Pursuant to Section 3.12 of the Charter of the City of Delray Beach, Mayor Jeff Perlman has
instructed me to announce a Special Meeting of the City Commission to be held for the following
purposes:
1. PURCHASE AWARD/R. GEORGE & ASSOCIATES, INC.: Approve a purchase
award to R. George & Associates, Inc. in the amount of $771,944.56 VIa the Florida State
Contract #420-590-02-1 for the purchase of furniture for the Delray Beach Public Library.
Funding is available from 380-3552-571-64.10 (2004 G.O. Bond, Library, Office Furniture/
Fixtures).
2. BID AWARD/COMMUNITY TREE SERVICE: Approve a bid award to Community
Tree Service in the amount of $24,330.00 via Palm Beach County Contract #05018 for the
removal and trimming of trees at the Municipal Golf Course. Funding is available from 445-
4714-572-34.95 (Municipal Golf Course Fund/Debris Removal).

$771,944.56 for the Delray Beach Public Library.
John Callahan, Library Director is requesting the purchase of this furniture for the Public Library

ACTION
City Commission is requested to approve a bid award under Palm Beach County contract number
05018 in the amount of $24,330 with Community Tree Service for the removal and trimming of
trees at the Municipal Golf Course damaged by last year's hurricanes as well as other required
work. Funding is available from insurance proceeds.
BACKGROUND
Attached is supporting documentation concerning this bid award. Included is a detailed list of
work to be completed. This work will complete all necessary clean up work from last year's
hurricanes that could not be completed with in-house crews due to the size of trees to be
removed and trimmed.
RECOMMENDATION
Staff recommends bid award in the amount of $24,330 with Community Tree Service under
Palm Beach County contract number 05018 with funding to come from insurance proceeds.

Community Tree Service
The Delray Beach Municipal Golf Course is requesting approval for remaining tree removal
at the Delray Beach Municipal Golf Course for the total amount of $24,330.
The Municipal Golf Course has remaining cleanup of hurricane damage and other tree work from
last year's hurricanes.
Community Tree Service has submitted a quote dated June 21, 2005, for removal of Australian
Pines, Ficus Trees, and Malaleuca Trees for the total amount of $24,330. Pricing per Palm Beach
County "Tree Removal Services" Contract #05018 with the expiration date of March 02,2007.
Community Tree Service has done work at the golf course and they know the problems involved
with equipment size and site development. All chipped debris will be left on site in the mulching
area of the golf course and all logs to be hauled away.

Community Tree Service has a contract with Palm Beach County that will cover the
necessary work. We can use the county contract (indicated on attached proposal
line items) as a basis for issuing a PO.
Community is a good contractor that does a lot of golf course work. They knovv the
probtems involved with equipment size and site development.
Chips will be left on site (in our mulching area) and used for mulch. All logs will be
hauled fNlaY.
They can start no later than three weeks after issuance of a PO. Tree contractors
are very busy at this time of the year and Community is big enough that they can get
us into their schedule.

II BACKGROUND II
Since August of 2004, the Board has been reviewing its mission and vision statements, goals and
objectives, enacting ordinances, and rules and regulations. The Board determined that their
Mission and Vision statements, as well as the goals and objectives were antiquated and needed
updating to better mirror the goals of the City Commission, the Community, and Palm Beach
County School District.
The Board heard presentations from various groups that provide educational opportunities to
students in the City to better understand the resources being provided. In addition, they talked to
stakeholders (realtors, police, principals, chamber of commerce members, etc.) to get their input on
issues they see facing education in the next 5 years.
In February, the Board attended a City Commission Workshop meeting to discuss the direction that
they were headed and requested that the City Commission provide them with input. The
Commission suggested that they address the following:
· Help increase parental and community involvement in schools.
· Increase community volunteers at the schools with programs and reading.
· Help identify school populations to insure that their needs are met, and that they have the
right programs and resources in place for an optimal learning environment.
· Help in securing and advocating for the middle school at the old AHS site.
· Help in rebuilding our relationships with the School Board and School Board Staff.
· To talk to stakeholders that aren't so obvious such as the guidance councilors to see what
their take is on the schools needs.
· Continue the "Spotlight on Education" at City Commission Meetings.
· Be involved with the Eagles Nest Project.
The Education Board took into consideration all of the information that they gathered over the past
year and developed a new Mission and Vision Statement as well as new Goals and Objectives. In
addition, they developed a calendar of events for this coming school year (see attachments). The
Board will continue its existing programs such as the Principal Breakfast, Walk A Child To School
Day, and Principal for a Day, and would like to develop two new programs relating to parental
involvement and literacy that will be implemented in 2006/07.
At this time, the Board would appreciate the City Commission's input on their new goals and
objectives and validate that they are heading in the right direction for the upcoming school year.

