Commen t s : After discussion, the Commission, by consensus, deter- mined that the following alternate items are to be included: Alternate No. 2 - Mezzanine Floor Alternate No. 4 - Cabinetry at Alcove, Watch Office, etc. Alternate No. S - Aluminum Storm Shutters Alternate No. 8 - Wood Lockers Alternate No. 9 - Provide Jack Hole Direction was given to staff to recalculate the figures and bring a recommendation for bid award to the Commission at the May 8, 1990 regular meeting. Additionally, the use of any approved contingency funds will be strictly monitored and will require Commission approv- al. 2. Presentation Storm Water Utility Fee - Gee and Jenson (City Manag- er) . Comments: (a) Staff (i.e., Dave Huddleston, Bob Barcinski, Mr. Harden) directed to establish a temporary billing system (until we can program with the County tax bills) as quickly and efficiently as possible. Also, look at mechanisms for notifying the public that this fee will be coming (i.e., use "News for Neighbor- hoods" , press releases, etc. ) (b) Prepare the ordinance to create the utility and schedule for 1st reading at the May 22, 1990, regular meeting. Also, provide for the Commission a projected S-year rate schedule, building in all costs (i.e., project list as well as adminis- trative costs). 3. Sea Turtle Conservation Program (City Manager) . Comments: Consensus was to proceed with FP&L's recommendation to use the cut-off fixtures tilted as much as possible to keep light off of the beach/road; also, check into Mr. Andrews suggestion that the cut-off fixtures be mounted on the east side of AlA with the lights tilted at a severe angle ( looking at costs involved, effectiveness, etc.); monitor the situation closely over the next few months in an effort to determine how best to handle the matter in future years. 4. Palm Beach County Coastal Ordinance No. 90-2 (City Manager). Comments: Staff was directed to draft our own ordinance using Palm Beach County's as a base; this draft ordinance is to be re- workshopped prior to first reading. S. Amendment to Local Rules regarding Meeting Dates, Times, and Agenda Format (City Commission). Comments: (a) Meeting time will remain at 6:00 P.M.; however, agenda format will be adjusted to schedule Public Hearings/public comments at 7:00 P.M., in an effort to accommodate the public. (b) After discussion, consensus was to continue holding public hearings on 2nd reading of ordinances; however, the Commission intends to allow limited public comment on 1st reading of ordinances which pertain to more controversial issues so as to obtain public input/concerns in advance of a vote. (c) Regarding Non-Agenda Public Comments, the consensus was to respond to the public by giving appropriate direction via the Ci ty Manager, wi thout becoming embroiled in any confrontational, controversial or in-depth discussions on items presented. 6. Appointment of Commissioners as Ex-Officio Member of City Advisory Boards (City Commission). Comments: Consensus was that the various boards and committees need to be reviewed on a cast by case basis as to their functions, legal justification for existence, need, etc. Assignment of Commissioners to the various boards can be made as they go along. A special meeting/workshop to begin this process was scheduled for Tuesday, May 29, 1990, and will focus on the more visible development-related boards (i.e., Planning and Zoning Board, Historic Preservation Board, Community Appearance Board, Board of Adjustment. NOTE: The Board of Construction Appeals and the Code Enforcement Board were also mentioned as possibilities, if time/scheduling permits. This was left to staff's discretion). A second meeting was scheduled for Tuesday, July 31, 1990, to address the remainder of the boards. 7. Direction regarding Traffic Impact on Roadways in the Sherwood Park Development (Mayor Lynch). Comments: (a) Commissioner McCarty asked staff to research whether or not there is any commitment or legally binding agreement on the part of the City which allows Lowson Boulevard to be used as the delivery entrance for The Hamlet, since she felt this was part of the cause for the truck traffic. (b) Mayor Lynch asked for statistics on how many tickets had been issued in the last 6 months on Lowson, and what kind of speed- ing limits were ticketed. (c) Overall consensus was to proceed immediately with the installa- tion of "No Thru Trucks" signage as well as a reduction of the speed limit from 30 mph to 2S mph. In addition, the Engineer- ing Department was directed to study (either them or a consul- tant) the area and report their findings/recommendations back to the Commission at a later date. 8. Direction Regarding Request to Pave the Woman's Club Parking Lot (City Manager) . 9. Proposal to Acquire Woman's Club Property (Mayor Lynch). Comments: Items 8 & 9 were considered together. Consensus was not to move forward with the paving at this time; staff was directed to look into the whole situation (costs, feasibility, etc. ) and come back to the Commission with a recommendation at a later date. 10. Prioritization and Scheduling of Future Workshop Items (City Manag- er). Comments: (a) Employee Health Insurance Rates, Alternatives and Options (Commissioner McCarty). An Insurance Task Team will be appointed by the Commission at the May 8, 1990, regular meeting. A recommendation from thi s task team is scheduled to be heard at the June Sth workshop meeting. (b) Proposed Pay Plan for General Employees (City Manager) . To be considered at Mr. Harden's direction throughout the budget process. (c) Proposed Landscape Ordinance (City Manager) . To be considered in conjunction with the Land Development Regulations (LDR' s) ; tentatively scheduled for September 1990. (d) Site Selection for Fire Station No. 1 Relocation - CRA Recom- mendation (City Commission). Scheduled for June 5, 1990, workshop. (e) Tennis Center Location/FSLIC Status (City Manager) . Scheduled for July 3, 1990, workshop. (f) Water and Sewer Rate Study (City Manager). Scheduled for June S, 1990, workshop. (g) - Creation of Neighborhood Task Force (City Commission) - Construction of Duplexes on Substandard Lots (Commissioner Andrews) - American Civil Liberties Union Challenge of City's Definition of Family Ordinance (City Attorney) Consensus was that these items ought to be considered under the purview of the Neighborhood Task Force which is to be formed in the near future; tentative scheduling date of August 7, 