Development that was required to go before the CAB included
multi-family developments, including duplexes and
commercial/industrial development. Single family homes were
only required to go thru the Building Department and meet
code. No board oversight was required.
When the Historic Preservation ordinance was written. it
required that all items that needed a permit for an exterior
improvement in a Historic District; must obtain a
Certificate of Appropriateness (COA) by going thru the Board
process for approval. A review fee of $20.00 was
established.
Therefore. in an effort to protect our Historic Districts.
single family home owners now had to go to a board for
approval and pay an extra fee. This has added an extra
layer of bureaucracy to the process of obtaining a building
permit. .

I have asked the City Manager to have the Building
Department review all items that currentl~,~þqui~e
a building permit in order to re-evaluate its
necessity. While this would be imposed City-wide, it
will have a result on the Historic Preservation

SUBJECT: Certified Local Government Annual Report (Report
follows checklist)

( 1 ) Changes to Local Ordinance: Exhibits A, A-I.
Changes were made to chapter 174 "Historic Preservation" of the
City Code of Ordinances. The changes are explained in exhibit A.
Exh±bit'A-I,.', "Historic Preservation", includes these changes as
adopted by the City Commission; Ordinance No. 153-88 approved on
December 13, 1988.
( 2 ) Changes to Rules of Procedure: Exhibit B.
The Historic Preservation Board approved the revised Rules on
November 29, 1988 and the City Commission approved them on
~ December 16, 1988.
¡¡ Most of the modifications were minor, involving the renumbering
--
of items and éorrecting syntax errors. The major changes
included a modification to the text adding language which
provides that, if the Board grants a motion for rehearing, public
notice of the rehearing shall be given at the cost of the
applicant.
(3 b.) Number of new local designations.
SEABOARD AIR LINE RAILWAY STATION: Exhibits C, C-1, C-2.
On September 16, 1988 the Board held a Public Hearing to get
community imput on designating the Seaboard Air Line Railway
Station as a Local Historic Building. The Board's recommendation
of approval was forwarded to the City Commission and as Ordinance
No. 1l9-88 it was passed on October 11, 1988.
(The Seaboard Air Line Station was listed on the National
Register September 4, 1986)

MARINA HISTORIC DISTRICT: Exhibits D, D-1, D-2
The Board held a Public Hearing on October 27, 1988 and
recommended to the City Commission that the district be
designated. The Commission voted to approve Ordinance No. 156-88
on December 20, 1988 and the Marina District became our fourth
Local Historic District. Designation report attached.
777 NORTH OCEAN BLVD. "THE KOCH HOUSE": Exhibits ~, E-I
A Public Hearing was held on November 29, 1988 and the Board
voted to approve the designation. The City Commission voted to .
approve Ordinance No. 162-88 777 North Ocean Blvd. on January 10,
1989. Designation report attached.
FIVE. HISTORIC SITES IN THE BLACK COMMUNITY: Exhibits F, F-1, F-2
At, the::suggestionof leaders in the black community, Board member
Spencer PompeT, researched the following five proposed sites:
St. Paul A.M.E. Church
The Free and Accepted Masonic Lodge
Greater Mount Olive Missionary Baptist Church
School No. 4 Delray Colored
St. Matthew Episcopal Church
With the exception of St. Matthew Episcopal, Church, all of the
buildings have been demolished or remodeled beyond recognition.
The Episcopal Ciocese in Miami did not want St. Matthew
designated as an historic building, but agreed to its being
designated a site. It was felt that with these designations a
sense of black history could be preserved. A bronze plaque is
planned to commemorate the sites (text is enclosed) and will be
placed on property owned by Mt. Olive Church. Individual markers
will be placed at the actual locations.
The Ordinance numbers are listed on the attached agenda report.
The City Commission approved all five sites on April 11, 1989.

(3 d.) Appointments to the Board: Exhibits G, G-1, G-2
Alice Finst was appointed by the City Commission to fill a
vacancy on the Board in August, 1988. Mrs. Finst was appointed
for a full two year term in June, 1989. Resume attached.