school/SAC.
4. Conduct an annual review (November) and compilation of SAC

performance at Delray Schools by annual review and analysis of the Gold Reports
and FCAT scores.
6. Monitor Local, State and Federal legislation/issues and report to

7. Liaison with Palm Beach County School Board staff to discuss their 5 year Capital
improvement plan on an ongoing basis and provide regular comments to the City
Commission.
8. Advocate for a Middle School of the Arts at the Atlantic High School site located at
2501 Seacrest Boulevard.
9. Advocate for appropriate programs and funding to support our student population
B. Promote a positive image of Delray Beach schools through continuous public
relations efforts.
1. Update the Education Board Pamphlet on an annual basis and distribute to the
public on an as needed basis.
2. Present the goals and accomplishments of the Delray Beach Education Board to
at least three businesses annually.
3. Promote schools through the City's Public Information Officer, Neighborhood
Advisory Council and special events.
4. Write a Column for the News for Neighborhood on the Education Board, their role
within the City and "Great News from Delray Schools" on a quarterly basis.

is held annually in February of each year.

C. Identify and attract Local, State and Federal programs and grants in direct support

2. Arrange once a year for a First Time Home Buyer seminar for educators within our
community.
3. Present Education Board Goals and Accomplishments annually to each Delray
Beach School Advisory Council (SAC) and faculty.

REDEVELOPMENT OF THE ATLANTIC PLAZA SITE
The Planning and Zoning Department has received a redevelopment proposal for the Atlantic
Plaza site and the east half of the block to the west. The development proposal involves the
construction of 325 residential units, 66,000 sq. ft. of retail space, 12,000 sq.ft. of restaurant, and
56,000 sq. ft. of office space. Two conditional use requests have been submitted to allow 60' in
height (5 stories) and 44.82 units per acre. The proposal incorporates property currently owned
by the City i.e. the publicly dedicated sidewalk and surface parking lot (86 spaces) adjacent to
Veterans Park and proposes modifications to the Veterans Park including the City Shuffleboard
courts, Lawn Bowling, and playground areas. Additional off site improvements include the
installation of a cul-de-sac at the end of NE 15t Street which would require the relocation of a
major city lift station and elimination of the 20 back-out parking spaces onto NE 1st Street.
The applicant has indicated the developer wishes to swap the city owned property (approx.
42,700 sq. ft.) for private property (27,800 sq.ft.) located at the northeast comer of NE 7th
Avenue and NE 15t Street. Further, the proposal is to relocate the Veterans Park surface parking
(86 spaces) along the west side of the park with 86 spaces public spaces in a new garage which
will serve the development. The proposal does not include replacement of the 20 back-out
spaces.
A reference is also made in both the project write-up and the development plans for a new and
relocated City Community Center, however it is unclear if this is to be constructed by the
developer and donated to the City or built at tax payers expense.
As the proposal involves City owned property and public parking, City Commission's comments
and direction are requested.

2001 SUBJECT: Dwanna Newsome, a personal representative of the Estate of Ralph
Antonio Brown and Paul Emmanuel Stevens vs. the City of Delray
Beach, Florida
The purpose of this memorandum is to call for a closed attorney-client session
pursuant to Florida Statutes §286.011 (8) for 'the July 12, 2005 City Commission
meeting to discuss settlement negotiations and strategy related to litigation
expenditures in the above case.
Law requires strict compliance with Florida Statutes §286.011 (8). Therefore, prior
to the commencement of the closed attorney-client session, the Mayor should read
the following:
"The City has scheduled a closed attorney-client session pursuant to
Florida Statutes §286.011 (8) regarding the lawsuit of Dwanna
Newsome, a personal representative of the Estate of Ralph Antonio
Brown and Paul Emmanuel Stevens. The estimated length of the
closed session shall be 15 minutes. The following persons will be
attending: Mayor Jeff Perlman, Commissioners Pat Archer, Alberta
McCarthy, Rita Ellis and Jon Levinson, City Manager David Harden,
City Attorney Susan Ruby, Assistant City Attorney Cathy Kozol, Fred
Gelston, Esq., and a certified court reporter."
After the closed session is over, the Mayor should announce that the regular meeting
is reopened, and the closed session is terminated.
By copy of this memorandum to David Harden, our office requests that the agenda be
prepared giving reasonable public notice of the time and date of the closed attorney-
client session for July 12, 2005 and that the agenda item include the name of the
case, the names set forth above of those persons attending the session, and identify
the item as a closed door session pursuant to Florida Statutes §286.011. Our office
will arrange for a court reporter to be present as required by statute. Attached is a
copy of Fla. Stat. §286.011.