1990, workshop to discuss creation of Neighborhood Task Force. (h) Determination of Purpose and Need for Certain Advisory Boards (City Commission). This matter will be addressed during Commission review of Boards and Committees scheduled for workshop meetings on May 29, 1990 and July 31, 1990. (i) Review of Terms of Service for Commissioners, Campaigning Procedures, Installation, etc. (City Commission). Scheduled for July 3, 1990, workshop; discussion will involve potential changes to the City's Charter for inclusion on the November 1990 ballot. (j) Police Legal Advisor Position (City Manager) . (a) Consensus was basically to give the City Attorney's office time to get settled and assess their needs; have them come back to the Commission when they are comfortable to discuss whether additional staff is needed. (b) Jeff Kurtz, in concert with the City Manager, was directed to look into and report back to the Commission on a suggestion by Mr. Andrews to acquire the services of a firm which has staff who were previously with the Public Defender's office, who now give seminars to arresting officers as to the legalities with regard to arrests, etc. Mr. Andrews felt this could be helpful right away as in interim measure. (k) Participation in Palm Beach County Ordinance on Sexual Orienta- tion and Discrimination (City Attorney). The City Attorney's office was asked to provide an opinion to the Commission on this matter. (1) Proposal to Exchange Jurisdiction with County - S.W. 10th Street for Swinton Avenue. Staff was directed to discuss this matter with the County, assess the feasibility and impacts (costs, etc. ) , and report back to the Commission at a later date. Commissioner Alperin specifically asked if doing this would have any effect on promises made with respect to the GO bond issue. (m) Preliminary Budget Review Session (separate workshop proposed for June 19, 1990, third Tuesday in June). Okay; hold in the first floor conference Room. As an additional discussion item, the Commission discussed with Jeff Kurtz his decision with respect to accepting the position of City Attorney. KOEN, FIRE CHIEF DATE: APRIL 27, 1990 SUBJECT: FIRE STATION NO. 2 - AWARD OF BID As you know, a replacement project for Fire Station No. 2 was originally authorized in 1987. Subsequently, a site was selected just north of the existing location and design work was initiated by Currie Schneider and Associates. Neighborhood input was solicited and received throughout the design process and a high degree of emphasis was placed on compatibility with the neighborhood, landscaping, pedestrian beach access, design interface with the adjacent hotel complex, etc. In addition, great attention has been given to user input to make this Fire-Rescue facility compatible with the current and projected mission of the Fire Department. Bids were solicited and six bids were received on March 12, 1990 from area general contractors. A copy of the bid tabulation is attached. This item should be forwarded to the City Commission as a workshop item for the May 1st Workshop Session, in order that a determination may be made as to which options the Commission wishes to consider. Ultimately, a final recommendation can then be prepared for consideration as part of the May 8, 1990 regular meeting agenda. Based on a staff analysis of the base bid and the alternates listed by the consultants, it is my recommendation that the base bid and the alternates, listed in priority order, be approved by the Administration and the City Commission. For the purpose of this analysis, I am using the bid of Pioneer Construction as the basis for my recommendation. The contingency could not be used without approval by the City Manager. With the contingency amount, the recommended allocation for construction would be $1,105,602. Funding for this purpose would come from three accounts. Two relate to the project itself, including the 1987 Utility Tax Bond which has been used to pay for design work, and the proceeds of the sale of property at Venetian and Miramar. The balance of the funds could be made available from unappropriated interest from the 1987 Utility Tax Bond. Consulting, survey, soil tests and design fees for this project represent a total of $78,236 which has either been expended, or is encumbered. Decade of Excellence G. O. Bonds. A portion of the Street, Drainage, Sidewalk, A 11 ey and Beautification Projects to be financed with the proceeds of the City's upcoming Decade of Excellence General Obligation Bonds will consist of certain drainage improvement projects. Although the proceeds from the G. O. Bonds may be deposited in the City's general fund, they are required to be used. for the specific voter-approved projects. The property owner's tax bill will have a separate line item representing the millage to service the G.O..debt. On the other hqnd, the other ad valorem taxes on the tax bill are imposed by the authority granted in the Florida Constitution and Statutes and are levied to provide the funds necessary to run the City and carry. out variousCi ty programs. The general fund also receives money from non-ad valorem sources I such as the proceeds from the Utilities Tax (levìed on the sale . of certain utilities services in the Ci ty). To the extent that . the City uses the non-ad valorem sources and the ad valorem taxes (other than ad valorem taxes imposed for voter-approved debt) in the general fund for its stormwater management program, funding for other City programs will be reduced. When the City creates a funding source by enactment of a stormwater utility assessment or fee, it may pay back the general fund for prior expenditures. City programs and other budgetary requirements do not suffer by virtue of using the G. o. proceeds because such moneys have a restricted use. The taxpayers cannot be asked to pay for the G. o. Bonds and, at the same time, the City seeks to reimburse itself for such p~ior expenditures. The result would be a double tax for the. same purpose. B. $4,300,000 Utilities Tax Revenue Notes. Subordinate Series 1989. A portion of the proceeds from the above-referenced Notes are or will be used for certain drainage projects. The Notes are secured on a subordinate basis by the utilities Tax revenues. Since the Florida Statutes allow the City to use the proceeds from the tax for various municipal purposes, the persons paying such tax do not expect or require a specific use by the City. As mentioned above, if these tax proceeds are used for a specific municipal purpose, such as stormwater projects. available moneys for other municipal projects will be reduced. In such a case, the III .' City is entitled to reimburse itself when 1 t creat,es a specific stormwater utility funding source. 