Diane DeMarco was appointed to fill a Board vacancy on April 11,
1989. In June, 1989 Miss DeMarco was appointed to a full two
year term. Resume attached.

( 4 ) Administration Activity
VARIANCES: Exhibit H
The Board approved a Variance Application form and established a
Variance Application fee of $151.25.
Twelve (12) variance requests have been granted.
CERTIFICATES OF APPROPRIATENESS: Exhibits I, 1-1, I-2
The application for a Certificate of Appropriateness has been
revised twice from its original form: Exhibit I.
The first revision was in November, 1988: Exhibit I-1.
The second revision was made in August, 1989: Exhibit I-2.
The City Commission approved a $25.00 COA filing fee on November
8, 1.88; Ordinance No. 141-88.

this reporting year.

Department of Community Improvement to the Planning and Zoning
Department.

( 5) Report on CLG Grant Supported Activities
In 1989 the City received a $4,000 grant award and $5,500 was
matched by the City, for a total $9,500. These funds are to be
used for publishing the Delray Beach Design Guidelines as
specified in our Historic preservation Ordinance.

( 5 ) Report on CLG Grant Supported Activities (continued).
The RFP was published in October and two proposals have been
received. The Board has scheduled a Special Meeting for December
4, 1989 to review the proposals and interview the applicants. A
copy of the propos~ls will be sent for your consideration and
review.
Community Educational Activities
1. The first annual historic preservation conference "This Old
Town" was sponsored by the Board in January, 1989. The
conference attracted approximately 100 guests and was well
received by both local residents and visitors. Exhibit J.
2. The Board has made every effort to support the Morikami
Museum in its goal to obtain funds to relocate the Sundy Feed
Store (Local Register of Historic Buildings) from downtown Delray
Beach to the museum grounds.
, ' 3. The Historic Preservation Board nominated the Cason Cottage,
" Delray's Historical Museum, for the Florida Trust's annual
Preservation Award. Cason Cottage was awarded a Meritorious
Preservation citation for restoration of a residential structure.

NOW, 'rHEREFOP.E, BE IT ORDA:!NED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA; Þ.S FOLLOWS:
Section 1. Tha.t ';hapt.9r 174, "Historic Preservation" ,
110enara1 Provisions", Section 174.02, "Definitions", of the Code of
Ordinances of the City of Delray Beach, F1.orida, be, and the same is
nttreby amended, by amending the definition of "Undue Economic Hardship"
as follows:
"tTndue Economic Hardship". An exceptional financial burden
created by the implementation of or created by conditions
imposed pursuant to Sections 174.31 or 174.33, that might
otherwise amount to taking of property without just compensa-
tion, 01 failure to achieve a reasonable economic return.
Section 2. That Chapter 174, "Historic Preservation", "Cer-
tificate of Appropriateness", Section 174~30, "Basic Requirements",
Subsection 174.30(B) is hereby amended as follows:
(B) Plan app~e~a~ review required. No certificate of appro-
priateness will be approved unless ~àe -a~eft~~ee~~~ai
,--' PhotOqraÐ~ an4 plans for such construction, reconstruc-
;..t<;;¡¡,., tion, re oca.tinn, alteration,· excavation, restoration,

plans or reports, as deemed nece:asary by the Historic
Preservation Board.
Section 3. That Chapter 174, "Historic Preservation" ,
"Certificate of Appropriateness", Section 174.32, "Initia.tion and
procedure", of the Code of Ordinances of, the City of Delray Beach,
Florida, is hereby amended by repealing Subsection 174.32fB) by enacti~g
a new Subsection 174.32(B) and amending Subsection 174.32(F), as
follows:
(E) An application for a Certificate of Appropriateness"
must be filed with the Department of Development
Services by the first Friday of the month. The
applipant shall pay a filing fee of $25.00, and no
application will be acted upon by the "Board unless
it contains all required and pertinent information
and is accompanied by the required fee.
(F) The Boar¿ may approve, modify or deny an application
for a Certifica~e of Appropriateness. If the Board
~pproves the application, a Certificate of ~ppropri-
atencss will be issued. Construction for which a
Certificate of Appropriateness is issued shall
cC'lmmenc~ within 18 months from the date of issuance,