BUSINESS PROVISIONS
286.011 Public meetings and records; public inspection; criminal and civil penalties.--
(1) All meetings of any board or commission of any state agency or authority or of any agency or
authority of any county, municipal corporation, or political subdivision, except as otherwise
provided in the Constitution, at which official acts are to be taken are declared to be public
meetings open to the public at all times, and no resolution, rule, or formal action shall be
considered binding except as taken or made at such meeting. The board or commission must
provide reasonable notice of all such meetings.
(2) The minutes of a meeting of any such board or commission of any such state agency or
authority shall be promptly recorded, and such records shall be open to public inspection. The
circuit courts of this state shall have jurisdiction to issue injunctions to enforce the purposes of this
section upon application by any citizen of this state.
(3)(a) Any public officer who violates any provision of this section is guilty of a noncriminal
infraction, punishable by fine not exceeding $500.
(b) Any person who is a member of a board or commission or of any state agency or authority of
any county, municipal corporation, or political subdivision who knowingly violates the provisions of
this section by attending a meeting not held in accordance with the provisions hereof is guilty of a
misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.
(c) Conduct which occurs outside the state which would constitute a knowing violation of this
section is a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.
(4) Whenever an action has been filed against any board or commission of any state agency or
authority or any agency or authority of any county, municipal corporation, or political subdivision
to enforce the provisions of this section or to invalidate the actions of any such board, commission,
agency, or authority, which action was taken in violation of this section, and the court determines
that the defendant or defendants to such action acted in violation of this section, the court shaLL
assess a reasonable attorney's fee against such agency, and may assess a reasonable attorney's fee
against the individual filing such an action if the court finds it was filed in bad faith or was
frivolous. Any fees so assessed may be assessed against the individual member or members of such
board or commission; provided, that in any case where the board or commission seeks the advice of
its attorney and such advice is followed, no such fees shaLL be assessed against the individual
member or members of the board or commission. However, this subsection shall not apply to a
state attorney or his or her duly authorized assistants or any officer charged with enforcing the
provisions of this section.
(5) Whenever any board or commission of any state agency or authority or any agency or authority
of any county, municipal corporation, or political subdivision appeals any court order which has
found said board, commission, agency, or authority to have violated this section, and such order is
affirmed, the court shaLL assess a reasonable attorney's fee for the appeal against such board,
commission, agency, or authority. Any fees so assessed may be assessed against the individual
member or members of such board or commission; provided, that in any case where the board or
commission seeks the advice of its attorney and such advice is followed, no such fees shall be
assessed against the individual member or members of the board or commission.
(6) ALL persons subject to subsection (1) are prohibited from holding meetings at any facility or
location which discriminates on the basis of sex, age, race, creed, color, origin, or economic status
or which operates in such a manner as to unreasonably restrict public access to such a facility.

(7) Whenever any member of any board or commission of any state agency or authority or any
agency or authority of any county, municipal corporation, or political subdivision is charged with a
violation of this section and is subsequently acquitted, the board or commission is authorized to
reimburse said member for any portion of his or her reasonable attorney's fees.
(8) Notwithstanding the provisions of subsection (1), any board or commission of any state agency
or authority or any agency or authority of any county, municipal corporation, or political
subdivision, and the chief administrative or executive officer of the governmental entity, may
meet in private with the entity's attorney to discuss pending litigation to which the entity is
presently a party before a court or administrative agency, provided that the following conditions
are met:
(a) The entity's attorney shall advise the entity at a public meeting that he or she desires advice
concerning the litigation.
(b) The subject matter of the meeting shall be confined to settlement negotiations or strategy
sessions related to litigation expenditures.
(c) The entire session shall be recorded by a certified court reporter. The reporter shall record the
times of commencement and termination of the session, all discussion and proceedings, the names
of all persons present at any time, and the names of all persons speaking. No portion of the session
shall be off the record. The court reporter's notes shall be fully transcribed and filed with the
entity's clerk within a reasonable time after the meeting.
(d) The entity shall give reasonable public notice of the time and date of the attorney-client
session and the names of persons who will be attending the session. The session shall commence at
an open meeting at which the persons chairing the meeting shall announce the commencement and
estimated length of the attorney-client session and the names of the persons attending. At the
conclusion of the attorney-client session, the meeting shall be reopened, and the person chairing
the meeting shall announce the termination of the session.
(e) The transcript shall be made part of the public record upon conclusion of the litigation.
