Pursuant to Section 3.07 of the City Charter of the City of Delray
Beach¡ Florida¡ Mayor Thomas E. Lynch has instructed me to advise you
of a Special Meeting of the Commission to be held in the First Floor
Conference Room at 6 P.M. on Tuesday¡ September 3¡ 1991.
This meeting has been called for the purpose of considering the
following:
1. Waiver of development standards regarding back-out parking
and perimeter landscaping for improvements proposed at Veterans
Park.
2. Accept a settlement offer in the amount of $4¡000 to settle
the Wagner vs the City of Delray Beach case. City Attorney
recommends approval.

REQUEST FOR WAIV~RS/VETERANS PARK

Action on this item was deferred at your August 27th meeting àt which
time the Commission¡ by consensus¡ directed that this item be
considered at a special mee-ting on September 3 ¡ 1991. This item
involves a request for waivers for the Veterans Park Improvements
project. At your July 16th special/workshop meeting the Commission
reviewed the sketch plan for Veteran's Park and approved it
conceptually. In order to accommodate the relocated lift station and
shuffleboard courts¡ a portion of the existing parking spaces will be
removed. New parking spaces will be provided along the north property
line adjacent to N.E. 1st Street. A portion of the parking spaces
( 12 feet) are located interior to the property line and the balance
within the right-of-way. As these spaces are on the property line¡
the required perimeter landscape treatment cannot be provided.
Additionally¡ relief from the Parking Regulations is also required
because of the back out parking situation created by the proposed
relocation of the parking spaces. Normally¡ relief from the Parking
Regulations requires a variance from the Board of Adjustment.
However¡ the proposed back out parking does not result in an
unnecessary and undue hardship¡ but is proposed to enhance the
development proposal. Therefore¡ pursuant to Section 30. 15 of the
Code of Ordinances¡ the Commission has the authority to waive those
provisions.
At the public hearing held on August 27th the Commissiou heard from
several citizens opposed to the waiver requests. At that Commissioner
Mouw requested that scale drawings be made available to the Commission
which show the entire right-of-way¡ to include parking and access on
the north side of the street and the new proposed parking on the south
side of the street. A copy of which is attached as backup material
for this item.
Recommend approval of waivers to allow back-out parking onto N.E. 1st
Street and relief from the perimeter landscape requirements along the
north property line for Veterans Park.

ACTION REQUESTED OF THE COMMISSION:
The action requested of the City Commission is that of granting
a waiver from provisions of Code Section 4.6.16(H)(3)(a)
[Landscaping] . And;
Granting a waiver from provisions of Code Section 4.6.9(D)(2)
[Parking] for Veteran's Park located north of Atlantic Avenue,
west of the Intracoastal.
The request is associated with a concept plan wherein the parking
spaces are proposed to back out onto the street system. A
portion of the parking spaces ( 12 ' ) are located interior to the
property line and the balance within the right-of-way. As these
spaces are on the property line, the required perimeter landscape
treatment cannot be provided.
BACKGROUND:
At its meeting of . July 16 1991, the City Commission reviewed the
sketch plan for Veteran's Park and approved it conceptually. A
portion of the existing parking spaces will be eliminated in order to
accommodate the relocated lift station and shuffleboard courts. The
proposal is to relocate the parking spaces along the north property
line adjacent to N.E. 1st Street.
Normally, relief from section 4.6.9 would require a variance from the
Board of Adjustment. However, the proposed back out parking does not
. resul t in an unnecessary and undue hardship, but is proposed to
enhance the development proposal. Pursuant to the Code of Ordinances
Section 30.15, the City Commission has the authority to waive
provisions of the code.
RECOMMENDATIONS:
Approval of waivers to allow the back out parking onto N.E. 1st Street
and relief from the perimeter landscape requirements along the north
property line for Veteran's Park.

This letter will respond to your Special Courtesy Notice re-
garding the proposed waiver of the Land D.v.lopm~nt Regulations
relating to the parking and landscaping associated with the
redevelopment proposals for veterans Park that is scheduled to be
on the agenda for the Commission me.ting Tuesday, August 27th.
Atlantic Plaza, Ltd., owners of Atlantic Plaza, hereoy
SUPk~rt the waiver and favor the oonoept plan, including the
par ng spaces to be located on N.E. 1st street and the removal
of a portion of the spaces on the exilting City parking lot.
The improvements aa designed by Currie Schneider are
excellent and well reoeived by Atlantic Plaza, Ltd., and all of
the 22 merchants and office tenantl in the Plaza. In fact, they
urge the early approval and the proposed schedule of starting
modifications as 600n as possible.
We have prospective tenants that we are trying to attract to
downtown Celray Beach who tell us that the planned changes to
Veterans Park are very much part of their favorable considera-
tion.