not approve extensions for certificates of Appropri-
c:1t~ness. If the Board disapproves the application,
a Certificate of Appropriateness shall not be
lssued. The Board will state its reasons for
disapproval in writing and present these reasons to
the applicant within ten calendar days of the
Board's disapproval.
Section 4. That Chapter 174, "Historic Presèrvation",
"Historic Preservation Board" , Section 174.43, "Powers and Duties" ,
Subsection 174.43(F), of the Code of Ordinances of the City of. 'Delray
Beach, Florida is hereby amended as followst
(F) Act in lieu of Board of Adjustment. The Board
shall act in lieu of the Board of Ad~ustment and is empowered to
grant variances from existinq ordinances for properties desiqnated
as historic sites, anð-!er-preper~*es-Aad-s*§fta7 within designated
historic districtsr or listed on the Local Register of Historic
Places. In addition, the Board is empowered to grant variances
from the sign code for those non-conforming signs which existed at
the time of enactment of the siqn code.
Section 5. That Chapter 174, "Historic Preservation", \I Admin-
istration and Enforcement", Section 174.54, "Variances", is hereby
amenc1ed by amending Subaectiona 174.54(B)(1) 'and 174(B)(121 and by
unending Subsection 174.S4(B)(7) by enacting a new sub-subsection
174.54(B)(7)(D) as follows:
( B) The Board shall not grant a variance from the terms I
of existing ordinances unless and until:
( 1) A written application for a variance is submit-

ship exists pursuant to the criteria contained
within Section 173. 917~ 1) and the variance
requested is the min variance necessar¡
that will make possible the reasonable use of
the buildinq or structure, or that a variance I

(a) Tha~ a variance would not be contrary to the
public interest, safety or welfare.
( b) That special conditions and circumstances
exist, because of the historic setting,
location, na.ture or character of the land,
structure, appurtenance, sign or building
involved, which are not applica.Þle to other
lands, ~tructures, appurtenances, signs or
buildings in the same zoning district, which
have not been designed as historic sites or a
historic district, nor listed or the Local
Register of Historic Places.

to maintain the preservation of the historic
chnracter of the historic site or of the
historic district.
(7) Variancßs Prohibited.
(D) Sign Code. The Board is hereby e~ressly
prohibited from granting a variance from the
3ign code. except that the Board may qrant a
varidnce from the sign code for those noncon-
forming signs which existed at the time of the
enactment of the sign code.
(12) A variance from the terms of existing ordinances
shall only be granted to preclude unnecessary hardships
anå or to maintain the historic character of the
building, structure, site, property or district.
Section 6. That should any section or provision of this
ordinance or any portion thereof, any paragraph, sentence, word, be
declared by a court of competent jurisdiction to be invalid, such
decision shall not effect the validity of the remainder hereof as a
whole or part thereof other than the part declared to be invalid.
Section 7. That all ordinances or parts of ordinances in
conflict herewith, be and the same are hereby repealed.
Section 8. That this ordinance shall become a effective
immediately, upon second and final reading.

We have researched the cost to do that and it appears that our annual

would be done by contract labor. t have enolosed a copy of a

your attention to the last paragraph. I think it is interesting they
want us to take care of it but they think they would like to bid on
doiuc¡ the work.
Please review and advise how staff is to handle this, whether we are to
aqenda it for costs only or whether you need us to take some other
action.

Per your request, attached is a quote from American Pro's to maintain
the three (3) medians adjacent to Del-Aire Country Club in the amount
of $4,935.00 per year. Those costs were arrived at by using our
existing specifications for Linton Avenue.