2. COLLECTION AND ENFORCEMENT OF STORMWATER UTILITY fEE PRIOR TO ADOPTION OF THE UNIFORM METHOD. A. Placing the stormwater utility fee on the water and sewer bill does not capture the entire customer base. If the City chose this method. further research would be required to determine if water service could be disconnected for nonpayment: of the stormwater component. B. The advantage of a separate billing system implemented by the City prior to going over to the County System is that it will reach the entire customer base. Under the City's home rule powers and Florida case law, the a1 ty has the ability, through the enactment of an ordinance. to impose a lien on property for nonpayment of the Stormwater Utility Fee. which would be analogous to a special assessment lien. Although such a lien would be inferior to other state, county and municipal tax liens. it would be superior to all other liens. This Stormwater Utility lien could be enforced through a for-eclosure action. The City could· impose a lien by express contract with its customers but such a method would be expensive and time-consuming. and the lien would be inferior to other liens. c. Timing Requirements to Implement County Uniform Method for· the Levy. Collection and Enforcement of Non-Ad Valorem Assessments. (a) For 4 consecutive weeks, City publishes notice of intent to use uniform method. (b) city adopts resolution in fifth week. Such resolution must be adopted prior to January 1 , 1991, and must state the City's intent to use the uniform method, the need for the levy of the non-ad valorem assessment and a legal description of the boundaries of the real property subject to the levy. (c) Copy of resolution must be sent to property appraiser by January 10, 1991. (d) By June 1, property appraiser is required to provide the City with certain information on the ad valorem tax roll. (e) Between June 1 and September 15, 1991, City must adopt a non-ad valorem assessment roll at a public hearing. The City must mail and publish notice of the public hearing at least 20 days prior to the hearing. ~2- i (f) By september 15, 1991 t the Mayor shall certify the non-ad valorem . assessment roll to the tax collector. (g) The City will not have to adopt a new roll each year, but will be required to annually inform the property appraiser and tax collector by January 10 of each subsequent year that it intends to continue using the uniform method. If all of the requirements are met, the City's Stormwater Utility Assessment will appear on the City residents' tax bills. The advantages of the uniform method are the imposition of penalties for delinquent payments and the issuance and sale of tax certificates and tax deeds for nonpayment. Under Florida Statutes, the discount for early payment and the ability to prepay by installment method would also be available for the j Stormwater Utility assessment. From a credit standpoint, this method of collection would be the most condusive for issuing Stormwat~r Utility bonds. STEPHEN D. BACKGROUND The City of Delray Beach, Florida, has recognized the need to upgrade their current stormwater management program to address current and future drainage issues, such as anticipated stormwater quality permitting requirements, system maintenance, capital improvements, and financing. The City has retained Gee & Jenson Engineers-Architects-Planners, In c . , to conduct a preliminary data inventory and develop a study plan to provide an integrated Stormwater Utility, including a Stormwater Master Plan, to address these issues. The Problems Currently, no overall plan exists for managing or treating storm- water runoff in the City of Delray Beach. Historically, the Engineering Department has identified and· corrected the most pressing drainage problems in a piecemeal fashion through selective studies of trouble-prone areas. These flood-prone areas were identifi~d through records of citizen complaints. Construction has been funded by traditional methods. Also, the City currently conducts a maintenance program for the stormwater system that i s conducted by the Street Department. The program is minimal and insufficient to adequately monitor the condition of system com- ponents and prevent costly new flooding problems. At present, an additional $9.2 million of further drainage improve- ments have been identified by the Engineering Department, of which only a fraction i s presently funded. A major hindrance to implementing an overall plan i s the 1 ack of information available for the City to assess system-wide effects and costs related to approving new developments. In addition, the U . S . Environmental Protection Agency (EPA) i s completing Public Hearings regarding stormwater permitting require- ments intended to reduce the water quality impacts of urban drainage on receiving waters (40 CFR, Parts 122, 123, 124, and 504). Application of these permitting requirements is restricted to urban areas with populations i n excess of 100,000 plus storm- water systems for smaller urban areas that cause non-compliance to water quality standards. These new permit rules will be administered through the Florida Department of Environmental Regulation (DER) using a Watershed Management approach that will require Master Stormwater Plans and may include regional coopera- tion with surrounding communities to monitor and control existing stormwater discharges. As the City i s served predominantly by old stormwater systems that do not include the water quality control 3 ~ ~ I ~ I . ~ ~ I features required of new developments, this Federally mandated program may prove very costly. Traditional stormwater funding methods using General Fund revenue wi 11 fa 11 far short of satisfying the collective future needs. Study Plan Development In response to these issues, Gee & Jenson has developed a study plan to develop a Stormwater Utility to finance improvements and a Stormwater Master Plan to efficiently identify, prioritize, and manage system-wide stormwater issues and problems. The Stormwater Utility wi 11 be developed and implemented in the earliest phases of the study. Phases I through III will establish the Utility within the first year. This will