, activities such as festivals, concerts, sporting events, parades, walks and runs, etc.
(2) Temporary events. When an applicant plans to engage intempora uses
or activities on private property which do not significantly endanger the health,
safety or welfare of the community, but which may be in technical violation of the
requirements of this Chapter, a tempora!:� permit may be issued to permit noise
produced by the event. Temporary events include, but are not limited to, store
openings. outdoor markets, carnivals, etc.
(347) Code compliance in progress. When an applicant is utilizing best efforts to
comply with the noise restrictions in this Chapter, but additional time is required for
the applicant to modify his activity to comply and no reasonable alternative is
available to the applicant, such permits may be granted for a period of time not to
exceed ten (10) consecutive days.
(4-2) Construction. When construction activities pursuant to a valid building
permit cannot be carried out in a manner which would comply with Section 99.03,
notwithstanding that all equipment is operated in accordance with manufacturer's
specifications, is in good repair and utilizes all noise baffling methods as specified by
the manufacturer.
(a) The City Manager may authorize any necessary construction
activities to occur earlier and /or later than normally allowed
based upon a finding that:
1. There are no reasonable alternatives;
2. There are no prior code violation adjudications or
fines and no pending construction noise violation
cases against the property owner, contractor, or the
construction site; and
3. There is a significant community need, public purpose
or benefit.
(b) The work authorized by the City Manager may be
conditioned upon reasonable notice to surrounding property
owners and tenants. Permits issued pursuant to such
authorization shall not exceed seven (7) consecutive days.
(c) Notwithstanding the provisions 4-2 (a) and (b), temporary
permits shall be subject to authorization by the building
official under emergency circumstances or when the building
official determines that for reasons of technical necessity
work earlier or later than the time frames normally allowed or
on any day (including Sundays or national holidays) is
required. The work authorized by the building official
pursuant to this subsection shall be conditioned upon
reasonable notice to surrounding property owners and
tenants.
(B) Violation of temporary permit. Failure to comply with any condition of a
temporary permit issued pursuant to this section shall constitute a violation and shall result
in enforcement procedures and penalties as set forth in Section 99.08.
(C) Revocation of temporary permits. Any temporary permit may be immediately
revoked if the City Manager finds that an emergency condition exists involving serious
danger to the public health, safety, or welfare; if the permit holder failed to disclose or
misrepresented material information in the permit application or in the permit application
process; or that there was a failure to comply with any condition of a particular temporary
permit.
(D) The issuance of a temporary permit is a privilege and does not constitute a
right or expectation that said permit will remain in effect. Any permits issued pursuant to
this section shall not constitute or be deemed precedent for the granting of any future
permits.
(E) Appeals. Appeals of the decision of the City Manager or his /her designee
shall be made to the City Commission by submitting the appeal in writing to the City Clerk
within ten (10) days of the denial. Decisions of the City Commission shall be final subject to
appeal of such decision within thirty (30) days to the Circuit Court of Palm Beach County.
Section 6. That Section 99.06 "Notice of Violation" of the Code of Ordinances of the
City of Delray Beach, Florida, shall be amended by repealing it in its entirety:

Sec. 99.08. — NOTICE OF VIOLATION /PENALTY.
(A)
��A code enforcement officer or a law enforcement officer may issue a civil citation
for a violation of this Chapter pursuant to the procedures and amounts listed in Section
37.45 of this City's Code of Ordinances. Each violation shall constitute a separate instance
for which a separate fine may be imposed. A person may receive a separate notice of
violation once every hour if a violation has occurred at any time within that period. A
violation shall be deemed to have occurred on the date that the incident that was the basis
for violation occurred. A violation occurring twelve (12) months after the last violation shall
be treated as a first violation for purposes of incurring new fines and penalties.
(L3) A code enforcement officer or law enforcement officer may issue a notice of
violation of this Chapter and initiate enforcement proceedings to be heard by the code
enforcement board pursuant to the procedures listed in Section 37.36 of this City's Code of
Ordinances and in accordance with the amounts listed below:
(1) If the offense is the first offense to come before the code
enforcement board, a maximum fine of $250.00 may be imposed upon a finding of
guilt by the code enforcement board.
(2) If the offense is the second offense to come before the code
enforcement board within the preceding 12 months, a maximum fine of $500.00 may
be imposed upon a finding of guilt by the code enforcement board.
(3) If the offense is the seee)ftd third offense to come before the code
enforcement board within the preceding 12 months, a maximum fine of $1000.00
may be imposed upon a finding of guilt by the code enforcement board.
(44) If the offense is the fhird fourth offense to come before the code
enforcement board within the preceding 12 months, a maximum fine of $3000.00
may be imposed upon a finding of guilt by the code enforcement board.
(54) If the offense is more than the 4tird fourth offense to come before
the code enforcement board within the preceding 12 months, a maximum fine of
$5000.00 may be imposed upon a finding of guilt by the code enforcement board.
{ (6) For the purposes of this section, "offense" shall mean a finding of

An

(C) This Chapter shall be enforced using procedures set forth in this Chapter,

means available to the City.
Section 9. That should any section or provision of this ordinance or any portion
thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 10. That all ordinances or parts of ordinances in conflict herewith be and the
same are hereby repealed.
Section 11. That this ordinance shall become effective upon its passage on second and
final reading.