Re: Sea Lice
One of our greatest assets in Delray Beach is our Beach. Its
vitality and utility is of great concern to the economic health of
our city. For several years we have been plagued by persistent
invasions of Sea Lice. It is also apparant that we know too little
about this menace. From a discussion with Joe Weldon, I discovered
that our area is more impacted by sea lice than areas further up
and down the coast. Continued failure to address this problem may
lead to a declining return rate of visitors to our city. We need to
investigate what research has been done and what research is in
progress. If necessary we may need to initiate a symposium to
gather the existent resources and potential resources to combat the
repeated attacks of sea lice.
I request this subject be placed on a workshop to determine the
interests of the rest of the commisssion.

Dear Mr. Weldon,
I am sending this letter to update you on the activities of
the task force that has been assembled by the Bl-oward health
department to study IIsea lice". This effort involves staff
of the Broward county public Health Unit Epidemiology
section, dermatologists from Palm Beach County and the
University of Miami, marine biologists from the university
of Miami and Florida Atlantic university, lifeguards, and
the Florida Beach patrol Chiefs Association.
It is our hope to characterize and deseribe the syndrome
caused by sea lice, study the distribution and determinants
of this condition in South Florida, identify the organism
(or organi~ms) that cause this condition and develops
methods of detecting and preventing this condition. A
summary of the current status of the study is listed on the
following paqe.
At present the major need of this study is to cover expenses
for supplies and medical tests not covered by health
insurance. Estimated costs are as follows:

5UBJECT: Recommendations of the Charter Revision Committee
on AUgust 8, 1991, the charter Revision committee met to
ccnsider possibly amendlnq the City's Charter by lengthening
the terms for elected officials and/or limiting the number of
terms serve4.
Àftp.r some lengthy discussion and debate, the committee voted
in favor of amendin9 the Charter to allow all commissioners and
~he mayor to serve three-year terms. The vote for three-year
terms was 6 in favor, 5 opposed.
The committee recommends that the City stagger its elections in
order that a majority of tbe city commission will not. be
elected in anyone :roar, and in order to hold an e.lect1on every
year. 1f it is desired to implement the recommendations prior
to the March 1992 elect ion, it wi 11 be necessary to hold a
special election. Should tbis timing be desired, the committ~e
would recommend that the special election be held in January at
the latest 1n order for potential candidate a to be aware as to
the length of term they would be connitt.lng to.
If the voters approve the charter amendmen~ in January, 1992,
the mayor elected i.n 1992 would serve a two year term, and the
mayor elected in 1994 anð subsequent years will serve a three
year term. The commiss1onera elected in 1992 and in 1993 will
serve 3 year terms. This would allow for the desired
st'.a9ger ing .
Another alternative 1. to have the referendum in March, 1992 at
the same time .s the general election. If approvecl at. that
time, the commissioners and mayor elected in 1992 would serve a
two year term. The c''Ommiaølonera elect.e4 in 1993 woulcl also
serve a two year term. The commissioners elected in 1994 andu1995 would then serve a three year t.erm. The mayor elected in
1994 would serve a two year tena, and beqinninq in 1996, the~~

mayor would serve a three year term. Thi$ would allow for the
desired sta9gering anð an election every year.
At its meeting of August 22, 1991, the commi t. tee voted by a
mar9in of 7-3 to abOlish run-off elections. This will require
revisions to any section of the charter in which there is a
reference to second non-partiaan election. Abolishing run-off
elections will result in a simple majority election, in which
the candida te receiving the røajority of the votes cast being
elected.
The committee then entertained several motions relatinq
limiting the nUJ'Dber of consecutive terms a commissioner or
mayor could serve. A motion for tbree consecutive terms was
defeated 9 to 2. A motion for 6 consecutive years of service
was defeated 6 to 5. Finally, a motion for unlimited terms of
service was. approved 6. to 5. Thus, the committee concluded the
Charter need not be amended to limit the number of terms.
The Charter Revision COI'IIDi ttee also considered other possible
changes to the City's code and the charter. The cOl1l1\ittee
voted by a margin of 9-1 to retain the numbered seats
designation. The committee then voted 9-1 against changing any
of the qualifications for candidates.