provide the City with a mechanism to finance the subsequent Stormwater Master Planning studies and capital improvements within the City. The Stormwater Utility wi 11 charge users of the stormwater system fees according to their fraction of stormwater contributed to the system. The initial user fees will be calculated to cover costs of estimated capital improvements, maintenance improvements, stormwater billing, and the study to develop a City-wide Stormwater Master Plan. The Stormwater Master Plan wi 11 be comprised of a system-wide engineering assessment of the stormwater drainage system to identify necessary improvements and renovations for drainage, flooding, and water quality concerns. The Stormwater Master Plan wi 11 be conducted i n five annual segments corresponding to Phases IV to VIII. The entire stormwater system will be documented using existing data, delineated into drainage subbasins, and evaluated using computer models of stormwater runoff and system conveyance. The capacity of each major facility as well as its current condition will be evaluated to identify necessary and anticipated capital improvements. I CITY OF DELRAY BEACH STORMWATER UTILITY REPORT Executive Summary The City of Delray Beach, Florida, is facing a dilemma common to many other South Florida communities: traditional funding for maintenance, repair, and improvements to their stormwater system is not keeping pace with the increasing deterioration of the pipes, canals, and structures that comprise the system. In addition, Federally mandated stormwater permitting regulations are expected soon, drastically increasing operation costs and requiring retrofitting of water quality controls. The City of Delray Beach, Florida, has recognized the need to upgrade their current stormwater management program to address current and future drainage issues, such as anticipated stormwater quality permitting requirements, system maintenance, capital improvements, and financing. Traditional stormwater funding methods using General Fund revenue will fall far short of satisfying the collective future needs. Capital improvements already identified by the City for localized drainage problems and long needed improvements in the maintenance program exceed availabl e funding sources. This does not even consider costs associated with the new stormwater permitting requirements by the EPA and DER. Therefore, the City is interested in generating revenues to be utilized strictly for stormwater management programs. The method of choice for generating this revenue is a stormwater utility, which operates much like any other user-based utility (water, sewer, power, etc.). The stormwater Utility method of financing stormwater management costs is a fee system that charges users based on the proportion of stormwater that their property con tributes to the stormwa te r sy stem. Fe e s are, therefore, reflective of the benefits derived by the "user" and the costs associated with providing the level of service. Many advantages may be derived from a Stormwater Utility over traditional funding methods, including: - Additional funding is reliable and less subject to cuts and tradeoffs with other City programs. - Stormwater costs are more equitably distributed. - There is a possibility of property tax relief by redistributing stormwater costs to tax-exempt and large commercial properties. ~ , ~ . t ~ I Kev Eleaents of a Stormwater Utility In the development of a Stormwater Utility, there are several key elements involved in the adoption of a rate structure and the administration of the utility. A Stormwater Utility must be adopted which has the following attributes: - Rates must be fair and equitable for all users of the utility. - Rate assessments must be based on sound principles. - Rates must be capable of generating enough revenue to fund capital improvements and operation and maintenance cost (including administration). - The Utility must be manageable and cost effective to operate. - User fees must be enforceable and collectable. - The Utility must be specifically suited for each municipality with flexibility to address special situations. Current Level of Service The City's existing level of service basically consists of a regularly scheduled street sweeping program, a reactionary maintenance program generally addressing "emergency" problems, and a few capital improvements usually funded through special programs such as the "Decade of Excellence" bond issue. The current level of service offers no comprehensive solution to water quality or drainage problems. The current stormwater management program is funded through the City's General Fund. Exoanded Level of Service In an effort to provide an expanded level of service in the area of stormwater management, the City of Delray Beach has made a commitment to increase their operation and maintenance capabilities as well as providing necessary capital improvements. - Alternative Financinq Methods A number of different methods could be used to fund the upgraded level of service in stormwater management. Alternatives include developer incentives, betterment charges, subdivision exactions, homeowners associations, and special taxing districts. However, the only two methods having the ability to solely fund the stormwater management programs on a city-wide basis are ad valorem taxes or stormwater Utility user fees. ¡ , I . . i . I Because the most equitable way of determining contributions is based on use of the service (i.e., contribution of runoff to the stormwater management system), the utility fee is the method of choice. This is because it can be assessed based on runoff generated, whereas ad valorem taxes are based on property values, which are not always representative of runoff generated. Also, ad valorem taxes are used to fund a number of other municipal programs cutting down on the revenue available for stormwater management, and they are capped under the mileage rate of the City. - Proposed Budgets It is necessary to estimate the funding required to support the expanded level of service proposed. This budget should include proposed capital improvements and expanded operation and maintenance costs, including administrative costs associated with operating the utility. Proposed needs regarding operation and maintenance are shown in Table 1. Initially, capital improvement costs will consist of reimbursement to the General Fund for projects associated with the -Decade of