ITEM BEFORE COMMISSION
The item before the Commission is a discussion of City Advisory Boards and Commission Liaison
Appointments to various boards.
BACKGROUND
Advisory Boards
At the Goal Setting session held earlier this year (April 2013), the Commission discussed reviewing
City Advisory Boards. The following information is attached for review by the Commission:
- Summary Chart Providing Overview Information on Advisory Boards (including description, absences,
resignations, current projects, what has been produced, whether the board has been effective /duplication
of effort, and estimated staff time)
- Advisory Board Description - document with various board related information (membership, terms,
qualifications, etc.)
- Advisory Board Authori . List - Provides citiations for the authority for the establishment and
operation of various advisory boards
Liaison Appointments
At the April 2013 Goal Setting session, the Commission also discused reviewing the list of Commission
Liaison Appointments to various boards. Attached for review by the Commission is a list of the current
liaison appointments as previously approved by Commission. The only liaison appointments that might
be considered as "required" on the attached list are those boards for which a Commissioner may actually
sit on the board/group as a member (highlighted on the attached list). Liaison appointments can be
revised or removed as directed by the Commission.

AFFORDABLE HOUSING ADVISORY COMMITTEE
Purpose: To develop an Affordable Housing Incentive Plan. This plan sets forth the
policies, procedures and activities that will be carried out with State Housing Initiative
Partnership (SHIP) funds.
Membership: Nine.
Term: Two years after initial appointment.
Qualifications: Residency is not a requirement to serve on this committee. The
membership is composed of the following:
One residential home builder;
One banker or mortgage banker;
One carpenter, plumber or electrician;
One advocate for low - income persons;
One provider of affordable housing;
One real estate professional;
Three citizens -at- large.
Meetings: Called as needed
Liaison: Community Improvement Department, 243 -7282.
BOARD OF ADJUSTMENT
Purpose: To hear appeals from the decisions of the Chief Building Officer, to hear
appeals for variances regarding zoning codes, noise codes, or to hear appeals regarding
decisions of the Fire Marshal.
Membership: Five regular; two alternates.
Term: Two years after initial appointment.
Qualifications: All members must be either a resident of, own property, own a business
or be an officer, director or manager of a business located within the City of Delray
Beach.
Meetings: The first and third Thursday of each month at 5:30 p.m. in the City
Commission Chambers, if there is business.
Liaison: City Clerk's Office, 243 -7056.
CIVIL SERVICE BOARD
Purpose: To hear appeals from employees under Civil Service who have been
discharged, demoted or suspended without pay for a period in excess of seven calendar
days.
Membership: Five regular; two alternates.
Term: Two years for appointed members; one year for elected members.
Qualifications: Three members are to be of different vocations or vocational
backgrounds; not employed by the municipality in any other capacity, official or
otherwise. Two members are to be city employees from different departments, who are
elected by city employees. One alternate is to be appointed by the City Commission,
with a different vocation or vocational background from other appointed members. One
alternate is to be a city employee from a different department than the two regular
members, who was elected by city employees.
Meetings: Called as needed.
Liaison: City Clerk's Office, 243 -7056.
CODE ENFORCEMENT BOARD
Purpose: To hear alleged municipal code violations and to render a decision. The Code
Enforcement Board is a quasi-judicial body, created in accordance with Florida State
Law.
Membership: Seven regular; two alternates.
Term: Three years.
Qualifications: All members must be residents of Delray Beach. When possible, the
membership should include the following:
One architect;
One businessperson;
One engineer;
One general contractor;
One subcontractor;
One real estate person.
Meetings: The second and fourth Tuesday of each month at 1:30 p.m. in the City
Commission Chambers.
Liaison: Community Improvement Department, 243 -7213.
COMMUNITY REDEVELOPMENT AGENCY
Purpose: To revitalize the physical environment and the economy of a defined
geographic area known as the redevelopment area. The Community Redevelopment
Agency is a public body created in accordance with State of Florida Statutes.
Membership: Seven commissioners.
Term: Four years.
Qualifications: Per Florida Statute, any person may be appointed as a CRA
commissioner if he or she resides in or is engaged in business (which means owning a
business, practicing a profession or performing a service for compensation, or serving as
an officer or director of a corporation or other business entity) within the area of the
agency which is coterminous with the municipality and is otherwise eligible for such
appointment. Anyone who resides within the City limits is eligible for appointment. A
CRA commissioner cannot hold any other public office.
Meetings: The second and fourth Thursday of each month at 5:30 p.m. at 20 North
Swinton Avenue.
Liaison: Community Redevelopment Agency, 273 -8640.
DELRAY BEACH HOUSING AUTHORITY
Purpose: To provide decent, safe, sanitary and affordable housing to persons of low -
income. The Delray Beach Housing Authority is a non - profit corporation created in
accordance with Florida State Law.
Membership: Seven.
Term: Four years.
Qualifications: Residency is not a requirement to serve as a commissioner; however,
one member must be a resident, current in rent, of the housing project or a person of low
or very low income who resides within the housing authority's jurisdiction and is
receiving rent subsidy through a program administered by the authority. City officials
and city employees are not eligible for membership.
Meetings: The second Tuesday of each month at 8:15 a.m. at 770 S.W. 12th Terrace,
Delray Beach.
Liaison: Delray Beach Housing Authority, 272 -6766.
DOWNTOWN DEVELOPMENT AUTHORITY
Purpose: To make recommendations to the City Commission for improving the