If you decide to pursue this, I recommend a agreement' ~ th
Del-Aire since the source for median irrigation is a lake on '·t~ir
golt course. I would not reCOJDJDend that we be responsible-'lor
anything East of the medians, including feeder lines, pumps, electric
sourc., etc. Also, it would have to be clarified if this would be
funded out of the same account.
Mr. Glas thought this could be added to the existing contract under a
new policy being discussed. He is in the process of clarifying this.
Additionally, a Mr. Joe Bowman, a resident of Del-Aire and on their
Board of Directors, called and said he wanted to submit a bid on
behalf of their maintenance crew if approved by their board.

This subject was suggested as a workshop item in late November.
Subsequently, the Commission provided direction on the Lavers/Tennis
site matter at a December meeting. Direction at that time did not
address the matter of TDRs. My previous discussions with Commissioner
Andrews have led me to believe that the TDR matter pertained only to
Lavers and that the desired results could be obtained through other
avenues. Commissioner Andrews is unavailable at present, thus I have
suggested that the item not be discussed on January 9th.
If, upon Commissioner Andrew's return, it is necessary to continue with
the TDR concept the matter can be addressed on January 23rd.

SPACE THROUGHOUT THE CITY, TO PROVIDE FOR THE DEFINITION AND

NOW, THEREFORE, be it ordained by the City Commission of
the City of Delray Beach, Flori.da, as follows:
Section 1. That Title 17, "I,and Use, II Chapter 173, "Zoning
Code," subheading, "General Regulations", is hereby amended. by
enacting a new section 173.041, "Transfer of Development Rights
Option," to read as follows:
173.041 TRANSFER OF DEVELOPMENT RIGHTS OPTION
The Transfer of Development Rights Option established
herein, shall apply in designated zoning districts. throughout
the City.
Þ.. PURPOSE AND INTENT
The purpose of the Transfer of Development Rights Option
is to provide {a program whereby the owner ( s) of significant
historic/architectural structures may preserve those struct.ures
and ,sell the unused development potential of their property
instead of demolishing the structure to allow redevelopment, of
the property, as well as to provide for additional recreational
facilities and open space throughout the City.
The t.ransfer is optional and is intended to provide an
economic incentive to property owners to preserve historic
structures as well as to provide for public open space and
recreational facilities while allowing the unused development
potential of the site to be used on another site.
B. DEFINITION AND CALCULATION OF DEVELOPMENT RIGHTS
1. Definition
'l'he "development rights" associated with a parcel
shall herein be defined as the maximum number of dwelling units
permitted under the base density for the subarea in which the
property is located.
2. Calculation of Transferable Development Rights
Transferable development rights shall be calculated
as the difference bet.ween the total number, of dwelling units
permi tted on the property and the number of existing dwelling
units.
C. CONDITIONS FOR TRANSFF~RING DEVELOPMENT RIGHTS
1. Eligibility
Only eligible development rights may be transferred.
Eligibility of property owners shall be determined by meeting
one of the following conditions:
a. The property is an historical site desiqna,ted by
the Historical Site Board;