Excellence" program. This reimbursement schedul e (noted as Drainage Fee Transfer), from 1989-1990 to 1993-1994 is highlighted in the General Fund Forecast (Table 2) for the City of Delray Beach. User Assessments and Rate Criteria One of the most important facets of a Stormwater utility is the development of an equitable set of criteria for fee assessments. Since the utility is established to support the city's stormwater management system, the rate criteria should be based upon a land parcel's contribution to that system. Many different property characteristics affect stormwater runoff including impervious area, soil type, depth to water table, topography, etc. Many of these factors are fairly uniform over the expanse of the city limits. Therefore, the relative amount of runoff produced is most closely linked to the impervious area. This is also the parameter most easily identified and utilized as far as land parcel assessment is concerned. This information is generally available or obtainable from Palm Beach County tax records, Real Estate Data Index, or aerial photography. - Data Sources As previously mentioned, three of the most important sources of data were the Master Appraisal File (MAF) for Palm Beach County, the Palm Beach County Real Estate Data Index, and aerial photography. The most vital and most convenient source, due to its automation, was the MAP. I ~ I - ERU Basis As it was mentioned earlier, impervious area will be utilized as the basis for assessing developed parcels (undeveloped parcels will also be assessed). To do so, a base unit had to be determined for uniformity to be achieved in the assessments. This base unit is referred to as the Equivalent Residential Unit (ERU). The ERU is equivalent to the average impervious area for all single family residential units in the City of Delray Beach. All other developed parcels are assessed based on the ratio of their total impervious area to that of the ERU. - Parcel Assessment All developed parcels, residential and non-residential, are assessed based on the ERU concept discussed previously. However, vacant undeveloped parcels are also assessed å stormwater Utility fee because they still generate runoff even though it is to a lesser extent than a developed parcel. Their assessment is based on a percentage of an ERU calculated using the ratio of runoff coefficients for undeveloped and impervious area. This assessment was converted to an ERU/AC basis utilizing the average single family residential lot si z e. A br eakdown of the total ERU's for all of the parcels in the City of Delray Beach is shown in Table 3. A system of credits for non-residential and commercial residential (condominium and mUlti-family) parcels will be established for those properties providing retention of design storm rainfall runoff. Initially, credits are to be given only to a few of the large condominium groups for which permits indicating the provision of on-site retention are available. This is done in an attempt to alleviate the large volume of requests for credits which could occur if each condominium owner notified the Stormwater Utility staff. In all other instances it is recommended that the responsibility be placed upon the parcel owner to noti fy the Ci ty of Del ray Beach of their provision of retention. They should fill out the credit application form with attached calculations and engineering plans showing that, in fact, retention is being provided on site. No credit for retention systems will be given to single-family residential parcels. Establish a billing system: A number of alternative billing systems were evaluated to determine the most appropriate for the city of Delray Beach's particular situation. Among those were the existing City Utility Billing system, a new billing system operated by the City, or utilization of the palm Beach Coun ty Tax Bill. It was determined that the utilization of the Pal m Beach County Tax Bill is the most advantageous. However, the Ci ty cannot use this billing vehicle until 1991. It could be feasible for the city to distribute their own bill in 1990 although the enforceability of collection may be reduced. 2. Determination of a final utility rate required for the desired level of funding: Tabl e 4 shows the proposed operating budget and level of funding possible at a proposed rate per ERU. For the purpose of estimating total revenues, a ten percent reduction in total ERU's has been assumed to result from credits and uncollectible bills. 3. Our contractor began monitoring the beach for nesting activity April 20, 1990. The program this year begins with an unresolved issue - street lights. Last year our program parameters included turning off seven street lights along SRA1A north of Sea Spray Avenue. Sea turtle nests were left in place and marked except in the area of heavy use, roughly the south half of the municipal beach. In that area nests were relocated either to a safer location on the beach or to the hatchery. Only 24 nests were placed in the hatchery. During 1989, 180 nests occurred yielding approximately 19,800 hatchlings. Two nests were apparently not located. Some hatchlings from these became disoriented by street lights and wandered toward SRA1A. This resulted in highly publicized incidents of turtle kills confirmed at SO hatchlings. For the 1990 season Florida Dept. of Natural Resources (DNR) requires that all releases from a hatchery be done at night (see my memo of 4/23/90). For this reason we have altered our methodology to relocate threatened nests to safe areas of the beach, retaining the hatchery as a backup for emergency purposes. Otherwise, the scope of work for this year IS program will include nesting surveys, relocation of nests found in unsafe locations, a public awareness and education program and submission of progress and final reports. All work is done according to DNR standards. During the six years since inception this program has released over one hundred thousand hatchling sea turtles and gathered base scientific data used by DNR and other agencies to design turtle monitoring programs and increase the body of knowledge of these animals. As of today there have been no turtle nestings reported in Delray Beach this season. ~ I . . t ~S/3 '! Sea Turtle Conservation Program April 24, 1990 Page Two One continuing problem for the program is the presence of street lights on SRA1A. Lights visible from the beach have the potential to disorient nesting and hatchling turtles. As detailed in the attached report of 4/11/90, we have researched alternative approaches to the existing street lights. A test section of flat-lens cut-off fixtures were installed and evaluated by representatives of Palm Beach County, DNR and US Fish and Wildlife Service. These agencies report that while lighting on the beach is greatly reduced by cut-off fixtures, they cannot be considered a solution since the light source is still visible from the beach. US Fish and Wildlife Service recommended in a letter of 4/17/90 that: 1 . All street lights adjacent to the beach be turned off from May 1 - October 31. 