required to pay taxes. City officials and city employees are not eligible for membership.
Meetings: The third Wednesday of each month at 12:00 noon at 64 S.E. 5th Avenue.

EDUCATION BOARD
Purpose: To advise the City Commission on matters pertaining to education and school
facilities. The Board monitors the activities of the Palm Beach County School Board;
serves as liaison between the school board and the City Commission; and maintains a
continuous public relations effort to improve the public image of the Delray Beach
school s.
Membership: Eleven regular; two students.
Term: Two years.
Qualifications: All members must be either a resident of, own property, own a business
or be an officer, director or manager of a business located within the City of Delray
Beach, or have a child attending a Delray Beach public school. When possible, the
Education Board shall include members who have a background in business, real estate
or education.
Meetings: The first Monday of each month at 5:30 p.m. in the First Floor Conference
Room, City Hall.
Liaison: Community Improvement, 243 -7231.
FINANCIAL REVIEW BOARD
Purpose: To make recommendations regarding revenues, salaries and benefits, operating
expenses, debt service expenses, capital outlay, grants to other entities and transfers to
other funds or any other items that may favorably impact the City's budget and overall
financial condition.
Membership: Seven regular; two alternates.
Term: Two years.
Qualifications: Five seats must be filled with a certified public accountant, accounting
professional, finance professional, certified financial planner, investment advisor,
insurance professional, business owner /manager /officer and someone with an MBA or
MPA degree. The remaining four members may be at large.
Meetings: The second and fourth Tuesday of each month at 8:15 a.m. in the First Floor
Conference Room.

GENERAL EMPLOYEES RETIREMENT FUND COMMITTEE
Purpose: To administer the pension plan for all general city employees. This entails
approval of pension benefits, plan expenses and oversight in the investment of plan
assets.
Membership: Five.
Term: Indefinite. Members serve until a successor is appointed by the City
Commission.
Qualifications: Members may, but need not, be an official or employee of the city.
Meetings: Called as needed.
Liaison: Finance Department, 243 -7116.
GREEN IMPLEMENTATION ADVANCEMENT BOARD
Purpose: To make recommendations regarding ways to improve the environmental
sustainability of City programs, services, equipment and facilities; strategies for
improving the environmental sustainability of the community; incentives for residents,
businesses, and organizations to practice environmental conservation including recycling;
proposed means to enhance water and energy conservation; ideas for promotion of tree
planting and xeriscaping; best practices to be considered for implementation in Delray
Beach.
Membership: Five regular; two alternates.
Term: Two years.
Qualifications: All members shall have expertise or an interest in environmental
conservation and sustainability and must be either a resident of, own property, own a
business or be an officer, director or manager of a business located within the City of
Delray Beach.
Meetings: The fourth Thursday of each month at 9:00 p.m. at the Environmental
Services Facility.