b. The property contains a contributing structure
wi,thin the Historic District (Subarea Two), as determined by
the Historical Site Board; or
c. The property contains a structure designated as
historically/architecturally significant in a documented
survey, approved by the Historical Site Board.
d The property is on a site designated by the City
to add additional public open space or recreational facilities.
2. Facade Easements for Historic Structures
a. Property owners who transfer d,evelopment rights
for historic development rights shall also grant a facade
easement, in perpetui.ty, on their historic/architecturally
significant structure (s) to The City of Delray Beach. The
facade easement shall contain the fOllowing elements:
1.) Description of property.
The protected property should be identified
as precisely as possible, including street address, legal
description, and property control number. The. precise aspe,cts
of the building to be governed by the restrictions shoul.d 'be
indicated.
2) Standards and responsibilit.y for care and
maintenance.
3) Approval for alterations.
4) Arbi tréltion of disputes.
5) Conditions for inspections.
6) Specificity of exterior architectural
features to be included.
7) Restrictions (if any) on the land and site.
8) Standards and responsibility for repairs if
destruction of all or part of the structure should occur.
9) Retention of rights and obli.gations of the
property owner(s).
10) Successors.
The terms of the easement shall apply not
only to the original owner(s), but to all those later claiming
a.n int,erest in ¡the property.
il) Other such stipulations as agreed to by
both, The City of Delray Beach and the property owner(s).
b. All facade easement agreements. shall be sub-
mitted by the Planning Direct01: to the Historic Preservation
Site Board for review and recommendation prior to submittal to
the City COU11Cil for approval.
c. All facade easement agreements shall be filed in
the Public Records of Palm Beach County, with the office of the
City Clerk, and the Planning Director.
3. Registration
The purchaser of development rights shall, register
all development right, transfers including resales prior to
their ut:ilization, with the Planning Department. Failure to
register sale and utilization transactions shall render the
right to utilize purchased development rights null and void.
a. Registrat.ion shall include a copy of the
contract between the property owner ( s) and the development
rights purchasex: which reflects that the contract has been.
record.ed i.n the Public Records of Palm Beach County, and which.
shall include:
1.) Street address, legal description and
property con.trol number of the property from which the develop-
ment rights are being transferred;
2) Name and address of the owner (s) of the
property from which the development. rights are be.ing trans-
ferred and the development rights purchaser; and
3) Nwnber of development rights transferred by
the property owner(s).

D. CONDITIONS FOR 'UTILIZING ACQUIRED DEVELOPMENT RIGHTS
Development and redevelopment projects utilizing acquired,
development rights shall comply with all applicable regulati.ons
of the transfe:r:red-to zoning district.
1. Transfer Zones
a. Acquired development rights may be utilized, in
zoning district.s of the Cit.y provided they are not
used on a site for which transfer development rights are also
sought.
2. Maximum De.nsity
The total number of units, including acgu.ired develop-
ment rights, constructed on a site, may only exceed the base
density by a maximum of 25%, except in the case of special
activities districts in which the base density is set forth in
the S.A.D. Zoning Ordinance itself.
3. Appllcat.ion
Applications to use acquired development rights shall
be filed concurrently with applications for permi t.s and shall
state fully the circumstances and conditions relied upon as
grounds for application. Application may be made by the,
owner(s) of the property where the acquired development rights
are to be used, and shall be filed with the Planning Department
on the forms provided.
Section 2. That. should any section or provision of this
ordinance or any portion thereo,f, any paragraph, sentence" or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall, not effect the validi,ty.
Section 3. That all ordinances or parts of o:r:dinances in
conflict herewith be, and the same are hereby repealed.
Section 4. That this ordinance shall. become effective ten
days after passage on second and final reading.

OFFICE OF THE CHIEF OF POLICE.

RECOMMENDATION #9: THAT THE PROFESSIONAL STANDARDS DIVISION BE
MOVED FROM THE SUPPORT BUREAU TO THE ADMINISTRATION BUREAU.
We recommend that the Professional Standards Division remain with
the Support Bureau and that no Administrative Bureau be created.
RECOMMENDATION #10: THAT THE INTERNAL AFFAIRS SECTION BE PLACED
UNDER THE OFFICE OF THE CHIEF OF POLICE AND REPORT DIRECTLY TO
THE CHIEF OF POLICE.
The Internal Affairs Section is already under the Office of the
Chief of Police and reports directly to him. therefore. this has
already been accomplished.
RECOMMENDATION #11: THAT AN INSPECTIONS UNIT BE CREATED AND
PLACED UNDER THE RESPONSIBILITY OF THE PROFESSIONAL STANDARDS
DIVISION.
An Inspection Unit has been created. however. the fine tuning of
such a unit wi 11 not become existent until after the
Accreditation Team completes its task in early January. This