2. If lights cannot be turned off because of safety reasons, low-pressure sodium lamps should be installed in combination with flat lens cut-off fixtures. We formally requested FPL to install low-pressure sodium lights on 4/19/90. FPL has informed us verbally that the Public Service Commission has not authorized them to install low-pressure sodium lamps in their facilities. (See letter of 4/24/90). We face several options relative to the street lights: * Turn off the street lights on SRA1A between Casaurina Road and the north end of the municipal beach from May 1 - October 31. * Install low pressure sodium lamps in flat lens cut-off fixtures in the above area. This would require construction of a customer owned, metered street light system separate from FPL, functioning in the manner of E. Atlantic Avenue. * Replace existing "cobra head" fixtures with flat lens cut-off fixtures in the above area and continue the current scope of work for the program. Staff recommends this option given the conflicting needs of wildlife and public safety. Your direction is requested. As a result of these incidents, representatives of the u.s. Fish and wildlife Service and Florida Department of Natural Resources met with former City Manager Byrd and other city officials to discuss legal issues regarding the Federal Endangered Species Act of 1973, as amended and possible solutions to prevent further turtle mortality. The city agreed to several immediate measures and also to modify existing streetlights to prevent direct lighting of the beach prior to the 1990 sea turtle nesting season (see enclosed letter of September 14, 1989) . Ms. Barbara Schroeder, Florida Department of Natural Resources, and I met with Mr. John Walker of the city's Engineering Department on the night of April 10, 1990, to view five street- lights which were modified as a test prior to modifying all of the other problem streetlights. It was both Ms. Schroeder's and my opinion that although the flat-faced cut-off fixture is a significant improvement over the present cobra head fixture, the light reduction is not sufficient to preclude future conflicts with sea turtle nesting and hatching activities. consequently, we made the following recommendations to Mr. Walker: 1- Turn off the streetlights adjacent to the beach along AlA during the nesting season (May 1-0ctober 31). Residents on the west side of AlA concerned about home security could put up more compatible lighting such as low pole mounted and shielded low pressure sodium lamps. 2. If specific streetlights cannot be turned off because of critical human safety and security reasons, then we recommend low pressure sodium lamps be used in combination with the flat-faced cut-off fixtures. In this case green turtle nests should be relocated to areas of the beach not influenced by these or other lights, since lights from LPS lamps can disorient green turtle hatchlings. ~ / ~ . f ~ '. , . 3. In addition to 1 and 2, allow native vegetation such as sea grapes to grow to maximum height to further reduce beach lighting from moving vehicles and streetlights. I did contact Dr. Ross Wilcox, Chief Ecologist at Florida Power and Light Company (FPL) , to determine if FPL had any restrictions on the use of low pressure sodium lamps either through internal policy or requirements of the Public utilities Commission (PUC) . Dr. Wilcox informed me he was not aware of any and that PUC "requirements" do not supercede state or Federal laws such as the Endangered Species Act. The Service appreciates the efforts the city is making to resolve the streetlight problem and other efforts the city is undertaking on behalf of sea turtles under the direction of Mr. Walker. The remaining "cobra-head" type street lights were left in operation. This lead to a conflict of needs. Residents in the darkened area have been concerned about a reduction in security. Conservationists have expressed concern that the remaining lights were too bright, providing the potential for disorientation of hatching sea turtles. Engineering Department, in conjunction with Florida Power & Light Company, has investigated alternate lighting methods. Our parameters were a method that would provide lighting for traffic on SRA1A, protecting public safety, as well as reducing "light spill" onto the beach to prevent potential disorientation of sea turtle hatchlings. As part of the study, suggestions of City Commissioners, Conservation agencies and the public were reviewed. Our research was completed in January, 1990 with the following results: * Post mounted street lights, installed on the east side of SRA1A and shielded on their east side, would still spill to much light onto the beach, leaving a potential for hatchling disorientation. ~ I ~ . , '! . ! , I Sea Turtle Conservation Program April 11 , 1990 Page Two * Shielding the existing street lights on the seaward side was addressed. Pole mounted fixtures such as the existing "cobra heads" and flat-lens luminaires are not designed for shields on the street side. A fabricated shield would subject the fixture to excessive heat build-up and corrosion. The shield may be blown off in winds. For these reasons FPL will not install shields or authorize such installation on their fixtures. * Low pressure sodium bulbs were suggested because they appear less attractive to most sea turtle species. FPL is not authorized to' use this type bulb by the State of Florida. 