Subject: Wagner v. City or Delraý Beach

This case is currently set on Judge Rodger's' dOcket beginning
September 23, 1991. It 1s anticipated that the case will t~ke
at least four days to try, with the Clty·be1ng represented by
Kent. Pratt from the firm or Pratt, Gaunt and Radford in We'st.'
Palm Beach. Mediation took plðce In th~~above-referenced case
on Friday afternoon, August 30, 1991.
This case involves the stopping of Daniel wagner for speeding
and his~~ubsequent arrest for DUl. Mr. Wagner was at the time
of arrest and is currently a Plantat.ion police of fleer. The
stop and arrest' 1n question was hand¡ed by two officers,
Sgt. Thomas Stufano and O;C!1cer Douglas Szczepanik, who are no
longer with the Delray Beach police. Department. The handling
of the arrest was proper with the except~on that a video was
taken of Mr~ wagner, without him kno~ln9 about it. ~he reo son
this is of some concern that despite ·having blown a .15 on; a
pre-test Breathalyzer (which is inadmissible in a criminal
action) and then refusing the official Breathalyzer, Mr. Wagner
makes a good appearance on the video. That fact is important
only because .following his arrest, the video ~as not made known
to the State· Attorney's Office or Officer Wagner's defense team
immediately. Once it became kn9wn, the State Attorney's Office
nolle prossed the case 1n light of what the vIdeo showed and
the lack of a Breathalyzer.
Mr. wagner is represented by Jack scarola of t.he Searcy,
Denney, scarola, Barnhart & Shipley law fIrm 1n West Palm
Beach. They have ~ued the City ,on two count~: one. for false
arrest and the second count 1s a sec.· 1983 claim tor depriva-
I tlonot constitutional rights. The false arrest claim, based
on Officer Wagner's own admissions, is, without merit.
Similarly with respect to the Sec. 1983 claim, we feel it is
unlikely that a jury would find liability against the city.

Dear David,
I was shocked when Jasmin Allen told me on FridðY, Au-
gust 30, 1991, that the Planning & zoning Staff had Just de-
cided that day that the concept plan for Veterans Park would
be on the September 11 th agenda for t he Sit e Plan Review &
Appearance Board.
As you are we 11 aware, 1 have been following this mat-
ter closely, and I believe that t he concept plan cannot be
heard on this timetable because of certain notice and proce-
dural requirements contained in Sections 2.4.1 and 2.4.2 of
the City'5 LOR's.
Section 2.4.1 provides that a potential developer may
request an audience before the Site Plan Review and APpear-
ance Board for a concept plan review. The rule in Section
2.4.1(A) specificallY states that u[t]he request must be In
writing and received at least twenty days prior to a regu-
larly scheduled meet1ng of the Board." I have been monitor-
ing the file on this app11cat ion ~ and when I reviewed i t6
contents on Friday, August 23~ 1991 , no letter was on tile.
Furthermore, I had gone to the P&Z Department that dðy to
review any written materials Mr. Currie had submitted wi t h
the preliminary site plan and the only documentation accom~
panying the plan involved storm drainage. Consequently, the
concept rev i ew cannot be held on September 11th because Hr.
Currie as the agent foT" the developer (the city Commission)
had not submitted the request required in Section
2 . 4 . 1 ( A )( 2 ) .
Section 2 . 4 . 1 ( A )( 3 ) states that "[t]he Board shall Te-
view and comment on the development concept at a duly no-
ticed pub 1 i c .bearing" ( emphas 1 s added) . section 2 . 4 . 2( B )

Dear Jeff,
As you are aware, I have been accumulating matfi"rials
from various City departments reqarding the proposed plans
for Veterans Park and the proposed cruise boat operaticl1.
Something has come to my attention in this research of which
I think you should be made aware. As you may remember, Cap-
tain Mark was questioned on the record at least once in a
public hearino about whether he had the applicable permits
to dock his boat at Veterans Park. He represented at that
time that he had Coast Guard approval, and while J have nev-
er seen any proof of this fact, I think we all assumed that
Coast Guard approval was sufficient.
In the process of reviewing Joe Weldon's tiles 011 Vet-
erans Park, it has come to my attention that this is not the
case. As part of its rIND c¡rant request for half the cost
of the seawall renovation in Veterans Park, the City had to
obtain a number of permits from the Army Corps ?f Engi.neet"s,
the County and the Department of Environmental Regulation.
The correspondence relating to these permits includes a
statement from the City's consultants, Coastal Planning &
Engineering¡ rnc. , that the DIR permit could be obtained
only j f the marginal dock in the park was used for gal' ---Y.~ e

This fact is reiterated in the project Nartative pro-
vided to FIND during the application process which specifì
cally states that "(t]he permit from the Department of Envi-
ronmental Regulation will not be 8 probl em as long as the
marqinal dock is used for day use only (no fuel or sewage
removal)" (see attached Exhibit 11). In fact, Joe weldon's
statement concerninc¡ the permits at the FIND hearing for the

grant proposal included this same statement (see attached
Exhibit III) . As a result, I believe the FIND qrant was
predicated, at least in patt, upon this representation.
Consequen t1 y , the license agreement between the City
and the cruise boat operation and any proposed amendments to
Chapter 92 of the City code for mooring to facilitate t.he
license agreement wi 11 jeopardize the DER permit and the
FIND grant for the seawall. Tn short¡ the agreement and the
amendments will violate the terms of the FIND grant and the
DER permit. At a minimum, this will force the City to repay
the $157¡S16.00 obtained from the State for the 31'!(1Wa j 1
renovation in order to have the boat operation.
Finally, the attitude of the DER and apparently the At
my Corps of Engineers (see Exhibit IV) calIs into que-slio"