. It is our feeling that the Review Team has suggested the creation
of eight , (8) additional positions to accomplish their

t h r e,e (3) can b-e eliminated therebv reducing the cost impact.
Those three (3) would be one (1) police major and two (2) pol ice
captains that would have been necessary under the third bur'eau
concept that we feel is unnecessary.
Essentially needed at this time is a civilian Public Information
Officer, whose prime objective will be to bridge the present gap
between the Police Department and the media that was focused on
as a major operational problem.
The second position of importance is that of a Planning/Budget
Administrator. Additionally, we agree with the recommendations
for an additional Crime Prevention Specialist. Trainer. and a
Police Legal Advisor. Let it be noted that the positions of
Planner, Crime Prevention Specialist, Trainer. and Legal Advisor
were requested in the 1989/90 budget presentation and were
denied.

commercial loe-alions throughout the city for implementation of

local businesses (conven ience stores) arid community groups. "

The estimated cost for a 5' wi~e asphalt path ªlong the
subject section of roadway is approximately $304000 (4,4QO
lineal feet - $7/lineal ft.) If the City Conuais$io~ wishE¡)s
to proceed with the proj ect in the cQr:r~mt bUQget year, the
following procedure is recommended: -
1. Up to $30,000 be appropriated from 1989-90
Resurfacing Funds for the path.
2. The bid documents for the 1990 Resu~fac~ng Project
include the construction of the path.
3. If the low bidder's price for path construction
exceeds $30,000, the item be deleted from the
contract and work accomplished by City crews.
The above procedure was utilized for the West Atlantic path
between Barwick Road and Military Trail.
According to Engineering's 1989-90 Construction Project
Schedule, the Resurfacing Project is scheduled for bid
opening in May 1990 and start of construction in June 1990.
Copies of previous correspondence regarding this project are
attached for your reference.

HOMEWOOD BOULEVARD

The Master Bike plan that the City has established does not
note a proposed bike path on Homewood Boulevard between
Lowson and Atlantic. The criteria for a bicycle path would
require that it be a minimum of 10' in width. At present
the right-of-way for Homewood Boulevard is 80'. It is a two
lane roadway which is not located in the center of the
right-of-way. The west side of the right-of-way would be
the most appropriate location for the bikepath. However,
there are numerous mature trees along this side of the
roadway which would have to be avoided in planning its
location. There would be no connections to the bikepath as
there are no sidewalks or bikepaths to the north on Atlantic
Avenue, nor on Lowson Boulevard. There is a sidewalk on the
last block of Homewood Boulevard between Lowson Boulevard
and Linton Boulevard. There is only 8' of right-of-way from
east edge of pavement on Homewood to east right-of-way line.
The City at present does not have a bike path funded
program. If there is sufficient funding in some other source
this project could be accomplished in house as an
Engineering Department/streets Department Project, such as
the Atlantic Avenue Bikepath.

SFWMD WATER RESTRICTIONS
DATE: January 5, 1990
Mr. Huddleston projects a net decrease of $220,000 because of the
SFWMD requested fifteen (15) percent reduction in water consump-
tion.
In addition, Mr. Thiele is requesting $100,000 for additional
professional services. These two requests require the existing
FY90 Public Utilities operating budget to be decreased by
$320,000.
Revising the budget to fund approved capital projects with 1983
and 1984 Revenue Bond funds will reduce operating capital expen-
ditures by $290,190.
This results in $70,120 available for other professional services
requested by the City Attorney. Remaining monies of $29,880 to
fund the total request of $100,000 will come from "Prior Year
Unencumbered Balance Project Reserves".
The proposed budget adjustments are based upon the assumption
that the SFWMD restrictions remain in affect for the remainder of
FY90 and the City Attorney's need for additional funding. We
feel these assumptions represent the worse case scenario.
Attached is our proposed budget adjustments to fund the requested
$320,000.

DATE: January 5, 1990
We received a request from Richard Snow, Trellis Shop, regarding
the passing of an ordinance which would prohibit skateboard riding on
sidewalks. Apparently, he witnessed an accident in which a woman was
knocked down by a kid riding a skateboard on the sidewalk.
Staff has reviewed the City Code and found no ordinance prohibiting the
riding of skateboards or bicycles on City- owned ~idewalks, therefore,
Commission direction is requested.