'In setting rates, the Public Service Commission mandates use of the most energy efficient bulbs, hence the use of high-pressure sodium. * Lowering fixture heights was investigated. Current fixture height is approximately 20 ft. This height is governed by the need for uniform spacing to create even lighting, clearance requirements from other facilities on the poles, and a minimum vertical clearance of 1 8 ft. dictated by FDOT. * The remaining method of lighting investigated is replacement of the existing "cobra head" fixtures with flat lens cut-off luminaires. These lights direct the cone of light straight down to control horizontal spillage. This method was recommended by FPL. In February, 1990 we authorized FPL to install a test section of five cut-off luminaires on SRA1A north of Seaspray Avenue. The installation was made in March. vIe then requested representatives of Federal, State and County conservation agencies to inspect the installation and share their opinion with us. Visits were made in late March and on April 10 with the following results. I inspected the area and found that in the area with the original "cobra-head" fixtures, the light on the beach was bright enough to cast a distinct shadow. In the test area with cut-off fixtures no apparent shadow was cast. The bulbs of the cut-off fixtures, while still visible from the beach, did not appear as bright as the "cobra heads". Lighting quality on SRA1A was unchanged in the test section. ~ I . . 1 . Sea Turtle Conservation Program April 11 , 1990 Page Three A representative of Palm Beach County Department of Environmental Resource Management inspected the area separately and called me to report that while lighting on the beach is greatly diminished, he could not recommend cut-off luminaires as a solution since the bulb is still visible from the beach. On the night of April 10, 1990, I met with representatives of u.S. Fish and Wildlife Service and Florida Dept. of Natural Resources. I explained our investigations to date and showed them the test area and control area. In summary, they stated that the cut-off luminaires were a "nice try but not good enough" because the bulbs were still visible from the beach. When asked what they did consider good enough, they suggested low-pressure sodium bulbs qr shielding. I explained again that these were not an allowable option; they recommended turning off all street lights between Casuarina Road and the north end of the municipal beach during sea turtle nesting season. In Delray Beach this ordinance affects the beach erosion control program, dune crossings, maintenance of beach vegetation, beach cleaning, development approvals and building permit approvals. The ordinance is effective in both incorporated and unincorporated areas of the County unless municipalities opt out or adopt an equivalent ordinance. County funds for dune restoration or shore protection (beach nourishment) projects are contingent upon the ordinance being enforced or a municipal ordinance adopted which is equally or more stringent. A Coastal Protection Zone (mean high water line (MHW) to a line 2S' landward of the dune crest or Coastal Construction Control Line ( CCCL) ) is established wherein the integrity of the coastal beach and dune system is protected. Permits are required for construction, filling excavation, alteration of ground elevation, alteration of dune vegetation and driving a vehicle. A Sand Preservation Zone is established (MHW to a line 600' landward) wherein the volume and quality of beach sand in the beach/dune system is maintained. A permit is required for excavation of beach/dune sediments. ~ I !' . 1 w~14 ~ County Ordinance 90-2 - Coastal Protection April 25, 1990 Page Two Criteria for permitting various activities are established. For example: * private dune walkovers may not exceed 4 ' wide; public may not exceed 8' wide. * in beach cleaning, seaweed and organic debris must be left on the beach. * construction will not degrade or result in a net loss of sand in the Sand Preservation Zone. * appendices are included detailing guidelines for dune and vegetation maintenance. Requirements in the ordinance are, in general, good and should be in place in the City to guide future development/redevelopment. The City's options relative to the ordinance are: * Allow the County to enforce the ordinance within Delray Beach. This means we must require permit seekers to obtain County permits before development; the City must also obtain County permits for its own activities, including maintenance and the beach nourishment project. * opt out of the ordinance. This could mean giving up County funding for erosion control, currently up to $200,000 per year. * Adopt our own version of the coastal protection ordinance. The City would then have to review development applications for another set of criteria. On the other hand, we would set the standards for coastal development within the City. We would avoid creating another layer of bureaucratic regulation. The City also avoids entering another permit process for our own projects, reducing the risk to our programs. Overall, we retain local control over local work. Staff recommends preparation of a Coastal Protection Ordinance equivalent to or more stringent than Palm Beach County Ordinance 90-2. MEETING DATES, TIMES AND AGENDA FORMAT DATE: April 27, 1990 1. Meeting Dates: , At your April 24th meeting, public comment was heard regarding the frequency of Commission meetings on days other than Tuesdays. Previously, Commission meetings were confined to Tuesdays, with the exception of Special meetings, which can be called at any time provided 12 hours notice is given. However, for the most part, even special meetings, when practical, were scheduled on Tuesdays. While no specific action is required, the Commission may wish to take public comments received under advisement. 2. Meeting Times: At the Organizational Meeting on March 29th, the Commission adopted revised Local Rules which changed the meeting time for regular Commission meetings to 6:00 p.m. While the revised starting time did not pose any legal problems, public concerns were voiced. At your April 24th meeting, several individuals came forth in opposition to the changed meeting time, thus prompting placement of this item before you for discussion. At a Regular meeting held on September 14, 1970, the sitting Commission voted to change the meeting time from 8:00 p.m. to 7:00 p.m. That time has stood unchanged until now. Prior to 1970, however, meeting times fluctuated based upon the composition of the Commission. The options before the Commission are to either: A. Leave the meeting time at 6:00 p.m., or; B. Leave the meeting time at 6:00 p.m. and modify the agenda to hold public hearings after the regular agenda to allow for greater public participation, or; C. Change the meeting time to 6:30 p.m., or; D. Change the meeting time to 7:00 p.m. Should the Commission wish to proceed with changing the meeting time, the City Attorney's office should be directed to prepare an amendment to the Local Rules for adoption at your next regular meeting. 