HISTORIC PRESERVATION BOARD
Purpose: To foster and promote the recognition, protection, enhancement and use of
historic resources in the city. The Board serves as a regulatory body with the authority to
act on matters pertaining to historic preservation.
Membership: Seven.
Term: Two years.
Qualifications: All members must be either a resident of, own property, own a business
or be an officer, director or manager of a business located within the City of Delray
Beach. Members will have knowledge, experience, judgment, background, and a
personal or professional interest in historic restoration and preservation. They will have
the ability to make informed and equitable decisions concerning the preservation,
conservation, and protection of historic districts and structures.
Meetings: The first and third Wednesday of each month at 6:00 p.m. in the First Floor
Conference Room, City Hall.
Liaison: Planning and Zoning Department, 243 -7040.
KIDS AND COPS
Purpose: To strengthen the relationship between local youth and the police department
by sponsoring constructive and enjoyable activities which promote harmony and
communication. Reviews issues and seeks solutions to problems facing youth and
suggests to the City Commission certain specific programs and guidelines to address
these identifiable problems.
Membership: Sixteen.
Term: Two years.
Qualifications: Members are selected by school principals, city staff, clergy and civic
organizations subject to ratification by the City Commission. Members may be selected
again for one additional two -year term. The membership is composed of the following:
One representative of the Parks and Recreation Department;
One representative of the Police Department;
One representative of the Police Benevolent Association;
One clergy representative of the Ministerial Association;
One representative of each public elementary school;
One representative of Carver Middle School;
One representative of Atlantic High School;
One youth representative of Atlantic High School;
One representative of MADDADS;
One citizen -at- large;
Other representation.
Meetings: The first Wednesday of each month at 6:00 p.m. at the Delray Beach Police

NEIGHBORHOOD ADVISORY COUNCIL
Purpose: To help maintain broad -based community involvement with the residents,
create neighborhood outreach initiatives, enhance communication, improve the aesthetics
of the neighborhoods and identify any potential threats to the stability of the
neighborhoods.
Membership: Fifteen members consisting of two members from each of six
neighborhood zones, three at large representatives and two students.
Term: Three years.
Qualifications: A member shall be a resident of Delray Beach for at least two years.
Meetings: The third Monday of each month at 5:30 p.m. in the First Floor Conference
Room.

NUISANCE ABATEMENT BOARD
Purpose: To hear evidence relating to the existence of certain public nuisances on
premises located in the City. It provides additional assistance in the continued efforts to
control prostitution, illegal drug activity, and criminal street gang activity, and will
provide citizens with an effective method of addressing such nuisances within the City
limits.
Membership: Five regular; two alternates, each appointed by an affirmative vote of at
least four members of the City Commission.
Term: Two years.
Qualifications: All members must be either a resident of, own property, own a business
or be an officer, director or manager of a business located within the City of Delray
Beach.
Meetings: The first and third Monday of each month (if there is business) at 3:30 p.m. in
the City Commission Chambers.

Purpose: To advise and make recommendations to the City Commission with respect to

TRUSTEES
Purpose: The Police and Fire Fighters Retirement System Board of Trustees has a
fiduciary responsibility to safeguard the assets of the retirement system. The Board is
responsible for the hiring of consultants, a money manager, a fund custodian and
actuarial firms charged with the on -going care and investment of these funds.
Membership: Nine.
Term: Two years.
Qualifications: All members must be either a resident of, own property, own a business
or be an officer, director or manager of a business located within the City of Delray
Beach. The Board of Trustees is composed of the following:

Purpose: Act as an advisory body to the Chief of Police, City Manager and City

to address their issues and community problems through a cooperative effort; to review
community needs and concerns, expectations and responses relative to police services
and community policing. Advises the Police Department on and provides support for
communication and education between the community and the Police Department.
Membership: Thirteen.

Qualifications: The membership shall include a diverse cross section of the community;
business owners, religious and faith based organizations, youth, school officials and local
organizations, where feasible.

Qualifications: Three seats must be filled with either an artist, architect, landscape
architect or engineer. Lay persons of knowledge, experience and judgment who have an

PUBLIC EMPLOYEES RELATIONS COMMISSION
Purpose: To oversee the implementation of the collective bargaining rights guaranteed

appropriate, certifies collective bargaining agents, resolves unfair practice changes and
performs related functions.
Membership: Three regular; one alternate.

Qualifications: Specific background classification is required for each of its members to
ensure equal representation of both labor and management. The membership is

The Metropolitan Planning Organization of Palm Beach County was created pursuant to Chapter
339.175 of the Florida Statutes. Their objectives are to encourage and promote the safe and
efficient management, operation and development of surface transportation systems that will serve
the mobility needs of people and freight within, and through, urbanized areas of Palm Beach County

countywide library services. The intent is to have municipalities work together on issues of
countywide concern or impact and to assist in the resolution of any disputes which may arise
between local governments. The Issues Forum meets on a quarterly basis. Meeting dates are to be
determined.