3. Agenda Format: A. Discussion was held at your April 23rd meeting relative to amending the agenda format as a possible solution to the 6:00 p.m. Commission meeting issue. One solution mentioned was the possibility of holding public hearings at 7:00 p.m. While this seems to be a feasible alternative, it is not all that practical. To set a specific time for public hearings would mean, for example, if the procedural portion of the agenda was completed at 6:30 p. m. , the Commission could not continue the meeting until 7:00 p.m. Another suggestion was to hold the public hearings after the regular agenda. Again, depending on the number of items being considered, this alternative may not be practical in that it ~Js; I Workshop Agenda 5/1/90 Page 2 could make for a long evening. Separately, discussion was held relative to amending the agenda to hold public hearings on first reading of an ordinance. While there are no statutory limitations, there are advertising requirements which may make this suggestion impractical. In general, ordinances must be advertised 10 days prior to the public hearing date. In order to meet the advertising requirements, an ordinance would have to be prepared and turned in to the City Clerk's office, for advertisement of first reading, atleast three weeks prior to a Commission meeting, or advertised and held three or four weeks before action could be taken on it. Subsequently, if the caption of an ordinance was modified in any manner during public hearing on first reading, it would have to be readvertised and the process repeated. As an alternate consideration the Commission may, at any time during second reading, continue a public hearing to allow more information to be presented. It is recommended that this option be exercised rather than amending the agenda format to hold public hearing on first reading. Speed limits and No Thru Trucks (over a certain size) Signs were previously posted and Police have enforced on a "spot" basis. Volume and speed studies are required in order to determine if problems exist and, if they do, formulate possible solutions. Direction is required as to whether the City Commission wants to have the studies performed at this time. If Commission does wish to proceed, further direction is required as to whether to use City staff or an outside consultant to perform the studies. It is recommended that a consultant be utilized in this instance since it wouldn't take staff away from other duties and the Engineering budget includes funds for miscellaneous traffic studies of this nature. The City's 1990 Resurfacing Contractor is willing to pave the subject lots at contract prices. The estimated cost of the work is $4,250, or approximately half of the quote received by the Women's Club to perform the work. Funding for the resurfacing is available in the City's Resurfacing account. The original 1948 lease agreement included no maintenance by the City; how- ever, in 1965 an amendment was executed whereby City took over maintenance responsibilities for a portion of the grounds. In December of 1989, City Commission agreed to maintain all the grounds around the building. This specifically addressed landscaping rather than pavement. S"th Avenue, Delray Beach, Florida 33483 . \ Sometime ago when you were the guest speaker at a breakfast held by the Delray Beach Board Of Realtors, I spoke to you re the terrible condition of the driveway and parking lots of the Delray Beach Woman's Club. At that time you suggested that I obtain some estimates and send them to you. As you are aware, the land that the Club is on is owned by the City Of Delray. The building is old and this year alone the members of the Womans Club has put in new windows, new doors, new kitchen flooring and also a lot of painting to refurbish the building. Many vehicles that do not belong to members of the Womans Club use the parking lot and, quite frankly, we do not have the money to redo the lots. The South lot is in horrible condition and if anyone fell and hurt themselves I am afraid a law suit would occur. Is there any money available for this - - the Citizenship Depart- ment of the Womans Club will try to assist with a partial payment but cannot do it all. While we did obtain two estimates we certainly feel the one to use would be Hardrives. The price given by Precise Asphalt Maintenance, Inc. is prohibitive. May we hear from you. Barcinski, Interim City Manager SUBJECT: Consideration of Acquisition of Woman's Club Building DATE: April 27, 1990 A request has been received regarding the possibility of the City acquiring the Woman's Club building located at 505 S.E. 5th Avenue, Delray Beach. The City owns the land upon which the Woman's Club is built, but not the structure. On August 24, 1948, the City entered into a 99-year lease with the Woman's Club, for an annual fee of $1.00, which allowed them to construct a building to serve as their meeting place. The balance of the property was to be used for passive park purposes with maintenance responsibility for the building as well as the grounds resting with the Woman's Club. In 1965, the agreement was amended to provide that the City would assume maintenance responsibility for the passive open area on the eastern half of the block. In December of 1989, the Commission approved, by motion, a request for the City to assume maintenance responsibil- ity for all of the grounds, with the Woman's Club responsible for building maintenance. While maintenance responsibility for the grounds has shifted over the years, the building itself is owned by the Woman's Club. If the City is interested in acquiring the building, it appears that the most appropriate course of action would be to terminate the existing lease agreement and execute a new agreement. There is a provision in the original lease which states that should the lease be terminated, the lessee (Woman's Club) has the right to remove from the property any improvements placed thereon by them. Therefore, should the City Commission wish to pursue the acquisi- tion of the Woman's Club building, direction should be given to the City Attorney's office to enter into negotiations with representatives of the Woman's Club as to acceptable terms and conditions.
